meeting on Tuesday, January 12, 2021 at 7:00 p.m. in the Council Chambers of the Dunn Municipal
Building, 401 E. Broad Street, Dunn, NC. Some members of the Council may participate
electronically.
SPECIAL NOTICE REGARDING MEETING ACCESS DUE TO STATE OF EMERGENCY
In an effort to reduce the spread of Covid-19, in -person access to the Council meeting is limited
to a total of25 people to include Council and needed staff.
Face Coverings are required by all members of the public entering the Municipal Building.

Public Comment Period - Comments can be called in or emailed to the City Clerk by Monday,

CITY OF DUNK CITY COUNCIL PUBLIC COMMENT POLICY
The City Council for the City of Dunn does hereby adopt a Public Comment Policy to
provide at least one period for public comment per month at a regular meeting of the City
Council. This policy shall remain in effect until such time that it is altered, modified, or
rescinded by the City Council.
All comments received by the City Council during the Public Comment Period shall be
subject to the following procedures and rules:
1. Anyone desiring to address the City Council must sign up and register on a sign-
up sheet available on the podium within the City Council chambers prior to the Mayor calling the
meeting to order. The sign-up sheet shall be available thirty (30) minutes prior the beginning of
the City Council meeting in the City Council Chambers. Once the Mayor has called the meeting
to order, the City Clerk shall collect the sign -rip sheet and deliver it to the Mayor. The speaker
shall indicate on the sign-up sheet his or her name, address and matter of concern.
2. The Public Comment Period shall be for thirty (30) minutes.
3. Comments are limited to three (3) minutes per speaker. A speaker can not give
their allotted minutes to another speaker to increase that person's allotted time.
4. Each speaker must be recognized by the Mayor or presiding member of the City
Council as having the exclusive right to be heard. Speakers will be acknowledged in the order in
which their names appear on the sign up sheet. Speakers will address the City Council from the
podium at the front of the room and begin their remarks by stating their name and address.
5. Individuals who sign up but can not speak because of time constraints, will be
carried to the next regular meeting of the City Council and placed first on the Public Comment
Period.
6. During the Public Comment Period, a citizen, in lieu of or in addition to speaking
may pass out written literature to the City Council, City Staff and audience.
7. Groups supporting or opposing the same position shall designate a spokesperson
to address the City Council in order to avoid redundancy.
8. After the citizen has made his or her remarks, he or she will be seated with no
further debate, dialogue or comment.
9. The Public Comment Period is not intended to require the City Council to answer
any impromptu questions. Speakers will address all comments to the City Council as a whole
and not one individual Council member. Discussions between speakers and members of the
audience will not be allowed. The City Council will not take action, or respond to questions
about, issues raised during the Public Comment Period at the same meeting.
10. Speakers shall refrain from discussing any of the following: matters which
concern the candidacy of any person seeking public office, including the candidacy of the person
addressing the City Council; matters which involve pending litigation; matters which have been
or will be the subject of a public hearing; and matters involving specific personnel issues related
to disciplinary matters. If the speaker wishes to address specific personnel issues related to
disciplinary matters, he or she should take their comments to the City Manager, who shall share
the comments with the City Council.
11. Speakers shall be courteous in their language and presentation.
12. The Mayor and City Manager shall determine, on a month to month basis, where
the Public Comment Period will appear on the monthly agenda when developing the agenda,
prior to its publication.
13. The Public Comment Period shall only be held during the regularly scheduled
monthly meeting of the City Council. There shall not be a Public Comment Period at any other
meetings of the City Council, unless specifically approved by the City Council.

Consideration of Ordinance to Demolish - 706, 710, 800 N Fayetteville Ave
Mayor Elmore opened the Public Hearing at 7:19 p.m. for consideration of Ordinance to Demolish structures
located at 706, 710, 800 N Fayetteville Ave. The Public Hearing was duly advertised on November 27 and
December 1, 2020. Chief Building Inspector King conducted an inspection and based upon his observations, the
structures are unsafe and have been condemned in accordance with G.S. §160A-426. King also found the
structures dangerous or prejudicial to public health or public safety and a nuisance in violation of G.S. §160A-
193. King added that demolition was taking place but is now at a standstill due to the asbestos abatement that is
needed. According to state law, demolition can't proceed until asbestos at the site has been abated. If the
ordinance is adopted, the city would have to get the property abated and demolished by outside contractors,
with the cost being passed to the property owner. Currently, there is concrete crushing at the site brought in
from other locations as the contractor hired for demolition is currently using the site for that purpose. Council
Member- Turnage asked what the timeline would be if the City passed the ordinance. King replied approximately
six months. Council Member Tart asked if the current contractor would have to remove his property. King
confirmed that he would have to remove his property if he was not hired by the Gity,. Sills asked if the property
was zoned correctly. Adler replied it would be allowed but it has not been approved. Council Member Gaulden
stated that she has received several complaints from residents and King confirmed that the Inspections
Department has also received complaints. Adler was told by the Lester, Groupthat a contractor was hired in
March for the abatement but nothing has been done.
James Godwin, the contractor hired to handle the demolition, requested additional .time. He shared that the
demolition had been stopped over three times with utilities and then asbestos issues. He has a contract with a
company to handle the asbestos abatement to begin next week. He confirmed that lie was crushing stone from
other locations and had checked with Planning Director-A'dle} to make sure it is permitted with the zoning on
that location. He also replied to question from Council Member Tartthat he-fel that the demolition could be done
3-5 days after abatement was done, with project completed by the Jihstweek of January.
James Rankin, a resident at the corner of N Fayetteville Ave and W:Granville St, spoke against the concrete
busting and complained about all the dust and was concerned about the zoning allowing concrete busting at that

of the motion and Council Members Bradham, Gaulden and Sills opposed.
Consideration of Ordinance to Demolish -1014 E Edgerton St
Mayor Elmore opened the Public Hearing at 8:11 p.m. for consideration of Ordinance to Demolish house located
at 1014 E Edgerton St. The Public Hearing was duly advertised on November 27 and December 1, 2020. Building
Inspector Slater Johnson conducted an inspection and based upon his observations, the structures are unsafe and
have been condemned in accordance with G.S. §160A-426. Johnson also found the structure dangerous or
prejudicial to public health or public safety and a nuisance in violation of G.S. §160A-193. King added that they
had spent quite a bit of time trying to help the renter (who is part owner) as there were several children living
there. He shared that the sewer leak was the major issue and with so much sewage under the house they could
not get a plumber to touch it. He said that there are 103 items that need to be addressed at this house with
nothing being repaired to -date. He confirmed that the tenant has moved out. With no additional comments, the
public hearing was closed.
Motion by Council Member Sills and second by Council Member Bradham to adopt the ordinance directing the
Building Inspector to proceed with the demolition of the dwelling located at 1014 E. Edgerton St. (PIN #: 1516-
95-6297,000). Motion unanimously approved. A copy of the Ordinance (02020-26) is incorporated into these
minutes as Attachment #5.

