The Harnett County Board of Commissioners met in regular session on Monday,August 5, 2013,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington,North Carolina.

Chairman Burgin called the meeting to order at 9:00 am. Commissioner Miller led the pledge of
allegiance and invocation.
Chairman Burgin called for additions and deletions to the published agenda. Commissioner
Miller asked to remove from the consent agenda for discussion purposes the resolution to place
Article 46, 1/4-Cent Local Option Sales Tax Voter Referendum, on the November 5, 2013 ballot.
Commissioner Springle moved to approve the agenda as amended. Commissioner Miller
seconded the motion which passed 4—0.
Commissioner Hill moved to approve the items listed on the revised consent agenda.

3. Tax refunds,rebates and releases (Attachment 1)
4. Senior Staff Attorney requested approval of resolution regarding public notice calling the
question whether the Harnett County Board of Commissioners adopt a resolution
directing the Board of Elections to hold elections concerning the"on-premises" and"off
premises"sale of malt beverages and unfortified wine the Grove Township.

5. Senior Staff Attorney requested approval of resolution declaring intent to close public
road or easement and to call a public hearing on the question. Campbell University, Inc.,
does not object to the request. (Attachment 3)
6. Director of Human Resources requested approval of Resolution Authorizing County of
Harnett Early Retirement Incentive Program and approval of the Harnett County Early
Retirement Incentive Plan. (Attachment 4)
7. The Tax Administrator submitted a sworn report of the total unpaid taxes, as of June 30,
2013, constituting liens on real property and a total of unpaid taxes on personal property
no constituting liens on real property and make settlement for 201-2/2013 taxes. The total
amount of unpaid county taxes for 2012 is $1,150,087.96. Of this amount,the real
property and non-DMV(all property, except licensed motor vehicles)total is
$545,507.44. The DMV (licensed motor vehicles) amount is $604,580.52.
8. In Accordance with NC G.S. 105-321(b), the Harnett County Board of Commissioners
authorizes, empowers and commands Tax Administrator Tony Wilder to collect the taxes
of the 2013-2014 tax levy.
9. Administration requested approval of the Harnett County 2014 Holiday Schedule
10. Cooperative Extension requested permission to receive the Race to the Top Grant from
Child Care Networks,Inc. for the 2013-2014 fiscal year in the amount of$12,237 for
delivery of services.
11. Cooperative Extension requested permission to accept the Race to the Top Grant from
Child Care Networks, Inc. for the 2013-2014 fiscal year in the amount of$9,619 for
delivery of services.
12. Cooperative Extension requested permission to receive a grant from the Harnett County
Partnership for Children in the amount of$77,668 to fund the Parents As Teachers
Program. This allocation is 50%of the awarded grant.
13. Emergency Services requested authorization to accept the proposal from Chowder Gulf
for debris management and removal even though they were not the lowest bidder. Staff's
recommendation is based on Crowder Gulfs years of experience in the industry,their
ability to work multiple disasters simultaneously, and their resource inventory which
allows them to handle large disasters. Their proposal included a large percentage of local
contract hire to assist in the debris removal process. There are no initial funds required.
The cost begins once the county activates this contract during a disaster event.
14. General Services requested approval of an additional fee for Spay/Neuter of$70. This
fee will be used to provide an adoptee with a$70 voucher for Spay/Neuter services with
local veterinarians.

15. Airport Administrator requested approval of the 5 year hangar lease agreement with
Lomax Aviation.
Chairman Burgin opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Alisa Yochim of 50 Ticonderoga Road in Cameron posed several questions regarding
schools needs in western Harnett County. Mrs. Yochim asked that the resolution to place
the Article 46 '/4 Cent Local Option Sales Tax Voter Referendum on the November 5,
2013 Ballot be reworded saying"a strongly worded resolution is the key to getting this
passed." Mrs. Yochim shared a copy of a similar resolution she said was recently passed
by Orange County.
- Maggie Gray, 80 Valley Pines Circle,requested more information to help promote the
additional sales tax to the public. She asked what the plan is if the sales tax fails again
and if options being considered included county-wide redistricting or %2 day schooling
with morning and afternoon shifts. Mrs. Gray also asked if there is a push to get more
industry and businesses to the County.
- Lisa Clifford of 605 Whispering Pines Drive,who serves on the Student Assignment
Planning Committee, sought the County's plan or vision to help the committee make
better recommendations.
- Billy Norris of 1238 Cool Springs Road and a Harnett County Public Utilities employee
said the Whistle Blower Policy will not work for him. Mr.Norris suggested that the
County hire an attorney of his choosing, at the same rate Public Utilities pays for their
attorney, to ensure he gets equal representation.
- Joe Langley, 298 Kirk Adams Road in Angier,talked about an individual who, he said,
has failed to pay his property taxes for the last 3 years totally approximately $230,000.
Mr. Langley said the taxes are scheduled to be settled with the State Board in October.
Commissioner Hill moved to approve the appointments listed below. Commissioner Springle
seconded the motion which passed unanimously.
RESEARCH TRIANGLE REGIONAL PARTNERSHIP
Frankie Lewis was reappointed to serve on this committee for a term of two years ending
June 30, 2015.
TRIANGLE SOUTH DEVELOPMENT WORKFORCE BOARD
Scott Daniel was reappointed to serve on this Board for a term of four years ending June
30, 2017.
Joseph Jeffries was appointed to serve on this Board in the Economic Development
Category for a term of four years ending June 30, 2017.
Carolyn Blue was appointed to serve on this Board in the Public Assistance Category for
a term of four years ending June 30, 2017.

