101821 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes October 18, 2021 The Harnett County Board of Commissioners met in regular session on Monday, October 18, 2021 at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Lewis W. Weatherspoon, Vice Chairman Matt B. Nicol, Commissioner Member absent: W. Brooks Matthews, Chairman Staff present: George Wood, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Vice Chairman Weatherspoon called the meeting to order at 6:00 pm. Commissioner Johnson led the Pledge of Allegiance and invocation. Vice Chairman Weatherspoon called for any additions or deletions to the published agenda. Melissa Capps, Clerk to the Board, shared staff would request the Commissioners consider removing Budget Amendment No. 441b in the amount of $5 from the consent agenda. Commissioner Nicol made a motion to approve the agenda. The motion was seconded by Commissioner Johnson and carried unanimously. Commissioner Nicol made a motion to approve the consent agenda. Commissioner Johnson seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A. Minutes i. Work Session Minutes of September 27, 2021 ii. Regular Meeting Minutes of October 4, 2021 B. Budget Amendments (Attachment 1) C. Tax Rebates, Refunds and Releases — Motion to approve tax rebates, refunds and releases as requested by the Tax Administrator. (Attachment 2) D. The Harnett County Public Library is requesting approval from the Harnett County Board of Commissioners to eliminate late fines for materials checked out by customers. This would include historical, currently outstanding, and all future late Harnett County Board of Commissioners October 18, 2021 Regular Meeting Minutes Page 1 of 8 fines. The library will continue to bill for the cost of lost items, and block patron card access if items are not returned in a reasonable amount time. E. Administration requests approval of a Resolution declaring some of the furniture currently being stored in County warehouse space as surplus and authorizing donation to Harnett County Habitat for Humanity as described in Exhibit A. (Attachment 3) F. The Parks and Recreation Department request adoption of the Harnett County Parks and Recreation Facility Rental Fee Waiver Policy. This policy is designed to provide an equitable means for event and program organizers to apply for fee reductions or waiver and to establish mutually beneficial partnerships between the Department and the community. G. Motion to approve a Resolution of the Harnett County Board of Commissioners to convey certain real property to the City of Dunn. (Attachment 4) H. Motion to approve County Manager's recommendation regarding Jetport pending projects and Engineer of Record RFQ Review Process. I. Proclamation Announcing Keep Harnett Beautiful Initiative and Encouraging Harnett County Residents to Participate in Fall Litter Sweep. George Wood, Interim County Manager, reviewed information pertaining to the application for public school building capital fund North Carolina Education Lottery and a budget amendment for the Board of Education in the amount of $1.2 million for property acquisition for Southern Harnett area middle school. Commissioner Johnson made a motion to approve the application. Attorney Snow asked that approval of the budget amendment be added to the motion as well. Commissioner Johnson amended the motion to include approval of the application for public school building capital fund for the North Carolina Education Lottery and the budget amendment for the Board of Education in the amount of $1.2 million. Commissioner Nicol seconded the amended motion which carried unanimously. (Attachment 5) Vice Chairman Weatherspoon opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Jerry Rivas of 364 Twin Palms Road, Sanford, NC. 2. Rosanne Teniente of 179 Tilden Howington Drive, Lillington, NC. 3. Dolly Griggs of 39 Queens Court, Angier, NC. 4. Ilia Smirnov of 100 S. Main Street, Lillington, NC. 5. Woody Lee of 217 Woodview Court, Fuquay Varina, NC. 6. Chris Nighswonger came to speak on a public hearing. Vice Chairman Weatherspoon asked that he wait until the public hearing. 