100% inspection rate. They will be used for food, lodging and institution sanitation programs
and activities.

The Harnett County Board of Commissioners met in regular session on Monday, March 21, 2022
at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library,
455 McKinney Parkway, Lillington, North Carolina.

Chairman Weatherspoon called the meeting to order at 6:00 pm. Commissioner Johnson
provided the invocation.
Chairman Weatherspoon called for any additions or deletions to the published agenda. Vice
Chairman Nicol made a motion to approve the agenda as presented. The motion was seconded by
Commissioner McKoy and carried unanimously.
Commissioner Matthews made a motion to approve the consent agenda. Commissioner Johnson
seconded the motion. The motion passed unanimously. The items on the consent agenda were as
follows:

C.Tax Rebates, Refunds and Releases – Motion to approve tax rebates, refunds and
releases as requested by the Tax Administrator. (Attachment 2)
D.Harnett County Department of Aging requests approval of additional Block Grant
funding from Mid Carolina Area Agency on Aging in the amount of $5000.
These funds will be used to provide In Home Aide services for the elderly.
E.Harnett County Health Department requests approval of additional WIC (Women,
Infants, and Children) funding provided through NC DHHS in the amount of

$33,732. These funds are allocated based upon the average monthly participation
increasing above the 107% of the base caseload assignment.
F.General Services / Harnett Area Rural Transit System (HARTS) Director requests
the Board of Commissioners consider and approve NCDOT/IMD Certifications
and Assurances for FY23 funding applications to complete the FY2023
Community Transportation Program (CTP) Grant application. The Certifications
and Assurances, Equivalent Service Certification, Certification and Restrictions
on Lobbying and the Special Section 5333(b) Warranty were distributed by
NCDOT/IMD. Certifications and Assurances are required to process, approve
and disburse 5311 and 5339 funding for FY2023. The Board of Commissioners
approved the application for grant funding on October 18, 2021 for the amount of
$730,230 with local match of $91,593, however, NCDOT/IMD revised the FY23
funding request total amount to $719,989 with a local match of $90,057.
G.Approve Harnett County Library’s request to accept a 2022 LSTA Technology
Grant in the amount of $40,000 with no match required.
H.Soil and Water Conservation is requesting permission to apply for the new NCDA
Streamflow Rehabilitation Assistance Program in the amount of $2,376,000.
Funds will be utilized to clean vegetative debris from stretches of Kenneth and
Neills Creek from the Harnett/Wake County line to the Cape Fear River in order
to improve stream flow during heavy rain events in an effort to minimize flooding
therefore protecting infrastructure, property and human lives. This is a
reimbursement based grant with no required match.
I.Emergency Services is requesting the approval of the fireworks application from
Pyro Shows East Coast for the March 25th/April 8th and April 22nd shows at
Campbell University all displays are scheduled for 9:00p.m. Pyro Shows East
Coast meets all requirements and has met fire code compliance for the events.
J.Harnett County Economic Development is requesting the Harnett County Board
of Commissioners approve the Economic Development Work Plan for Q2-Q4.
Chairman Weatherspoon opened the meeting for informal comments by the public, allowing up
to 3 minutes for each presentation up to 30 minutes. No one spoke. The public comment period
was closed.
Mark Locklear, Development Services Director, petitioned the Board for a Public Hearing on a
Proposed Zoning Change, Case #PLAN2201-0002 Landowner / Applicant: Marie West
Blackmon / Marie West Blackmon; 1.17 acres; Pin # 9575-95-8594; From Commercial to RA-
20R Zoning District; Off SR # 1115 (Buffalo Lake Road on Cooks Lane); Barbecue Township.
Mr. Locklear stated staff’s evaluation is:
•The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The impact to the surrounding community is
reasonable, as the requested zoning district is compatible with surrounding parcels.