Commissioners and staff discussed the resolution to place Article 46, 1/4-Cent Local Option

concerns about how it is written. Discussions continued and clarifications were made to amend
the proposed resolution. Commissioner Miller moved to approve the revised Resolution to place
Article 46, 1/4-Cent Local Option Sales Tax Voter Referendum on the November 5, 2013 ballot.
Commissioner Springle seconded the motion that passed 4—0. (Attachment 5)
County Attorney Snow petitioned the Board for a public hearing concerning a proposed
agreement to extend economic incentives to Rooms To Go Distribution Company, LLC (Rooms
To Go)which intends to purchase real property in the City of Dunn area of Harnett County for
the construction and operation of an approximate 1.1 million square foot regional furniture
warehouse and distribution center. Mr. Snow recognized Rooms to Go Vice Presidents Jeffrey
Finkle and Peter Whitenel in attendance. Mr. Snow shared highlights of the Local Development
Act that authorizes this agreement.
Chairman Burgin called to order a public hearing on the matter and opened the meeting for
comments from the public.
- Gene McLeod, 346 Prospect Church Road in Dunn, said this is not for a public purpose
and should be approved by a majority of qualified voters. He believes we will never see
the 240 jobs at that place and it is discrimination to give anyone what you are doing for
this outfit unless you do it for everybody.
- Ken Weisman, 140 Tannerwood Drive in Dunn, asked about the numbers and why they
were not provided. He asked how much money is being given back and said 10 years
seems like a long time. He also said he couldn't believe they held a public hearing on a
Monday morning.
Commissioners and staff responded to questions Mr. McLeod and Mr. Weisman and discussions
continued. Seeing no one else move Chairman Burgin closed the public hearing.
Commissioner Springle moved to approve the proposed agreement to extend economic

Mr. Burns presented the following report:
- Public Health Activities Summary June 2013
Chairman Burgin called for any new business. He mentioned a recent meeting with NC
Department of Transportation Secretary Tata. Chairman Burgin moved that the Board of
Commissioners pass a resolution stating they support a four lane 401 Corridor from Cumberland
County to Wake County. Commissioner Springle seconded the motion which passed 4—0.
Chairman Burgin noted that N.C. DOT has new grading system of five different factors and this
project should score well. The 401 Corridor is currently in study mode which includes
environmental assessments with one year left in that study.

Commissioner Miller said he hadn't heard anything about the littering problem in the County.
Chairman Burgin said he would be sitting down with Judge Gilchrist later this week and would
talk to him about littering and drugs in Harnett County. Commissioner Miller said they have a
pan-handling problem in Western Harnett, especially near the Food Lion on Hwy 87. Mr. Burns
said he believes there is a N.C. State Statute against this and will research the matter and discuss
with Sheriff Rollins.
Commissioner Miller moved that the Board go into closed session for the following purposes(s):
(1) To consult with the County's legal counsel in order to preserve the attorney-client
privilege concerning the handling of certain legal claims including the following
cases:
a. "County of Harnett vs. Randy D. Rogers and Gary A. House"Harnett County
file No. 12 CVS 890
b. Worker's Compensation claim on Ashley Rosser IC File No. W72544
c. Worker's Compensation claim on Donna Renee Collins IC File No. X16718
(2) To discuss matters relating to the location or expansion of industries or other
businesses in Harnett County.
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3) & (4).