Mayor Elmore opened the Public Hearing at 8:15 p.m. for consideration of Ordinance to Demolish house located
at 1008 E Harnett St. The Public Hearing was duly advertised on November 27, and December 1, 2020. Building
Inspector Slater Johnson conducted an inspection and based upon his observations, the structure is unsafe and
has been condemned in accordance with G.S. §160A-426. Johnson also found the structure dangerous or
prejudicial to public health or public safety and a nuisance in violation of G.S. §1bQA-193. King added that
someone was planning on moving in but it had to be inspected prior.to the;water being turned on. The owner is
not planning on malting repairs and is ok for the city to demolish. With no additional comments, the public
hearing was closed.
Motion by Council Member Bradham and second by Council Member Gaulden to adopt the ordinance directing
the Building Inspector to proceed with the demolition of the dwelling,located at1008 E. Harnett St. (PIN #: 1516-

Mayor Elmore commended the Inspections staff for all their hard work on these condemnations. He shared
about being on site of a house being demolished in Westfield Subdivision and immediately was approached by a
neighbor thanking them for cleaning up the neighborhood. Council Member Turnage asked about boarded up
homes. King stated he is currently working on an ordinance to handle boarded up property and the city can also
handle it as an abandoned building. Council Member Bradham asked that businesses be given the same
guidelines concerning boarded up structures.
Consideration on offer to Purchase City -owned Property - 415 S Magnolia Ave
The City has received an offer of $8,000, by Lucknow Homes LLC, to purchase real property located at 415 S
Magnolia Avenue in Dunn. Offer to Purchase was received by the City Clerk on November 24, 2020.
Motion by Council Member Bradham and second by Council Member Turnage to table to the January meeting.
Motion unanimously approved.
Election of Mayor Pro Tem
Mayor Elmore shared that the Mayor Pro Tem will be appointed annually. He commended Council Member
Turnage for his outstanding job as Mayor Pro Tem in 2020.
Motion by Council Member Turnage and second by Council Member McLean to elect Council Member Bradham
as Mayor Pro Tem. Motion unanimously approved.
Council Goals/Reports
City Manager Neuschafer reviewed the reports. Council Member Bradham requested status on trail from Tyler to
Tart Parks. Neuschafer stated that the path has been informally identified and;"request has been sent to NCDOT
concerning crossing certain NCDOT right of ways. Surveyor has gone out to mark,, some crossings especially the
Ashe Avenue crossing to make sure crossings are as safe as possible. Goal is to have permissions and a plan of
action in place for crossings and marking trail for spring activities.;He added that we need to make sure it is as
safe as possible before being promoted to the public. Mayor Elmore:added`that he has'seen;a lot of use of the new
Dog Park. Neuschafer further updated Council that only one bid.was received on the Watauga project for utilities
and paving so the process has to start over again. Hopefully; ifenough bids are received in Januaiy,,the utilities
will be in spring and early summer for the paving.
Administrative Reports
City Manager Neuschafer reported on the Pope Street sewer repair. and that it was not as bad as feared.
Emergency repairs have been done with totalcost estimated at $130,06,0 after paving is completed. Staff feels
these expenses can be covered in the budget butafthe'le are any other repairs, -needed in the fiscal year, they will

• Debt Service expenditures to date are $551,605 in the General Fund. One interest payment for Water/Sewer
Debt Service was made this month with total for the year - $204,119 for all Debt Service payments.
Mayor Elmore asked for an update on the mapping for the storm water system. Neuschafer said that the mapping
for the sewer system was almost complete and was funded through a grant. There are no grants to handle the
mapping of the storm water system so the city will have to look at funding approximately $75-$100,000 through
the storm water fees. Mayor Elmore asked for this to be placed on the January agenda.
Reports were also received as follows: Communications/Public Information, Planning and Inspections Report,
Public Works Report, Public Utilities Report, Parks and Recreation Report, Library Report and Police Report.

Mayor Elmore welcomed everyone to the joint meeting at 6:00 p.m, %M'ay' or Medlin gave the invocation and Mayor
Parker led in the pledge of allegiance. Dinner was served.
CALL TO ORDER AND INVOCATION
Mayor Elmore opened the meeting of the Dunn City Council at,6:38 p.m. and introduced those representing Dunn.
He acknowledged Council Member McLean was unable to attend, due to being sick'
Partnership Opportunities for Economic Development
Mayor Parker shared the backgrcmmf on the proposed partnership - I-95/I-40 Crossroads of America Economic
Planning Alliance which started with the, Mayors and staff meeting and researching the possibilities.
Reid Williams, Town of Four Oaks Development Coordinator, presented an economic snapshot on the region which
showed success with employers such as the Food Lion Warehouse, Ashley Furniture, Becton Dickerson, Berry
Global and Rooms To Go but also lower median incomes than in surrounding areas including Harnett and Johnston
Counties. He shared the benefits of a regional appr6.ach'which included a broader base of resources; a centralized
economic development operation; cohesive short and long term planning; a focused approach to addressing
strategic-ls'sues such as workforce development, and increased coordination resulting in an efficient use of
City Manager Neuschafer presented the proposed jurisdiction map, which encompasses the I-95 corridor,
approximately four. piles west and-2 miles east of 1-95. The proposed jurisdiction encompasses 20 miles from exit
70 to exit 90. He added that there; are several parcels over 50 acres each that total close to 12,000 acres in this
proposed jurisdiction. .The Partnership could capitalize on available infrastructure such as the railroad and
airports, combining these assets with property that is ready to develop.
Benson Town Manager Fred Nelson shared the preliminary tentative Goals and Objectives to include:
® Goal 1 - Identify opportunity zones for commercial/industrial development within proposed jurisdiction.
® Goal 2 - Formulate relationships with local technical colleges and universities as well as the Department of
Commerce to enhance workforce development in the region
® Goal 3 - Conduct a strategic visioning campaign to assist strategy formulation and resource alignment.
fie also shared the proposed draft of bylaws of the organization to include representatives from each community
and a share of the cost to include a formula for new industry recruited.
Mayor Parker shared that initial discussions were received with favorable feedback with the NC Department of
Commerce as well as elected representatives Congressman David Rouzer, Senators Jim Burgin and Brent Jackson
and Representatives Howard Penny and Larry Strickland. He also talked about potential partners such as the
Department of Agriculture and Harnett and Johnston Counties. He shared that the main goal is to spur growth for
the region and raise the overall quality of life for people in these communities.
Mayor Pro Tem Bradham felt the partnership was a great idea and the towns could get more traction working
together. He did inquire on how the communication will work between the organization and the three town
boards and how often will the organization's board meet. Mayor Parker said he felt they will probably meet
monthly with oversight from the three boards as it is getting started. Council Member Turnage said that goals
would need to be established with timelines to measure success.
Mayor Elmore stated that if the boards agree to move forward staff from each community will begin to move the
process forward in the establishment of the partnership organization. All three ,boards will work together to
develop the bylaws and structure of the SO1C-3 organization. City Attorney Pope shared the value of having a
separate 501C-3 organization for the partnership's efforts are the other available funding sources and the ability to
do things that governments are not allowed to do but are important for economc,development such as give away
land and handle confidential matters privately.
After additional discussion from each board represented, motion by.Mayor Pro Tem;,Bradham and second by
Council Member Turnage to support and move forward with the formfng of the 195/I 40;Crossroads of America
Economic Planning Alliance. Motion unanimously approved.

