WHEREAS, it has come to the attention of the Mayor and the City Council that a
local mechanic and businessman of the City of Dunn exhibited exemplary conduct on
Wednesday, June27, 2018; and
WHEREAS, this individual, Jerome Warren, recognized an emergency situation
and rendered immediate aid to save the life of not only someone Jerome considered a
customer but also a friend, when he administered CPR to Tim Potter at Jerome's place of
business, Warren W. Blake CITGO and Wrecker Service; and
WHEREAS, if it had not been for the life-saving and skilled response of this
individual and of the responding emergency medical crews, a precious life may have
been lost; and
NOW, THEREFORE, I, Mayor Oscar N. Harris, on behalf of the City Council of
the City of Dunn and the citizens of Dunn, North Carolina do hereby commend and
recognize Jerome Warren for his exemplary conduct and outstanding performance in an
emergency.
FURTHER, I urge all citizens of the City of Dunn to reflect upon and recognize the
dedication, outstanding training and selfless contribution exhibited daily by this
individual.

WHEREAS, Kellie Dair Godwin was born February 3, 1977 to Kenneth and Pattie Godwin of Dunn, NC; and
WHEREAS, Kellie graduated from Fayetteville State University in 1999 with an Associate Degree in Education. She
married husband, Richard Hinshaw in October 2001 and used her degree in education to home school her children, and
VVMREAS, Beginning in 2000, Kellie Hinshaw fought a courageous fourteen year battle with Adenoid Cystic Carcinoma
(ACC), dealing with several recurrences and physical setbacks.; and
WHEREAS, Determined to empower herself and others against the disease, Kellie started a 5k run in 2009 aimed at bringing
together survivors of the rare cancer, and raising money to support research. Her fund raising efforts have been responsible
for donating over $100,000 in research funding, $12,000 in financial support for head and neck cancer patients, and $5,000 in
community outreach and scholarships; and
WHEREAS, in 2012, Kellie was diagnosed with Osteosarcoma in the right side of her face, which occurred as a result of the
radiation from her earlier treatments; and
WHEREAS, in 2013 Kellie broadened her vision to include a patient financial assistance program and community outreach
in addition to funding research by forming Kellie's Krew, Ltd, a not -for -profit organization. This program funds educational
scholarships based on community service and volunteerism; and
WHEREAS, Kellie was an active member and Ambassador of the Dunn Area Chamber of Commerce and was named
Ambassador of the Year in 2011 and Dunn's Woman of the Year in 2013; and
WHEREAS, Kellie was a wish granter with the Make -A -Wish Foundation and was also a member of Central Baptist
Church, and
WHEREAS, on April 7, 2014, Kellie ran her final race and won the applause of heaven when she went home to be with the
Lord at the age of 37; and
WIIEREAS, Kellie was a tireless advocate for those undergoing Cancer treatment and was an inspirational speaker at many
churches and group meetings; and
WIIEREAS, Kellie spent countless hours encouraging others who were fighting their own battles; and
NOW THEREFORE, I, Oscar N. Harris, by virtue of the authority vested in me as Mayor of the City of Dunn, and on
behalf of the City Council and all of our citizens, do hereby recognize the dedicated loyal service and many contributions
made to this community by Kellie Hinshaw.

