Harnett County

REQUEST:
On behalf of Benson Fire Department, Emergency Services is requesting approval of
Benson responding to EMS calls as First Responders. These response will be within the
area within Harnett County that we contract Fire Response with Benson. This requires
no additional funding from the County. In July they will begin EMT level response
within the county.

Markets be added to Article V, Section 1.2 “Table of Use Regulations”. Add, “Outdoor
Flea Markets” to 7.6.2 as well as the Letter E, which tells what outdoor display, consist
of and how long it can be displayed. Delete 7.6.3 in its entirety.
Additional Information:
At the April 1, 2024 Planning Board meeting, the Planning Board voted unanimously
(3-0) to recommend approval of the text amendment as written.

A. All outdoor articles display tables and/or racks, tents, tarps, shelters, coverings of any type, or vehicles used
shall be removed from dusk to dawn.
B. Preparation and sale of perishable foods shall be regulated by NCGS 130A-247 and 130A-248, and T15A
NCAC 18A.2600.
C. Sale or trade of exotic, domestic, or farm animals shall be prohibited.
D. Any buildings or structures shall meet the current North Carolina State Building Code for indoor use.

Reason for Requested Change:
To amend Harnett County’s U.D.O. to allow outdoor flea markets to be an allowable special use in the
RA-20M, RA-20R, and RA-30 zoning districts.
Additional Information:
On April 1, 2024, the Planning Board voted unanimously (3-0) to recommend approval of the proposed
text amendment. The Planning Board stated that approval was recommended based on the use
regulations set forth in the staff suggested text as well as the requirement for a special use permit to be
obtained from the Board of Adjustment.
Suggested Statement-of-Consistencies: (Staff concludes that…)
Approved
If approved, staff’s suggested text is compatible with the economic development strategies set
forth in the Harnett County Land Use plan. Therefore, it is recommended that this Text
Amendment request be APPROVED.

Denied
The requested Text Amendment is unreasonable based on the potential negative effects the
use could have on adjacent property owners and surrounding communities. Therefore, it is
recommended that this Text Amendment request be DENIED.

AN ORDINANCE AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed;
and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article V. Use
Regulations, Section 1.2, Table of Use Regulations 7.6.2, Flea Markets, Rummage, Second Hand Sales, &
Activities, Indoor, and 7.6.3, Flea Markets, Rummage, Second Hand Sales, & Activities, Outdoor, shall be
amended to read as indicated in “Attachment”.
“Attachment” is filed with the Unified Development Ordinance in the Clerk to the Board’s Office.
Duly adopted this 15th day of April 2024 and effective upon adoption.

FINANCE OFFICERS RECOMMENDATION:
COUNTY MANAGERS RECOMMENDATION:
N.C. General Statute Section 159-30 authorizes the Finance Officer to
invest idle funds of the County in a commingled investment pool. North
Carolina Investment Pool “NCIP”, is such an investment pool and would
be a good tool for the finance office to use to ensure that we are
maximizing our return on the investment of the County’s idle funds in as
safe a way as possible.
Adoption of the attached resolution authorizing the use of NCIP as an
investment tool will not violate any statutes that restrict the investments
that we are allowed to utilize, as NCIP only invests in those types of
instruments with the proper credit ratings as authorized by the NC
General Statutes.

RESOLUTION TO PARTICIPATE IN NORTH CAROLINA
INVESTMENT POOL
A resolution authorizing County of Harnett, North Carolina (the "County") to join with other
political subdivisions of the State of North Carolina as a Participant ("Participant") in the North Carolina
Investment Pool (NCIP) (the "Trust") to pool funds for investment.
WHEREAS, the provisions of Section 159-30 of the General Statutes of North Carolina, as
amended ("N.C. Gen. Stat."), provide the guidelines for any local government or public authority of the
State of North Carolina (a "Local Government" or "Local Government Unit") to invest idle funds;
WHEREAS, under N.C. Gen. Stat. § 159-30(c)(10), moneys may be invested in a commingled
investment pool established by interlocal agreement pursuant to N.C. Gen. Stat. § 160A-460 through 160A-
464 (a "Local Government Investment Pool"), if the investments of the Local Government Investment Pool
are limited to those qualifying for investment under N.C. Gen. Stat. § 159-30(c) or other laws of the State
of North Carolina governing the investment of monies of a Local Government Unit ("Permitted
Investments");
WHEREAS, certain Local Government Units have executed an Interlocal Agreement dated March
1, 2023 (the "Original Interlocal Agreement" and as supplemented and amended the "Interlocal
Agreement") for the purpose of creating the Trust or executed a joinder agreement for purposes of joining
the Original Interlocal Agreement;
WHEREAS, the Trust is governed by the terms of an Indenture of Trust (as amended, the
"Indenture"), which provides for the deposit of the pooled idle funds in the Trust and the investment of such
funds in only Permitted Investments;
WHEREAS, the County desires to become a Participant in the Trust.
NOW, THEREFORE, it is hereby RESOLVED by the Board of Commissioners (the "Governing
Body") of the County as follows:
1. The Governing Body hereby approves the County becoming a Participant in the Trust,
which is governed by the Indenture.
2. The Governing Body authorizes the execution and delivery of a New Participant
Application (the "Application") substantially in the form presented at this meeting, together with such
changes, modifications and deletions as may be approved by the County's Finance Officer (the "Finance
Officer"). The approval of the Application will be evidenced conclusively by the execution and delivery of
the Application by the Finance Officer.
3. The Finance Officer is hereby authorized to take or cause to be taken any and all such other
actions as they may determine in their discretion to be to be necessary or advisable or in the best interest of
the County in order to effectuate, complete and carry out the intent and purposes of the foregoing resolutions
and the management, supervision, and investment of the County's idle funds, including, but not limited to,
the execution of all depository forms or other documents required by the administrator, the custodian or the
investment advisor of the Trust and for the purpose of (i) adding an additional Participant to the Trust or
(ii) which do not have financial implications for the County.

4. The Governing Body hereby approves the Finance Officer to serve as the County's
Authorized Representative under the Indenture and in such capacity shall remain responsible for the
management, supervision, and investment of the County's idle funds.
The undersigned hereby certifies that the Board of Commissioners has enacted this Resolution, a
copy of which is enclosed, and that such Resolution is a true and correct copy of the original which is in
my possession.
