BACKGROUND: BUDGET IMPACT: RECOMMENDATION/ACTION REQUESTED: Adopted 8-4-05 CITY OF DUNN CITY COUNCIL PUBLIC COMMENT POLICY The City Council for the City of Dunn does hereby adopt a Public Comment Policy to provide at least one period for public comment per month at a regular meeting of the City Council. This policy shall remain in effect until such time that it is altered, modified, or rescinded by the City Council. All comments received by the City Council during the Public Comment Period shall be subject to the following procedures and rules: 1. Anyone desiring to address the City Council must sign up and register on a sign-up sheet available on the podium within the City Council chambers prior to the Mayor calling the meeting to order. The sign-up sheet shall be available thirty (30) minutes prior the beginning of the City Council meeting in the City Council Chambers. Once the Mayor has called the meeting to order, the City Clerk shall collect the sign-up sheet and deliver it to the Mayor. The speaker shall indicate on the sign-up sheet his or her name, address and matter of concern. The Public Comment Period shall be for thirty (30) minutes. 3. Comments are limited to three (3) minutes per speaker. A speaker can not give their allotted minutes to another speaker to increase that person's allotted time. 4. Each speaker must be recognized by the Mayor or presiding member of the City Council as having the exclusive right to be heard. Speakers will be acknowledged in the order in which their names appear on the sign up sheet. Speakers will address the City Council from the podium at the fiont of the room and begin their remarks by stating their name and address. 5. Individuals who sign up but can not speak because of time constraints, will be carried to the next regular meeting of the City Council and placed first on the Public Comment Period. 6. During the Public Comment Period, a citizen, in lieu of or in addition to speaking may pass out written literature to the City Council, City Staff and audience. 7. Groups supporting or opposing the same position shall designate a spokesperson to address the City Council in order to avoid redundancy. 8. After the citizen has made his or her remarks, he or she will be seated with no further debate, dialogue or comment. 9. The Public Comment Period is not intended to require the City Council to answer any impromptu questions. Speakers will address all comments to the City Council as a whole and not one individual Council member. Discussions between speakers and members of the audience will not be allowed. The City Council will not take action, or respond to questions about, issues raised during the Public Comment Period at the same meeting. 10. Speakers shall refrain from discussing any of the following: matters which concern the candidacy of any person seeking public office, including the candidacy of the person addressing the City Council; matters which involve pending litigation; matters which have been or will be the subject of a public hearing; and matters involving specific personnel issues related to disciplinary matters. If the speaker wishes to address specific personnel issues related to disciplinary matters, he or she should take their comments to the City Manager, who shall share the comments with the City Council. 11. Speakers shall be courteous in their language and presentation. 12. The Mayor and City Manager shall determine, on a month to month basis, where the Public Comment Period will appear on the monthly agenda when developing the agenda, prior to its publication. 13. The Public Comment Period shall only be held during the regularly scheduled monthly meeting of the City Council. Present was Mayor Oscar N. Harris, Mayor Pro Tem Frank McLean, Council Members Buddy Maness, Dr. Gwen McNeill, Billy Tart, Chuck Turuage, and Billy Barfield. Mayor Harris read the City of Dunn City Council Public Comment Policy. Rodney Johnson — Discussed education in Harnett County — the school system is suffering. There is a high drop put rate for young men of color. We need to focus more on the education system than a dog park or pot holes. We need to work together and help the schools. Motion unanimously approved. ITEMS FOR DECISION Consideration of Ordinance to Demolish Storage Building 1001 N. Fayetteville Avenue PIN# 1517-70-7318.000 Chief Building Inspector Steven King has conducted and inspection at 1001 N. Fayetteville Avenue and based upon his observations, the storage building failed to comply with the minimum standards of fitness established by the Minimum Housing Code of the City of Dunn. The Building Inspector also found the storage building dangerous or prejudicial to the public health or public safety and is a nuisance in violation of G.S. § 160A-193. The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S. §160A-443, the City Council has the power to proceed with the demolition of this property. Motion by Council Member Barfield and seconded by Council Member Turnage to adopt the ordinance directing the Chief Building Inspector to proceed with the demolition of the storage building located at 1001 N. Fayetteville Avenue, PIN 91517- 70-7318, Motion unanimously approved. A copy of Ordinance (02018-01) is incorporated into these minutes as Attachment 93. Proposed Summer Hours City Manager Neuschafer stated that these operating hours are being referred to as Proposed Summer