7. Craig Fenerty of 1395 Gregory Circle, Lillington, NC. 8. Alan Longman of Bunnlevel, NC. 9. Vicky Longman of 234 Hamilton Road, Bunnlevel, NC. 10. Marina Elliott of 52 Sawgrass Court, Bunnlevel, NC. Harnett County Board of Commissioners October 18, 2021 Regular Meeting Minutes Page 2 of 8 Commissioner McKoy stated I would like to put on record I knew nothing about the asphalt plant until I read it in the paper. Comments were provided by Eileen Moriarty of Kipling, Jody Rock of Fuquay-Varina, and the Harnett County Tourism Authority regarding the asphalt plant. A copy of the comments are available in the Clerk's Office. No one else spoke. The public comment period was closed. Commissioner Nicol made a motion to appoint Katrina Latimer to the Harnett County Commission for Women and Youth and to table the appointment for the Juvenile Crime Prevention Council until the first meeting in November. Commissioner Johnson seconded the motion. The motion carried unanimously. Mark Locklear, Development Services Director, petitioned the Board for a Public Hearing on the Proposed Zoning Change: CASE # 2019-0001 Landowner / Applicant: Thomas E. Chancy / Jimmy Pierce; 106.6 +/- acres; Pin # 1529-44-3463.000; From RA -40 to RA -30 Zoning District; SR # 1709 (Hodges Chapel Road) & SR # 1704 (Tilghman Road); Averasboro & Grove Townships. The property is primarily agricultural use. There is mostly agricultural land in the area with some single family residential. Mr. Locklear stated staff's evaluation as: - The IMPACT to the adjacent property owners and the surrounding community is not reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The benefits of the rezoning do not outweigh any potential inconvenience or harm to the community, as the requested zoning district would allow for higher density developments. - The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the Land Use classification of Agricultural & Rural Residential. These areas are typically outside of public sewer service areas and are often residential lots greater than '/Z acre. - The proposal does not ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested zoning to RA -40 will not maintain the public health, safety and general welfare of the surrounding community. This community is predominately rural and uses and density provided by the proposed zoning classification would be would not be appropriate for this area. - The request is not for a SMALL SCALE REZONING and should not be evaluated for reasonableness. REASONING: Due to the parcel's size, this application does not need to be considered for a Small Scale rezoning. Suggested Statement of Consistency: As stated in the evaluation, the requested rezoning to RA - 30 would not only have an impact on the surrounding community, but would also fail to enhance Harnett County Board of Commissioners October 18, 2021 Regular Meeting Minutes Page 3 of 8 the public health, safety, and general welfare for the reasons stated in the evaluation. It is recommended that this rezoning request be DENIED. On October 4th, the Harnett County Planning Board voted 3-1 to recommend approval of application based on compatibility with County's Land Use Plan. Planning Board comments consisted of... • schools have capacity in this area • poorly draining soils limit the development area • could be a valuable asset to the tax base • PB member in opposition was concerned if the soils report was credibly enough to justify a rezoning in this rural area. Several citizens attended the meeting and one spoke in opposition for them. Their concerns were... • Traffic and desire to preserve the original RA -40 rural area Commissioner Johnson asked if the property is rezoned to R-30 how many lots would there be. Mr. Locklear stated it depends on how the land is developed and we are a little hesitant to say but an estimate would be about 44 lots. The developer is here and may be able to provide additional information. Commissioner Johnson asked if the zoning stays at RA -40 how many lots would he have. Mr. Locklear stated I think it is 112. Vice Chairman Weatherspoon opened the public hearing and the following people spoke: 1. Chris Nighswonger, Attorney representing a number of individuals in the area around this property, spoke in opposition of the requested rezoning. 2. Devon Miller spoke in opposition of the requested rezoning. 3. Danny Norris, Developer, spoke in favor of the requested rezoning. 4. Don Beasley spoke in opposition of the requested rezoning. 5. Joe Creech spoke in opposition of the requested rezoning. 6. Carolyn Strickland spoke in opposition of the requested rezoning. 7. Joanne Creswell spoke in opposition of the requested rezoning. 8. John Allen spoke in opposition of the requested rezoning. 9. Marissa Mezzacappa spoke in opposition of the requested rezoning. 