(Ken) Stephenson — Maintenance Worker BACKGROUND: 1 .111004 11 11173d II RECOMMENDATION/ACTION REQUESTED: Adopted 8-4-05 CITY OF DUNN CITY COUNCIL PUBLIC COMMENT POLICY The City Council for the City of Dunn does hereby adopt a Public Comment Policy to provide at least one period for public comment per month at a regular meeting of the City Council. This policy shall remain in effect until such time that it is altered, modified, or rescinded by the City Council. All comments received by the City Council during the Public Comment Period shall be subject to the following procedures and rules: 1. Anyone desiring to address the City Council must sign up and register on a sign- up sheet available on the podium within the City Council chambers prior to the Mayor calling the meeting to order. The sign-up sheet shall be available thirty (30) minutes prior the beginning of the City Council meeting in the City Council Chambers. Once the Mayor has called the meeting to order, the City Clerk shall collect the sign-up sheet and deliver it to the Mayor. The speaker shall indicate on the sign-up sheet his or her name, address and matter of concern. 2. The Public Comment Period shall be for thirty (30) minutes. 3. Comments are limited to three (3) minutes per speaker. A speaker can not give their allotted minutes to another speaker to increase that person's allotted time. 4. Each speaker must be recognized by the Mayor or presiding member of the City Council as having the exclusive right to be heard. Speakers will be acknowledged in the order in which their names appear on the sign up sheet. Speakers will address the City Council from the podium at the front of the room and begin their remarks by stating their name and address. 5. Individuals who sign up but can not speak because of time constraints, will be carried to the next regular meeting of the City Council and placed first on the Public Comment Period. 6. During the Public Comment Period, a citizen, in lieu of or in addition to speaking may pass out written literature to the City Council, City Staff and audience. 7. Groups supporting or opposing the same position shall designate a spokesperson to address the City Council in order to avoid redundancy. 8. After the citizen has made his or her remarks, he or she will be seated with no further debate, dialogue or comment. 9. The Public Comment Period is not intended to require the City Council to answer any impromptu questions. Speakers will address all comments to the City Council as a whole and not one individual Council member. Discussions between speakers and members of the audience will not be allowed. The City Council will not take action, or respond to questions about, issues raised during the Public Comment Period at the same meeting. 10. Speakers shall refrain from discussing any of the following: matters which concern the candidacy of any person seeking public office, including the candidacy of the person addressing the City Council; matters which involve pending litigation; matters which have been or will be the subject of a public hearing; and matters involving specific personnel issues related to disciplinary matters. If the speaker wishes to address specific personnel issues related to disciplinary matters, he or she should take their comments to the City Manager, who shall share the comments with the City Council. 11. Speakers shall be courteous in their language and presentation. 12. The Mayor and City Manager shall determine, on a month to month basis, where the Public Comment Period will appear on the monthly agenda when developing the agenda, prior to its publication. 13. The Public Comment Period shall only be held during the regularly scheduled monthly meeting of the City Council. There shall not be a Public Comment Period at any other meetings of the City Council, unless specifically approved by the City Council. A petition from landowner Dunn Commerce Park LLC requesting the closure was received on June 27, 2019. PRESENTATIONS: Cape Fear District Funeral Directors Association and Funeral Directors and Morticians Association of North Carolina honor the late Walter Dafford, Jr., Dallas "Be" Dafford and the late Nathaniel Tucker Jr. as Past Presidents of the State Association. Mayor Harris and representatives from the associations presented plaques to the Dafford family and Tucker family. A plaque was also presented to the Dunn Area History Museum paying tribute to these three men and recognizing Dunn for being the only City with three Past Presidents of the State Association. Recognition of First Citizens Bank, Dunn NC 90" Anniversary Mayor Harris presented a Proclamation to representatives from First Citizens Bank on the 90'11 Anniversary of the