Minutes 06-13-2017322 MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Tuesday, June 13, 2017, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tern Billy Barfield, Council Members Buddy Maness, Dr. Gwen McNeill, Frank McLean, Billy Tart, and Chuck Turnage. Also present was City Manager Steven Neuschafer, Finance Director Mark Stephens, Public Works Director Dean Gaster, Chief Building Inspector Steven King, Planning Director Samantha Wullenwaber, Police Captain Jenkins, Recreation Director Brian McNeill, Human Resources Director Anne Thompson, Librarian Mike Williams, Attorney Wiley Pope, City Clerk Jennifer Fortin, and Daily Record Reporter Melody Brown -Peyton. INVOCATION Mayor Harris opened the meeting at 7:00 p.m. and Reverend Danielle M. Maynor, Pastor of Fine Arts & Senior Adults at Gospel Tabernacle Church and leader of the Dunn United Ministerial Association (DUMA) Choir, gave the invocation. Afterwards, the Pledge of Allegiance was repeated. AGENDA ADJUSTMENT AND APPROVAL Motion by Council Member Barfield and seconded by Council Member Maness to adopt the June 13, 2017 meeting agenda with changes, if any, as listed below. PRESENTATIONS Proclamation Presentation Miss Dunn 2017—Kelsey Wright Mayor Harris presented a Proclamation to Kelsey Wright, in recognition of her being crowned Miss Dunn 2017. A copy of Proclamation (P2017-12) recognu-ing Kelsey Wright is incorporated into these minutes as Attachment #1. Proclamation Presentation Miss Dunn's Outstanding Teen 2017 — Carrie Stevens Mayor Harris presented a Proclamation to Carrie Stevens in recognition of her being crowned Miss Dunn's Outstanding Teen 2017. Citizens must sign up and register on a sign-up sheet available on the podium within the City Council Chambers prior to the start of the meeting. Mayor Harris read the City of Dunn City Council Public Comment Policy There were no public comments at this time. PUBLICHEARINGS Fiscal Year 2017-2018 Budget The public has been notified that the City Council of the City of Dunn will hold a public hearing for the purpose of receiving public comment concerning approval of the Fiscal Year 2017-2018 Budget. The public hearing was duly advertised on May 31, 2017. Hearing no comments, Mayor Harris closed the public hearing. 323 Demolition of House 102 N. Jackson Street — PIN# 1516-88-9607.000 The public has been notified that oral and written comments will be heard and received concerning the demolition of the dwelling located at 102 N. Jackson Street, Dunn, NC. The public hearing was duly advertised on May 30, 2017 and June 6, 2017. Hearing no comments, Mayor Harris closed the public hearing. Minutes — Council considered approval of the minutes of May 9, 2017 City Council Meeting Minutes — Council considered approval of minutes of the May 25, 2017 Budget Work Session Budget Amendments #7, 8, 9, 10, 11, and 12 Motion by Council Member Tart and seconded by Council Member Tumage to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION Adoption of Fiscal Year 2017-2018 Budget City Manager Neuschafer updated the public on the proposed FY 2017-2018 Budget. The proposed budget is in the City Clerk's office for viewing and has been since June 1, 2017, as required by law. (See attachment from the May 25, 2017 Budget Work Session). Motion by Council Member Maness and seconded by Council Member Barfield to approve the proposed FY 2017-2018 Budget as presented, to include the Budget Ordinance and Fee Schedule. Motion unanimously approved. A copy of Ordinance (02017-1 S) and fee schedule is incorporated into these minutes as attachment #3. Consideration of Ordinance to Demolish House 102 N. Jackson Street — PIN# 1516-88-9607-000 Chief Building Inspector Steven King has conducted an inspection of 102 N. Jackson Street and based upon his observations, the structure failed to comply with the minimum standards of fitness established by the Minimum Housing Code of the City of Dunn. The Chief Building Inspector also found the dwelling dangerous or prejudicial to the public health or public safety and is a nuisance in violation of G.S. § 160A-193. The owner of the property has failed to comply with the Chief Building Inspector's order and according to N.C.G.S. § 160A- 443, the City of Dunn has the power to proceed with the demolition of the property. Motion by Council Member Barfield and seconded by Council Member McLean to adopt the Ordinance to demolish house located at 102 N. Jackson Street, Dunn, NC, PIN# 1516-88-9607.000. Motion unanimously approved. A copy of Ordinance (02017-16) is incorporated into these minutes as attachment #4. Major Subdivision Final Plat Approval The Cottages Phase Two Planning Director Wullenwaber noted this was a request from Robert and SuLou Wellons to review and vote on the final subdivision plat for The Cottages Phase Two on N. Powell Avenue. The final plat shall meet the