10. Wanda McLamb spoke in opposition of the requested rezoning. Seeing no one else move, Vice Chairman Weatherspoon closed the public hearing. Commissioner Nicol stated Mr. Norris I know you do build some quality homes. Commissioner Nicol stated in regards to traffic and environmental concerns, I'd like to make a motion as stated in the evaluation, the requested Proposed Zoning Change: CASE # 2019-0001 to RA -30 would not only have an impact on the surrounding community, but would also fail to enhance the public Harnett County Board of Commissioners October 18, 2021 Regular Meeting Minutes Page 4 of 8 health, safety, and general welfare for the reasons stated in the evaluation. Commissioner Nicol made a motion to deny the Proposed Zoning Change: CASE # 2019-0001. Commissioner Johnson seconded the motion. The motion passed unanimously. Mr. Locklear, Development Services Director, petitioned the Board for a Public Hearing on the Proposed Zoning Change: Case # PLAN2109-0002 Landowner / Applicant: Kenneth Siecinski; 1.15 +/- acres; Pin # 9536-83-0016.000; From RA -20R to Commercial Zoning District; SR # 1209 (Barbecue Church Road); Barbecue Township. Site is currently occupied by a single- family structure. Undeveloped land, several non-residential uses, as well as single-family residential uses. Mr. Locklear stated staff's evaluation as: • The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The impact to the surrounding community is reasonable, as there are several nonresidential uses in this area. • The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of a Rural Center development node. Rural Center development nodes are "small scale commercial centers". These areas can be suburban in nature and contain smaller, nonresidential uses. • The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested zoning would enhance or maintain the public health, safety and general welfare due to the potential site improvements that could take place. • The request is not for a SMALL SCALE REZONING and should not be evaluated for reasonableness. REASONING: Due to the same zoning across that street as well as land use compatibility, this application does not need to be considered for a Small Scale rezoning. Suggested Statement -of -Consistency: As stated in the evaluation, the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based on the nonresidential growth patterns of this area as well as compliance with the County's Land Use Plan. Therefore, it is recommended that this rezoning request be APPROVED. On October 4th, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on compatibility with the Land Use Plan and the growing nature of this area. One neighboring resident asked a question about how it would affect his property, but did not object. Sasha Rathbone spoke in favor of the request. Seeing no one else move, Vice Chairman Weatherspoon closed the public hearing. Commissioner Nicol stated as stated in the evaluation, the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based on the nonresidential growth patterns of this area as well as compliance with the County's Land Use Plan. Commissioner Nicol made a motion to approve the Proposed Zoning Change: Case # PLAN2109- 0002. Commissioner Johnson seconded the motion. The motion passed unanimously. Mr. Locklear, Development Services Director, petitioned the Board for a Public Hearing on a Text Amendment: Case # PLAN2103-0002 Harnett County Unified Development Ordinance; Article IV; XIV, Sections 13.0, 6.0. To amend Harnett County's UDO where it pertains to the Military Corridor Overlay. The purpose of the Fort Bragg Military overlay is to promote compatibility between military operations at Fort Bragg and the use of development of private property. This is to ensure Harnett County and Fort Bragg officials coordinate on land use activities impacting or impacted by military operations and training activities. These regulations apply only to that of property that is located within a documented Military Influence Area. Nothing herein requires a change or alteration to land uses or structures existing on the effective date of this Ordinance. Suggested Statement -of -Consistency: Development Services staff recommends APPROVAL of this Text Amendment as it is compatible with Harnett County regulatory documents, NC General Statutes, and the 2020 Fort Bragg Joint Land Use Study. Therefore, it is recommended that this Text Amendment request be APPROVED. At their October 4th meeting, the Harnett County Planning Board voted 4-0 to recommend approval of this of the Text Amendment based on compliance with NC General Statutes. One Planning Board member did think it might be a good idea to extend the noise zone for notification purposes. Vice Chairman Weatherspoon opened the public hearing. Seeing no one move, Vice Chairman Weatherspoon closed the public hearing. Commissioner Johnson made a motion to approve Text Amendment: Case # PLAN2103-0002 to amend Harnett County's UDO where it pertains to the Military Corridor Overlay. Commissioner