CITY OF DUNN CITY COUNCIL PUBLIC COMMENT POLICY
The City Council for the City of Dunn does hereby adopt a Public Comment
Policy to provide at least one period for public comment per month at a regular meeting
of the City Council. This policy shall remain in effect until such time that it is altered,
modified, or rescinded by the City Council.
All comments received by the City Council during the Public Comment Period
shall be subject to the following procedures and rules:
1. Anyone desiring to address the City Council must sign up and register on
a sign-up sheet available on the podium within the City Council chambers prior to the
Mayor calling the meeting to order. The sign-up sheet shall be available thirty (30)
minutes prior the beginning of the City Council meeting in the City Council Chambers.
Once the Mayor has called the meeting to order, the City Clerk shall collect the sign-up
sheet and deliver it to the Mayor. The speaker shall indicate on the sign-up sheet his or
her name, address and matter of concern.
2. The Public Comment Period shall be for thirty (30) minutes.
3. Comments are limited to three (3) minutes per speaker. A speaker can not
give their allotted minutes to another speaker to increase that person's allotted time.
4. Each speaker must be recognized by the Mayor or presiding member of
the City Council as having the exclusive right to be heard. Speakers will be
acknowledged in the order in which their names appear on the sign up sheet. Speakers
will address the City Council from the podium at the fi-ont of the room and begin their
remarks by stating their name and address.
5. Individuals who sign up but can not speak because of time constraints,
will be carried to the next regular meeting of the City Council and placed first on the
Public Comment Period.
6. During the Public Comment Period, a citizen, in lieu of or in addition to
speaking may pass out written literature to the City Council, City Staff and audience.
7. Groups supporting or opposing the same position shall designate a
spokesperson to address the City Council in order to avoid redundancy.
8. After the citizen has made his or her remarks, he or she will be seated with
no further debate, dialogue or comment.
9. The Public Comment Period is not intended to require the City Council to
answer any impromptu questions. Speakers will address all comments to the City
Council as a whole and not one individual Council member. Discussions between
speakers and members of the audience will not be allowed. The City Council will not
take action, or respond to questions about, issues raised during the Public Comment
Period at the same meeting.
10. Speakers shall refrain from discussing any of the following: matters
which concern the candidacy of any person seeking public office, including the
candidacy of the person addressing the City Council; matters which involve pending
litigation; matters which have been or will be the subject of a public hearing; and matters
involving specific personnel issues related to disciplinary matters. If the speaker wishes
to address specific personnel issues related to disciplinary matters, he or she should take
their comments to the City Manager, who shall share the comments with the City
Council.
11. Speakers shall be courteous in their language and presentation.
12. The Mayor and City Manager shall determine, on a month to month basis,
where the Public Comment Period will appear on the monthly agenda when developing
the agenda, prior to its publication.
13. The Public Comment Period shall only be held during the regularly
scheduled monthly meeting of the City Council. There shall not be a Public Comment
Period at any other meetings of the City Council, unless specifically approved by the City
Council.

The City Council of the City of Dunn held a Regular Meeting on Tuesday, July 11, 2017, at 7:00 p.m. in the Dunn
Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tem Billy Barfield, Council Members Buddy
Maness, Dr. Gwen McNeill, Frank McLean, Billy Tart, and Chuck Turnage. Also present was City Manager Steven
Neuschafer, Finance Director Mark Stephens, Public Works Director Dean Gaster, Chief Building Inspector Steven
King, Planning Director Samantha Wullenwaber, Police Captain Royal, Recreation Director Brian McNeill, Human
Resources Director Anne Thompson, Librarian Mike Williams, Attorney Tilghman Pope, City Clerk Jennifer Fortin,
and Daily Record Reporter Melody Brown -Peyton.
INVOCATION
Mayor Harris opened the meeting at 7:00 p.m. and asked Pastor Roy Johnson, Police Chaplain and Director of Pastoral Care
for Harnett Health System, to give the invocation. Afterwards, the Pledge of Allegiance was repeated.

Motion by Council Member Maness and seconded by Council Member Barfield to adopt the July 11, 2017 meeting agenda

Rezoning Request RZ-02-17
City Initiated Large Scale Rezoning Phase 3
The public has been notified that oral and written comments will be heard and received concerning the City initiated rezoning
of properties in the northern portion of the jurisdiction, with boundaries as follows: W. Cumberland Street and E.
Cumberland Street north to the end of the City of Dunn jurisdiction, and west of 1-95.
The City is initiating the rezoning to amend the zoning map to reflect the current use of properties and the 2030 Land Use
Plan.

and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Chief Building Inspector's order and according to N.C.G.S. § 160A-
443, the City of Dunn has the power to proceed with the demolition of the property.

of the Dunn City Code within twelve (12) months of the adoption of this ordinance, the Building Inspector is directed to
bring this matter back before the City Council for further consideration of remedies available to the City of Dunn under
N.C.G.S §160A-443.