•The requested zoning district is COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning to RA-20R is compatible with the
overall land use classification of Compact Mixed Use, as well as within the Compatibility
Development Target area. The Compact Mixed Use classification is in areas that are
known for growing, activity centers based on potential utility availability, access to major
thoroughfares, and higher density developments.
•The proposal does ENHANCE or maintain the public health, safety and general welfare.
REASONING: The requested zoning to RA-20R would enhance or maintain the public
health, safety and general welfare due to the residential setting that it is located in.
•The request is not for a SMALL SCALE REZONING and should be evaluated for
reasonableness. REASONING: Since this parcel is adjacent to residential zoning, this
application does not need to be evaluated for a Small Scale Rezoning.
Mr. Locklear stated it may be in the best interest of the applicant to table this request tonight as
there is some questions regarding restrictive covenants and questions on how the property can be
used, to give them an opportunity to research and look into those issues.
Chairman Weatherspoon opened up the public hearing. No one spoke and the public hearing
was closed.
Vice Chairman Nicol made a motion to table this item to allow some time to research these
issues. Chairman Weatherspoon asked for a date for the item to come back to the board. Vice
Chairman Nicol amended his motion to include tabling this item until the April 4, 2022 meeting.
The motion was seconded by Commissioner McKoy. Commissioner Matthews stated I
understand the landowners are in favor of this and Vice Chairman Nicol confirmed yes they are.
Commissioner McKoy asked if the property surrounding is commercial or residential. Mr.
Locklear stated it could be utilized either way, it has both residential and commercial
surrounding it. Chairman Weatherspoon called for a vote on the motion to table it until April 4,
2022. The motion carried unanimously.

Brain Haney, Assistant County Manager, provided an overview of what the American Rescue
Plan Allocation funding could be used for. Chairman Weatherspoon opened the public input
period and the following people spoke:

Commissioner McKoy asked that Mr. Haney provide information regarding broadband. Mr.
Haney clarified recommendations for broadband. Mr. Haney also clarified the $10,000,000 that
could be used as Lost Revenue Replacement, may be used for any General Government purpose,
however, it must still follow Uniform Guidance. Mr. Haney state there is a misprint, where it
states Public Safety it should be General Government expenditures. Additional discussion
included Emergency (VIPER) Radio Replacement and Low Emission X-Ray Scanner for
Detention Center. No one else spoke and the public input session was closed.
Mr. Trout stated there were a number of reports included in the packet.
Vice Chairman Nicol made a motion to adjourn at 7:06 pm. The motion was seconded by
Commissioner Johnson and carried unanimously.

RESOLUTION APPROVING
THE AGREEMENT FOR THE
MID-CAROLINA WORKFORCE DEVELOPMENT CONSORTIUM
Whereas, Harnett County desires to enter into workforce development consortium agreement
pursuant to North Carolina General Statues, Section 160A-461 with the North Carolina counties of
Cumberland and Sampson to organize a workforce development area; and
Whereas, these contiguous units of local government agree to establish a consortium pursuant to
the provisions of North Carolina General Statues, Section 160A-464(1) to act jointly as a workforce
development area under the Workforce Innovation and Opportunity Act (WIOA), Public Law 113-128 as
enacted July 22, 2014; and
Whereas, this consortium shall be known as the Mid-Carolina Workforce Development
Consortium; and
Whereas, a copy of said consortium agreement is attached herewith.
Now, therefore, be it resolved by the Harnett County Board of Commissioners that it hereby
approves the attached consortium agreement by and between Cumberland County and Sampson County to
organize a workforce development area under the Workforce Innovation and Opportunity Act of 2014.

MID-CAROLINA WORKFORCE DEVELOPMENT CONSORTIUM AGREEMENT

ARTICLE I. TITLE AND PURPOSE
The contiguous units of local government listed below agree to establish a consortium to
act jointly as a local Workforce Development Area under the Workforce Innovation and
Opportunity Act (WIOA), Public Law 113-128 as enacted July 22, 2014. This consortium
shall be known as Mid-Carolina Workforce Development.
ARTICLE II. MEMBERSHIP
The Consortium shall be composed of the following independent and contiguous units of
general-purpose local government:
County of Cumberland
County of Harnett
County of Sampson
ARTICLE III. CERTIFICATION OF AUTHORITY
1.AUTHORITY UNDER STATE AND LOCAL LAW
The member units of government certify that they possess full legal authority, as
provided by state and local law, to enter into this agreement and to fulfill the legal
and financial requirements of operating as a local Workforce Development Area
under the Workforce Innovation and Opportunity Act for the entire geographic
area covered by this agreement.
2.SPECIFIC RESOLUTIONS TO ENTER INTO AGREEMENT
A copy of each duly executed resolution giving the respective counties specific
authority to enter into this consortium agreement will be attached to this document
and are incorporated herein by reference (optional).
3.DESIGNATION OF CHIEF ELECTED OFFICIALS FROM EACH MEMBER
UNIT OF GOVERNMENT
Each member unit of government designates as chief elected official for
Workforce Innovation and Opportunity Act purposes, upon whose representations
the State, the Workforce Development Board, the administrative entity, and the
other member units may rely, the duly elected Chair of each respective County
Board of Commissioners. Such person shall be the signatory of this agreement and
shall be authorized to execute such other agreements as are necessary for
Workforce Innovation and Opportunity Act purposes.
4.DESIGNATION OF CHIEF ELECTED OFFICIAL FOR LOCAL WORKFORCE
DEVELOPMENT AREA
The member units provide that the Chairs of the member units of government shall
select one chief elected official that shall be authorized to exercise the functions of
the local area chief elected official which are required under the Workforce
Innovation and Opportunity Act.