CITY OF DUNN CITY COUNCIL PUBLIC COMMENT POLICY
The City Council for the City of Dunn does hereby adopt a Public Comment
Policy to provide at least one period for public comment per month at a regular meeting
of the City Council. This policy shall remain in effect until such time that it is altered,
modified, or rescinded by the City Council.
All comments received by the City Council during the Public Comment Period
shall be subject to the following procedures and rules:
1. Anyone desiring to address the City Cotmcil must sign up and register on
a sign-up sheet available on the podium within the City Council chambers prior to the
Mayor calling the meeting to order. The sign-up sheet shall be available thirty (30)
minutes prior the beginning of the City Council meeting in the City Council Chambers.
Once the Mayor has called the meeting to order, the City Clerk shall collect the sign-up
sheet and deliver it to the Mayor. The speaker shall indicate on the sign-up sheet his or
her name, address and matter of concern.
2. The Public Comment Period shall be for thirty (30) minutes.
3. Comments are limited to three (3) minutes per speaker. A speaker can not
give their allotted minutes to another speaker to increase that person's allotted time.
4. Each speaker must be recognized by the Mayor or presiding member of
the City Council as having the exclusive right to be heard. Speakers will be
acknowledged in the order in which their names appear on the sign up sheet. Speakers
will address the City Council from the podium at the front of the room and begin their
remarks by stating their name and address.
5. Individuals who sign up but can not speak because of time constraints,
will be carried to the next regular meeting of the City Council and placed first on the
Public Comment Period.
6. During the Public Comment Period, a citizen, in lieu of or in addition to
speaking may pass out written literature to the City Council, City Staff and audience.
7. Groups supporting or opposing the same position shall designate a
spokesperson to address the City Council in order to avoid redundancy.
8. After the citizen has made his or her remarks, he or she will be seated with
no further debate, dialogue or comment.
9. The Public Comment Period is not intended to require the City Council to
answer any impromptu questions. Speakers will address all comments to the City
Council as a whole and not one individual Council member. Discussions between
speakers and members of the audience will not be allowed. The City Council will not
take action, or respond to questions about, issues raised during the Public Comment
Period at the same meeting.
10. Speakers shall refrain from discussing any of the following: matters
which concern the candidacy of any person seeking public office, including the
candidacy of the person addressing the City Council; matters which involve pending
litigation; matters which have been or will be the subject of a public hearing; and matters
involving specific personnel issues related to disciplinary matters. If the speaker wishes
to address specific personnel issues related to disciplinary matters, he or she should take
their comments to the City Manager, who shall share the comments with the City
Council.
11. Speakers shall be courteous in their language and presentation.
12. The Mayor and City Manager shall determine, on a month to month basis,
where the Public Comment Period will appear on the monthly agenda when developing
the agenda, prior to its publication.
13. The Public Comment Period shall only be held during the regularly
scheduled monthly meeting of the City Council. There shall not be a Public Comment
Period at any other meetings of the City Council, unless specifically approved by the City
Council.

The City Council of the City of Dunn held a Budget Work Session on Thursday, June 19, 2018, at 7:00 p.m, in the
Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tern Billy Barfield, Council Members
Buddy Maness, Dr. Gwen McNeill, Frank McLean, Billy Tart, and Chuck Turnage. Also present was City Manager
Steven Neuschafer, Finance Director Mark Stephens, Public Works Director Dean Gaster, Recreation Director Brian
McNeill, Human Resources Director Anne Thompson, Librarian Mike Williams and Attorney P. Tilghman Pope
INVOCATION
Mayor Harris opened the meeting at 7:00 p.m.
Special recognition to Lisa Farmer from The Daily Record for coming out to help share with the interpretation of the budget
for 2018-2019, with the citizens of Dunn.
Afterwards, he gave the Invocation and the Pledge of Allegiance was repeated.

Motion by Council Member Maness and seconded by Council Member Barfield to adopt the June 19, 2018 meeting agenda
with changes, if any, as listed below.