Nicol seconded the motion. The motion carried unanimously. Larry Smith, Transit Program Manager, petitioned the Board for public hearings to allow citizens an opportunity to comment on transportation needs and the proposed 5311 Community Transportation Program as well as the 5307 CARES Act to be submitted to the North Carolina Department of Transportation, Public Transportation Division (NCDOT/PTD). Seeing no one move, Vice Chairman Weatherspoon closed the public hearing. Commissioner Nicol approve the applications and resolution to apply for FY2023 funding. Commissioner McKoy seconded the motion. The motion passed unanimously. (Attachment 6) William Tyson, Tax Administrator, presented the 2022 Schedule of Values to the Board of Commissioners. This begins the process for adoption of the 2022 SOV. Mr. Tyson introduced Ryan Vinson, Vinson Evaluations. Mr. Vinson provided background information, information on reappraisals and next steps in the process which included: • November 1 — Public hearing • November 15 — Consider the adoption of the 2022 Schedule of Values • January — Reappraisal presentation • January — Public reappraisal presentations • January 1 — Effective date of Reappraisal • February/March 2022 — Mail notices Consensus of the Board was for staff to proceed with the process for adoption of the 2022 SOV. Mr. Wood stated the following information was provided in the agenda packet: • Harnett County Finance Monthly Report • Harnett County Veterans Services Activity Report • Harnett County Department of Public Health Activities Summary • Interdepartmental Budget Amendments Mr. Wood stated on the application for public school building capital fund for the North Carolina Education Lottery and the budget amendment for the Board of Education in the amount of $1.2 million approved earlier in the meeting, the Board of Education will be closing on that tomorrow. Mr. Wood stated under new business Commissioner Johnson has requested to speak on the renaming of Fort Bragg. Commissioner Johnson requested the Board consider doing a letter in support of renaming Fort Bragg to Ft. Bill Lee. Dunn is the home place to General Lee who was proven to be the driving force behind the formation of the Airborne Troops. Commissioner Johnson made a motion to write a letter of recommendation to rename Fort Bragg to Ft. Bill Lee to be submitted to the Renaming Commission. Vice Chairman Weatherspoon seconded the motion. Commissioner Nicol provided comments. Commissioner Nicol stated he had personal reservations with renaming it anything other than Fort Bragg for a couple of reasons. Commissioner Nicol provided information regarding General Edward C. Bragg another decorated General. Commissioner McKoy seconded the motion. Vice Chairman Weatherspoon, Commissioners McKoy and Nicol voted in favor of tabling the discussion. Commissioner Johnson voted against the motion. The motion to table the discussion passed 3:1. Vice Chairman Weatherspoon asked this item be put on the next work session agenda. Commissioner Johnson made a motion to go into closed session to discuss certain personnel matters. This motion made is made pursuant to NC General Statute section 143-318.11 (a) (5). Following a motion to come out of Closed Session, Vice Chairman Weatherspoon called the meeting back into open session. Commissioner Johnson moved to adjourn the meeting at 8:04 pm. TRACT TWO: That square shaped real property parcel located at 2494 US 301 South, Dunn, N.C. 28334 composed of approximately 0.1291 acre with PID No. 0215159002 which is more particularly described as the Second Tract in that deed to Harnett County recorded in Book 839, Page 124, Harnett County Registry; and WHEREAS, the Dunn City Council ("Dunn Council") has expressed a need to the Harnett County Board of Commissioners ("County Board") for the City of Dunn's procurement of the above- described real property tracts in that located on each tract is a sewer pump station that is operated and maintained as a part of the City of Dunn sewer system along the US 301 highway corridor south of the City of Dunn that was established as part of the original Food Lion warehouse economic development project; and WHEREAS, in response to the Dunn Council's request, the County Board has determined that it would be in the best interest of the County to assist the Dunn Council in providing sewer system service along the US 301 highway corridor south of the City of Dunn by conveying the above- described real property tracts to the City of Dunn at no purchase cost to the Dunn Council; that said conveyance of real property by the County to the City of Dunn is authorized by N.C.