ARTICLE IV. DURATION
This agreement will become effective on July 1, 2022 or the date of the last chief elected
official’s signature (whichever is the later date) and shall continue in effect until the local
Workforce Development Area is re-designated by the Governor of North Carolina or by
termination of this Agreement by a member unit of government as provided for in Article
XI.
ARTICLE V. ASSURANCES AND CERTIFICATIONS
The member units will comply with the requirements of the Workforce Innovation and
Opportunity Act, and regulations promulgated thereunder, all other applicable federal
regulations, the statutes of the State of North Carolina, and written directives and
instructions relevant to local workforce development area operation from the Governor of
North Carolina or his/her designee.
ARTICLE VI. FINANCING
1.It is anticipated that funding necessary to implement this agreement will be derived
from federal grant funds received through the Governor.
2.The units of local government acknowledge that they are jointly and severally
accountable for liabilities arising out of activities under the Workforce Innovation
and Opportunity Act, and all funds received by the local workforce development
area pursuant to WIOA. Liability includes, but is not limited to, responsibility for
prompt repayment from non-program funds of any disallowed costs by the
administrative entity of the local workforce development area, or any of its sub-
recipients or contractors, or the Workforce Development Board.
3.Mid-Carolina Council of Governments, also known as Mid-Carolina Regional
Council and Region M, shall serve as the Administrative Entity for the Mid-
Carolina Workforce Development Area.
4.Any entity or joint agency created or designated by this local workforce
development area, including the Workforce Development Board, and
Administrative Entity, shall be considered a public agency for the purposes of the
Local Government Budget and Fiscal Control Act.
ARTICLE VII. ESTABLISHMENT OF A WORKFORCE DEVELOPMENT BOARD
The member units of government agree that the Workforce Development Board shall be
established in accordance with Section 107 of the Workforce Innovation and Opportunity
Act and applicable State of North Carolina laws including G.S. 143B-438.11.
The Chief Elected Official, as noted in Article III. 4., shall appoint members of the
Workforce Development Board from among persons nominated in accordance with the
Workforce Innovation and Opportunity Act.

ARTICLE VIII. APPOINTMENT OF PERSONNEL
Appointment of personnel shall follow the Mid-Carolina Regional Council’s hiring and
recruitment process for regular full-time staff.
ARTICLE IX. REAL PROPERTY, EQUIPMENT AND SUPPLIES
The Mid-Carolina Workforce Development Consortium will follow all Workforce
Innovation and Opportunity Act requirements governing the title, use and disposition of
real property, equipment and supplies purchased with federal funds,
ARTICLE X. AMENDMENTS
The agreement may be amended at any time upon the consent of all the parties as
evidenced by resolution of the governing bodies of each member government and as
approved by the State.
ARTICLE XI. TERMINATION
The parties to this agreement may request termination at any time upon six months prior
written notice, such termination to be effective when the Governor considers local
Workforce Development Area re-designations or at the end of the then current grant
administration agreement program year.

Rule 29. Public Comment Periods
(a) Public comment periods will be limited to a maximum of thirty (30) minutes and each person desiring
to speak shall have a maximum of three (3) minutes to make their remarks. A speaker may not speak
more than once during the same public comment period. To avoid repetition, groups of individuals who
expect to have the same or similar comments are encouraged to select a spokesperson to speak on their
behalf. Please silence all electronic devices.
(b) Speakers shall address the Board from the podium and begin their remarks by stating their name and
residential address. Speakers shall maintain proper order and shall make their comments in a civil
manner. Personal attacks and use of profanity is prohibited.
(c) Public comment is not intended to require the Board to answer any impromptu questions. The Board
should refrain from engaging in a dialogue, except to the extent necessary to clarify the speaker’s
position. The Board shall not entertain questions from the audience, and discussions between speakers
and members of the audience shall be prohibited.
(d) Speakers shall maintain proper decorum and shall make their comments in a civil manner. Personal
attacks and use of obscene and profane language are prohibited.
(d) Speaker comments should be limited to subjects that are within the Board’s jurisdiction. Speakers
shall not discuss matters that concern the candidacy of any person seeking public office, including the
candidacy of the speaker, closed session matters, those matters which are the subject of public
hearings, and any matters intended to promote any individuals’ commercial or pecuniary interest.
(e) Action on items brought up during the Public Comment Period will be at the discretion of the Board.

