The Harnett County Board of Commissioners met in regular session on Monday, June 18,
2007, in the County Commissioners Meeting Room, County Administration Building,
102 East Front Street, Lillington, North Carolina.

Vice Chairman Hill called the meeting to order at 7:00 p.m. and Commissioner Andrews
led the pledge of allegiance and prayer.
Commissioner Andrews moved to approve the agenda as published with removal from
the consent agenda of item G-2 regarding the economic development incentive program
for Central Carolina Tire. Commissioner House seconded the motion and it passed
unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Andrews, the
Board approved the following items on the consent agenda with a unanimous vote.

3. Tax refunds (Attachment 1)
4. Amendment to contract with Bateman Senior Meals to extend the current contract one
year with a 2.5% increase in cost of the meals. The amended contract will be for the
period of July 1, 2007 through June 30, 2008.
5. Documents which put into place Area Agency on Aging funding for FY 2007-2008
Home and Community Care Programs. The total Federal and State Home & Community
Care Block Grant funding for FY 2007-2008 is $608,298.
6. Grant of a twenty foot easement (Non-Warranty Deed of Easement, Parcel ID:
099566 9001 02, PIN: 9566-51-8505.000) for Mr. Albert Haines across property owned
by Harnett County located off Ponderosa Road in Cameron, North Carolina. In 2002,
Harnett County was granted a quitclaim deed from the North Carolina Department of
Transportation, approximately 30 acres of property determined surplus by NCDOT. A
portion of the property granted to Harnett County by NCDOT included a ten acre tract
adjacent to property owned by Mr. Haines. Mr. Haines has been utilizing a twenty foot
right-of-way through the property now owned by Harnett County for many, many years.
An access road is clearly present. Without use of the right-of-way, Mr. Haines’ property
would be landlocked.
7. Resolutions to approve the Harnett County Economic Development Incentive Grant
program for two existing industries: Kidde Fire Arms in Angier and Edwards Brothers in
Lillington. (Attachments 2A and 2B) A third resolution regarding Central Carolina Tire
in Cameron will be considered later in this meeting due to Commissioner McNeill
wishing to recuse himself from voting because of his employment with the company.
8. Resolution to approve Harnett County matching funds for a $60,000 One NC Grant
for Boon Edam Tomsed Corp. in Lillington (Attachment 3)
9. Renewal of contract with Republic Services of North Carolina, effective July 1, 2007,
to operate the four Harnett County convenience centers including personnel, containers
and transportation of waste. Terms of the contract renewal are 4 years, at current rates
through June 30, 2008; and increases after June 30, 2008 will be based on Consumer
Price Index (CPI) with a cap of 3%. Republic Services of North Carolina has agreed to
help Harnett County to enhance its recycling program.
10. Intergovernmental agreement between Harnett County and the City of Dunn
establishing a cooperative relationship among the Parties for Harnett County to act as the
primary point of contact on behalf of the Parties for the purposes of retaining legal
representation and negotiating an Agreement between the parties and Nextel pursuant to
the “800 MHz Order” issued by the Federal Communications Commission, or what is
commonly referred to as Nextel public safety rebanding”.
11. Settlement and Release Agreement with Charter Communications LLC. An audit
conducted by Telecommunications Consulting Associates determined that Harnett
County was underpaid in the amount of $2,823.00 in franchise fees for the period July 1,
2003 through June 31, 2006. This agreement will allow the County to receive the funds.
Once received, Harnett county will pay “TCA” 50% of that amount for audit services.
12. Increasing change order for Park Construction Contract A2 in the amount of
$16,718.00 due to excess rock excavation above the estimated quantities in the contract.
Funds to pay for this change are included in the project contingency.
13. Professional Services Agreement for Architectural Services with Skinner, Lamm &
Highsmith, PS from Wilson. These architectural services are for the new Harnett County
Public Utilities Center facilities planned in conjunction with the 2007 Water Treatment
Plant Upgrade project. The payment of all fees associated with this agreement are
budgeted in the capital project.
14. Award of Waterworks Materials and Supplies contract to TEC Utilities, Inc. from
Garner. Sealed bids were received on June 8, 2007 and TEC Utilities was the lone
company to submit a bid. The request for bids was advertised locally and forwarded to
five additional suppliers in the area. The prices for various items are guaranteed for one
year until the contract is re-bid on an annual basis. The amount of the contract depends
upon the quantities ordered throughout the year by Harnett County Department of Public
Utilities.
15. Resolution authorizing the Angier & Black River Fire Department to finance an
amount of up to $450,000.00 for the purchase of a Rescue Pumper Truck. The U.S.
Internal Revenue Code requires that for such financing to be carried out on a tax-exempt
basis the Harnett County Board of Commissioners must first approve proceeding with the
loan process for financing of the vehicle. Angier & Black River Fire Department Board
of Directors chose BB&T for the loan with an interest rate for up to $450,000.00 at
4.56% for 12 years. (Attachment 4)
16. Grant Agreement for Waste Water Infrastructure between County of Harnett and the
State of North Carolina Clean Water Management Trust Fund. On November 13, 2006,
Harnett County received approval of its application requesting a grant of monies to
engage in the construction of a pumping station, force main, gravity sewers, and
wastewater treatment plant to eliminate failing septic systems and to facilitate
regionalization. The Board of Trustees for the State of North Carolina Clean Water
Management Trust Fund approved a grant of up to $2,500,000.00. Harnett County will
provide matching funds for the engineering design and permitting, land surveying costs,
land and/or easement acquisition, easement preparation, remainder of the construction
costs, construction administration and observation, construction contingency, legal costs,
Harnett County’s administrative costs, and any other project costs. The total cost of the
project is estimated to be $10,612,454.00. (Attachment 5)
17. Amendment to the Harnett County Personnel Ordinance: delete the following:
Article III, Section 10.
F. Time spent in “Trainee” or Work Against” status does not count toward