Hours since they coincide closely with Daylight Saving Time. These seasonal hours have worked very well during the past fourteen (14) years. Motion by Council Member Maness and seconded by Council Member McNeill to approve the Proposed Summer Hours. Motion approved 5-1 with Council Member Barfield being in opposition of. Consideration of Time Frame to Start Foreclosure Proceedings on Properties At the recent Budget Retreat/Planning Session, the City Council directed City Staff to start foreclosure procedures on properties with past due demolition/weedy lot fees. The City has an agreement with Pope Law Group, PA to foreclose on properties. City Staff is requesting direction from Council when to begin the foreclosure process at either two (2) or five (5) years past due. Council Member Turnage recommended prioritizing by either the amount owed or the number of years for non-payment Council Member Maness recommended starting with the largest outstanding balances regardless how many years and prioritize based on the largest outstanding balance and work our way down. Council Member Tart stated some of these lots have been neglected for some five (5) — ten (10) years and it may not be one of the highest balanced owed but the neighbors have to sit there and look at it. If we do the highest amount owed that is fine but we should also include a minimum of at least five (5) years or even reduce to three (3) years. Council Member Maness suggested sending a letter to the property owner notifying them the City will be proceeding with the foreclosure process. Motion by Council Member Maness and seconded by Council Member McNeill to direct the City Manager and City Staff to begin the foreclosure process on properties with past due demolition/weedy lot fees beginning with the highest amount down to the two (2) year past due balance. Motion unanimously approved. Consideration of Resolution for Adoption of the 2017 City of Dunn Local Water Supply Plan Public Works Director Dean Gaster stated the 2017 Local Water Supply Plan (LWSP) cannot be considered compliant with the requirements of N.C.G.S. §143-335(1) until an adoption resolution is received by Linwood Peele, Supervisor for the North Carolina Division of Water Resources. A Resolution is required to be adopted every five (5) years by City Council. The City of Dunn Local Water Supply Plan was recently updated to include system information for 2017. The updated LWSP was submitted to the NC Division of Water Resources for review and was found to be complete and met the minimum criteria established inN.C.G.S. §143-335(1) Motion by Council Member Turnage and seconded by Council Member Barfield to adopt the Resolution for the 2017 Local Water Supply Plan for the City of Dunn. Motion unanimously approved. A copy of Resolution (R2018-02) is incorporated into these minutes as attachment #4. ITEMS FOR DISCUSSION AND/OR DECISION Consideration of Pepsi Scoreboard Contract for the Parks '& Recreation Department City Manager Neuschafer stated the City is looking at doing a project for the Tart Park renovation and we are always looking for outside funding sources for Council to consider. This is mostly for information and not necessarily that we need to act on it. We wanted to make sure Council is aware that there are funding sources out there. Pepsi Bottling Venture has presented the City with a contract to sponsor funding of $18,500.00 for the purchase of scoreboards. The sponsorship will be under the agreement the Pepsi products are to be sold during park events and selected vending locations at the City of Dunn buildings. The length of the contract is for ten (10) years with sales of 9,500 total cases (vending and concessions) or until goal case count is met if not met within the ten (10) year time period. Pepsi Bottling Ventures will provide maintenance of the scoreboards throughout the duration of the ten (10) year contract. Mayor Harris stated it was premature in the re -designing of Tart Park to decide which way we will be going for financing. The contract is open ended as it states "ten (10) years or until you have met the required sales of 9,500 cases Recreation Director McNeill stated there is no time frame of acceptance of the contract by the City. Mayor Harris has deferred action on this item. Board Appointments — Cemetery Board There are two (2) vacancies on the Cemetery Board. There was one applications received for the Cemetery Board. Motion by Council Member Barfield and seconded by Council Member Tart to appoint John Frazee to the Cemetery Board. Motion unanimously approved. Financial Report Finance Director Stephens provided the following financial report for the period ending February 28, 2018: ® The City as of February 28, 2018 had $4,753,599 in cash in the General Fund and $2,765,209 in the Water and Sewer Fund, In February 2017 the City had $4,321,516 in the General Fund and $2,597,607 in the Water and Sewer Fund. ® Property Tax collections through February were $3,700,225 or 96.41% of budget. Last year property tax collections through February were $3,714,070 or 97.23% of budget, Sales Tax Revenue is $1,270,566 or 66.00% of budget. Benchmark for the month 58.33% of budget. Utilities Sales Tax is $540,123 or 72.68% of budget. Benchmark for this month is 75.00% of budget. • Building Permit Fees were $59,056 or 90.85% of budget. Benchmark for this month is 66.67% of budget. • Water