ITEM FOR DISCUSSION

Proposed Budget FY 2018-2019
Motion by Council Member Tumage and seconded by Council Member Maness to approve the budget as presented.
Council Member McNeill expressed concern with the current fee increase request for the Park and Recreation that is already
$400.00 for rental and $300.00 for deposit. Item is located on page 7 of 14, Parks and Recreation.
Council Member Barfield believes everyone has done a pretty good job on the budget with the exception of going from $5 to
$30 on the Vehicle Registration fee. It is his opinion that $10 is a sufficient amount at this time to go up with the economy as
it is and he asks that the Council would consider going up $10 rather than $30.
Council Member McLean agrees with Mr. Barfield, and doesn't think that folks can handle the $30.
Council Member Barfield added that it used to be $1, for that registration, and it changed to $5. Now we want to go to $30.
He thinks it's just too much right now and he would ask that we make it $10 rather than $30.
Council Member Tumage stated that a lot of times our City Official's, meaning City Manager, Public Works workers and
those most inclined with roads, have already addressed any kinds of outside money grants or otherwise. The $30 increase has
already been approved by the state and many of the local communities around here are increasing to the $30 as well.
Increasing by only $10, will not bring in enough funds for the paving project that the citizens want. The only way to raise the
money for that paving project, along with the Powell Bill Fund that the city gets from the state, is to increase this fee. And
then we would have a viable source of income. The reasons why we can't tap into the fund balance have been discussed
explaining that the extra fonds from the $30 increase, are earmarked and can't be touched for anything other than the paving
of the roads.
Council Member Maness stated that the people of the city may not know the cost of undertaking the repaving and repairs.
The public should know about what happened when the General Assembly changed the formula in funding the Powell Bill
Fund. He asks for the Mayor or City Manager to correct him if he was wrong in his knowledge, that the Powell Bill Fund
was changed from miles to lanes. Which gave a distinct advantage to the large municipalities with multiple lanes of roads.
Before when it was miles, it was an equal allocation. It was based on miles in a town or a municipality. Now it's skewed to
the larger Municipalities that have multi lane roads. Mr. Maness continued discussion on the costs that we receive, which are
not enough for the street maintenance or repairs that the town requires. He states that the only other source to replace what
this registration fee increase is going to provide, would be a two and a half cent (2 1/2) increase in the tax rate, to the City of
Dunn.
Council Member Turnage added that the money would go to the worst surfaced roads.
Council Member Maness added that there are 26 paving projects currently on the map, at a proposed cost of $3.6 million
dollars. It takes serious dollars to accomplish this task.
Council Member Barfield said "We thought Rooms To Go was going to be a salvation for us. But all the money we get,
Erwin, Angier, Coats, and Lillington also get part of that sales tax. The City of Dunn doesn't get all of it"
There was further discussion on the sales tax process of Rooms To Go.
Council Member Maness added that the sales tax was one of those set by the General Assembly and the City of Dunn doesn't
have any control over that.
Mayor Harris asked all of those in favor say aye, those opposed. Motion unanimously approved.
Mayor Harris asked if there was anything else to come before the Council.

The City Council of the City of Dunn held a Budget Work Session on Thursday, June 25, 2018, at 5:00 p.m. in the
Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tem Billy Barfield, Council Members
Buddy Maness, Dr. Gwen McNeill, Frank McLean, Billy Tart, and Chuck Turnage. Also present was City Manager
Steven Neuschafer, Finance Director Mark Stephens, Public Works Director Dean Gaster, Recreation Director Brian

INVOCATION
Mayor Harris opened the meeting at 5:00 p.m. and thanked everyone for agreeing to come back on the vote that they recently
had on the 2018-2019 Budget. He gave the invocation. Afterwards, the Pledge of Allegiance was repeated.

Mayor Harris explained that when he heard that Council Member McLean had said that he had voted no on the budget issue,
he was concerned about that, so he called Mr. McLean, and asked about his vote. Mr. McLean stated "Yes, that he did vote