completion of the time required for either the 3 year or 5 year salary
adjustment. While serving in “Trainee” or “Work Against” status the employee
receives scheduled salary adjustments so long as they perform assigned duties in
a fully acceptable manner.
This ordinance provision was designed to withhold 3/5 pay plan benefits to employees in
“trainee” or “Work Against” status by not counting such time toward completion of that

time required for either the 3 or 5 year salary adjustment. Reasoning was that such
employees were not yet at the journeyman level of knowledge, skills and ability. The
reason for deletion is in review of employees in “Trainee” or Work Against” status
revealed that they were, in almost all cases, becoming qualified to perform journeyman
level work after a short period of orientation and training.
18. Write-off of delinquent Emergency Medical Services accounts for the month of May
totaling $3,257.48. Many of the requests for write-offs are because the patient is now
deceased or the time has lapsed for filing for benefits.
Informal comments were provided by the following citizens:
- Hope Turlington, advocate for Dorothea Dix Hospital, encouraged the Board to contact
legislators to support keeping Dorothea Dix Hospital open.
- Mary Ann Stinson, Forest Ridge Subdivision, thanked the Board for the satellite police
station in her neighborhood.
- Ronnie Bowen, Stewart’s Creek Township, would like for his property to be removed

Skip Green, Skip Green & Associates, noted that the Board held a public hearing on