Dunn location. Recognition of the 100"' Anniversary of the American Legion Mayor Harris presented a Proclamation to representatives from the American Legion Post 59 and the Auxiliary Unit 59 in recognition of the 100' Anniversary of the American Legion and further, proclaimed September 1 through 7, 2019 as "American Legion Centennial Week" in the City of Dunn, A copy of the Proclamation (P2019-11) is incorporated into these minutes as Attachment #2. CONSENTITEMS: Minutes — Council considered approval of the minutes of June 11, 2019 City Council Meeting, Resolution Declaring the Badge and Service Weapon carried by Lt. James Ashley Barefoot surplus and awarding both to him on his Retirement. A copy of the Resolution (R2019-12) is incorporated into these minutes as Attachment #3. Resolution adopting the 2019 General Records Retention and Disposition Schedule. A copy of the Resohrtion (R2019-13) is incorporated into these minutes as Attachment #4. A copy of the Resolution (R2019-14) is incorporated into these minutes as Attachment 46. Motion by Council Member Bradham and second by Council Member McNeill to approve all consent items. Motion unanimously approved. In appreciation of Lt. James Ashley Barfoot's years of service to the City of Dunn Police Department, Mayor Harris read the Resolution declaring his badge and service weapon surplus and awarding both to Lt. Barefoot on his retirement. ITEMS FOR DECISION., Consideration of Resolution Directing the Clerk to Investigate Voluntary Annexation Petition ANX-01-19 1001 Meadowlark Road, owned by John A Willoughby Jr. PIN #1517-65-0443.000 A petition requesting the voluntary contiguous annexation of +/- 18.96 acres, owned by John A. Willoughby, Jr and Clarice Willoughby, was received under NC General Statute 160A-31. This is the location for a proposed Solar Farm by Cubera Solan Cubera Solar, as the applicant, and The Willoughby LLC, as the owner of the property, were approved for a Conditional Use Permit (CU -01-18) at the May 8, 2018 City Council meeting. One of the conditions of the permit was that the property owner and applicant would agree to file a petition for a voluntary annexation within 30 days of the beginning of construction. Motion was made by Council Member Turnage and second by Council Member Maness to adopt the Resolution directing the Clerk to investigate a Voluntary Annexation Petition ANX-01-19 consisting of +/- 18.96 acres, located at 1001 Meadowlark Road, PIN # 1517-65-0443.000 and owned by John A. Willoughby Jr, and Clarice L. Willoughby. Motion unanimously approved. A copy of the Resolution (R2019-15) is incorporated into these minutes as Attachment #7. Consideration of Ordinance to Demolish House— 602 East Pearsall Street, PIN #: 1516-75-1263.000 (Deferred front June Il, 2019 CC meeting) Chief Building Inspector King conducted an inspection at 602 East Pearsall Street and based upon his observations, the structure failed to comply with the minimum standards of fitness established by the Minimum Housing Code of the City of Dunn. The owner of the property failed to comply with the Building Inspector's order, and according to N.C.G.S. § 160A-443, the City Council has the power to proceed with the demolition of this property. The Public Hearing was held at the June 11, 2019 Council meeting and the Council deferred the Ordinance to Demolish until the July meeting to allow the property owners time to sell the property. The realtor reported to King that they are unable to sell the house due to a price disagreement between the potential buyer and the owners. Motion by Council Member Tart and second by Council Member McNeill to adopt the ordinance directing the Building Inspector to proceed with the demolition of the dwelling located at 602 East Pearsall Street (PIN #: 1516-75-1263.000). Motion unanimously approved. A copy of the Ordinance (02019-06) is incorporated into these minutes as Attachment #8. Resolution of Intent to Consider Permanently Closing the 200 block of East Best Street and unopened portion of Wilson Avenue and to set Public Hearing City Manager Neuschafer presented a proposed Resolution of Intent to consider permanently closing the unopened street in the 200 block of East Best Street on the west side of South Clinton Avenue and the unopened potion of South Wilson Avenue between South Clinton Avenue and Phillips property at PIN #1516-44-2191.000. The proposed resolution will also set the public hearing for the next Council meeting on August 13, 2019 at 7:00 p.m. in Council Chambers. The petition from landowner Dunn Commerce Park LLC was also signed by adjoining property owners: Castton Properties LLC and Lester Ray Phillips. Motion by Council Member McNeill and second by