no." Mayor Harris stated that he was not aware that Mr. McLean had voted no. IIe thought Mr. McLean did not vote at all
so Mayor Harris ruled on that. Mayor Harris stated that there is a difference in not voting versus voting no. Mayor Harris
told Council Member McLean that he would not hold him to the decision of not voting, if he indeed wanted it to go on record
as a no vote towards the budget issue. Mayor Harris then decided, after clearing with the City Attorney, to call a special
meeting for the purpose of clarity on the voting. Mayor Harris went on to explain how things work in subject to the vote
issue. It can be said, in the declaration that the prior vote passed and prior motion is back on the table. That means that we
do not have to make another motion. Mayor Harris will resend the vote that was previously taken and call for a revote of the
budget as motion was made.
Council Member Turnage asked to please state the motion
City Manager Neuschafer stated that the motion was made by Mr. Turnage to adopt the budget as presented and was
seconded by Mr. Maness.
Mayor Harris asked if there were any questions on what they were voting on and if not, he then asked the Council Members
to raise their right hand on all of those in favor, (Buddy Maness, Billy Tart, and Chuck Turnage.) All of those opposed,
Gwen McNeill, Frank McLean and Billy Barfield. With that being said, Mayor Harris voted affirmative and the budget is
approved. A copy of (02018-06) Budget Ordinance FY 2018-2019 and Fee Schedule is incorporated into these minutes as
Attachment #1.
Mayor Harris stated that that is what he, would have done had he not misread what took place at the previous council meeting
and he does not fault Council Member McLean for holding up to how he wanted to vote and he appreciates Mr. McLean
corresponding with him on this. He stated that he would not let that decision stand until they brought it back into session to
address the issue properly.
Mayor Harris then stated that he thought Council Member Maness had a comment he wanted to make
Council Member Maness stated that he did and he appreciates the privilege in doing so. He stated that he was made aware on
Friday, that a statement he had made at the last special called meeting, about the Powell Bill Fund, was inaccurate. He
wanted to say that he was wrong in his information and that the Powell Bill Fund formula had in fact, not been changed. He
stated that he honestly thought that it had and that perhaps there were others that were led to believe the same. Even though
there was a lot of discussion in the General Assembly about changing it, it was never adopted. Therefore, he wanted to go on
the record correcting his misstatement and apologizing, both to those watching and to those that may have read it. Upon
notification of finding out of his mistake, he immediately called Lisa Farmer, at The Daily Record, and informed her that he
had made a mistake.
Council Member Tumage added that the City had looked at developing some fact sheets for reference. He then asked Mark,
to make sure those facts gets changed back, about the Powell Bill Fund, to what it was.
Finance Director Stephens stated that it already has been.
Mayor Harris stated that he had the corrected fact sheets.
Council Member Tumage stated that the fact sheets should be added to the City website so people can go in and look at some
of the situations that the council deals with. It's a very informative way for the citizens to review and see nothing but the
facts as they apply to some of the decisions the Council makes.
Council Member Barfield would like to comment on a letter from Ms. Elmore about the problems at her office, the NC
License Plate Agency. Some residents don't have their vehicles registered in the proper city. Discussion continued on the
location of whether vehicles are registered properly because since the budget passed on the new Vehicle Registration Fee,
everyone will be checked. He just wanted to bring that to everyone's attention.
Discussion on where the Shrine trailer was registered and located.
Council Member Maness added that trailers are not affected by this. The only thing that's affected are cars, trucks,
motorcycles, boats are not but golf carts are if it's a licensed tag cart. But, trailers are not affected and neither are boats.
Council Member Barfield gave more discussion on where the Shrine trailer has always been registered.
Motion by Council Member Barfield and seconded by Council Member Tart to adjourn the meeting at 5:13 p.m. Motion
unanimously approved.