Chief Building Inspector Steven King conducted an inspection at 604/606 S. Fayetteville Avenue and based upon his
observations, the structure failed to comply with the minimum standards of fitness established by the Minimum Housing
Code of the City of Dunn. The Building Inspector also found the dwelling dangerous or prejudicial to the public health or
public safety and is a nuisance in violation of G.S. §160A-193.
The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S. §160A-443,
the City Council has the power to proceed with the demolition of the property.
This matter was tabled at the May 9, 2017 Council Meeting to be brought before the City Council at the July 11, 2017
Council Meeting to allow the property owner more time to make repairs on the dwelling. At this time, the property owner has
requested no additional inspections for repairs since the March 14, 2017 Council Meeting. The repair/renovation of the
dwelling is approximately 30% completed.
Chief Building Inspector King recommended giving the homeowner an additional 60 days for repairs
Motion by Council Member Maness and seconded by Council Member Turnage to bring back before the Council at the
September meeting to allow more time for the renovation to be completed at the dwelling located at 604/606 S. Fayetteville
Avenue, PIN# 1516-45-7909.000. Motion unanimously approved.
Consideration of Ordinance to Demolish Structure
510 Spring Branch Road

Chief Building Inspector Steven King has conducted an inspection at 510 Spring Branch Road and based upon his
observations, the structure in in a condition that constitutes a fire and health hazard. The Building Inspector also found the
structure dangerous or prejudicial to the public health and public safety and was condemned.
The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S. §160A-443,
the City Council has the power to proceed with the demolition of this property.
This matter was tabled at the January 2017 Council Meeting to be brought before the City Council at the March 2017 Council

agreement to achieve certain milestones by specific dates. At this time, the property owner and prospective buyer have
completed some of the repairs since the March 2017 meeting.
On March 14, 2017 a Condemnation Estoppel] and Hotel Investment Agreement was made and signed by the City of Dunn
Mayor, Oscar N. Harris and New Dunn Hotel, LLC, Amar N. Patel, Manager
Motion by Council Member Maness and seconded by Council Member Barfield to allow 60 days for the purchasing of the
property and to obtain building permits and bring back in front of the City Council at the October City Council Meeting.
Motion unanimously approved.
Rezoning Request RZ-02-17
City Initiated Large Scale Rezoning Phase 3
The public has been notified that oral and written comments will be heard and receive d concerning the City Initiated
rezoning of properties in the northern portion of our jurisdiction, with boundaries as follows: W. Cumberland Street and E.
Cumberland Street north to the end of the City of Dunn jurisdiction, and west of I-95.
The City is initiating the rezoning to amend the zoning map to reflect the current use of the properties and the 2030 Land Use
Plan. The Planning Board has held several workshops and discussed the proposed zoning changes for the past 1.5 years.
The Planning Board met on June 27, 2017 to review the request and asked for comments from the public. There was no one
present to speak for or against the request; the Planing Board voted unanimously to recommend approval of this request.
Motion made by Council Member Barfield and seconded by Council Member McLean to approve the request to rezone
parcels in the northern portion of our jurisdiction. (A copy of the rezoning map is incorporated into these minutes as
Attachment #7).
Application for an Owner's permit to Operate a Taxicab
Police Captain Royal noted he spoke with the applicant and she would like to table the application at this time until her
pending citations are resolved.
Motion by Council Member Turnage and seconded by Council Member McNeill to table this matter until such time as the
pending citations are resolved to include any citations until this matter is brought back before the City Council. Motion
unanimously approved.
Engineering Services Proposal & Capital Project Ordinance for the Black River WWTP Aeration Replacement
Project
Public Works Director Gaster noted the City of Dunn's Black River WWTP has a severely deteriorated aeration system
which is in need of replacement to avoid a major disruption of the City's wastewater treatment process and potential NPDES
permit violations and fines. The existing aeration system was installed in the early 1980's and has reached the end of its
useful life. Over the past several years the aeration piping has deteriorated and there are numerous air leaks in the
underground and in -basin piping. There are approximately 64 individual diffuser drops and these are failing with increased
frequency. Outdated blower and motor technology also adds to the inefficiency of the existing system.
The following are tasks as they relate to the replacement of the deteriorated aeration system at the Black River WWTP:
Task 1 — Preliminary Design Phase
Task 2 — Division of Water Infrastructure Funding Application
Task 3 — DWI Engineering Report/Environmental Information Document
Task 4 — Final Design Phase
Task 5 — Bidding and Contract Award
Task 6 — Construction Administration a& Resident Project Representative Services
Engineering expenses will be incurred in fiscal years 2017-2018 and 2018-2019. Debt service is expected to begin in FY
2019-2020,
Finance Director Stephens stated financing has not been secured at this time but we are looking at different options. There is
straight financing or loan/grant combination. The City would incur the expenses and get reimbursed when the funding is
received.
Motion by Council Member Tumage and seconded by Council Member Maness to approve the request from Davis Martin
Powell & Associates for the engineering services proposal for the Black River WWTP Aeration Replacement Project and
approve the Capital Project Ordinance for the Black River WWTP Aeration Replacement Project. (A copy of Ordinance
(02017-21) is incorporated into these minutes as Attachment #8). Motion unanimously approved.
Water Asset Inventory & Assessment Grant
The City of Dunn has applied for and has been offered a grant in the amount of $150,000 for the purpose of updating the
existing water system map, updating the existing Hydraulic Water Model, and updating the existing Capital Improvements
Plan.
Motion by Council Member Barfield and seconded by Council Member McLean to adopt the Resolution accepting the AIA
Grant offer in the amount of $150,000 and making the applicable assurances contained therein, recommend the AIA Grant
Project be awarded to the engineering firm of WithersRavenel, and approve budget amendment #3 to record the grant
proceeds and the City's required match. (A copy of the Resolution (R2017-13) and budget amendment #3 are into porated
into these minutes as Attachment #9). Motion unanimously approved.