Council Member Bradham to approve the Resolution of intent to consider permanently closing the unopened street in the 200 block of East Best Street on the west side of South Clinton Avenue and the unopened portion of South Wilson Avenue between South Clinton Avenue and the CSX Railroad and to set the Public Hearing for August 13, 2019 at 7:00 p.m. at the Dunn Municipal Building. Approval of the Deed to the Trustees of Harnett Chapel Freewill Baptist Church City Attorney Pope shared that the County and City approved a john Resolution at their June meetings to sell real property with "Notice to sell Real Property with Invitation for Upset Bids," The property is jointly owned by the City and County and is a 50 foot x 150 foot vacant tract contiguous to Harnett Chapel. The net proceeds, after payment of advertising expenses, will be evenly divided between the City and County. The proper notice was published on June 20 and no upset bids were received within the required time period. Therefore, the City and County are in position to proceed with approving the final sale of the property. The County will consider approval at the July 15, 2019 meeting of the County Commissioners. Motion by Council Member Maness and second by Council Member McNeill to approve the joint sell of real property located at East Edgerton Street to the Trustees of Harnett Chapel Freewill Baptist Church and authorize the Mayor to execute the Deed as presented. ITEMS FOR DISCUSSION AND/OR DECISION: Financial Report/Assessments Update Finance Director Roberts provided the following financial report for the period ending June 30, 2019 as follows: • $4,381,844 in cash in the General Fund and $2,325,007 in the Water and Sewer Fund. Through June of 2018, the City had $3,954,145 in General Fund and $2,170,595 in Water and Sewer Fund. • Property tax collections - $3,885,471 or 101% of budget with last year at $3,831,768 - 99.9% of budget. • Sales Tax Revenue - $1,839,193 or 85% of budget. Benchmark for this report - 92% of budget. The City has one more sales tax month to collect for the year. • Utilities Sates Tax is $556,109 or 101% of budget. • Building Permit Fees were $82,602 or 110% of budget. Budget for the year is $75,000. • Water and Sewer Fund Revenues - $4,745,517 or 100% of budget. Budget for the year is $4,760,000. • Expenditures are at 88.5% of budget in the general fund. Budget was $11,061,038 with $9,789,105 expended. The Water and Sewer Fund spent 95% of budget of $5,328,065 with $5,033,118 expended. The benchmark for this period is 100% of budget. Roberts also presented the Tax Report and added that over $45,000 was collected on weedy lots and assessments in the past year. City Manager's Report City Manager Neuschafer gave a Paving update. He also told Council members that NC DOT is considering revising the US 421 Bypass study. DOT is planning to divide the project in hopes that it will score better and be funded. The study, to widen Cumberland or to shift Cumberland and Broad into one-way traffic, has ended and is not funded any longer. Neuschafer also shared that the deadline to propose any new projects to DOT is approaching this fall. Parks and Recreation Dn•ector McNeill gave an update on the ongoing state tournament currently being held in Duna He reported that 25 teams are participating. Mayor Maris commended Parks and Recreation Directr McNeill and his staff on the great job they have done in preparing the facilities and running the tournament. ANNOUNCEMENTS/INFORMATION Mayor Harris announced upcoming events and activities. He reported that the City of Dunn recently hosted a meeting of the Mid -Carolina Council of Government and they are in the process of hiring a new director with hopes to revive the organization. Council Member Bradham is serving as the City's representative. He also reminded Council Members that Mark Johnson of Dmm will be sworn in as a member of the Harnett County Board of Commissioners on July 15, 2019. He will replace the late Honorable Abe Elmore. The Council further set a public hearing on this question for the 13th day of August, 2019 at 7:00 p.m. in the Municipal Building at City Hall, 4. The resolution declaring an intent to permanently close the PUBLIC STREET AT THE 200 BLOCK OF EAST BEST STREET ON THE WEST SIDE OF SOUTH CLINTON AVENUE, AND SOUTH WILSON AVENUE BETWEEN SOUTH CLINTON AVENUE, CSX RAILROAD, COOKE STREET AND YAM STREET was published once a week for four consecutive weeks prior to the hearing. BASED ON THE FOREGOING FINDINGS OF FACT, it is concluded to the satisfaction of the City Council that closing the described right-of-way is not contrary to the public interest and no individual owning property in the vicinity of the property