Chief Building Inspector Steven Icing has conducted an inspection of 103 E. Bay Street and based upon his observations, the
structure failed to comply with the minimum standards of fitness established by the Minimum Housing Code of the City of
Dunn. The Chief Building Inspector also found the dwelling dangerous or prejudicial to the public health or public safety and
is a nuisance in violation of G.S. § 160A-193.
Motion by Council Member McLean and seconded by Council Member Barfield to adopt the Ordinance Declaring the
property located at 103 E. Bay Street, PIN# 1516-55-3875.000 as Unfit for Human Habitation according to N.C.G.S. § 160A-
445. Motion approved. A copy of Ordinance (02018-07) is incorporated into these minutes as attachment #2.
Resolution Authorizing Finance Director

Cost of Automated Meter Reading Project
The Council is being asked to adopt the attached Resolution to authorize the Finance Director to file an application with the
LGC to finance the cost of the automated meter reading project.
Motion by Council Member Maness and seconded by Council Member Tart to adopt the Resolution authorizing the Finance
Director to file an application with the LGC for approval of a Financing Agreement Authorized by NC General Statute 160A-

Mayor Harris explained that this matter is not quite resolved at this time and BB&T has agreed to a thirty day extension on
their proposal. This matter was deferred to August 14, 2018.
Authorization to Accept Tart Park
Renovation RFQ Bid
Design Professional Selection
In March 2018, a Request for Qualification (RFQ) packet was advertised to various engineering firms. Of those received, city
staff reviewed and scored each upon the same criteria for comparison. Crawford Design Company received the highest
collective score to warrant them the opportunity to enter into contract negotiations.
The Parks and Recreation Department is seeking approval to accept Crawford Design Company's bid on the design
engineering and construction administration for the Tart Park Renovation project.
This contract will fall under the overall park renovation budget that was previously approved by city council.
Motion by Council Member McLean and seconded by Council Member Turnage authorizing City Manager to execute the
contract after review from City Attorney. Motion unanimously approved. A copy of Contract is incorporated into these
minutes as attachment 44.
Consideration of Engineering Agreement
Sewer Line Rehabilitation
The overall scope will be to present the long-term sewer rehabilitation program including approximately $15M in
Rehabilitation needs and identification of a first phase rehabilitation project in the $3M - $5M range (2021 timeframe).
This will allow the City Manager to enter into an engineering agreement with DMP to begin the planning efforts that satisfy
USDA Rural Development Guidelines. In an effort to be prepared to bring to council at the 2019 retreat, we have to engage
them now and come to this agreement of what the deliverables are and what expectations we have to be moving forward and
to make sure that the work is done according to USDA standards. This is an agreement to hire them to do the planning and
have everything ready for a decision to move forward in the early spring of 2019 at the budget retreat.
Costs will be covered by the approved 2018/19 Water/Sewer Fund Budget
Motion by Council Member Tumage and seconded by Council Member Barfield authorizing the City Manager to enter into
the agreement upon review of the City Attorney. Motion unanimously approved. A copy of Engineering Agreement is
incorporated into these minutes as Attachment#5.
Request Authorization to
Seek Bids for Paving Project
The approved resurfacing program of 2017 contains a list of proposed projects which are identified as being in need of work.
Last year (17/18), the Public Works Department contracted with a paver to do some of the smaller projects on the list. We
now propose to complete the bid package which will cover at least three of the worst areas in the program:
1. Intersection of W. Broad St. and N. Ellis Ave.
2. Brunswick Dr. —1240 linear feet
3. S. Washington Ave. —1000 linear feet
4. Alternate A, N. Wilson Ave. — 350 linear feet
5. Alternate B, E. & W. Carr St. — 516 linear feet
This will allow the City Manager to have a bid document prepared and advertised to receive qualified bids to resurface
selected sheets in Dunn.
Costs will be covered by approved 2018/2019 budget.
Motion by Council Member McLean and seconded by Council Member Tuinage authorizing the City Manager to seek bids
for the above project list and bring them back to the Council for final authorization. Motion unanimously approved.

Finance Director Mark Stephens provided the following financial report for the period ending May 31, 2018:
• The City as of May 31, 2018 had $3,995,987 in cash in the General Fund and $2,023,266 in the Water and
Sewer Fund. In May 2017 the City had $3,839,652 in the General Fund and $2,377,424 in the Water and Sewer
Fund.
• Property Tax collections through May were $3,831,768 or 99.84% of budget. Last year property tax collections
through May were $3,830,729 or 100.28% of budget.
• Sales Tax Revenue is $1,784,561 or 88.46% of budget. Benchmark for the month is 83.33% of budget.
• Utilities Sales Tax is $747,122 or 100.53% of budget. Benchmark for this month is 100.00% of budget.
• Building Permit Fees were $104,735 or 161.13% of budget. Benchmark fonthis month is 91.67% of budget.
• Water and Sewer Revenues were $4,142,404 or 87.21% of budget. Benchmark for this month is 91.67% of
budget.
• Expenditures were 87.90% of budget in the general fund and 90.73% of budget in the water and sewer fund.

Human Resources Director, Anne Thompson gave a brief update from Human Resources.
1. April 3, 2018 a fire drill was performed at City Hall. Everyone was evacuated from building in 2 minutes
48 seconds.

facilities.

Thank you for all of the support the City of Dunn has given the Dunn Chamber and the
Boogie on Broad Concert Series in Downtown Dunn this year, and over the past twelve years.
On behalf of our current Event Planning Committee, I ask that you continue that support for a
special fourth concert in 2018. This event will be held on Thursday, October 4 in conjunction
with the Dunn Area Tourism Authority and Cycle NC. As will the previous three concerts,
this one will be held in Downtown Dunn.
For the event, we are requesting at 2:00 p.m, to close Broad Street from Wilson Avenue to the
Clinton Avenue parking area. At 5:00 p.m., we ask that Wilson Avenue be closed from First

