This removes any potential contradictions with the NC State Building Code. Suggested Statement-of-Consistency: (Staff concludes that…) The requested Text Amendment is compatible with the State of North Carolina Building Code & Harnett County regulatory documents. Therefore, it is recommended that this Text Amendment request be APPROVED. Basically this amendment will give the FM’s Office flexibility within the UDO for non-residential structures that would be typically be regulated via the State Bldg Code for fire protection, if applicable.  ex….if the Bldg Code wouldn’t require an office of a certain size (based on use type, occupancy, sq ft, etc) to have a sprinkler system or other type of fire protection, the UDO probably shouldn’t’ require that either.   It is also somewhat of a continued clean-up from the July sprinkler TA. On November 8th, the Harnett County Planning Board voted 5-0 to recommend approval of this of the Text Amendment application based on based on the understanding that the NC Building Code regulates fire protection within non-residential structures. ADD (red text)/ REMOVE (highlighted text) the following to… Article VII. Development Design Guidelines 6.4 Fire Protection 6.4.3 Fire Hydrants for Nonresidential Development Fire hydrants, or other fire protection methods as approved by the Fire Marshal’s Office, shall be required for all new construction and expansions of nonresidential development. Fire hydrants shall be located in such a manner that no primary structure is further than 400 feet from a hydrant, measured along the street centerline. Development of lots located along divided right(s)-of-way shall only consider distance to hydrants located on the same side of the right(s)-of-way.