would be deprived of reasonable means of ingress and egress to its property. Wake Street). The City has been notified that the project is eligible to receive funding based on the application that was submitted. BACKGROUND: The 14 -inch water line along Dunn -Erwin Rd. was originally installed in 1930's and was the main transmission line into Dunn before the 16 -inch and 24 -inch water lines were constructed. Several years ago the 14 -inch water line was abandoned from the Dunn Water Plant to the Black River Bridge on Dunn -Erwin Rd. However, the remaining section of 14 -inch water line pipe is still active. The proposed project would begin near the intersection of Bruce Drive to just south of the intersection of S. Wayne Avenue and W. Cumberland Street. To mitigate the hazards associated with the age of the infrastructure and current alignment, the 14 -inch line would be abandoned and 6 -inch and 8 -inch pipe will be installed in order to serve the affected areas. The new lines will be installed within the City's right of way and therefore ongoing maintenance and repairs will be possible. The second part of the project abandons an existing 2 -inch water line along E. Wake from Carolina Drive to E. Johnson St. and replaces with a 6 -inch water line for the purpose of meeting current design standards and providing fire flow. This would also include installing fire hydrants on the new water line. BUDGET IMPACT: The eligible loan amount is $875,750 with a 20 -year term and maximum interest rate of 1.89%. Debt service is predicted to begin in fiscal year 2021-2022. The debt service is estimated to be approximately $61,000/year. Having multiple pieces of equipment will allow collection operations in different areas at the same time, increasing service to the residents. After this purchase we will have the option to dispatch either piece of equipment, depending on the situation. At this time, we are prepared to seek funding for the pull behind trailer and box unit. If approved, we will seek quotes for the financing and return that selection to you at the September Council Meeting. This equipment is in stock and available for this leaf season. Once the utility project is complete, the City would own the sewer lines that are constructed in the public right of way along Jonesboro Road, BUDGET IMPACT: Option #1 Total Estimated Project Budget $1,570,000 No cost to the City Option #2 Total Estimated Project Budget $1,686,000 City cost is $116,000 The City would be expected to pay the difference (estimated at $116,000) between the betterment design/construction cost and NC DOT's minimum design/construction cost for the utility project. If the City declined the betterment option, a future gravity project along this same route is expected to cost in excess of $500,000. The anticipated let date for this phase of the NC DOT project is July 2020 so no costs would be incurred until the project moves to construction, which is expected to be fiscal year 2020-2021. We will also be seeking additional funding via other environmental grants such as the Cleanwater Trust Fund and the EPA 319 grant as their timeframes permit. There are precious few parks in Harnett and Sampson Counties and no parks at all in the vicinity of Dunn, which borders Harnett and Sampson Counties. I am especially excited forthe young folks in the area and my students in the Biology Department at Campbell University. Our proposed park is right in the heart of the city — a rare and highly impactful location, amenable to bicycle and foot traffic and close to several schools, As an educator with 20+ years of teaching experience, I can promise you that many of our local teachers will take advantage of the close proximity of our proposed park to enhance learning and encourage character development in their students — instilling pride in their hometown and a sustainability ethic that our planet's future leaders will desperately need. As Director of Campbell University's Cape Fear River Initiative, I am tasked with creating opportunities for our faculty, students and neighbors to join together in celebration of our green spaces in Harnett County. Rural counties like ours are in desperate need of open spaces for people to rest and play — places to build memories and exercise and connect to the land. Our proposed park in the heart of Dunn will most certainly serve us well in this regard and I will personally ensure that our students and faculty at Campbell University take a leading role in educating our neighbors in Dunn about the many benefits of open, green spaces. As I alluded to earlier, I am the resident Terrestrial Ecologist at Campbell University. I can envision many research and teaching opportunities afforded