Resolution Approving Financing Terms
WHEREAS: The City of Dunn ("City") has previously determined to undertake a project for the
financing of water meters, (the "Project"), and the Finance Officer has now presented a proposal for the financing
of such Project.
BE IT THEREFORE RESOLVED, as follows:
1. The City hereby determines to finance the Project through Branch Bank and Trust Company
("BB&T"), in accordance with the proposal dated June 26, 2018. The amount financed shall not exceed
$1,898,000.00, the annual interest rate (in the absence of default or change in tax status) shall not exceed 3.63%,
and the financing term shall not exceed fifteen (15) years from closing.
2. All financing contracts and all related documents for the closing of the financing (the "Financing
Documents") shall be consistent with the foregoing terms. All officers and employees of the City are hereby
authorized and directed to execute and deliver any Financing Documents, and to take all such further action as
they may consider necessary or desirable, to carry out the financing of the Project as contemplated by the proposal
and this resolution.
3. The Finance Officer is hereby authorized and directed to hold executed copies of the Financing
Documents until the conditions for the delivery of the Financing Documents have been completed to such officer's
satisfaction. The Finance Officer is authorized to approve changes to any Financing Documents previously signed
by City officers or employees, provided that such changes shall not substantially alter the intent of such documents
or certificates from the intent expressed in the forms executed by such officers. The Financing Documents shall
be in such final forms as the Finance Officer shall approve, with the Finance Officer's release of any Financing
Document for delivery constituting conclusive evidence of such officer's final approval of the Document's final
form.
4. The City shall not take or omit to take any action the City of Dunn or omission of which shall cause
its interest payments on this financing to be includable in the gross income for federal income tax purposes of the
registered owners of the interest payment obligations. The City hereby designates its obligations to make principal
and interest payments under the Financing Documents as "qualified tax-exempt obligations" for the purpose of
Internal Revenue Code Section 265(b)(3).
5. The City intends that the adoption of this resolution will be a declaration of the City's official intent
to reimburse expenditures for the project that is to be financed from the proceeds of the BB&T financing described
above. The City intends that funds that have been advanced, or that may be advanced, from the City's general
fund, or any other City fund related to the project, for project costs maybe reimbursed from the financing proceeds.
6. All prior actions of City officers in furtherance of the purposes of this resolution are hereby ratified,
approved and confirmed. All other resolutions (or parts thereof) in conflict with this resolution are hereby repealed,
to the extent of the conflict. This resolution shall take effect immediately.

Chief Building Inspector Steven King has conducted an inspection at 104 Short Street, and found the structure in
a deteriorated condition that does not meet the requirements of the City of Dunn Minimum Housing Code (MHC).
The Chief Building Inspector also found the property dangerous or prejudicial to the public health or public safety
and is a nuisance in violation of N.C.G.S. 160A-193.
The owner of the property has failed to comply with the Chief Building Inspector's order to bring the structure on
the property into compliance with the City of Dunn MHC and pursuant to N.C.G.S.160A-443, the City Council has
the authority to direct the Chief Building Inspector to post on the main entrance of the property a placard that

AN ORDINANCE DECLARING THE PROPERTY HEREIN DESCRIBED AS UNFIT FOR
HUMAN HABITATION PURSUANT TO N.C.G.S. §160A-441, ET SEQ.
WHEREAS, that on April 3, 2018 the Building Inspector for the City of Dunn sent a notice to
Carl B. Munday and James R. Levinson, the owners of record of the property located at 104 Short St,
that the property was in a condition that does not meet the requirements of the City of Dunn Minimum
Housing Code and served on the property owner of Complaint and Notice of Hearing, that a hearing
would be held on April 17, 2018, at the office of the Building Inspector located at 102 North Powell Ave.,
Dunn, North Carolina pursuant to North Carolina General Statute § 160A-441, ei seq.; and
WITEREAS, on April 17, 2018, attending the hearing was Building Inspector Slater Johnson and
following the completion of the hearing, the Building Inspector entered an Order, pursuant to North
Carolina General Statute §160A-443, declaring that the property referenced above was deteriorated
pursuant to the City of Dunn Minimum Housing Code and ordering the property owner to bring the
structure on the property into compliance with the City of Dunn Minimum Housing Code within ninety
(90) days of the date of such Order, being July 19, 2018 and if necessary, that the property be vacated
until the repairs, alterations and improvements to the property were made to bring such property into
compliance with the City of Dunn Minimum Housing Code as set forth in Section 4-31 of the Dunn City

Building Inspector within the ten (10) day time period prescribed in Section 4-31 of the Dunn City Code
such Order is therefore a final Order; and
WHEREAS, on July 31, 2018 and August 7, 2018, the City of Dunn published legal notices that
a public hearing would be held before the Dunn City Council on August 14, 2018, to consider the
adoption of this Ordinance, directing the Chief Building Inspector to post on the main entrance of the
property a placard that states: "This building is unfit for human habitation; the use or occupation of this
building for human habitation is prohibited and unlawful;." and
WHEREAS, the City Council of the City of Dunn, NC finds that the dwelling described herein is
unfit for human habitation and that the Chief Building Inspector shall post the main entrance of such
property with the placard provided for herein; and
WHEREAS, the owner of this dwelling has been given a reasonable opportunity to repair the
dwelling pursuant to an Order issued by the Chief Building Inspector on April 20, 2018, and the owner
has failed to comply with the Order;
NOW, THF,REFORE, BE IT ORDAINED by the City Council of the City of Dunn, North Carolina,
that:
Section 1. The Building Inspector is hereby authorized and directed to place. a placard on the main
entrance of the building located on the property described herein, containing the legend:

