080221 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes August 2, 2021 The Harnett County Board of Commissioners met in regular session on Monday, August 2, 2021 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner (Joined via Zoom) Matt B. Nicol, Commissioner Staff present: George Wood, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Matthews called the meeting to order at 9:00 am. Commissioner Johnson joined in via zoom. Commissioner Nicol led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. George Wood, Interim County Manager, stated you have before you resolution to declare personal property surplus and authorize the donation of property to Habitat for Humanity. These are items from the former Public Library and Information Technology buildings that were left over following the previous donation. Facilities staff have determined that these items are no longer needed by the County. You also have a request from the Harnett County Division on Aging to accept a $3000 grant from Mid Carolina Area Agency on Aging to assist older adults with Medicare education and awareness. Vice Chairman Weatherspoon made a motion to add the Resolution to declare personal property surplus and authorize the donation of property to Habitat for Humanity and the request from the Harnett County Division on Aging to accept a $3000 grant from Mid Carolina Area Agency on Aging to assist older adults with Medicare education and awareness to the consent agenda and to accept the agenda as amended. Commissioner Nicol seconded the motion. Chairman Matthews stated that will make the Resolution Item K. and the receiving of the grant from Mid Carolina Area Agency Item L. on the Consent Agenda. A rollcall vote resulted in all members voting in favor of the motion. Motion carried 5:0. Commissioner Weatherspoon made a motion to approve the consent agenda as amended. The motion was seconded by Commissioner Nicol. A roll call vote resulted in all members voting in favor of the motion. Motion carried 5:0. The Harnett County Health Department has been allocated $1,089,044 in Communicable Disease funds from NC DHHS. These funds are to provide critical resources to state and local and territorial health departments in support of a broad range of COVID-19/SARS testing and epidemiologic surveillance related activities. Motion to accept $1,089,044 in Communicable Disease funds from NC DHHS. E. The Harnett County Health Department has received COVID-19 Vaccination Program funds in the amount of $259,538. These funds are to assist the Health Department with coronavirus vaccine activities to support broad-based distribution, access and vaccine coverage. Motion to accept COVID-19 Vaccination Program funds in the amount of $259,538. F. Motion to accept and approve the Tax Collection Settlement for FY 2020 and prior years taxes from the Tax Administrator. G. In accordance with North Carolina G.S. 105-321(b), the Harnett County Board of Commissioners shall adopt an order directing the Tax Administrator to collect the taxes charged for the 2021/2022 tax year. Motion to charge William R. Tyson, Tax Administrator, with the collections of all real, personal, and public service companies' taxes for the 2021/2022 levy year, and with the collections of all delinquent taxes. H. Harnett County's Legal Department requests approval of the Bylaws of Administrative Appeals Board for School Bus Stop Arm Violations. 1. Administration requests adoption of a Resolution of the Harnett County Board of Commissioners to Accept American Rescue Plan Act Funds. In order for the County to receive the Coronavirus State and Local Fiscal Recovery Funds of H.R. 1319 American Rescue Plan Act of 2021 (CSLRF), the Board is required to take formal action through the passage of a resolution to formally accept the funds. Attachment 3. J. Proclamation — Child Support Awareness Month, August 2021 K. Administration requests adoption of a Resolution of the Harnett County Board of Commissioners Declaring Personal Property as Surplus and Authorizing the Disposition of Personal Property by Donation. Attachment 4. L. The Harnett County Division on Aging received a $3000 grant from Mid Carolina Area Agency on Aging to assist older adults with Medicare education and awareness. Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Jay Sills of Dunn 2. Vice Chairman Weatherspoon stated Harnett County Health Director John Rouse recommended Linda Sturdivant be reappointed to the Board of Health, this will be Ms. Sturdivant's 3rd term. He also recommends Amy Allen, be reappointed. This will be Ms. Allen's Yd term. Vice Chairman Weatherspoon made a motion to approve these recommendations. The motion was seconded by Chairman Nicol. A roll call vote resulted in all members voting in favor of the motion. Motion carried 5:0. Vice Chairman Weatherspoon made a motion to reduce the per 1,000 gallons fee for septage and portable waste haulers from $85 to $65, maintain the $20 per load; to open the septic pump receiving station from 7:00 am — 6:00 pm; and for HRW to develop a written policy for emergency situations from 6:00 pm — 7:00 am; as well as state of emergencies due to hurricanes, tornados and other acts of God. The motion was seconded by Commissioner Nicol. Chairman Matthews, Vice Chairman Weatherspoon, Commissioners Johnson and Nicol voted in favor of the motion. Commissioner McKoy voted against the motion. Motion carried 4:1. Vice Chairman Weatherspoon made a motion to interview The Mercer Group and Slavin Management Consultants, County Manager Executive Search Firms. The motion was seconded by Commissioner Nicol. A roll call vote resulted in all members voting in favor of the motion. Motion carried 5:0. George Wood, Interim County Manager, provided an update on the broadband infrastructure project and potential funding options. Commissioner McKoy asked if there would be available funding for water infrastructure. Mr. Wood stated we are waiting to hear what the state's budget will be and I intend to go over in- depth what the funding will be available for, in 3 to 4 weeks. Commissioner McKoy moved to go into Closed Session to consult with the County's legal counsel in order to preserve the attorney-client privilege concerning the handling of a certain litigation, namely the following case: Whitaker vs. Lamco Custom Builders, LLC vs. Harnett County, et al, Harnett County Superior Court, File No 21CVS670. The motion was seconded by Commissioner Nicol. A roll call vote resulted in all members voting in favor of the motion. Motion carried 5:0. Chairman Matthews called the meeting back into open session. NOW, THEREFORE BE IT RESOLVED by the Harnett County Board of Commissioners as follows: That the County Manager and County Finance Officer are designated and directed to take all actions deemed reasonably necessary on behalf of the Board of Commissioners to apply for, receive, and administer the CSLRF funds in accordance with all applicable federal and state laws, regulations, and guidance. 2. That all such CSLRF funding for which the County of Harnett is eligible which has been or will be distributed by the US Treasury Department and which is received by the County of Harnett is hereby accepted subject to all applicable federal and state laws, regulations, and guidance. Main Street, Lillington, North Carolina 27646, and the former Information Technology Building at 201 W. Front Street, Lillington, North Carolina 27546, identified on the attached Exhibit A and Exhibit B, is surplus to the needs of the County; and WHEREAS, pursuant to North Carolina General Statute § 153A-176 and § 160A- 280, the County may convey surplus personal property to a nonprofit organization which carries out a public purpose; and WHEREAS, the Harnett County Board of Commissioners desires to convey the surplus property to Habitat for Humanity of Harnett County to assist in their mission to bring people together to build homes, communities, and hope in Harnett County; and NOW, THEREFORE BE IT RESOLVED by the Harnett County Board of Commissioners as follows: That the furniture identified in Exhibit A and Exhibit B is hereby declared surplus property. 2. That the County Manager is authorized to transfer and execute any documents necessary to transfer the property to Habitat for Humanity of North Carolina. 3. That the property or subsequent sale thereof shall be used by Habitat for Humanity of North Carolina for a public purpose that benefits the citizens of Harnett County. 4. That the County of Harnett makes no express or implies warranties of merchantability of any surplus property, or part thereof, or its fitness for a particular purpose regardless of any oral statements that may be made concerning the surplus property or any part thereof. 5.
