HARNETT COUNTY BOARD OF COMMISSIONERS Recessed Meeting Minutes November 17, 2021 The Harnett County Board of Commissioners met in a recessed meeting on Wednesday, November 17, 2021 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Matt B. Nicol, Commissioner Others present: George Wood, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Matthews reconvened the meeting at 9:00 am. The following agenda was before the Board: 1. Call to order — Chairman W. Brooks Matthews 2. Pledge of Allegiance and Invocation — Vice Chairman Lewis Weatherspoon 3. Discuss and possible vote on Resolution Finding Substantial Inequality of Existing Districts and Adopting New Election Boundaries. 4. Adjourn Chairman Matthews shared information related to Session Law 2021-56, Senate Bill 722 which states "the board of county commissioners shall review and revise its electoral districts in accordance with State and federal law, and adopt a resolution containing the revised electoral districts on or before November 17, 2021." Vice Chairman Weatherspoon shared information he received if the Commissioners fail to adopt a new map. Additional discussion included special election costs. Commissioner Nicol made a motion to withdraw his motion to table and move to pick back up the motion on the item Resolution Finding Substantial Inequality of Existing Districts and Adopting New Election Boundaries. Vice Chairman Weatherspoon seconded the motion. The motion carried unanimously. Chairman Matthews called for discussion. Commissioner McKoy stated we are here to do the will of the people. Commissioner McKoy asked about the difference between the green and blue shading from the maps, is there a change in District 1. Craig Schauer stated there is no change to District 1; it is the current colors chosen by the county, simply a choice of colors. Chairman Matthews called for a vote on the motion to adopt Phase 5 map. Following a roll call vote, all Commissioners voted in favor of the motion. Chairman Weatherspoon made a motion to adjourn. The motion was seconded by Commissioner Nicol. The motion carried unanimously. Chairman Weatherspoon withdrew the motion to adjourn. Vice Chairman Weatherspoon made a motion to adopt a Resolution Finding Substantial Inequality of Existing Districts and Adopting New Election Boundaries as indicated on the Phase 5 map (Attachment 1). The motion was seconded by Commissioner Nicol. The motion carried unanimously. There being no further business, Commissioner Nicol made a motion to adjourn. Capps, Clerk Harnett County Board of Commissioners November 17, 2021 Recessed Meeting Minutes Page 2 of 2 and Attachment 1 RESOLUTION FINDING SUBSTANTIAL INEQUALITY OF EXISTING DISTRICTS AND ADOPTING NEW ELECTION DISTRICT BOUNDARIES WHEREAS, the Harnett County Board of Commissioners includes five members; WHEREAS, the Harnett County Board of Commissioners members are elected from five districts; and WHEREAS, the five election districts are subject to the constitutional and statutory requirement of one-person, one -vote; and WHEREAS, the five election districts are subject to the requirements of Section 2 of the Voting Rights Act of 1965; and WHEREAS, the Board of Commissioners has recently received and reviewed the population of the districts as determined by the 2020 federal census; and WHEREAS, the Board of Commissioners has determined that the populations of the districts are out of balance and that the boundaries of the districts need to be altered to provide equal representation; and WHEREAS, the Board of Commissioners is authorized and required by North Carolina General Statutes § 153A-22 to revise its district boundaries to correct population imbalances shown by a federal census; and WHEREAS, at a public session held on August 16, 2021, the Board of Commissioners met with legal counsel to discuss the existing district boundaries and possible revisions to the existing district boundaries for the districts to be legally compliant; and 4856-3915-2899.0 WHEREAS, at a public session held on October 26, 2021, legal counsel presented the Board of Commissioners and Board of Education with a joint map of revised districts for both boards, and the Board of Commissioners and Board of Education reviewed the draft map and provided instruction to legal counsel on changes to be made; WHEREAS, at a public session held on November 8, 2021, the Board of Commissioners accepted public comment on draft maps labeled Plan 4 and Plan 5; WHEREAS, at a public session held on November 15, 2021, the Board of Commissioners reviewed a revised map labeled Plan 6; WHEREAS, the census block information associated with Plan 5 demonstrates that the revised district boundaries are in compliance with the constitutional and statutory requirement of one-person, one -vote, and with the requirements of Section 2 of the Voting Rights Act of 1965; and NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners as follows: 1. The Board of Commissioners finds as a fact, based on the population numbers in Exhibit A, that there is substantial inequality of population in the existing districts from which its members are nominated and elected such that revising the district boundaries is required by North Carolina General Statutes § 153A-22. 2. Plan 5 was prepared from United States Census Bureau maps and the boundaries of Plan 5 have been drawn to follow census block lines as depicted in Exhibit B. A list of the census blocks in each district under Plan 5 is attached as 4856-3915-2899.v I Exhibit C for reference and to resolve any issue that might arise concerning the boundaries of the districts. 3. The population and demographic statistics associated with Plan 5 are presented in Exhibit D. 4. The new district boundaries shall be used for the next election of members of the Board of Commissioners and for each subsequent election until the boundaries are altered according to law. 5. A copy of this resolution and the maps showing the district boundaries shall be retained in the office of the Clerk to the Board. 6. As required by Section 153A -22(f) of the General Statutes, a certified copy of this resolution shall be provided to the Secretary of State, the Harnett County Register of Deeds, and the Hamett County Board of Elections. In addition, maps and information about the new district boundaries shall be provided to the Harnett County Board of Elections with the request that the board notify residents of Harnett County of changes in the districts in which they vote. 4856-3915-2899.v1 ADOPTED this the (q day of November, 2021 W.