DECLARING THE BADGE AND SERVICE WEAPON CARRIED BY
HAROLD DWAYNE COLLINS
SURPLUS AND AWARDING THEM TO HIM ON HIS RETIREMENT
WHEREAS, Harold Dwayne Collins served as a member of the Dunn Police Department
from January 16, 2007 until November 5, 2020, at which time he retired from the Dunn
Police Department and an active career in law enforcement; and
WHEREAS, North Carolina General Statute Chapter 20-187.2 authorizes governing boards
of law enforcement agencies to award to a retiring member the badge worn by him, as
well as his service weapon: Clock, 9mm caliber, Model 17, Serial Number PKV774; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dunn, North
Carolina, that the badge and service weapon (Serial Number PKV774) with three
magazines carried by Harold Dwayne Collins be declared surplus and awarded to him on
the occasion of his retirement.
AND BE IT FURTHER RESOLVED that we extend our sincere appreciation to Harold
Dwayne Collins for dedicated service rendered by him during his employment with the
City of Dunn.

PURPOSE:
The United States Congress failed to extend the Families First Coronavirus Response Act (FFCRA). The Act
allowed employees to be paid up to 80 hours of emergency sick leave due to absences related to COVID-19,
of which the City will be reimbursed. The Act expired December 31, 2020.
Staff is requesting that the Council approve the extension of limited paid leave to employees due to Covid-19
for required quarantines. This will keep employees from losing pay and having financial hardship associated
with loss of pay due to required quarantines.
BACKGROUND:
Many of our City employees have been required to quarantine due to exposure with other City employees or
with family members. The Emergency Sick Leave Act paid up to 80 hours. Most employees that had to be
quarantined did not use the total funds allowed.
BUDGET IMPACT:
Continued pay to employees as needed through June 30, 2021, unless the Emergency Sick Leave Act is
reinstated.
RECOMMENDATION/ACTION REQUESTED:
Motion to approve the extension of leave to employees for required paid leave due to the Covid-19 pandemic
through the Fiscal Budget Year ending June 30, 2021 or until the Emergency Paid Sick Leave Act is extended
by Congress.

The City of Dunn is taking proactive steps to protect our employees since the United States
Congress failed to extend the Families First Coronavirus Response Act (FFCRA). The Act
expired on December 31, 2020. It is the City's goal to continue to operate effectively and
ensure that all essential services are continuously provided and that employees are safe
within the workplace.
The City of Dunn is committed to provide accurate information about the nature and spread of
infectious diseases, including symptoms and signs to watch for, as well as required steps to
be taken in the event of an illness or outbreak.The City will provide eligible employees with
temporary emergency paid sick leave under certain conditions. This policy will become null
and void should Congress extend or adopt an Emergency Paid Sick Leave Act prior to the
expiration date of this policy.
The City of Dunn Emergency Paid Sick Leave
The City of Dunn Emergency Paid Sick Leave (DEPSL) is separate from and independent of
Family and Medical Leave (FMLA) and is independent of any existing sick leave policies that
the City grants employees in the normal course of business.
The DEPSL allows an eligible employee to qualify for emergency paid sick leave as follows:
The employee is subject to a federal, state, or local quarantine or isolation order
related to COVID-19;
2. The employee has been advised by their healthcare provider to self -quarantine
because they are infected with or have been exposed to COVID-19 or because they
are at high risk of complications from COVID-19;
3. The employee is showing symptoms of COVID-19 and is actively seeking but has not
yet received a medical diagnosis;
4. The employee is caring for an individual subject to a federal, state, or local quarantine
or isolation order related to COVID-19 or who has been advised by their healthcare
provider to self -quarantine for COVID-19 related reasons;
5. The employee is caring for his or her son or daughter because the child's school or
childcare facility has been closed or the childcare provider is no longer available
because of COVID-19 related reasons; or
6. The employee is experiencing substantially similar conditions as specified by the
Federal Secretary of Health or Human Services, in consultation with the Federal
Secretaries of Labor and Treasury.
Eligibility
All employees who have been employed with the City for at least 30 days (full-time, or part-
time) are eligible for DEPSL in the event the employee is unable to work or telecommute
because the employee meets one or more of the conditions stated above.
Duration/Compensation
Employees are eligible for, on a one-time basis, the following:
• Full -Time employees: 80 hours of pay at their regular hourly rate of pay. However,
when caring for a family member, for reasons 4, 5 and 6 above, DEPSL is paid at two-
thirds the employee's regular hourly rate of pay.
Part -Time employees: The number of hours the employee worked, on average, over
the most immediate prior full pay period. However, when caring for a family member,
for reasons 4, 5 and 6 above, DEPSL is paid at two-thirds the employee's regular
hourly rate or pay.
Paid leave under this policy is limited to $511 per day (or $5,110 in total) where leave is taken
for reasons 12, and 3 described above (generally, an employee's own illness or quarantine);
and $200 per day ($2,000 in total) where leave is taken for reasons 4, 5, or 6 (generally care
for others or school closures).
General DEPSL Rules
• Employees may elect to use DEPSL prior to utilizing any accrued paid sick leave under
the City's sick leave policy.
• No leave provided by the City under any governmental act prior to January 1, 2021, may
be credited against the DEPSL eligibility.
• Employees are responsible for immediately notifying Human Resources of their intent to
utilize this policy, so that the appropriate application paperwork may be given to the
employee in a timely manner.
• Employees must successfully complete the necessary application paperwork and return it
to Human Resources in a timely manner in order to receive compensation under this
policy.
® Employees seeking compensation under this policy found solely to be taking this leave to
defraud the City will be subject to disciplinary action up to and including termination of
employment.
The City will not retaliate against any employee who requests to take DEPSL in
accordance with this policy.
® This policy expires on June 30, 2021.
Definitions
Child Care Provider Defined for the Purposes of DEPSL
For the purpose of this policy, the term "child care provider" is defined as one who provides
child care services on a regular basis and receives compensation for those services,
including an 'eligible child care provider' as defined in Section 658P of the Child Care &
Development Block Grant Act of 1990 (42 USC 9858n).
School Defined for Purposes of DEPSL
The term "school" means an 'elementary school' or 'secondary school' as such terms are
defined in Section 8101 of the Elementary & Secondary Education Act of 1965 (20 USC
7801).