by the City of Dunn's new park. For example, my Biology students can assist with floral and faunal surveys and monitoring, water and habitat quality assessments and recreational use, quality -of -experience and wellness surveys. Our proposed park, which features open water, streams and wetland areas will also provide important research and learning opportunities for Campbell's Chemistry, Education and Engineering majors. A multidisciplinary strategy for exposing future leaders to our park for educational and monitoring purposes is especially important in urbanized areas like the City of Dunn where water pollution, trash, stream channelization and invasive species can erode public support for our parks and threaten ecosystem health. As such, I plan to reach across academic disciplines at Campbell to build a coalition of educators that can work with our team to build a strong, sustainable future for our new park and our neighbors in Harnett and Sampson Counties. INTRODUCTION PURPOSE AND BACKGROUND The Office of the North Carolina Attorney General has issued this Request for Proposals (RFP) to identify environmental enhancement projects contemplated by the Smithfield Agreement for reimbursement under the Environmental Enhancement Grant Program ("EEG Program") In 2000, the Attorney General and Smithfield Foods entered into a 25 -year Agreement that, in part, provided $2 million per year for environmental projects across the state. This money was used to establish the EEG Program that has awarded environmental grants since 2002. The goal of the EEG Program is preserve and enhance North Carolina's natural resources with an emphasis on projects that are related to the swine industry or that are located in eastern North Carolina. . In the over 15 years since the Agreement was signed, nearly $24 million dollars in grant funds have been spent to improve North Carolina's environment. EEG funds have been used for projects such as wetland restoration, land acquisition, storm -water remediation, stream stabilization, and buffer installations, among many others. EEG funds have been used to conserve over 23,000 acres, close 240 hog lagoons, and over one-fourth of the projects improved or added to public lands. Please review each section carefully. This RFP explains the application process, including funding criteria, eligibility of participants, evaluation criteria, and deadlines. The Request also outlines some of the performance guidelines for grant recipients. The RFP is solely a request for expressions of interest and statements of qualification. It is not an invitation for tenders, an offer to contract or an invitation capable of acceptance to create a contract. The Attorney General may cancel this RFP at any time without liability for any loss, damage, cost, or expense incurred or suffered by any applicant as a result of that cancellation. OBJECTIVES The EEG Program offers reimbursement grants for projects that meet the goals of the Smithfield Agreement, including obtaining environmental easements, constructing or maintaining wetlands, restoring and protecting of impaired, degraded, or endangered surface waters, as well as conserving and protecting of targeted natural areas. Past Grant Award Examples: • Obtained over 900 acres along Salmon Creek and Albemarle Sound with significant ecological and archaeological importance which were transferred to the State to create the Salmon Creek State Natural Area • Acquired a 1,789.64 acre tact near Black River, which was home to a bald cypress tree that was determined to be over 2,613 years old • Permanently protected 1,896 acres in Western North Carolina including more than twenty miles of stream and river frontage • Acquired 2,991.58 acres along the Waccamaw River that was transferred, in part, to the State as public game lands as well as retaining a portion of the land for a nature preserve RESEARCH, PLANNING AND EDUCATION Research, planning, and education ate crucial to identifying challenges facing North Carolina's cnviromnent and creating solutions to address those challenges. EEG funds allow researchers to identify and investigate environmental changes, inform organizations on where future environmental efforts should be focused, and deepen the public's interest in their role in protecting North Carolina's natural resources. In August of 2018 there was $357,550 in assessments of all types. The total reported last month was $369,500. • Also, under the direction of council on July 13, 2018, we started with the highest dollar amounts first and collected over $45,000 in the first few months. Many of these indivivals have multiple properties and owe for more than one location. • Water and sewer has $15,800 outstanding, assessments