and Sewer Revenues were $3,034,895 or 63.90% of budget. Benchmark for this month is 66.67% of budget • Expenditures were 63.08% of budget in the general fund and 62.60% of budget in the water and sewer fund. The benchmark for this period is 66.67% of budget. Motion by Council Member Barfield and seconded by Council Member McLean to accept the Financial Report. Motion carried unanimously. Approval of Contract with Lorman, Inc, and Budget Amendment 913 for Emergency Sewer Line Repairs at Clinton and Pope City Manager Neuschafer stated that under the requirements of emergency bidding process, practices for the City of Drum and the State of North Carolina have been followed but the City does need to come up with a contract with the contractor so that we can ensure proper insurance and bonding is in place. We have a relationship with the general contractor and they have been able to rearrange their schedule to meet the City's emergency demand. We have worked with NCDOT and received the approvals from NCDOT for rerouting traffic as well as the information we had to get from the City Engineer's to come up with a proper repair plan. This is a specialized pipe that will be replaced. A 21 inch sewer line along Pope Street and Clinton Avenue collapsed and the City has been using a temporary bypass pump to maintain operations. The City has received the necessary NCDOT approval and received a contract from Lorman, Inc. to temporarily close Clinton Avenue and replace the sewer line. The contract is for $511,580 and requires a budget amendment. The funds will come from the City's existing budget and will suspend all other scheduled water/sewer system improvements through the end of the budget year. Motion by Council Member Tmnage and seconded by Council Member Maness to approve the contract with Lorman, Inc. in the amount of $511,580 for the sewer line repair at Pope Sheet and Clinton Avenue and Budget Amendment #13. Motion unanimously approved. A copy of the contract and Budget Amendment #13 are incorporated into these minutes as attachment #5. City Manager's Report City Manager Neuschafer stated Clinton Avenue will be closing Thursday, April 12, 2018 and there will be a detour in place. The detour is already mapped out and approved by NCDOT. The detour will be activated Thursday and could be in place for up to thirty (30) days. Chief Building Inspector Steven King gave a brief update from the Planning & Inspections Department, Council Member Tart stated Council appreciates what the Planning & Inspections Department is doing and understands there can be a lot of demands. Our event hosted over 500 people last year which included runners, sponsors, volunteers, and survivors. We would first like to thank you and your staff for your support of our run the years. Concern over the safety of our participants has never been an issue since bringing our event to Dunn, due to the diligence and coordination of your staff. As always, a major consideration for our 2018 event is the safety of our participants, volunteers, and spectators from the community. With that in mind, we would sincerely appreciate your support again this year and we solicit any input regarding the best use of city safety staff versus volunteer safety staff to maintain course and participant safety. We would also appreciate your input concerning potential road closings as well. The run course will remain the same as last year. We have enclosed a copy of the certified course. Again this year our run will include a 10k, 5k, and a 1-mile fun run. Registration for the event will start at 7AM at the General Lee Museum. The 10K Run will begin at 8:30AM with the 5K following at 9AM. WHEREAS, that on January 22, 2018, the Chief Building Inspector for the City of Dunn sent a notice to Spoyle Properties, LLC, the owner(s) of record of storage building located at 1002/1004 E. Environmental concerns Care is taken to design the site to minimize grading on the site by individually setting poles to support the solar cells. During construction, erosion control measures will be maintained in accordance with the County regulations and the site will comply with County storm water regulations. Summer Camp Registrations: We started our summer camp registrations on April 2nd. Parents will be able to register their children online. The maximum number of kids per camp is 20. On March 11, 2018 officer responded to the area of W. Broad St and N. King Ave in reference to a disturbance. The victim advised someone attempted to hit her with a vehicle. The victim advised she had to jump out of the roadway to keep from being struck. On March 27, 2018 officers responded to 501 Spring Branch Rd in reference to a panic alarm at the I mart. Upon their arrival the spoke with the store clerk. The clerk advised a B/M wearing a yellow shirt and black jacket grabbed money out of the register while she had it open. The suspect then left the scene in a light color passenger car. 3. On March 27, 2018 officers responded to 873 Long Branch Rd. reference to a robbery. Officers were advised a B/M wearing a yellow shirt and black jacket entered the store and grabbed money from the register. The clerk advised the suspect was paying for some merchandise and asked for a cigar. He then grabbed the clerk by the hand bending it back, that's when the suspect grabbed the money. The suspect left the scene in a silver ford tempo.