PURPOSE:
Chief Building Inspector Steven King has conducted an inspection at 706, 710, & 800 N. Fayetteville Ave. and
based upon his observations, the structures are unsafe and have been condemned in accordance with G.S.
§160A-426. The Chief Building Inspector also found the dwelling dangerous or prejudicial to the public health
or public safety and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S.
§ 160A-432, the City Council has the power to proceed with the demolition of this property.
Should Council decide to proceed with the demolition of the structure at 706, 710, & 800 N. Fayetteville Ave.
an ordinance (which is attached) would need approval directing the Chief Building Inspector to remove or
demolish said structures.
BACKGROUND: Demolition was started by a third -party contractor without the proper asbestos abatement
being performed. A Stop Work Order on the demolitions was placed on the property on January 27, 2020
due to the asbestos abatement of asbestos containing materials not being removed properly. City Council
adopted, at the December 2020 meeting, to give the property owner until the January 2021 Council
meeting to have asbestos abated and all buildings demolished and removed.

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on September 3rd, 2019, the Chief Building Inspector for the City of
Dunn sent a notice to Lester Group, Inc., the owner(s) of record of the structure located at 706,
710, & 800 N. Fayetteville Ave. noting that the structures were in a condition that constitutes a
fire and safety hazard, and is dangerous to life, health and property and were thereby
condemned, pursuant to North Carolina General Statute §160A-426, and noticed the property
owner of a hearing on September 13th, 2019 at the office of the Chief Building Inspector located
at 102 North Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute
§160A-428;and
WHEREAS, on September 13th, 2019 a hearing was conducted by the Chief Building
Inspector Steven King, with Mr. Tom Mize and Mr. Andrew C. Palmer of the Lester Group, LLC. In
attendance. Following the completion of the hearing, the Chief Building Inspector entered an
Order, pursuant to North Carolina General Statute §160-429, declaring that the structure
referenced above is in a condition that constitutes a fire or safety hazard and is dangerous to life,
health or other property and ordering the property owner to repair or demolish the structure on
the property within sixty (60) days of the date of such Order, being October 21st, 2019; and

WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute
§ 160A-430 and such Order is therefore a final Order; and
WHEREAS, on November 27"', 2020 and December ls`, 2020, the City of Dunn
published legal notices that a public hearing would be held before the Dunn City Council on
December 8t", 2020 to consider the adoption of this Ordinance, directing that the Building Inspector
proceed with the demolition of the structure described hereby, and that all costs incurred shall be a lien
against such property, pursuant to North Carolina General Statute § 160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on October 21s`
2019 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structures including the surrounding fencing in accordance with his
Order to the owner thereof dated the 21" day of October, 2019 and in accordance with North Carolina
General Statute § 160A-432, based on the owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the same manner as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dunn city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus
with the Harnett County Clerk of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute §160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

Purpose: Chief Building Inspector, Steven King, has conducted an inspection at 906 & 908 N. Clinton Ave.
and found the structure in a deteriorated condition that does not meet the requirements of the City of Dunn's
Non -Residential Building Maintenance Code. The Chief Building Inspector also found the property dangerous
or prejudicial to the public health or public safety and is a nuisance in violation of N.C.G.S. §160A-193.
The owner of the property has failed to comply with the Chief Building Inspector's order to bring the structure
on the property into compliance with the City of Dunn Non -Residential Building Maintenance Code and
pursuant to N.C.G.S. §160A-439, the City Council has the authority to direct the Chief Building Inspector to
post on the main entrance of the property a placard that states "This building is unfit for human habitation;
the use or occupation of this building for human habitation is prohibited and unlawful".
If the owner of the property has not repaired, altered or improved the property to bring it into compliance with
Chapter 4, Article VII of the Dunn City Code within twenty-four (24) months of the adoption of this ordinance,
the Building Inspector is directed to bring the matter back before the City Council for further consideration of
remedies available to the City of Dunn under N.C.G.S. §160A-439.
BACKGROUND: The ordinance to deem the property Unfit for Human Habitation was tabled by City Council
at the September 81h, 2020 meeting until the October 131h, 2020 meeting for an update on the outstanding
repairs that had not been completed by the deadline given by the Chief Building Inspector. As of December
29, 2020, there are three items on the repair list to complete.