Applicable regulations in Chapter 20, Subdivision of Land, Article II Plats Section 20-43, of the City of Dunn Code of Ordinances. At the June 28, 2016, Planning Board meeting, the Planning Board approved the preliminary plat. Upon approval, the property owner/developer began infrastructure construction for the second phase of the subdivision. The property is currently zoned R-10, Single Family Dwelling District. The improvements required by the subdivision ordinance in the City of Dunn, Code of Ordinances are complete. The Planning and Inspections Department and Public Works Department have reviewed the construction plans and inspected the completed work. The Planning Board met on May 23, 2017 and voted unanimously to recommend approval of this request. The applicant wishes for the street and utilities to be accepted as public infrastructure. The street names will be Crescent Drive and Beaufort Circle. Motion by Council Member Turnage and seconded by Council Member Barfield to approve the final plat and allow for recording of the subdivision including all stipulations. Motion unanimously approved. Consideration of Resolution Directing the Clerk to Investigate Voluntary Annexation Petition ANX-01-17 Received Under G.S.160A-31 RP Wellons Land & Development, LLC 9+/- acres PIN# 1517-24-6607.000 City Manager Neuschafer noted there was a three part process for this land to be accepted into the City limits. It is in the first step for Council to direct the City Clerk to make sure the application is proper and then it will be brought back for a public hearing to be scheduled. Motion by Council Member Barfield and seconded by Council Member McLean to approve the Resolution Directing the Clerk to Investigate Voluntary Annexation Petition ANX-01-17 Received under G.S. 160A-31 for RP Wellons Land & Development, LLC 9+/- acres PIN# 1517-24-6607.000. Motion unanimously approved. A copy of Resolution (R2017-10) is incorporated into these minutes as Attachment #S. 324 Consideration of Waiving Fees for a Habitat for Humanity of Harnett County House Being Built on S. Fayetteville Avenue PIN# 1516-45-4626.000 Motion by Council Member Maness and seconded by Council Member McNeill to waive the fees associated with a house being built on S. Fayetteville Avenue by Habitat for Humanity of Harnett County. Motion unanimously approved. Awarding of Project for Storm Drainage System Repairs Public Works Director Gaster noted during the damage assessment by the Federal Emergency Management Agency (FEMA), two areas were identified with damaged stormwater drainage boxes. Area 14, located at 157 N. General William C. Lee Avenue beside Tyler Park and Area 20, located at 847 N. McKay Avenue. Bid packets were prepared by Davis, Martin, Powell, & Associates (DMP) and sent to Lorman Grading & Utility Construction, Sandy's Hauling & Backhoe, and Wellons Construction. Bids were opened on May 26, 2017 at 10:00 a.m. in the Council Chambers at City Hall with the only bid submitted by Lorman Grading & Utility Construction in the amount $177,600. After review of the bid beingsubmitted by Lorman Grading & Utility Construction and investigation into the non -submittal by Wellons Construction and Sandy's Hauling & Backhoe, DMP staff recommend awarding the project to Lorman Grading & Utility Construction in the amount of $177,600. Motion by Council Member Tart and seconded by Council Member Tumage to award Stormwater Drainage Repair project to Lorman Grading & Utility Construction in the amount of $177,600 contingent on a letter of approval for the project application package by FEMA, which will include a Project Application Summary with approved amounts from the Project Worksheet(s) and the allowed administrative costs with a total project cost of $210,000, which includes engineering fees and construction contingency. Motion unanimously approved. Awarding of Project for Dunn -Erwin Road Waterline Modifications Public Works Director Gaster noted during Utility Assessment by DOT for the project to replace the bridge at Black River on Dunn -Erwin Road, it was discovered that a portion of the 14" water line that used to provide water from the A.B. Uzzle Treatment Facility to Dunn is located in the construction area of the project. The purpose of this project is to remove that portion of the line from the construction area. The project will also provide a new fire hydrant located at the Church of God in Christ of Deliverance for the fire protection and water quality flushing purposes and installation of an inline gate valve to replace an existing gate valve that is non -operational. Bid packets were prepared by Davis, Martin, Powell, & Associates (DMP) and sent to Lorman Grading & Utility Construction, Sandy's Hauling & Backhoe, and Wellons Construction. Bids were opened on May 26, 2017 at 10:00 a.m. in the Council Chambers at City Hall with the only bid