426, and noticed the property owner of a hearing on April 19, 2018 at the office of the Chief Building
Inspector located at 102 North Powell Ave., Dunn, North Carolina pursuant to North Carolina General
Statute §160A-428; and
WHEREAS, on April 19, 2018 a hearing was conducted by the Chief Building Inspector
Steven Ding, following the completion of the hearing, the Chief Building Inspector entered an Order,
pursuant to North Carolina General Statute §160-429, declaring that the structure referenced above is in a
condition that constitutes a fire or safety hazard and is dangerous to life, health or other property and
ordering the property owner to repair or demolish the structure on the property within sixty (60) days of the
date of such Order, being June 26, 2019; and
WHEREAS, the owner of the above described structure did not appeal the Order of the
Building Inspector within the ten (10) day time period prescribed in North Carolina General Statute §160A-
430 and such Order is therefore a final Order; and
WHEREAS, on July 31, 2018 and August 7, 2018, the City of Dunn published legal notices
that a public hearing would be held before the Dunn City Council on August 14, 2018 to consider the
adoption of this Ordinance, directing that the Building Inspector proceed with the demolition of the structure
-;3escribed hereby, and that all costs incurred shall be a lien against such property, pursuant to North Carolina
General Statute § 160A-432; and
WHEREAS, the City Council of the City of Dunn, NC finds that the structure described
herein is dangerous or prejudicial to the public health or public safety and is a nuisance in violation of North
Carolina General Statute 160A-193; and
WHEREAS, this structure should be removed or demolished, as directed by the Chief
Building Inspector, and is an unsafe building condemned as set forth in North Carolina General Statute
§ 160A-426 and constitutes a fire and safety hazard; and
WHEREAS, the owner of this structure has been given a reasonable opportunity to repair or
demolish the structure pursuant to an Order issued by the Building Inspector on April 27, 2018 and the
owner has failed to comply with this order;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn, North
Carolina that:
Section 1. The Building Inspector is hereby authorized and directed to place a placard on the exterior of
the structure described herein, containing the legend:
"This building is unfit for human habitation and is a public nuisance; the use or occupation of this building
for human habitation is prohibited and unlawful."

Section 2. The Building Inspector is hereby authorized and directed to proceed to remove or demolish the
above described structure in accordance with his Order to the owner thereof dated the 271h day of April,
2018 and in accordance with North Carolina General Statute § 160A-432, based on the owner's failure to
comply with such Order.
Section 3. (a) The cost of removal or demolition shall constitute a lien against the real property upon
which the cost was incurred. The lien shall be filed in the office of the City Tax Collector, and shall have
the same priority and be collected in the same manner as the lien for special assessments in Article 10 of
Chapter 160A of the North Carolina General Statutes, and such costs shall also be lien against any other real
property owned by the owner of the property within the City of Dunn, North Carolina, or within one (1)
mile of the City of Dunn city limits, except for the property owner's primary residence.
(b) Upon completion of the required removal or demolition, the Building Inspector shall sell the useable
materials of the structure and any personal property, fixtures, or appurtenances found in the building and
credit the proceeds against the cost of removal or demolition. The Building Inspector shall certify the
remaining balance to the Tax Collector. If a surplus remains after sale of the materials and satisfaction of
the cost of removal or demolition, the Building Inspector shall deposit the surplus with the Harnett County
Cleric of Superior Court where it shall be secured in the manner provided by North Carolina General Statute
§ 160A-432.
,ection 4. It shall be unlawful for any person to remove or cause to be removed the placard from any
building to which it is affixed. It shall likewise be unlawful for any person to occupy or to permit the
occupancy of any building therein declared to be unfit for human habitation.
Section 5. This ordinance shall become effective upon its adoption.

to The Daily Record.
August 311, 2018 — Spoke with Ms. Amy Miller in reference to the property and about the Public
Hearing that is to be held on August 14th, 2018. She stated she would be at her child's student orientation
at that time and would like to have it postponed to the month of September. I told her I would talk to Mr.
Neuschafer about her request.