Fund.
• Property Tax collections through June were $3,830,729 or 103.65% of budget. Last year property tax
collections through June were $3,602,413 or 101.82% of budget.
• Sales Tax Revenue is $1,613,699 or 96.34% of budget. Benchmark for the month is 83.33% of budget.
• Utilities Sales Tax is $531,564 or 67.36% of budget. Benchmark for this month is 75.00% of budget.
• Building Permit Fees were $79,898 or 121.38% of budget. Benchmark for this month is 91.67% of budget.
• Water and Sewer Revenues were $3,812,445 or 84.72% of budget. Benchmark for this month is 83.33% of

AN ORDINANCE DIRECTING THE BUILDING INSPECTOR TO REMOVE OR DEMOLISH
THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on March 23, 2017 the Building Inspector for the City of Dunn sent a notice
to Eddie D. Smith, the owner(s) of record of property located at 603 N. Fayetteville Ave., noting that the
property was in a condition that constitutes a fire and safety hazard, and is dangerous to life, health and
property and was thereby condemned, pursuant to North Carolina General Statute §160A-426, and noticed
the property owner of a hearing on March 31, 2017 at the office of the Chief Building Inspector located at
102 North Powell Ave., Dunn, North Carolina pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on April 5, 2017 a hearing was conducted by the Chief Building Inspector Steven
King and Eddie D. Smith, property owner. Following the completion of the hearing, the Chief Building
Inspector entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
property referenced above is in a condition that constitutes a fire or safety hazard and is dangerous to life,
health or other property and ordering the property owner to repair or demolish the structure on the property
within sixty (60) days of the date of such Order, being June 6, 2017; and
WHEREAS, the owner of the above described property did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute § 160A-
430 and such Order is therefore a final Order; and
WHEREAS, on August 1, 2017 and August 8, 2017, the City of Dunn published legal notices
that a public hearing would be held before the Dunn City Council on August 15, 2017 to consider the
adoption of this Ordinance, directing that the Building Inspector proceed with the demolition of the property
described hereby, and that all costs incurred shall be a lien against such property, pursuant to North Carolina
General Statute §160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the dwelling described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of North
Carolina General Statute 160A-193; and
WHEREAS, this dwelling should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this dwelling has been given a reasonable opportunity to repair or
demolish the dwelling pursuant to an Order issued by the Building Inspector on April 7, 2017 and the owner
has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn, North
Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the exterior of
the property described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this building
for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or demolish the
above described dwelling in accordance with his Order to the owner thereof dated the 7' day of April, 2017
and in accordance with North Carolina General Statute §160A-432, based on the owner's failure to comply
with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall have
the same priority and be collected in the same manner as the lien for special assessments in Article 10 of
Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien against any other real
property owned by the owner of the property within the City of Dunn, North Carolina, or within one (1)
mile of the City of Dunn city limits, except for the property owner's primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the useable
materials of the dwelling and any personal property, fixtures, or appurtenances found in the building and
credit the proceeds against the cost of removal or demolition. The Building Inspector shall certify the
remaining balance to the Tax Collector. If a surplus remains after sale of the materials and satisfaction of
the cost of removal or demolition, the Building Inspector shall deposit the surplus with the Harnett County
Clerk of Superior Court where it shall be secured in the manner provided by North Carolina General Statute
§160A-432.
Section 4. It shall be unlawful for any person to remove or cause to be removed the placard from any
building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit the
occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

THE PROPERTY HEREIN DESCRIBED AS AN UNSAFE BUILDING CONDEMNED
PURSUANT TO N.C.G.S. §160A-426, ET SEQ.
WHEREAS, that on April 27, 2017 the Building Inspector for the City of Dunn sent a notice
to Sue Ann Jackson, the owner(s) of record of property located at 705 Maple Ave., noting that the property
was in a condition that constitutes a fire and safety hazard, and is dangerous to life, health and property and
was thereby condemned, pursuant to North Carolina General Statute §160A-426, and noticed the property
owner of a hearing on May 5, 2017 at the office of the Chief Building Inspector located at 102 North Powell
Ave., Dunn, North Carolina pursuant to North Carolina General Statute §160A-428; and
WHEREAS, on May 5, 2017 a hearing was conducted by the Chief Building Inspector Steven
King and Sue Ann Jackson, property owner. Following the completion of the hearing, the Chief Building
Inspector entered an Order, pursuant to North Carolina General Statute §160-429, declaring that the
property referenced above is in a condition that constitutes a fire or safety hazard and is dangerous to life,
health or other property and ordering the property owner to repair or demolish the structure on the property
within sixty (60) days of the date of such Order, being July 9, 2017; and
WHEREAS, the owner of the above described property did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute §160A-
430 and such Order is therefore a final Order; and
WHEREAS, on August 1, 2017 and August 8, 2017, the City of Dunn published legal notices
that a public hearing would be held before the Dunn City Council on August 15, 2017 to consider the
adoption of this Ordinance, directing that the Building Inspector proceed with the demolition of the property
described hereby, and that all costs incurred shall be a lien against such property, pursuant to North Carolina
General Statute §160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the dwelling described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of North
Carolina General Statute 160A-193; and
WHEREAS, this dwelling should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this dwelling has been given a reasonable opportunity to repair or
demolish the dwelling pursuant to an Order issued by the Building Inspector on May 10, 2017 and the

I) A petitioner for a conditional use permit must complete this application in full. This application
will not be processed unless all information is provided.
2) Include the filing fee for each conditional use permit, which is $700.
3) Include a site plan drawn to scale of the entire property and the location of each facility and the
uses of the property. The site plan should include parking layout, required landscaping and
specifications of installation/construction.
4) The application must be signed by the owner or by an authorized agent of the property requesting
the Conditional Use permit; the signature shall be notarized.
5) The Planning Board meets regularly on the fourth Tuesday of each month at 6:30 p.m. in the
Dunn Municipal Building at 401 E. Broad St., and shall make recommendations to the City
Council on all conditional use requests.
6) The City Council meets regularly on the second Tuesday of each month at 7:00 p.m, in the Dunn
Municipal Building located at 401 E Broad St., and is the approving authority for all conditional
use requests.
7) This project is required to go through the commercial site plan review process. This request is for
use approval only. In order to ensure specifications meet the minimum standard(s) for the City of
Dunn, a thorough review is performed. Reviewers may include, but is not limited to, Public
Works, Planning, Inspections, the Fire Department, Environmental Health, etc.