submitted by Lorman Grading & Utility Construction in the amount of $111,900. After review of the bid being submitted by Lorman Grading & Utility Construction and invest gation into the non -submittal by Wellons Construction and Sandy's Hauling & Backhoe, DMP staff recommend awarding the project to Lorman Grading & Utility Construction in the amount of $111,900. Motion by Council Member Maness and seconded by Council Member McLean to award Project for Dunn -Erwin Road Waterline Modification project to Lorman Grading & Utility Construction in the amount of $111,900 contingent upon receipt of the executed Utility Relocation Agreement with NC DOT in the amount of $138,000, which includes the $111,900 construction cost as well as engineering fees and contingency. Motion unanimously approved. Consideration of Resolution for Authorization to Apply for a Building Re -Use Grant Country Inns & Suites/New Dunn Hotel, LLC Planning Director Wullenwaber noted the City Council is being asked to adopt a Resolution to authorize the Mayor to file an application with the building Re -Use Grants Program — Vacant Building Category for grant assistance for New Dunn Hotel, LLC at 510 Spring Branch Road. New Dunn Hotel, LLC is renovating the former Highway Inn. The new hotel will be named Country Inn & Suites Hotel. A 5% local match of the grant is required. The requested grant amount is $95,000 and the 5% match will not exceed $4,750.The New Dunn Hotel, LLC will be responsible for this match. Motion made by Council Member Barfield and seconded by Council Member McLean to adopt the Resolution authorizing the Mayor to file an application with the Building Re -Use Grants Program — Vacant Building Category for grant assistance for New Dunn Hotel, LLC 510 Spring Branch Road. A copy of Resolution (R3017-11) is incorporated into these minutes as Attachment #6. Personnel Policy City Manager Neuschafer noted attached for Council consideration is a proposed list of amendments to the City of Dunn Personnel Policy. The attached lists the items to be amended and the reason for each revision. The majority of these changes will ensure compliance with the Affordable Care Act and address recent changes to the City's group health insurance plan. The City of Dunn Personnel Police has not been revised since August 2, 2007. All changes were submitted to the City Attorney for review and were approved as presented. Motion by Council Member Tumage and seconded by Council Member Maness to approve the City of Dunn Personnel Policy Changes as presented. A copy ofthe Personnel Policy revision is incotporated into these minutes as Attachment #7. Board Appointments Planning Board (3 year terra) In -town Incumbent Claudell Brown is willing to serve another term. Applications have been received from Mitch Kamphius, Barbara Holmes, and Dan Coleman. Motion by Council Member Maness and seconded by Council Member Tumage to re -appoint Claudell Brown to the Planning Board with a term expiring June 30, 2020. Motion unanimously approved. 325 Board of Adjustment (3 year term) In -town Incumbent Gary Beasley wishes to serve another term. Charles Moore and Teresa McKoy have not expressed a desire to serve another term. Blount Whiteside will serve another term if needed. No applications have been received. Motion by Council Member Barfield and seconded by Council Member McLean to re -appoint Gary Beasley to the Board of Adjustment with a term expiring June 30, 2020. Motion unanimously approved. ABC Board (3 year term) Incumbent Alice Judd wishes to serve another term. No applications have been received. Motion by Council Member Barfield and seconded by Council Member Maness to re -appoint Alice Judd to the ABC Board with a term ending June 30, 2020- Motion unanimously approved. Library Board (3 year term) Incumbent Linda James wishes to serve another term while Incumbent Gloria Gulledge is not eligible. Applications have been received from Dava Anderson, Barbara Holmes, Dan Coleman, and Renee Pope. Motion by Council Member Barfield and seconded by Council Member Tart to re -appoint Linda James and to appoint Dava Anderson to the Library Board of Trustees with a term ending June 30, 2020. Motion unanimously approved. Dunn Housing Authority As recommended by a letter from the Dunn Housing Authority, Mayor Harris re -appointed Lew Holloway as tenant representative to the Dunn Housing Authority with a term ending June 30, 2020. Cemetery Advisory Board (3 year term) Incumbent Mark Johnson does not wish to be re -appointed. No applications have been received. There were no appointments at this time. Recreation Advisory Board (3 year term) Incumbent Brian Allen wishes to be re -appointed. Rodney Warren, Eddy Langston and Dewayne Holmes have not responded as to whether they wish to serve another term. An application has been received from Parrish Daughtry. Motion by Council