Proclamation Announcing Keep Harnett Beautiful Initiative and Encouraging
Harnett County Residents to Participate in Spring Litter Sweep
WHEREAS, Harnett County promotes a Keep Harnett Beautiful initiative; and
WHEREAS, Keep Harnett Beautiful’s mission is to involve the community in responsible
solutions for a clean and beautiful environment through community awareness and public
education, litter reduction, waste reduction, and recycling; and
WHEREAS, Harnett County, in partnership with County municipalities, the North Carolina
Department of Transportation and community organizations, has organized a countywide two
week long Spring Litter Sweep roadside cleanup to ensure clean and beautiful roads across our
county; and
WHEREAS, the Spring Litter Sweep roadside cleanup encourages local governments and
communities, civic and professional groups, businesses, churches, schools, families, and
individual citizens to participate by sponsoring and organizing local roadside cleanups; and
WHEREAS, Harnett County residents have the ability to preserve their beautiful landscapes and
protect their roadways by preventing litter and road debris; and
WHEREAS, the great natural beauty of our county and a clean environment are sources of great
pride for all Harnett County residents, attracting tourists and aiding in recruiting new industries;
and
WHEREAS, the cleanup will increase awareness of the need for cleaner roadsides, emphasize
the importance of not littering, and encourage recycling of solid wastes; and
WHEREAS, the Spring Litter Sweep will be a part of educating the children of Harnett County
regarding the importance of a clean environment to the quality of life in Harnett County; and
WHEREAS, Harnett County recommends four ways the public can help prevent litter: (1) teach
young people not to litter, (2) cover truck and trailer beds when transporting trash or other loose
items, (3) use a litter bag in vehicles, and (4) participate in Harnett County litter sweeps; and
WHEREAS, Harnett County encourages citizens to participate in the sponsored Spring Litter
Sweep program to help beautify the county and raise awareness of the impact of litter on the
environment while giving every citizen the opportunity to take responsibility for clean roads; and
NOW, THEREFORE LET IT BE PROCLAIMED, by the Harnett County Board of
Commissioners that April 10 through 23, 2022 is hereby recognized as the Keep Harnett
Beautiful Spring Litter Sweep on behalf of all the citizens of Harnett County. The Board does
hereby encourage citizens to participate in the Harnett County Spring Litter Sweep and to
support efforts to protect and clean our environment. We encourage all citizens to pick up litter
to promote the well-being of this and future generations.

Administration requests the Board's adoption of the revised Draft Funding Plan for Harnett
County's American Rescue Plan Act allocation of $26,411,744 as reflected in the attached
document. The revised Draft Funding Plan reflects the Board's discussion from the March 29,
2022, work session, during which the Board determined which items included in the Draft
Funding Plan they wished to authorize staff to move forward with.
The revised Draft Funding Plan includes $20,632,419 in potential expenditures, leaving a
balance of $5,779,325, which the Board will need to appropriate at a future date. There is
also the potential for additional funds to become available for appropriation as the County
learns whether or not grants are awarded and obtains more realistic costs of projects where
estimates are currently provided.

REQUEST:
Administration requests the Board award the bid for the former Benhaven School parking lot
construction project to Bar Construction Company, as recommended in the attached Award
Recommendation Letter. Following the opening of bids on March 22, Bar Construction was
determined to be the low bidder. Once award has been approved, staff will route a contract
for staff review and Board approval.
This project is time sensitive, as parking lot construction must be complete in July to allow
for Harnett County Schools to open an early college location on the campus this fall as
planned. The County is also planning to begin providing services to the community in the
form of outdoor recreation and a Community Center & Library in the former Media Center
along with an office where other County departments - including the Health Department,
DSS, Veterans Services, and the Sheriff's Office - can provide satellite service.

contract for the Benhaven Parking Lot Repaving Project be awarded to Bar

This project was publicly advertised, and we received 3 bids for the project. As we

nothing but good comments were received. We were also informed that Bar
Construction had performed projects with similar scope as this project for other clients
with success.
We understand that your office will work with Bar Construction Company, INC. to
execute the Construction Contract for the proposal amount.