PURPOSE:
Request to amend the Utilities Ordinance — Chapter 21 of the City of Dunn Code of Ordinances.
This amendment will add text to clarify responsibilities of the City and the homeowner in the event of a
sewer stoppage in the sewer lateral.
BACKGROUND:
When a sewer stoppage occurs, many times the City is called on to determine if the blockage is on the
City's side of the sewer lateral or the homeowner's side of the sewer lateral. There has been much
confusion about who is ultimately responsible for stoppages due to the lack of a proper ordinance
specifying responsibilities.
It has been the City's unwritten policy that homeowners are responsible for blockages that occur in the
sewer lateral from the homeowner provided sewer cleanout located at the property line to the dwelling.
If there is no sewer cleanout provided at the property line, the homeowner is responsible for blockages
that occur anywhere in the sewer lateral to the sewer main.
This addition to the City's current Utility Ordinance will clarify responsibilities in the event of a sewer
stoppage in the sewer lateral.

shall be protected by a backwater valve installed in the building drain or horizontal branch

Exceptions:
1. In existing buildings, fixtures above the elevation of the manhole cover of the next
upstream manhole in the public sewer shall not be prohibited from discharging
through a backwater valve
2. Where the sewer service line ties directly to a manhole that manhole is
considered to be the next upstream manhole.
3. Where hub drains are located in the crawl space for condensate waste a
backwater valve or check valve be installed.
Material - Bearing parts o f backwater valves shall be ofcorrosion-resistant material Backwater
valves shall comply with ASMEA11214.1 CSA B181.1 or CSA B1812
Seal —Backwater valves shall be so constructed as to provide a mechanical seal against
backflow.
Diameter — Backwater valves when fully opened shall have a capacity not less than that of the
pipes in which they are installed
Location — Backwater valves shall be installed so that access is provided to the working parts for
service and repair_

The City of Dunn is preparing an application for a Community Development Block Grant (CDBG) through the NC
Dept, of Commerce. As part of the application, there needs to be a housing selection committee that will review
the individual requests for housing assistance and the Dunn Community Development Corporation has agreed to
act in that capacity.
The application is due in September, the CDBG will cover costs for individual housing repairs for owner occupied
dwellings as well as utility improvements in the same qualifying area. The intention is that the City will apply for
two grants in succession for the improvement of the qualifying neighborhood around the Dunn Enrichment Center
on E. Johnson St. (this is the only neighborhood in Dunn which meets the general criteria for this particular grant
offering).

The last regular season game ended on Thursday, May 241h. All -Stars started the week of June 16th for AA
(8U) baseball, and all other leagues started on the weekend of June 22"d. See attachment for All -Star
schedule.
• AA All Stars played in their district tournament round and unfortunately did not advance to the
state tournament.
Y Darlings (8U), Angels (10U) & Ponytails (12U) softball won their District titles and will advance to
the state tournament.
• Angels (10U) and Ponytails (12U) softball won their state tournaments in Laurinburg, NC to
advance to the World Series in Alexandria, LA
• Angels (10U) softball won their tournament to win consecutive Angels World Series
championships for Dunn
• Ponytails (12U) softball finished 2"d in their tournament as runner-ups.
• AAA (10U) & Majors (12U) baseball won their district tournament rounds will advance to the state
tournament as well.
• AAA (10U) baseball won their first game before losing their next two to be eliminated in their
state tournament in Ash, NC
• Majors (12U) baseball won their state tournament in Kenansville, NC to advance to the World
Series in Lumberton, NC where they are currently playing.
• Fall Registration will begin on Monday, July 2"d. We also are excited to announce that we have
added volleyball to our Fall program schedule. Our registration will end on Wednesday, August

Summer Camp Registrations:
We started our summer camp registrations on April 2"d, and we will continue to accept registrations
throughout the season. The maximum for each camp is 20 campers each.

Our board met last on Tuesday, April loth at 6:00 p.m. in the Dunn Community Building. The next
scheduled meeting will be held on Tuesday, August 28th at 6:00 p.m.

year's theme is Libraries Rock! By the end of the month the library had held 14 separate
events with a total attendance of 392. The breakdown is 309 children and 83 adults.
Last year we had 240 children and 89 adults in June for a total of 329 so we are ahead
of last year.
These are respectable numbers for library programs directed to children. Carrying out
such programs with our now adequate staffing level of four total is much easier. Given
the experience level of new staff, our programs are of higher quality.