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
CALLING A PUBLIC HEARING ON THE QUESTION
OF WHETHER TO ADOPT THE PROPOSED RESOLUTION BY THE HARNETT
COUNTY BOARD OF COMMISSIONERS REQUESTING THAT THE HARNETT
COUNTY BOARD OF ELECTIONS HOLD ELECTIONS IN THE GROVE TOWNSHIP ON
TWO PROPOSITIONS CONCERNING THE "ON-PREMISES"AND "OFF PREMISES"
SALE OF MALT BEVERGES AND UNFORTIFIED WINE
Whereas,the Harnett County Board of Commissioners has been asked to adopt a resolution
requesting that the Harnett CountyBoard of Elections g hold elections in the Grove Township of
Harnett Countyon two propositions concerning the"on-premises"and"off premises"
sale of malt
beverages and unfortified wine; and
Whereas, although not required by law,the Harnett County Board of Commissioners would
like to call a public hearing on the question and to hear all interested persons who appear with respect
to whether the Board of Commissioners should adopt a resolution requesting that the Harnett County
Board of Elections hold elections in the Grove Township on two propositions concerning the"on-
premises" and"off premises" sale of malt beverages and unfortified wine.
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as
follows:
A public hearing on the proposed resolution shall be conducted by the Harnett County Board
of Commissioners at 7:00 p.m. on the 19th day of August,2013, at which time said Board shall hear
all interested persons who appear with respect to whether the Board of Commissioners should adopt
a resolution requesting that the Harnett County Board of Elections hold elections in the Grove
Township on two propositions concerning the"on-premises"and"off premises"sale of malt
beverages and unfortified wine. Said public hearing shall be conducted in the assembly room of the
Harnett County Office Building, 102 E. Front Street,Lillington,North Carolina 27546.
Duly adopted by the Harnett County Board of Commissioners this 5th day of August,2013.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
DECLARING ITS INTENT TO CLOSE PUBLIC ROAD OR EASEMENT AND
CALLING A PUBLIC HEARING ON THE QUESTION
Whereas,the Harnett County Board of Commissioners has been asked to close the below
referenced public road or easement by Reedy Creek Firm, LLC; and
Whereas,the provisions of North Carolina law require that a resolution be adopted by the
Board of Commissioners declaring the intent of said board to close such public road or easement; and
Whereas, said Board is required by North Carolina law to call a public hearing on the
question and to hear all interested persons who appear with respect to whether the closing would be
detrimental to the public interest or to any individual property rights.
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as
follows:
1. It is declared to be the intent of the Harnett County Board of Commissioners to close the
public road or easement which has hereto served as a portion of Parrish Street as herein
described. The public road or easement to be closed is 0.230 acres of Parrish Street
located in Buies Creek,North Carolina which is undeveloped and unopened and is more
specifically shown on the attached Exhibit A.
2. A public hearing on the proposed closing of said public road or easement shall be
conducted by the Harnett County Board of Commissioners at 9:00 a.m. on the 3rd day of
September, 2013, at which time said Board shall hear all interested persons who appear
with respect to whether the closing would be detrimental to the public interest or to any
individual property rights. Said public hearing shall be conducted in the assembly room
of the Harnett County Office Building, 102 E. Front Street, Lillington,North Carolina
27546.
3. Notice of said public hearing shall be given as provided in North Carolina General
Statute 153A-241.
Duly adopted by the Harnett County Board of Commissioners this 5th day of August, 2013.

COUNTY OF HARNETT
EARLY RETIREMENT INCENTIVE PROGRAM
THAT, WHEREAS, the Harnett County Board of Commissioners desires to ensure that the
County's budget for FY 2013-2014 is balanced in a manner that carefully balances the rights of residents
and business to government services and the interest of County employees who provide those services;
and
WHEREAS,the County Manager has recommended an Early Retirement Incentive Program as a
cost savings measure that will provide the opportunity to realign staffing levels and redirect financial
resources;
WHEREAS, the Harnett County Board of Commissioners desires to implement the Early
Retirement Incentive Program(hereinafter referred to as "Program"), attached hereto as Exhibit A, under
which eligible employees may elect to retire early and to accept benefits in exchange for the signing and
execution of a General Release Agreement and Waiver of Claims relating to various terms and
conditions; and
NOW THEREFORE, BE IT RESOLVED, by the Harnett County Board of Commissioners as
follows:
1. That the Employee Retirement Incentive Program, attached hereto as Exhibit A, be hereby
ADOPTED; and
2. Any position vacated due to acceptance of the Program will be placed in a job freeze and be
subject to the following cost reduction reviews and actions:
a. The vacated position or an alternate comparable position or positions, whose
substitution shall be first approved by the County Manager shall remain frozen for a
minimum of six (6) months pending review and recommendation by the County
Manager and approval by the Board of Commissioners.
b. For any position vacated by a Department Director,the position may only be filled by
a current county employee to serve as an Interim Director for a period of not less than
six(6) months. As a result, the position vacated by the Interim Director shall remain
frozen for a period of not less than six(6)months.
c. The County Manager is authorized to work with departments for other cost reduction
plans and can make substitutions to ensure that all regulatory staffing is maintained in
those areas that are required to work in ratio.
d. Should an elected official decide to accept this plan, the elected official's position
will be filled in accordance with the North Carolina General Statutes.