from Planning and Inspections have billing in excess of $127,000, and demolitions and weedy lots make up the remaining $231,000. Our total outstanding at this time is $374,766. We are at the high time for weedy lots and will receive payments for many of these within the coming months. • Our billing process begins with notifications in writing and then following up with a second warning letter. With mowing, we then utilize a private contractor for land that is under one acre and Public Works handles the larger parcels. Payment is then expected within 30 days and land owners are notified in writing. We do not offer a payment plan. Sports offered will be youth football, soccer, cheer and volleyball. Registration for adult volleyball ended July 191h and teams began practice in preparation of the first game on August P. This season there are a total of four teams. All -Stars All Dunn all-stars teams participated in their respective state tournament throughout the month of July, AA (8u baseball) all-stars went to Lockwood Folly, NC on June 28th where they played two games before being eliminated. Ponytails (12u softball) all-stars went to Wilmington, NC on July 121h to play in their state tournament. The girls had a strong showing as they were one win away from winning their tournament but couldn't overcome Hope Mill's momentum and lost twice on championship night to finish as runner-ups. Majors (12u baseball) all-stars went to Clarkton, NC July 13' to play in the division two state tournament. They won four games before being eliminated in the championship game to Lockwood Folly. Dixie Youth Baseball AAA (10u) Baseball NC State Tournament The NC Dixie Youth AAA Baseball State Tournament was hosted at the Nathan Harris Athletic Complex at Tyler Park on July 5th -12th Opening ceremonies began July 5th. The baseball player and their families received a meal prior to the ceremony. Baseball players participated in an around the horn game. Special guest speakers included Mayor Oscar Harris and Michael Freddy, the Pastor at Hodges Chapel Church in Benson. Our national anthem was sung by Sydney Bradham, the daughter of Dr. David and Meredith Bradham. On day 1 Dunn all-stars played hard and gave it their all winning against West Robeson 6-4 unfortunately in their second game Dunn suffer their first loss against Stanley 5-4 followed by a 5-3 loss to Reidsville, eliminating them from the tournament. Summer Camps Summer camps are continuing through July until August 8th. Camps held during the month of July was softball, fun and games, baseball and soccer. Soccer has been the fastest growing camp of the years. Due to the number of registrants additional instructors were required. Please review the chart included for a breakdown in camp numbers. Present at the meeting: Board Members, Dal Snipes, Alice Judd and Lynn Jernigan, Manager, Robert Parker, who served as Secretary to the Board. Mr. Parker presented the minutes of the May 21, 2019 meeting that were approved by the Board. Each Board Member was given a copy of the May, 2019 Financial Statements. The Board reviewed the statements noting sales in May, 2019 are $14059.01 above last year. Year to date sales are $152524.01 above last year. Mixed Beverage sales are $9470.05 above last year. The Board discussed having store #2 power washed and repairs made to the windows in the attic. Window repairs have not been done. The Board approved the budget and budget message for 2019 — 2020. Copies attached. The Board also approved $1,800.00 for each store to add HD cameras to the outside of the buildings and update each store computer. Work is complete. There was no conflict of interest at this meeting. No other business. C. General Statute 1813-702 "Financial operations of local boards". The ABC Board determines, through adoption of an annual budget, the level of customer services that the ABC system will provide and the resources available for operations and capital projects. The primary drivers during the preparation of this budget included projected operating costs required to sustain acceptable levels of customer service during fiscal year 2019/2020 and the need to provide distributions to beneficiaries. The budget consist of projected revenues from liquor sales of $2.64 million, taxes related to income of $598 thousand, cost of sales of $1.42 million, operating expenses costs of $479 thousand. Highlights of Budget: Some sales increases are projected based on last year's sales. The assumption that no debt will be incurred. Longevity pay will continue. Distribution to the City of Dunn will be the $125 thousand. The Board's Budget Process: It is anticipated that the budget process will be improved in future years.