NC Fire Code and the City of Dunn's Non -Residential Maintenance Code.
January 29, 2020 — Notice sent to owner(s) notifying them of hearing on February 10, 2020.
February 10, 2020 —Hearing held at Planning and Inspections office. Mr. Hemir Alsanda and Mr.
Hosvan Giron (tenants/owners of D & H Mart) attended the hearing as well as Dwayne Williams and
Steven King.
February 12, 2020 — Findings of Fact and Order letter sent to owner(s) notifying them of the ninety (90)
day time period. Information on how to appeal the Building Inspector's Order enclosed as well.
February 21, 2020 — Follow up inspection performed to check off items on the list that had been
completed.
February 22, 2020 — Ten (10) day time period for appeal expires. No appeal received.
May 12, 2020 — Allowed time period of ninety (90) days expires.
July 7, 2020 — Walk-through performed with tenants of 906 & 908 N. Clinton Ave. to check on the status
of the property and what was left on the list to be completed. Being work had been completed on the
repair list, additional time was given for the items to be completed.
August 21, 2020 — Site inspection performed to see what is still outstanding on the repair list.
August 31, 2020 — Public Hearing notice sent to owner(s) notifying them of City Council Meeting on
September 8"i, 2020 at 7:00 pm.
September 8, 2020 — Scheduled for City Council Meeting. City Council tabled the ordinance until the
October 131h, 2020 meeting to allow for additional time for the outstanding repairs to be made.
September 17, 2020 — Contacted Mr. Gary Peacock with Warren Realty, LLC and set up meeting for
11:00 a.m. Mr. Slater Johnson and Mr. Dwayne Williams attended meeting with Mr. Peacock at his
office. Mr. Peacock was informed of all the items that had to be completed and he stated he would send a
letter to the tenant requiring them to 'finish the repairs.
September 22, 2020 — Spoke to Mr. Hemir Alsanda via telephone. He updated me on the progress and
stated that the canopy would be removed on the following day (23`d) and the gas company to pressure test
the tanks and underground piping was a month behind and it would be late October before they would be
able to complete the work.
September 23, 2020 — Rode by to check on status of canopy being removed. It was partially down and
workers were actively removing canopy at the time that I rode by. By the end of the day the canopy the
canopy had been completely removed.
October 6, 2020 — Site inspection performed and pictures taken of exterior of property. At this time, the
removal of the canopy has been the only thing completed out of the five (5) outstanding items previously
noted.
January 12, 2021 Scheduled for update to City Council.

AN ORDINANCE DECLARING THE PROPERTY HEREIN DESCRIBED AS UNFIT
FOR HUMAN HABITATION PURSUANT TO N.C.G.S. §160A-439, ET SEQ.
WHEREAS, that on January 29, 2020 the Building Inspector for the City of Dunn sent a notice
to Warren Realty, LLC, the owners of record of the property located at 906 & 908 N. Clinton Ave. that
the property was in a condition that does not meet the requirements of the City of Dunn Non -Residential
Building Maintenance Code and served on the property owner of Complaint and Notice of Hearing, that a
hearing would be held on February 10, 2020, at the office of the Building Inspector located at 102 North
Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute §160A-439, et seq.; and
WHEREAS, on February 10, 2020, attending the hearing was Hemir Alsanda, Hosvan Gil -on,
Chief Building Inspector, Steven King, and Code Enforcement Officer, Dwayne Williams and following
the completion of the hearing, the Building Inspector entered an Order, pursuant to North Carolina
General Statute § 160A-439, declaring that the property referenced above was deteriorated pursuant to the
City of Dunn Non -Residential Building Maintenance Code and ordering the property owner to bring the
structure on the property into compliance with the City of Dunn Non -Residential Building Maintenance
Code within ninety (90) days of the date of such Order, being February 12, 2020 and if necessary, that the
property be vacated until the repairs, alterations and improvements to the property were made to bring
such property into compliance with the City of Dunn Non -Residential Building Maintenance Code as set
forth in Article VII of the Dunn City Code; and

WHEREAS, the owner of the above described property did not appeal the Order of the Chief
Building Inspector within the ten (10) day time period prescribed in Section 4-186 of the Dunn City Code
such Order is therefore a final Order; and
WHEREAS, on August 28, 2020 and September 1, 2020, the City of Dunn published legal
notices that a public hearing would be held before the Dunn City Council on September 8, 2020 to
consider the adoption of this Ordinance, directing the Chief Building Inspector to post on the main
entrance of the property a placard that states: "This building is unfit for human habitation; the use or
occupation of this building for human habitation is prohibited and unlawful;." and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described herein is
unfit for human habitation and that the Chief Building Inspector shall post the main entrance of such
property with the placard provided for herein; and
WHEREAS, the owner of this property has been given a reasonable opportunity to repair the
property pursuant to an Order issued by the Building Inspector on February 28, 2020, and the owner has
failed to comply with the Order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn, North Carolina,
that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the main
entrance of the building located on the property described herein, containing the legend:

Section 3. This ordinance shall become effective upon its adoption.
Section 4. If the owner of the property described herein has not repaired, altered or improved
the property to bring it into compliance with Article VII of the Dunn City Code within

PURPOSE:
Chief Building Inspector Steven King has conducted an inspection at 503 E. Carr St, and based upon his
observations, the structures are unsafe and have been condemned in accordance with G.S. §160A-426. The
Chief Building Inspector also found the structures dangerous or prejudicial to the public health or public safety
and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S.
§ 160A-432, the City Council has the power to proceed with the demolition of this property.
Should Council decide to proceed with the demolition of the structures "B" and "C" at 503 E. Carr St. an
ordinance (which is attached) would need approval directing the Chief Building Inspector to remove or
demolish said structures.
BACKGROUND:
July 14th 2020 — City Council adopted to table the matter of demolition to allow potential buyer, Curtis Miles,
additional time to acquire ownership of the property. It was agreed upon that structure "A" could be kept and
repaired, but structures "B" and "C" will need to be removed by the owner or by the City to conform to Zoning
Regulations.
August 11th2020 — City Council adopted to table the matter of demolition of all properties to allow owner,
Curtis Miles, time to demolish structures 'B" and "C" prior to the City taking action to demolish the properties.
September 8th 2020 — City Council adopted to table the demolition on the principal structure until the
December 2020 Council meeting to allow renovations to be made by Mr. Curtis Miles.

April 9t', 2020 — Order after Condemned Hearing notice allowing sixty (60) days for repairs or
demolition of property sent to owner. Appeal letter sent with this notice informing owners of the appeal
process if they desired to do so.
April 19th, 2020 — Ten (10) day time period for appeal expires.
May 11t', 2020 — Mrs. Shirley White McNeil contacted me to inform me she had a buyer for the property
and wanted to know if she could get an extension. I informed her that City Council would have to grant
an extension.
June 81", 2020 — Allowed time period of sixty (60) days expires.
July 211, 2020 — Site inspection performed and updated pictures taken. No progress has been made on
repairing or demolishing the structure. Property has not been sold as of this time.
July 14t', 2020 — Scheduled for City Council Meeting. City Council agreed to table the matter to allow
Mr. Curtis Miles additional time to acquire the property from the current owners. Scheduled for next
City Council meeting on August 1 ld', 2020.
August 4"', 2020 — Contacted Mr. Curtis Miles via text message asking if had obtained ownership of 503
E. Carr St. He stated that he had not yet purchased the property.

THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on March 20th, 2020, the Chief Building Inspector for the City of
Dunn sent a notice to Johnny Smith and James Bell, the owner(s) of record of structure located at
503 E. Carr St. was in a condition that constitutes a fire and safety hazard, and is dangerous to
life, health and property and were thereby condemned, pursuant to North Carolina General
Statute §160A-426, and noticed the property owner of a hearing on March 301h, 2020 at the
office of the Chief Building Inspector located at 102 North Powell Ave., Dunn, North Carolina
pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on March 30th, 2020 a hearing was conducted by the Chief Building
Inspector Steven King, following the completion of the hearing, the Chief Building Inspector
entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
structure referenced above is in a condition that constitutes a fire or safety hazard and is
dangerous to life, health or other property and ordering the property owner to repair or
demolish the structure on the property within sixty (60) days of the date of such Order, being

WHEREAS, the owner of the above described structure did not appeal the Order of the

notices that a public hearing would be held before the Dunn City Council on July 14"', 2020 to
consider the adoption of this Ordinance, directing that the Building Inspector proceed with the
demolition of the structure described hereby, and that all costs incurred shall be a lien against such
property, pursuant to North Carolina General Statute §160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on April 9"',
2020 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structure in accordance with his Order to the owner thereof dated the 9"'
day of April, 2020 and in accordance with North Carolina General Statute §160A-432, based on the
owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the same mamier as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dunn city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surplus
with the Harnett County Clerk of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute § 160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

PURPOSE:
Building Inspector Slater Johnson has conducted an inspection at 809 E. Pearsall St. and based upon his
observations, the structures are unsafe and have been condemned in accordance with G.S. §160A-426. The
Building Inspector also found the structures dangerous or prejudicial to the public health or public safety and
is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S.
§ 160A-432, the City Council has the power to proceed with the demolition of this property.
1) Should Council decide to proceed with the demolition of the storage building at 809 E. Pearsall St. an
ordinance (which is attached) would need approval directing the Chief Building Inspector to remove
ordemolish said structure.
BACKGROUND:
November 10th, 2020 — City Council adopted to table the matter on the storage building demolition to allow
owner to make repairs or have it removed.

August 21, 2020 — Order after Condemned Hearing notice allowing sixty (60) days for repairs or
demolition of property sent to owner(s). Appeal letter sent with this notice informing owner(s) of the
appeal process if they desired to do so.
August 31, 2020 — Ten (10) day time period for appeal expires. No appeal received.
September 3, 2020 — Appeal received from Harvey Harris Jr. and Linda Faye Harris requesting more
time. Appeal was denied due to not receiving within the ten (10) day appeal time period.
October 20, 2020 — Allowed time period of sixty (60) days expires.
October 27, 2020 — Site visit performed at the property to see if any improvements have been made.
Exterior inspection of dwelling revealed that the exterior had been painted, exterior damages have been
repaired and new roof covering has been installed. Nothing appears to have been done to the storage
building behind the dwelling. Pictures taken to update file.
October 29, 2020 — Public hearing notice sent to Linda Faye Harris and Harvey Harris Jr. notifying them
of the November 10tl', 2020 Council Meeting.
November 10, 2020 — Scheduled for City Council Meeting. City Council adopted to table the matter on
the storage building demolition to allow owner to repair or have it removed.

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on August 51h, 2020, the Building Inspector for the City of Dunn
sent a notice to Linda Faye Harris and Harvey Harris Jr., the owner(s) of record of the storage
building located at 809 E. Pearsall St. noting that the storage building is in a condition that
constitutes a fire and safety hazard, and is dangerous to life, health and property and were
thereby condemned, pursuant to North Carolina General Statute §160A-426, and noticed the
property owner of a hearing on August 14th, 2020 at the office of the Building Inspector located
at 102 North Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute
§160A-428; and
WHEREAS, on August 14th, 2020 a hearing was conducted by the Building
Inspector Slater Johnson via telephone, following the completion of the hearing, the Building
Inspector entered an Order, pursuant to North Carolina General Statute §160-429, declaring that
the storage building referenced above is in a condition that constitutes a fire or safety hazard
and is dangerous to life, health or other property and ordering the property owner to repair or
demolish the storage building on the property within sixty (60) days of the date of such Order,
being October 20th, 2020; and

WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute
§ 160A-430 and such Order is therefore a final Order; and
WHEREAS, on October 30"', 2020 and November 3`d, 2020, the City of Dunn published
legal notices that a public hearing would be held before the Dunn City Council on November 10"',
2020 to consider the adoption of this Ordinance, directing that the Building Inspector proceed with the
demolition of the structure described hereby, and that all costs incurred shall be a lien against such
property, pursuant to North Carolina General Statute § 160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of
North Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to
repair or demolish the structure pursuant to an Order issued by the Building Inspector on August 215t
2020 and the owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn,
North Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the
exterior of the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this
building for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or
demolish the above described structure in accordance with his Order to the owner thereof dated the
21" day of August, 2020 and in accordance with North Carolina General Statute §160A-432, based on
the owner's failure to comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall
have the same priority and be collected in the same manner as the lien for special assessments in
Article 10 of Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien
against any other real property owned by the owner of the property within the City of Dunn, North
Carolina, or within one (1) mile of the City of Dunn city limits, except for the property owner's
primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the
useable materials of the structure and any personal property, fixtures, or appurtenances found in the
building and credit the proceeds against the cost of removal or demolition. The Building Inspector
shall certify the remaining balance to the Tax Collector. If a surplus remains after sale of the materials
and satisfaction of the cost of removal or demolition, the Building Inspector shall deposit the surphis
with the Harnett County Clerk of Superior Court where it shall be secured in the manner provided by
North Carolina General Statute § 160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from
any building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit
the occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

PURPOSE:
The City has received an offer of $8,000, by Lucknow Homes LLC, to purchase real property located at 415 S
Magnolia Avenue in Dunn. Offer to Purchase was received by the City Clerk on November 24, 2020.
If the Council wishes to proceed with the sale of the property, the property would be sold with "Notice to sell
Real Property with Invitation for Upset Bids." If approved, a deposit of at least 5 percent will be deposited with
the Clerk by the prospective purchaser. Notice will be published in The Daily Record, as well as other means
of advertising, for the potential sale of the residential lot. Prospective bidders have 10 days to present an
upset bid (to include 5% deposit) and the bid must be raised at least 10% of the first $1000, plus 5% of any
amount above $1000 of the original bid. This procedure will be repeated until an upset bid has not been
received.
BACKGROUND:
Ordinance to Demolish the house on the property was adopted in August, 2010. The property was accepted
by the Dunn City Council in January, 2013. The outstanding balance owed the City of Dunn by the previous
property owner is $6,701,10. The parcel land value shown on the Harnett GIS Parcel Report is $7,500.
Consideration to Sell Real Property owned by the City of Dunn at 415 S Magnolia Avenue was tabled at the
December 2020 Council Meeting.

