Commissioner Springle led the Pledge of Allegiance and invocation. Chairman Penny called for any additions or deletions to the published agenda. Commissioner Springle moved to approve the agenda as published. Vice Chairman Miller seconded the motion that passed unanimously. Vice Chairman Miller moved to approve items on the consent agenda. Administration requested approval of the Proclamation to Honor Kimberly S. Hargrove. 5. Harnett County Sheriff's Office requested approval to accept the donation of a six-month old Bloodhound, valued at $1,000, from Deputy Michael McCoy. 6. Harnett County Sheriff's Office requested approval of the 2020 Detention Center Health Plan. Harnett County contracts with Southern Health Partners, Inc. to provide medical care to the Harnett County Detention Center. 7. Harnett County Emergency Services requested approval of the Designated Agents form for the Hurricane Dorian Hazard Mitigation Grant. These agents will be responsible for signing numerous state and federal grant documents related to the application, award and execution of this grant. The Hazard Mitigation Grant Program is designed to assist local governments by offering funding for projects that will lessen the impact of future disasters to our government and citizens. 8. Harnett County Public Library requested approval of an award of bid to Bibliotheca, LLC for the installation, maintenance, and warranty of a Radio Frequency Identification (RFID) System for the Harnett County Resource Center and Library. Bibilotheca's proposal was chosen over other proposals based on weighted scores for certain criteria. RFID is a technology that uses electromagnetic fields to automatically identify tags attached to physical items. RFID implementation will benefit all users in our rapidly growing patron -base by freeing up staff availability, streamlining our circulation processes, providing a more accurate foot traffic report, enforcing an additional layer of security and inventory control, and simplifying collection management. Harnett County Finance Officer and Budget Officer requested approval of the revised Fiscal Policy for Harnett County. The revisions will enhance the policy to include budget preparation and administration. 10. Harnett County Tax Department reported total unpaid FY 2019/2020 property taxes totaling $2,596,213.55, as of January 31. 2020, constituting a lien on real property. The Harnett County Board of Commissioners ordered the Tax Administrator to advertise, pursuant to NCGS 105-369, unpaid taxes for the fiscal year 2019-2020 that constitute a lien on real property. Chairman Penny presented Mrs. Kimberly S. Hargrove with a proclamation recognizing her 34 years of dedicated service to the citizens of Harnett County. North Carolina Secretary of State Elaine Marshall presented Mrs. Hargrove with the Order of the Long Leaf Pine. Chairman Penny opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following citizens addressed the Board: Jerry Rivas of 364 Twin Ponds Road in Sanford Joe Langley of 298 Kirk Adams Road in Angier Tammy Truelove of 179 Knight Estates Circle in Fuquay-Varina - John Linderman, owner of 1211 Jackson Road in Fuquay-Varina Floyd Hein of 411 Raney Drive in Spring Lake - Geri Ritts of 25 Ben Court in Bunnlevel Carina Bibbens of 2614 McDougald Road in Lillington Mrs. Stewart was asked to follow-up with Mrs. Truelove regarding her request for guidance on what she can do about deer dogs. Chairman Penny reminded everyone that it would take a legislative action to change the game laws in Harnett County. Vice Chairman Miller moved to approve the following appointments. Commissioner Springle seconded the motion that passed unanimously. Board of Equalization and Review George Thurman, representing District 1, was re -appointed for a two-year term expiring February 28, 2022. Joe Miriello, who represents District 3, was given a second waiver of term limit and re -appointed for a two-year term expiring February 28, 2022. Bobby Doberstein, representing District 5, was re -appointed for a two-year term expiring February 28, 2022. Board of Health Amanda Langdon was appointed to serve on this board as the veterinarian representative for a term of three years expiring February 28, 2023. February 17, 2020 Regular Meeting Minutes Harnett County Board of Commissioners Page 3 of 6 Harnett County Commission for Women and Youth Allison Fenderson was reappointed to serve on this board for a term of three years expiring March 31, 2023. Larry Smith, Director of Harnett County Emergency Services, presented Benhaven Emergency Service's request for approval to purchase approximately three acres of land, not to exceed $65,000, at 13151 Hwy 27 West to construct a substation (Station 3). Benhaven Emergency Services Chief Andy Thomas said their station addition/relocation plan has been reviewed and approved by NC OSFM as meeting the maximum coverage for their five mile district. He said this substation would bring multiple parcels and proposed sub divisions into the 5 -mile for insurance purposes. Chief Thomas noted their 5 -year capital plan for 20/21 has funding for this land purchase and would not require financing. Vice Chairman Miller moved to approve the request as presented. Commissioner Johnson seconded the motion