March 19 for citizen input into the identification of community needs and desired
activities in preparation for submission of a grant application to the NC Department of
Commerce’s Small Cities Community Development Block Grant Program. A second
public hearing will be held tonight regarding specific proposed projects. Mr. Green
informed those present that Harnett County Economic Development is seeking a
$340,000.00 Community Development Block Grant (CDBG) that will be used with a
$370,000.00 NC Rural Center Economic Infrastructure Grant and $75,000.00 in local
money to construct a 300,000 gallon elevated water storage tank to be located near the
intersection of Dorman Road and Middle Road south of Erwin to upgrade fire protection
to an expanding business, Eastern Building Components, and a new business, Old
Castle/Adams products. Each company will create 20 new jobs within 24 months of the
grant award, with 60% of these positions being filled by low to moderate income persons.
Vice Chairman Hill called the public hearing to order and opened the meeting for
comments from the public. No comments were offered and Vice Chairman Hill closed

the public hearing. A resolution regarding the matter will be considered at the July 2
Board meeting.
Christi Barthelme, Planner, presented a zoning change request for Claude G. Britton,
from RA-30 to Commercial, Hwy 421, Upper Little River Township, 4.11 acres. The
Planning Board voted unanimously to recommend denial of the request based on the
unreasonableness of “Small Scale Rezoning”. Vice Chairman Hill called to order a
public hearing and opened the meeting for comments from the public. Comments were
received from the applicant. There being no further comments, Vice Chairman Hill
closed the public hearing. Commissioner Andrews moved to approve the zoning change
request as presented. Commissioner McNeill seconded the motion and it passed
unanimously.
Christi Barthelme, Planner, presented a zoning change request for James Robert Warren
from RA-30 to Commercial, Hwy 210 N, Neill’s Creek Township, 22.23 acres. The
Planning Board voted unanimously to recommend approval of the request. Vice
Chairman Hill called to order a public hearing and opened the meeting for comments
from the public. Comments were provided by the following citizens:

There being no further comments, Vice Chairman Hill closed the public hearing.
Commissioner Andrews moved to approve the zoning change request as presented.
Commissioner McNeill seconded the motion and it passed unanimously.
Christi Barthelme, Planner, presented proposed zoning by petition of portions of
Stewart’s Creek Township. Applicant: Amy Driggers, Planning Department and others.
The application contains 101 properties, 27 petitioners, 8 property owners were contacted
who did not sign the petition; and the Planning Department added 66 properties. The
requested zoning was RA-20R for 2700.07 acres. The Planning Board recommended
approval of the request. Vice Chairman Hill called to order a public hearing and opened
the meeting for comments from the public. Comments were provided by the following
citizens:
- Mary B. Johnson, Buies Creek, requested clarification of area.
- R. H. Byrd, Bunnlevel, has mixed feelings about zoning but there are things happening
in the area that needs some control.
- Amy Driggers, applicant, for zoning in the area.
There being no further comments, Vice Chairman Hill closed the public hearing.
Commissioner Andrews moved to approve the requested zoning but with property owned
by Ronnie Bowen removed from the petition. Commissioner McNeill seconded the
motion and it passed unanimously.
Departmental reports were filed with the Board from the Health Department, Planning
Department, and Finance Department (Attachment 6)
Neil Emory, presented the item removed from the consent agenda for the Board’s
consideration: Resolution to approve offering economic development incentive grant to
Central Carolina Tire in Cameron. Commissioner McNeill asked to recuse himself from
voting on the matter due to being an employee of the company. Commissioner House
moved that Commissioner McNeill could recuse himself. Commissioner Andrews
seconded the motion and it passed unanimously. Commissioner House moved to adopt
the resolution as presented. Commissioner Andrews seconded the motion and it passed
with the following vote: Yeas: 3, Nos: 0, Recused: 1, Absent: 1. (Attachment 7)
Commissioner McNeill moved to remove a temporary moratorium on all development
approvals for property within the area designated for rezoning pursuant to a voluntary
petition for rezoning in Stewart’s Creek Township. Commissioner House seconded the
motion and it passed unanimously.
Commissioner McNeill moved to authorize a letter to the NC Department of Health and
Human Services regarding a plan to use available space at the Good Hope facility in
Erwin for mental health services. Commissioner Andrews seconded the motion and it
passed unanimously. (Attachment 8)
There being no further business, Commissioner McNeill moved to adjourn.