RESOLUTION AUTHORIZING THE SELL OF REAL PROPERTY BY UPSET BID
WHEREAS, the City of Dunn is the owner of a 75 foot x 140 foot lot located at 415 S
Magnolia Avenue in the City of Dunn, Harnett County, NC 28334. This tract is conveyed to
the City of Dunn in that Deed recorded in Book 3113, Page 435-437, Harnett County
Registry, PIN# 1516-65-4531.000, Parcel ID No. 02151611170007; and
WHEREAS, North Carolina General Statute § 160A-269 permits the city to sell property by
upset bid, after receipt of an offer for the property; and
WHEREAS, the City has received an offer to purchase the property described above, in the
amount of $8,000, submitted by Lucknow Homes LLC.
THEREFORE, THE CITY COUNCIL OF THE CITY OF DUNN RESOLVES THAT:
1. The City Council authorizes sale of the property described above through the upset bid
procedure of North Carolina General Statute § 160A-269.
2. Upon receipt from Lucknow Homes LLC of the required five percent (5% deposit), the
city clerk shall cause a notice of the proposed sale to be published. The notice shall
describe the property and the amount of the offer, and shall state the terms under
which the offer may be upset.
3. Persons wishing to upset the offer that has been received shall submit a sealed bid
with their offer to the office of the city clerk within 10 days after the notice of sale is
published. At the conclusion of the 10-day period, the city clerk shall open the bids, if
any, and the highest such bid will become the new offer. If there is more than one bid
in the highest amount, the first such bid received will become the new offer.
4. If a qualifying higher bid is received, the city cleric shall cause a new notice of upset bid
to be published, and shall continue to do so until a 10-day period has passed without
any qualifying upset bid having been received. At that time, the amount of the final
high bid shall be reported to the City Council.
A qualifying higher bid is one that raises the existing offer by not less than ten percent
(10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that
offer.

6. A qualifying higher bid must also be accompanied by a deposit in the amount of five
percent (5%) of the bid; the deposit may be made in cash, cashier's check, or certified
check. The city will return the deposit on any bid not accepted, and will return the
deposit on an offer subject to upset if a qualifying higher bid is received. The city will
return the deposit of the final high bidder at closing.
7. The terms of the final sale are that the City Council must approve the final high offer
before the sale is closed, which it will do within 30 days after the final upset bid period
has passed.
8. The city reserves the right to withdraw the property from sale at any time before the
final high bid is accepted and the right to reject at any time all bids.
9. If no qualifying upset bid is received after the initial public notice, the offer set forth
above is hereby accepted. The City Manager is authorized to execute the instruments
necessary to convey the property to Lucknow Homes LLC.

PURPOSE: The City requests the Council to secure a loan for the purchase of new computer servers,
switches, software, and related equipment and expenses connected to its installation.
BACKGROUND: In 2020, the city purchased computers for offices and the police department replacing
those that had been on lease for the previous 4 years. In this process we also replaced many much older
computers as well. We elected at this time not to purchase the servers that run the software used by various
departments and handles such items as system back-ups, video surveillance, long term storage, etc. We
now believe it is time to replace this equipment as was recommended by our Harnett County computer
support team. The lease on the current servers ended last year and we extended that warranty for one
additional year. At this time, we have received proposals to replace and upgrade this equipment. These
proposals include the purchase of servers, switches, and system base for the upgrade of the computer server
system operated by the City. The equipment is a new technology system including: Two PowerEdge R640
servers, Two PowerSwitch S41112F-ON switches, and a Dell EMC PowerStore 1000T-AMER base.
BUDGET IMPACT: The total loan for this equipment will be approximately $110,000 with a repayment term
of four (4) years, at an interest rate of 1.80% (Bank Qualified) making payments in the amount of
approximately $29,000 per year. Payments will be made on a Quarterly basis. This payment is within our
budget appropriations and will be funded through our current General Fund income and expense budget
process.
RECOMMENDATIONIACTION REQUESTED: Motion to approve a Loan through First Citizens Bank in the
amount of $110,000 to pay for the purchase and installation of computer servers and related equipment for
use by the City and authorize the Mayor and City Manager to execute any and all documents associated with
this Resolution.

AGREEING TO PROCEED WITH LOANS FOR THE PURCHASE OF COMPUTER
SERVERS, SOFTWARE, AND RELATED EQUIPMENT AND COSTS FOR THE CITY'S
OPERATIONS
WHEREAS, the governing body of the City of Dunn desires to proceed with borrowing in the
amount of $110,000 for the replacement of computer servers, software and related equipment and
costs.
WHEREAS, the interest rate will not exceed 1.80% for a term of four years for the total project and
will have a repayment schedule not exceeding $29,000 per year.
WHEREAS, the governing body of the City of Dunn authorizes the Mayor and the City Manager to
sign all documents relating to the loans.

PURPOSE:
A Request for Letters of Interest and Statement of Qualifications were published in order to begin the process
of selecting an engineering firm based on qualifications to assist with the Merger/Regionalization Study and
the Water Treatment Plant Design.
BACKGROUND:
Requests for Letters of Interest and Statement of Qualifications was duly published on September 30, 2020.
The City received a total of six (6) Statement of Qualification for the Merger/Regionalization Study and the
Water Treatment Plant Design. Of those received, City Staff reviewed and scored each using the same
criteria for comparison. Staff short listed three (3) Firms (The Wooten Company, Hazen and Sawyer, and
WithersRavenel) and conducted in person interviews on November 13, 2020 and November 18, 2020.
WithersRavenel received the highest collective score and therefore Staff is recommending that the City move
forward with WithersRavenel in contract negotiations.

Motion to authorize staff to begin working with WithersRavenel to negotiate the scope of work and fees
associated with both the Merger/Regionalization Study and design of the Water Treatment Plant and

objectively evaluate the condition of every paved street the City is responsible for maintaining.
Since the total estimated professional fee for engineering will be less than $50,000,00, we recommend that

the City Manager to solicit proposals from qualified firms for evaluation and future recommendation to the
Council.