THE CITY OF DUNN, NORTH CAROLINA
WHEREAS, the City Council of the City of Dunn has been petitioned under G.S. 160A-31 to annex the area described
below; and
WHEREAS, the City Council has by resolution directed the City Clerk to investigate the sufficiency of the petition; and
WHEREAS, the City Clerk has certified the sufficiency of the petition and a public hearing on the question of this
annexation was held at the Dunn Municipal Building at 7:00 p.m. on August 15, 2017, after due notice by publication on
July 31, 2017; and
WHEREAS, the City Council finds that the area described therein meets the requirements of G.S. 160A-31;

PURPOSE:
This is a request to hereby amend Chapter 11, License and Business Regulations, to replace the privilege license
system with the business registration program.
BACKGROUND:
As with all of the text amendments the underlined is new text and striketgreugh is text being removed.
The NC General Assembly eliminated the authority for privilege licenses a couple years ago, since then the
General Assembly enacted legislation allowing cities to adopt a Business Registration Program. The business
registration program assists in the management and enforcement of the zoning, building and fire codes to ensure
the public's safety. Each business will be charged a yearly fee of $40.
City Attorney Tilghman Pope has reviewed the ordinance as presented.

ARTICLE 1. - IN GENERAL
(Code 1974, § 13-15; Ord. No. 02011-04, 3-8-11; Ord. No. 02013-08, 10-8-13)
Sec. 44-211-1. - Sales on streets or sidewalks —Generally.
(a) It shall be unlawful for any person to sell or offer for sale upon the public streets or public sidewalks
of the city any article of clothing, shoes, furniture, groceries, fruits, vegetables, or any other articles
or merchandise; except as provided in section 11-4.
(b) Nothing in this section shall apply to the sale of farm products raised on the premises owned or
occupied by the person, his bona fide agent, or employee selling the products.

Sec. 11-4. - Display of goods on sidewalks.
No person shall place for display any goods, wares, or merchandise of any kind upon any portion of
the sidewalks and public right-of-ways of the city without a valid sidewalk sale permit to do so, issued by
the city manager or his designee, and only valid for locations within the current downtown municipal
service district boundary following written city policies. The display of goods, wares, or merchandise shall
be for sale and not used as a sign or other means of attracting customers, the attention of passerby, or
the general public. The display of items referred to under this section as "displayed" shall be items forth e
sale under the valid business license.
(1) Any merchant desiring to display and sell merchandise on the city sidewalk or public right-of-
ways shall comply with the following regulations at all times:
a. The display and sale of merchandise must occur under the same name as the business and
may not be opened or operated at any time when the business is closed.
b. The display and sale of merchandise on the sidewalk or public right-of-way must be clearly
incidental to the associated business.
c. The placement of the outdoor display/merchandise shall be:
1. Permitted adjacent to the primary facade (facade with principal customer entrance)
and shall extend no more than three (3) feet from such facade;
2. Merchandise shall be located no closer than four (4) feet from any right-of-way
intersection; and
3. Merchandise shall be displayed in a manner not to impair the ability of pedestrians to
the use the sidewalk or parking areas.
d. The display of goods and sales of merchandise on sidewalks and public right-of-ways (i.e.
sidewalk sales) shall be allowed Monday thru Saturday from 8:00 a.m.-6:00 p.m.
e. Evidence of adequate insurance or other forms of security to hold the city and its taxpayers
harmless from claims arising out of the display and sale of merchandise, as determined by
the city manager;
f. A signed indemnity statement approved by the city attorney, whereby the business owner
agrees to indemnify and hold harmless the city and its officers, agents, and employees from
any claim arising from the display and sale of merchandise.
(2) Permit generally. The city manager or his designee may issue permits for the display and sale of
merchandise on city sidewalks and public right-of-ways in the city in the downtown municipal
service district. Along with the permit application, a signed indemnity statement and proof of
adequate insurance or other forms of security shall be provided before the permit is issued.
(3) Term, transfer, renewal and the like. Permits issued in accordance with the provisions of this
section shall:
Be issued annually beginning on July 1 and ending June 30;
b. Pay an annual renewal fee as listed in the fee schedule;
C. Not be transferable or assignable.
(4) Exceptions. All sidewalk sale permits are invalid during special events hosted by the City of Dunn,
Dunn Area Tourism Authority, and the Dunn Area Chamber of Commerce. Merchants must abide
by the event rules and regulations.
(5) Permit revocation. The city manager may revoke a permit issued pursuant to this section, if he
finds that the business owner has:
a. Deliberately misrepresented or provided false information in the permit application.
b. Displayed or sold the merchandise in such a manner as to create a public nuisance or to
constitute a hazard to the public health, safety or welfare; specifically including failure to
keep the area clean and free of refuse, or violate any part of this chapter.
c. Failed to maintain any health, business or other permit or license required by law for the
operation of the business.
d. Before the revocation of a permit, the city manager or his designee shall in verbal or written
format notify the permit holder of his intent to revoke the permit. One warning shall be
issued; any subsequent violation of this ordinance shall result in a ninety -day revocation of
such permit. A decision of the city manager to revoke the permit may be appealed to the
city council in accordance with the provision of this section.
(6) Removal. Merchandise must be removed within four (4) hours of notice from the city. If such
items are not removed upon four (4) hours notice, the city shall have the right to remove and
dispose of these items and may assess the property owner for the cost of such removal and
disposal. The city shall also have the right to remove such items immediately in an emergency
situation. The city shall not be responsible for damage to the merchandise under any
circumstances.
(7) Damage. The owner of the business displaying or selling merchandise on the sidewalk or public
right-of-way shall be responsible for repairing any incidental damage to public sidewalks and
right-of-ways resulting from the display of merchandise.

