Minutes of Regular Meeting
April 4, 2005
The Harnett County Board of Commissioners met in regular session on Monday, April
4, 2005, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett
Boulevard, Lillington, North Carolina.

Vice Chairman Hill called the meeting to order at 9:00 a.m. and Commissioner
Andrews led the pledge of allegiance and prayer.
Commissioner Andrews moved to approve the agenda as published. Commissioner
Titchener seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Andrews,
the Board unanimously approved the following items on the consent agenda:

3. Tax Refunds and Releases (Attachment 1)
4. Contract for Professional Services with The Wooten Company to develop a new
Unified Development Ordinance - When completed, this document will combine all of
the County’s land use ordinances into a single user-friendly document. Three
proposals were received. Each proposal was reviewed independently by members of
the U.D.O. Review Team and the team unanimously recommended The Wooten
Company, Raleigh. Other companies who submitted proposals were: Clarion
Associates, Chapel Hill, and CMR Services, Inc., Kannapolis.
5. Resolution to accept State Revolving Loan for Harnett-Fuquay Sewer Project
(Attachment 2)
6. Harnett County Holiday Schedule for 2006 (Attachment 3)
7. Proclamation regarding Relay for Life Week (Attachment 4)
8. Settlement agreement with Robert W. Winston, Jr., Joel Layton Winston and wife,
Nancy E. Robbins, and Margaret Layton Melton and husband, Norman H. Melton
regarding the Neill’s Creek Sewer Interceptor Project.
9. Two-year contract with Bateman Senior Meals to provide meals for the Elderly
Nutrition Program beginning July 1, 2005. Of the two companies who responded,
only Bateman Senior Meals provided all examples and samples required in the bid
packet. Bateman is the current provider and has served the County well. The other bid
received was from 3J’s Catering.
10. Request from Management Information Services (MIS) to use the sole source
purchasing option – N.C. General Statute 143-129(E)(6)(iii) – to have a fiber link
installed by TICS Corporation. The overriding consideration for this exception to the
normal bidding process is due to standardization and compatibility with the County’s
current infrastructure. TICS has been used for the majority of the County’s fiber optic
cabling for the past four years. This fiber link project will connect the governmental
complex to the existing fiber backbone. The cost of the project is $67,270.57.
Commissioner Titchener moved for the appointments listed below. Commissioner
Andrews seconded the motion and it passed unanimously.
Adult Care Home Community Advisory Committee
Lisa L. Hopkins and Dionne Holliday for 1-year terms to expire 4-30-06
nominated by Commissioner McNeill
Southeastern Economic Development Commission
N. Carnell Robinson for a 4-year term to expire 4-30-09
nominated by Commissioner Andrews
Buren Fulmer, Harnett County Forest Ranger, presented the 2004 Annual Report for
the North Carolina Forest Service. Ranger Fulmer gave a brief summary of progress
being made in the different program areas of the N.C. Forest Service in Harnett
County
George Jackson, Planning Director, presented the proposed Public Housing Agency
(PHA) Five Year Plan for 2005-2009 and the proposed Annual Plan for 2005.
Adoption of the Five Year and Annual Plan is in compliance with requirements as set
forth by the U.S. Department of Housing and Urban Development. Prior to adoption
of either Plan, a public hearing must be held. Vice Chairman Hill called to order a
public hearing and opened the meeting for comments from the public regarding the
proposed Plans. No comments were offered and Vice Chairman Hill closed the public
hearing. Commissioner McNeill moved to adopt a resolution which approves and
adopts the Public Housing Agency Five Year Plan and Annual Plan for Harnett
County as presented. Commissioner Andrews seconded the motion and it passed
unanimously. (Attachment 5)
Lee Anne Nance, Economic Development Director, explained Tomsed Corporation’s
plans to expand its current physical plant facilities in the Harnett County Industrial
Park. Dwight Snow, County Attorney reviewed Tomsed’s past transactions with the
County and the current proposed transaction. Mr. Snow then presented for the
Board’s consideration an “Amendment to Transfer Agreement Between Harnett
County and Tomsed Corp.” and a “Resolution to Convey Real Property to Tomsed
Corp.”. Vice Chairman Hill called to order a public hearing regarding the matter and
opened the floor for comments. Mary B. Johnson, 864 Johnson Farm Road,
Lillington, asked several questions regarding the number of jobs that will be
generated as a result of the proposed manufacturing facility expansion project.
There being no further comments, Vice Chairman Hill closed the public hearing.
Commissioner McNeill moved to adopt the amendment to the transfer agreement as
presented by Mr. Snow. Commissioner Titchener seconded the motion and it passed
unanimously. (Attachment 6) Commissioner McNeill moved to adopt the resolution
to convey real property to Tomsed as presented by Mr. Snow. Commissioner
Andrews seconded the motion and it passed unanimously. (Attachment 7)
Departmental reports were filed with the Board from Emergency Medical Services,
Animal Control, Veteran’s Service, and General Services.
Commissioner Andrews moved to adopt a resolution opposing delay in construction of
the I-540 Western Wake Expressway. Commissioner McNeill seconded the motion
and it passed unanimously. (Attachment 8)
There being no further business, Commissioner McNeill moved to adjourn.
Commissioner Andrews seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners regular meeting, April 4, 2005, adjourned at 10:00
a.m.