This project will evaluate the pavement condition of each street the city is responsible for maintenance. The
city has previously depended on the recommendation from department heads concerning which streets
needed resurfacing. This study will have a prioritization based upon actual field conditions and will present the
recommendations based upon extending the useful life of the pavement system.

Less than $50,000 upon the decision once proposals are received.

• The City, as of December 31, 2020, had $6,925,847 in cash from the General Fund and the
Water -Sewer Fund combined. As of November 30, 2020, the city had had $6,506,247 in cash
including the General Fund and the Water -Sewer Fund. As you can see, this is an increase of
$419,601. On December 31, 2019 we had $5,808,950. This is almost $1,117,000 less than we have
currently. We continue to have over $370,000 expended on PJ's project and we are still waiting on
DOT to reimburse us.
• We continue to receive our tax payments and expect to receive around $1,300,000 in January
for payments received in December. Through November 30, 2020, we have received $1,722,888. In
2019 the October's funds received were $1,649,259. We have received approximately $73,600 more
in taxes this year than last year. There is a one month lag in reporting taxes received. This month is
slightly more than 40% of our estimated receipts for the 2020 tax year which is $4,213,600. These
totals include Property, Motor Vehicles, and Downtown Service District taxes.
• Sales Tax Revenue continues to be very strong. Our October receipts were $200,081. For July
through October, we have received $866,631. That is up from $670,047 as of last month. We are up
18.1% from the same time last year. Last year we had Sales Tax Revenue of $733,995. Our Budget
for that income for the 2021 budget year is set at $2,160,000. Sales Tax Reports from the
Department of Revenue are provided at least two months behind actual collections. To date, we
have received $132,635 more than last year. Our next sales tax report will be January 15m.
• Utilities Sales Taxes are reported quarterly. For the first Two Quarters we have received
$337,594. For 2019 we had received $343,048, $5,454 more than this year. This report is for the
quarter ending September 30, 2020 and the amount received for this quarter was $193,324. In 2019
we received $195,909 for this same time period. This amount includes Electricity, Natural Gas,
Telecommunications, and Video Programming Sales Taxes. Our next report will be received on
March 15rh. Our budget for 2021 for these four areas is $739,000.

• Building Permit Fees for the month of December were $24,812, in November they were
$6,919 and in October they were $16,128. This year we have collected a total of $77,699 or 78%
of budget. Last year we had collected $69,064. Our budget for this year is $100,000.
• Water and Sewer Revenues for the month of December were $486,485, in November they
were $S03,664, and in October they were $482,629. Last year in December we had collected
$432,981. Our total collected to date is $2,988,998 or 51.1% of budget. Year to Date in 2019
was $3,003,014. This $14,016 difference is related to COVID-19 payment deferrals but is down
from over $60,000 last month. Our budget for the year is $5,850,000.
• General Fund expenditures in December were $685,085. The total expensed to date is
$5,219,118 or 44.8% of Budget ($11,641,100). For 2019 we had expended $5,663,619. Last
month we had expensed $4,502,128.
® The Water and Sewer fund expenditures in December were $453,831, The total expensed
to date is $2,658,255 or 36.5% of budget ($7,275,490). For 2019 we had expensed $2,351,264.
Last month we had expensed $2,197,973.
® The benchmark for this period is 50% of budget.
® Several Debt Service payments from the General Fund were made in December totaling
$13,090. Expenditures to date are $571,242 out of our total budgeted amount of $910,130. No
Debt service payments for Water/Sewer were made this month. Our total for the year is
$204,119 for all Water/Sewer Debt Service payments. Debt Service for the Water/Sewer Fund is
budgeted at $1,015,200.

During the month of December I worked on the Mainstreet Salary and Budget
worksheet and finished the DDDC Budget. I also finished the Cemetery Press Release
and promotion material. We held a Christmas Tree lighting wrap up meeting with the
Tree lighting committee and I have already started planning for next year. I also help
promote the Imagine Dunn events of December.
Mrs. Edith Elmore and I are in the process of beautifying our Downtown Alleyways
and making them safer/ more pedestrian friendly.

My main goal for this month is to talk to all building/alleyway owners for consent
and help to bring more lighting to our alleyways downtown.

This month we created a StoryWalk® at the Black River crossing of the Dunn -Erwin Rail
Trail. We chose as our story Hiking Day by Anne Rockwell, illustrated by Lizzie
Rockwell. It is a story about a young girl who goes on her first hike with her parents to
the top of a nearby mountain she can see from her bedroom window.
What we did is disassemble the book, laminate the pages with clear contact paper,
mount the pages on signs the size of political signs, and put them out at the approach to
the Black River and between the two bridges.
Our StoryWalk® gives children and their parents the opportunity to read a story as they
walk along the trail. This promotes early literacy and family engagement. Indirectly it is a
reminder of the library also.
We have received a lot of positive comments on Facebook. We plan to change the
stories periodically since most of the components are reusable. The stories can be
saved and reused as well.

CITY OF DUNN ABC BOARD
Minutes of Meeting, November 19, 2020
The Dunn ABC Board met on November 19, 2020. Present at the meeting: Board
Members, Dal Snipes, Alice Judd, Cindy Smith, Marc Phillips, and Manager, Charles
Willis, who served as Secretary to the Board. Board member Lynn Jernigan was not
present.
Mr. Willis presented the minutes of the October 20, 2020 meeting that were approved by
the Board.
Each Board Member was given a copy of October, 2020 Financial Statements. The Board
reviewed the statements noting sales in October 2020 were $91,465.51 above last year.
Year to date sales are $216,260.21 above last year. Mixed Beverage sales are $2,798.92
above last year. Each Board Member was given a copy of October Sales as reported by
all NC ABC Boards.
Mr. Willis reported to the Board that the Duke Energy bills for stores 1 and 2 were
$780.00 less for August -October, 2020 verses August -October, 2019.
The Board discussed and agreed on Holiday closings; Closed, Thanksgiving Day,
Christmas Day, and New Year's Day. Close at 6:00 pm on Christmas Eve.
The Board discussed and approved bonuses for employees. $900.00 for Full-time,
$600.00 for Part-time with 1+ years of service, and $300.00 for Part-time with less than 1
year of service.
The Board agreed on the logo for the employee uniforms.
The Board agreed to pay Alcohol Education Funding to Harnett County teachers in
December.
The Board will continue to work on revising and updating the Employee Handbook.
There was no conflict of interest at this meeting.
The next ABC Board Meeting will be December 15, 2020.