ARTICLE II. BUSINESS REGISTRATION
Sec. 11-31. - Purpose and authoritV.
Pursuant to N.C. G.S. 160A-194, the City of Dunn finds that annual business registration would be
prudent to assist the management of the City's zoning and public safety responsibilities.
Sec. 11-32. — Definitions.
The following words, terms, and phrases, when used in this article, shall have the meanings ascribed
to them in this section, except where the context clearly indicates a different meaning:
Administrator. The person designated bV the City Manager to operate the Business Registration
Program required by this Article.
Agent. The individual acting on behalf of a "Person," as defined herein.
Business. Each trade, occupation, profession business, and franchise subject to registration under this
chapter.
City. The City of Dunn.
Person. Any individual, trustee, executor, other fiduciary, corporation, unincorporated association,
partnership sole proprietorship, limited liability company, firm or other legal entity.
Seasonal in Nature. A business is seasonal in nature when it is conducted for profit six months out of
the year or less.
Sec. 11-33. Construction of this Article.
This Article is enacted for regulation purposes only. In addition, issuance of a registration in accordance
with this Article does not excuse a person from compliance with any other applicable ordinance or
statute. This Article does not prevent the City from requiring registration for additional businesses.
Sec. 11-34. Requirement for Registration.
Unless exempt as described in 11-37 of this Article, each person who conducts a business within this City
is sublect to this Article. One conducts a business "within the city" if one maintains a business location
within the City; or if, either personally or through agents, (1) solicits business within the city limits; or (2)
picks up or delivers goods or services within the city limits.
Sec. 11-35. Period of registration; probation; due date.
All registrations provided for and fixed in this Article shall be for twelve (12) months, unless otherwise
specified. All registration required by this Article shall date from the first of July of the year of issuance
and shall expire on June 30 next following, provided that where the registration is issued after January 1,
then the registrant shall be required to pay one-half of the fee prescribed, except where otherwise
specifically provided. A person maV not commence to conduct a business within the city until the business
registration is obtained and may not continue such a business beyond the period for which the
registration is issued.
Sec. 11-36. Separate Business.
A separate registration is required for each place of business unless two or more places of business under
common ownership are contiguous to each other, communicate directly with and open into each other,
and are operated as a unit.
Sec, 11-37. Exemptions.
The provisions of this Article shall apply to all businesses within the City of Dunn municipal jurisdiction
unless specifically exempted or excluded from registering by this Ordinance, bV the laws of North Carolina
or by the laws of the United States.
Sec. 11-38. Registration application.
A person shall apply to the Administrator for each registration required bV this Article before commencing
business. The application which shall be submitted on forms provided bV the City of Dunn Administrator
shall contain:
a) The name of the owner, and if applicable the agent for the business, and a complete statement as
to whether the agent is an individual, a partnership, a corporation, limited liability company or
some other entity.
b) The nature of the business.
c) The physical location of where the business is conducted.
d) An address where notices and statements may be mailed as required by this Article.
e) Whether the business is regulated by a state occupational licensing board subject to N.C. G.S.
Chapter 93B, and if so, the identification, licensure or other number of the state registration of
the business or the agent for the business issued by the applicable licensing board.
f) Any other information the Administrator determines may be necessary to issue the registration
or otherwise regulate the business appropriately.
The application shall be accompanied by the payment of a registration fee which shall be set forth and
adopted annually by the City Council in the Fee Schedule. In compliance with state law, this fee shall not
exceed the cost to the City of the administrative process of the production and issuance of the
registration, or to otherwise monitor the business.
Sec. 11-39. Reasons for refusal or revocation of a registration.
The Administrator shall refuse to issue a registration or may revoke a registration for either of the
following reasons:
a) The owner or agent misrepresents a fact relevant to his or her qualifications for a registration.
b) The owner or agent refuses to provide necessary information required by the form provided by
the Administrator or otherwise required bV this Ordinance.
Sec. 11-40. Unqualified agents; rights to a conference.
After receipt of the completed application, if the Administrator believes that a reason exists for refusing a
registration under 11-39 of this Article, the Administrator shall not issue the registration. At the agent's
request, the Administrator shall in accordance with 11-49 of this Article, give the owner or agent a written
statement of the reason for refusing the registration. The owner or agent maV, within ten days after the
day the statement is received, request a conference to discuss the refusal. In the request, the owner or
agent shall specify why the application for a registration should not be refused. The Administrator shall
arrange the conference within three business days of receiving the request.
If the Administrator refuses to issue a registration, the owner or agent may reapply for a registration at
any time thereafter. If the reason for which the application was refused no longer exists and if no other
reason exists for refusing to issue a registration, the Administrator shall issue the registration in
compliance with 11-51 of this Article.
Sec. 11-41. Administrator to issue registration; payment of registration fee a prerequisite.
After receipt of the completed application and payment of the registration fee, if the Administrator
believes that no reason exists for refusal of a registration under section 11-39 of this Article, the
Administrator shall issue the registration.
Sec. 11-42. Registration Fee.
The fee required of every owner or agent for any business conducted in or engaged within the OtV as
required bV this Article shall be set forth and made a part of the Fee Schedule adopted by the City Council,
as amended from time to time. Notwithstanding the foregoing, the fee shall in no case be more than the
maximum permitted by North Carolina law for that particular business or enterprise.
Sec. 11-43. Revocation.
The administrator may revoke a registration if a reason exists to revoke it as set forth in 11-39 of this
Article. Before revoking a registration, the Administrator shall give the person written notice of the
grounds for revocation, in accordance with 11-49 of this Article. The person may, within ten days after the
day on which notice is mailed, request in writing a conference with the Administrator. The request shall
specify the reasons why the registration should not be revoked. The Administrator shall arrange the
conference within three business days of receiving the request.
If the person fails to request a conference within ten days after the day on which notice is mailed, the
Administrator shall revoke the registration. If the person requests a conference, the Administrator may
not revoke the registration until after the conference.
If the Administrator revokes a registration, the person whose registration has been revoked may apply for
a new registration at any time thereafter. If the reason for which the registration was revoked no longer
exists and if no other reasons exists for refusing to issue a registration, the Administrator shall issue the
registration in accordance with 11-41 of this Article.
Sec. 11-44. Forms and contents of registration.
A registration shall show the name of the person, and any agent who may act on the person's behalf, the
place where the business is conducted (if it is to be conducted at one place), the nature of the business
and the period of which the registration is issued. The Administrator shall keep an exact copy of each
registration issued.
Sec. 11-45. Assignments.
A registration may be assigned if (1) a business under this Article and carried on at a fixed place is sold as
a unit to anV person and (2) the purchaser is to continue the same business at the same place. Such a
change shall be reported to the Administrator in accordance with 11-46 of this Article. Otherwise, each
registration issued under this Article is a separate registration and not assignable.
Sec. 11-46. Changes in the business conducted during the year.
A person or an assignee shall report any change in the information contained in the registration
application to the Administrator within ten days after the change occurs. If information shown on the
registration itself is affected, the person or assignee shall surrender the registration to the Administrator
when reporting the change.
a) Fee for change. If the change does not result in a separate registration fee, the Administrator shall
reissue a registration reflecting the change upon payment of a processing fee of $5.
b) Change requiring refusal of a registration. If the change creates a reason for revoking the
registration under 11-39 of this Article, the Administrator shall refuse to reissue a registration and
shall instead begin proceedings to revoke the registration in accordance with 11-43 of this Article.
Sec. 11-47. Administrator to furnish duplicates.
Upon satisfactory proof that a registration has been lost or destroyed, the Administrator shall furnish a
duplicate for a processing fee of $5.
Sec. 11-48. Record of conferences.
The Administrator shall maintain for three years a record of each conference held in accordance with this
Article. The record shall contain the agent's and person's name, the date of the conference and a brief
statement of the issues discussed and the result reached. After three years, the Administrator may
dispose of the record in accordance with N.C. G.S. 121-5.
Sec. 11-49. Providing notice to an agent or person.
Whenever this Article requires the Administrator to give a written statement or notice to an agent or a
person, the Administrator may do so in one of three ways:
a) By personally delivering the statement or notice to the agent or person;
b) By mailing the statement or notice by First Class Mail to the address on the application; or
c) By causing the statement or notice to be served on the agent or person in accordance with the
procedures for service of process under Rule 4 North Carolina Rules of Procedure.
Sec. 11-50. Dutv to determine whether registration is required.
Each person or his/her designated agent has the duty to determine whether the business he or she
conducts is required to be registered under this Article, and if so, whether that registration has been
obtained.
Sec. 11-51. Administrator to investigate.
If the Administrator has reason to believe that a person is conducting a business in the CitV in violation of
this Article, the Administrator shall conduct an investigation to determine the status of the business.
Sec. 11-52. Dutv to permit inspection.
Each person who conducts a business, as defined in 11-34, in the CitV shall permit the Administrator or
his/her designee to inspect the business premises during normal business hours to determine the nature
of the business conducted there.
Sec. 11-53. Duty to post registration.
A business shall post the registration or registrations conspicuously in the place of business registered. If
the person has a regular place of business, the registration must be kept where it may be inspected at all
times by the proper city officials.
Sec. 11-54. Compliance.
No application for zoning, inspections or other City permits will be accepted on behalf of a business which
has failed to comply with this Article, until the failure to comply has been corrected.
Sec. 11-55. Enforcement of ordinance.