that passed unanimously. Mark Locklear, Director of Harnett County Development Services, petitioned the Board for a public hearing: Proposed Zoning Change: Case # PLAN 1912-0001, Landowner / Applicant: Emilio & Danielle Flores; 2.0 +/- acres; Pin # 0654-66-0008.000; From RA -30 to Commercial Zoning District; US Hwy 401 N; Hector's Creek Township. The site is currently occupied by a single-family structure and a detached garage. Surrounding land uses included undeveloped land, several non-residential uses (Spence Mill Industrial Park) as well as low-density residential and agricultural uses. Services available are Harnett County public water and private septic tank. Mr. Locklear noted that on February 3, 2020, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on compatibility with the Land Use Plan and the growing nature of this area. He said no one spoke in opposition. Mr. Locklear stated staff's evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The impact to the surrounding community is reasonable, as there are several nonresidential uses in this area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning to Commercial is compatible with the overall land use classification of Employment Mixed Use, as well as within the Compatibility Development Target area. Per the County's Land Use Plan Employment Mixed Use areas "are located along major thoroughfares and include prime locations for economic development opportunities." The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested zoning would enhance or maintain the public health, safety and general welfare due to the potential site improvements that could take place. The request is for a SMALL SCALE REZONING and should not be evaluated for reasonableness. REASONING: Due to the size of these parcels and the Land Use compatibility, this application does not need to be considered for a Small Scale Rezoning. February 17, 2020 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 6 Suggested Statement -of -Consistency: Staff concludes that the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based on the nonresidential growth patterns of this area as well as compliance with the County's Land Use Plan. It is recommended that this rezoning request be approved. Chairman Penny called to order a public hearing on the matter and opened the meeting for comments from the public. - Emilio Flores, the owner and applicant, spoke in favor of the rezoning. Mr. Flores responded that he might utilize the existing house on the property as office space for his commercial landscape business. Seeing no one else move, Chairman Penny closed the public hearing. Commissioner Springle moved to approve the requested rezoning to Commercial, as it would not have an unreasonable impact on the surrounding community based on the nonresidential growth patterns of this area as well as compliance with the County's Land Use Plan. Vice Chairman Miller seconded the motion, which passed unanimously. Ms. Stewart presented the following reports: Harnett County Veterans Services Activities Report — January 2020 Harnett County Public Health Activities Summary — January 2020 - Interdepartmental Budget Amendments Mrs. Stewart informed the Board that the cost to construct the new access driveway into North Harnett Primary from NC 210 has increased $900,000 due to litigation and other issues. The project is now estimated at over $1.4 million. She reminded commissioners that the County currently has an agreement with NCDOT for the design and construction of the North Harnett Primary access road. The County previously agreed to pay approximately $200,000 towards this project. Mrs. Stewart asked the Board if they wish to pay the additional $900,000 or let the project go. She said the access road does not seem to be a high priority for the Board of Education and confirmed that there is already an emergency access out from the school. Mr. Snow answered that the Board has 60 days to respond. Commissioner Springle moved to table the issue. Commissioner McKoy seconded the motion, which passed unanimously. Mrs. Stewart also announced that US Congressman Mark Walker plans to visit the District 11A Veteran Treatment Court in Harnett County on Wednesday. Chairman Penny called for any new business. Vice Chairman Miller talked about the NCDOT's SWAT -A -LITTERBUG Program where citizens can report the license plate of anyone they see littering. He also announced the 2020 Spring Litter Sweep event scheduled for April 22, 2020. Vice Chairman Miller encouraged citizens to pick up litter on their own if they are unable to participate in the County's events. He noted the County would help provide supplies for litter events if needed. Commissioner Springle moved that the Board go into closed session for the following purpose: February 17, 2020 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 of 6 1) Consultation with the County's legal staff in order to preserve the attorney-client privilege concerning the handling of a certain claim; and 2) To instruct the County staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property; and 3) To discuss a certain personnel matter. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)&(5) &(6). Commissioner McKoy seconded the motion that passed unanimously.