Member Barfield and seconded by Council Member McLean to re -appoint Brian Allen to the Recreation Advisory Board with a term ending June 30, 2019. Motion unanimously approved. ITEM FOR DISCUSSION AND/OR DECISION Temporary Blocking of Street — Dunn Crime Stoppers A request has been received from Dunn Crime Stoppers requesting the closing of. • N. General William C. Lee Avenue, just north of the alley that runs behind Parrish Apartments to the dumpsters • W. Harnett Street at the intersection of N. General William C. Lee Avenue • W. Harnett Street at the pathway to the splash pad and shelter area of Tyler Park on Tuesday, August 1, 2017 from 4:30 p.m. to 9:30 p.m. for National Night Out. Motion by Council Member McLean and seconded by Council Member Barfield to approve the request for closing of the street for Dunn Crime Stoppers for National Night Out. Motion unanimously approved. Temporary Blocking of Street — AAA Dixie Youth Baseball Dunn Parks and Recreation Department has requested a temporary closing of W. Harnett Street at the crosswalk connecting Harnett School and Tyler Park from 4:30 p.m. until 8:30 p.m. on Friday, July 7, 2017 to allow patrons to safely enter the park for AAA Dixie Youth Baseball opening ceremony. Motion by Council Member McLean and seconded by Council Member Maness to approve the request for closing of the street for the AAA Dixie Youth Baseball opening ceremony and use the same map as submitted by Dunn Crime Stoppers for National Night out. Motion unanimously approved. Consideration of Contract for City Manager Neuschafer Motion by Council Member Barfield and seconded by Council Member Tumage to accept the employment and severance contract for City Manager Neuschafer with retro-active pay back to original hire date of April 2, 2017. Financial Report Finance Director Mark Stephens provided the following financial report for the period ending April 30, 2017: • The City as of April 30, 2017 had $4,005,035 in cash in the General Fund and $2,356,495 in the Water and Sewer Fund. In April 2016 the City had $3,682,448 in the General Fund and $2,074,137 in the Water and Sewer Fund. • Property Tax collections through May were $3,823,250 or 103.44%% of budget. Last year property tax collections through May were $3,582,763 or 101.27% of budget. • Sales Tax Revenue is $1,430,989 or 85.43% of budget. Benchmark for the month is 75.00% of budget. • Utilities Sales Tax is $531,564 or 67.36% of budget. Benchmark for this month is 75.00% of budget. • Building Permit Fees were $75,848 or 116.69% of budget. Benchmark for this month is 83.33% of budget. • Water and Sewer Revenues were $3,812,445 or 84.72% of budget. Benchmark for this month is 83.33% of budget • Expenditures were 79.09% of budget in the general fund and 78.71% of budget in the water and sewer fund. The benchmark for this period is 83.33% of budget. Mayor Harris requested a list of all construction being completed in the Dunn City limits to be presented at the July meeting. 326 Motion by Council Member Tart and seconded by Council Member Barfield to accept the Financial Report. Motion carried unanimously. Motion unanimously approved. City Manager's Report City Manager Neuschafer noted the traffic signals at Magnolia and Broad and Clinton and Edgerton have been put back in service. The traffic signal at Wayne Avenue is on hold waiting for the contractor. The bathroom project at Tart Park has started. The swimming pool is not open due to a faulty pump. A new pump has been ordered and will be installed this week. The pool should be open within the next two weeks. Police Chief Halliburton was at a meeting and will present his report at the July meeting. ANNOUNCEMENTS The following announcements and/or comments were made. Mayor Harris: ➢ Boogie on Broad will be held on Thursday, June 15, 2017, 2017 from 6:30 p.m.-9:30 p.m. in Downtown Dunn ➢ Habitat for Humanity of Harnett County would like to cordially invite you to a ground breaking ceremony for a new house to be located in Dunn, in the 700 block of S. Fayetteville Avenue. The ceremony will begin at 1:00 p.m. on Friday, June 30, 201 T ➢ City offices will be closed on Tuesday, July 4, 2017 in observance of Independence Day ➢ The next regular City Council Meeting is scheduled for Tuesday, July 11, 2017 @ 7:00 p.m. Council Member Turnage noted he went to a neighborhood meeting regarding concerned citizens wanting to focus on the current crimes situation of breaking and entering. A presentation was given to the public by the Police Chief and staff on where the trends are happening for the break in's and their successes. The Harnett County Sheriff was present and gave further information. Mayor Harris noted the Main Street Group was here last week and spent a half a day with the City. They toured the City and were impressed and we are one of the five to advance in the Main Street Program.