a) Criminal remedies. Conducting business within this City without a valid registration issued in
accordance with this Article, or without posting a registration in compliance with 11-53 of this Article
s a misdemeanor, punishable as provided in N.C. G.S. 14.4. Each day that a person conducts business
in violation of this Article is a separate offense.
b) Equitable remedies. In addition to the criminal remedies set forth subsection (a) of this section and in
compliance with N.C. G.S. 160A-175(d), the City may seek an injunction against any person who
conducts a business in violation of this Article.
Sec. 11-56. Appeal.
Any Agent or Person refused or denied a registration under this Ordinance may appeal to the City
Manager for review of such refusal or denial. Such appeal shall be in writing and shall be delivered to the
City Clerk within thirty (30) days after notice of such refusal or denial has been sent or otherwise
delivered to the Agent or Person.
Sec. 11-57-11-60. — Reserved.
ARTICLE III. - ITINERANT MERCHANTS, SOLICITORS, PEDDLERS AND PANHANDLERS
DIVISION 1. - GENERALLY
Sec. 11-61, - Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed
to them in this section, except where the context clearly indicates a different meaning:
Charitable solicitation means approaching strangers requesting monies or contributions, whether or
not it involves the exchange of other goods or services, for any charity or non-profit organization.
Charity or non-profit organization means any enterprise entered into with the primary purpose to
pursue social, charitable, or other benevolent activities and that is classified as a tax-exempt organization
under applicable provisions of the United States Internal Revenue Code and the regulations thereunder.
Itinerant merchant means any salesman or merchant offering for sale goods, wares, or merchandise
who conducts such business within the city for less than six (6) consecutive months, except in the case of
discontinuance for one (1) of the reasons mentioned in this article.
Panhandler means a person who approaches or solicits strangers for money or other thing of value.
Panhandling means any solicitation made in person upon any street, sidewalk, public way, or public
place, or upon the premises of any business establishment or other private property that is routinely or
customarily frequented by the general public, requesting an immediate donation of money or other thing
of value.
Person means a natural person.
Registrant or registered solicitor means any person who is subject to this Ordinance and who has
obtained a valid certificate of registration from the City of Dunn, N.C.
Residence means any living unit contained within any building or structure that is occupied by any
person as a dwelling consistent with the definition of "residence" as defined in the Zoning Ordinance of
the City of Dunn, N.C.
Solicitation and/or peddling shall mean any of the following activities:

additional three (3) years if approved by Council. Vacancies in on the commission Recreation
Advisory Board shall be filled for the unexpired term by appointment by the City Council. The
members shall serve without compensation. Regular members shall be residents within Dunn city
limits.

Sports Programs:
We began the month with our All -Stars State tournaments in which five of our teams advanced to
compete in the NC Dixie State Tournaments in baseball and softball. Dunn Parks & Recreation hosted
the NC Dixie Youth Baseball AAA (10U) State Tournament on July 7" thru July 131h at the Nathan Harris
Athletic Complex at Tyler Park. Unfortunately Dunn AAA All-stars had an early exit losing their first
game to Leland and the second game to Whiteville. Competition was tough throughout the week with
Stanley taking home the crown of NC Dixie Youth Baseball AAA State Tournament Championship. The
Majors all-stars started their tournament on July 151h; they lost their first game against South Port with a
score of 15-5. They bounced back by defeating Stanley 11-4 and East Duplin 3-2 in extra innings. Their
run came to an end when they lost to Elizabethtown 18-3 ending their chance to advance to the World
Series. The Angels (10U) began their state tournament on July 141h at Carthage. The angels continued
their district run by going undefeated and winning the state title for the second consecutive year.
Results of the games went as followed West Chatham 6-1, Montgomery County 13-1, Lumberton 18-3,
West Chatham 6-0 and wrapped up with Lumberton 13-0. They have worked so hard to accomplish
their wins as a team and will be advancing to the World Series on July 282h in Alexandria, LA. We are
proud of these young girls and coaches along with all of our teams as they have worked very hard
representing the City of Dunn.
Summer Camps:
We are still accepting registrations for Weight Training & Physical Conditioning Summer Camp. It is our
last camp for the season.
Fall Registrations:
We began taking registration for Fall Sports with our online registration being in place also. We have
had a great response so far with the addition of online registration, and we expect it to continue until
our deadline of August 171n

July 2017 Library Monthly Narrative Report
Attendance for the library's children's summer reading program is down from 2015-
2017. In 2015 there were 49 events with 1,576 participants. The following year there
were 48 events with 1,028 participants. This year there were 40 events with 718
participants.
One factor was fewer events: 49/48/40, In past years Dunn has started about one week
earlier. This year the library followed the calendar established by new Harnett County
Public Library's new children's librarian Laura Bright.
Another factor is more competition. In 2015 there were 58 other library programs
directed to a wider audience including teens. In 2016 there were 60 other library
programs. This year there were at least 61 other library programs. Some were held in
new locations.
Familiarity is a factor also. Dunn Public Library has used the same schedule of events
over these years: story times on Mondays; crafts on Tuesdays and Wednesday
mornings; professional performers on Wednesday afternoons; and movie times on
Thursday afternoons. It is time for the library to revamp summer library programs
generally and to target a wider age group than toddler to age 12.

CID Narrative:
On July 241h 2017, Sgt. Kelvin Barbour and Lt. Byron Tyndall apprehended Brandon Jarrell Hodges
for the crimes of: First Degree Burglary, Felony Larceny, Secretly Peeping, 3 B&E/Larceny From a Motor
Vehicle, and Possession Of Stolen Property. Investigators were able to Close and Clear 4 cases stemming
from March of 2017 thru July of 2017.
Narcotics Narrative:
The Narcotics Division made 13 confidential buys of controlled substances throughout the city in the
month of July. Agents are completing an operation that has continued since 2016. A round -up of all

Patrol Narrative:
On July 8th, Officer C.M. Dean responded to a vehicle collision at Powel and Cumberland. After a few
minutes passed, a witness, D. Mcmillan, told Officer Dean that she went to help the people in the
collision, and observed one of the subjects walk over the the bushes and put something in them. Officer
Dean and Lt. Barefoot checked the area and located a handgun with the serial number defaced and a
small amount of marijuana. Officers then followed up at Betsy Johnson, arrested the subject that was
reported to have dropped the gun, with a bond hold of $25,000.
On July 101h, Gavin Deans was reported to have run away from his residence. He was located and ran
away again several more times throughout the month. Investigator Brannon last advised that once he
was located, he would be moved from the current foster home and out of Dunn city.
On July 20th, the short stop located on East Cumberland at 1-95 was robbed. According to email sent
out by Lt. Hinson, the subject has been identified in several robberies throughout the state. No weapon
was displayed, no money was taken from the business.
On July 211t, an armed robbery occurred on West Vance Street in the area of the Ready Mix Concrete
plant. Victim stated that 2 men in a small white passenger car with tinted windows pulled up beside
her, made conversation, and eventually pulled a handgun out and robbed her of 2 smart phones.
On July 271h, Dunn traffic unit and A squad patrol units were conducting a license check at US 301 and
Dinan Road. A driver pulled up, showed his N.C. ID, was told to pull to the side of the road and wait for
an officer to further investigate his license. The driver failed to pull over and drove away from the
check point. Sgt. Byrd attempted to stop the vehicle, however, the driver failed to pull over. Sgt. J. Byrd

chased the vehicle and called the chase until the traffic unit arrived and took over the chase just as the
suspect was leaving the city limits. Officers Godwin, Johnson and Bass stopped the vehicle
approximately 5 miles outside of the city and arrested the subject for DWLR, DWI, and felony flee to
elude. The vehicle was seized under the run and you are done law.
On July 291h, there was a homicide at the Super 8 motel. CID was called out to the scene and the
suspect was arrested.
On July 3111, Mitch Smith was robbed at gunpoint at his residence located at 802 East Edgerton Street.
Mr. Smith identified Reece Taylor as the suspect that robbed him. Sgt. Smith located the vehicle in the
area of Burke and Lincoln Street. Two subjects were in the car fled from the vehicle and got away while
officers were in route to assist. A weapon was later located under a trash can behind an apartment on
McNeil Circle that matched the description of the one used in the robbery. Investigator Tyndall was
notified, the weapon was seized and put into evidence for finger printing.

Minutes of Meeting
July 18, 2017
The Dunn ABC Board met on July 18, 2017. Present at the meeting: Board Members,
Lynn Jernigan, Alice Judd and Dal Snipes, Manager, Robert Parker, who served as
Secretary to the Board. City Council Member Buddy Maness did not attend.
Mr. Parker presented the minutes of the June 27, 2017 meeting that were approved by the
Board.
Each Board Member was given a copy of the June, 2017 Financial Statements. The
Board reviewed the statements noting sales in June, 2017 are $17428.35 above last year.
Year to date sales are $146040.80 above last year. Mixed Beverage sales are $4538.10
below last year.
The Board approved given the City of Dunn $15,000.00 more than budgeted. The City
has been paid.
The Board was given copies of the 2016 - 2017 amended budget. Copies attached.
The Board approved a 6% paid increase for Dunn ABC employees.
There was no conflict of interest at this meeting.
No other business.
The next ABC Board Meeting will be Aug 15, 2017.
With no other business, Lynn Jernigan motioned to adjourn which received a second

Secretary to the Board, and City Council Member Buddy Maness.
Mr. Parker presented the minutes of the May 16, 2017 meeting that were approved by the
Board.
Each Board Member was given a copy of the May, 2017 Financial Statements. The
Board reviewed the statements noting sales in May, 2017 are $26089.25 above last year.
Year to date sales are $128612.45 above last year. Mixed Beverage sales are $2956.90
below last year.
The Board approved given the City of Dunn $15,000.00 more than budgeted.
The public hearing for next years' budget was held on June 27, 2017 in Dal Snipes office.
The Board approved the 2017-2018 budget and budget message. Copies attached.
There was no conflict of interest at this meeting.
No other business.
The next ABC Board Meeting will be July 18, 2017.

RE: BUDGET MESSAGE
To the Dunn ABC Board
The Annual Budget for the fiscal year July 1, 2017 through June 30, 2018 (FY11/12) has
been prepared in accordance changes to N. C. General Statute 1813-702 "Financial
operations of local boards". The ABC Board determines, through adoption of an annual
budget, the level of customer services that the ABC system will provide and the resources
available for operations and capital projects.
The primary drivers during the preparation of this budget included projected operating
costs required to sustain acceptable levels of customer service during fiscal year
2017/2018 and the need to provide distributions to beneficiaries.
The budget consist of projected revenues from liquor sales of $2.37 million, taxes related
to income of $515 thousand, cost of sales of $1.31 million, operating expenses costs of
$418 thousand.
Highlights of Budget:
Some sales increases are projected based on last year's sales.
The assumption that no debt will be incurred.
Longevity pay will continue.
Distribution to the City of Dunn will be the $110 thousand.
The Board's Budget Process: It is anticipated that the budget process will be improved in
future years.
Debt: The Board does not have any debt at this time; there is no anticipation of incurring
debt during the budget year.

The Dunn ABC Board met on May 16, 2017. Present at the meeting: Board Members,
Lynn Jernigan, Alice Judd and Dal Snipes, Manager, Robert Parker, who served as
Secretary to the Board. City Council Member Buddy Maness did not attend.
Mr. Parker presented the minutes of the Apr. 18, 2017 meeting that were approved by the
Board.
Each Board Member was given a copy of the Apr., 2017 Financial Statements. The
Board reviewed the statements noting sales in Apr., 2017 are $1730.55 above last year.
Year to date sales are $102523.20 above last year. Mixed Beverage sales are $5632,05
below last year.
The 4`h quarter profit distribution has been paid to the City of Dunn.
Copies of the proposed 2017-2018 budget and budget message were given to each board
member. Copies attached.
The public hearing for next years' budget will be held on June 27, 2017 in Dal Snipes
office.
