Commissioner Miller led the Pledge of Allegiance and invocation. Chairman Springle called for any additions or deletions to the published agenda. Mrs. Stewart requested the addition of Harnett County General Service's request for award of the base bid of $175,000, not to exceed $190,000, to A-1 Salvage and Demolition, Inc., of Archdale, NC for the demolition of the old Boone Trail School recently condemned. Commissioner Miller moved to approve the agenda as amended. Commissioner McKoy seconded the motion that passed 4-0. Vice Chairman Penny moved to approve items on the consent agenda. Harnett County Finance Officer requested approval of the Northwest Harnett Elementary School Project Capital Project Ordinance totaling $29,634,397. (Attachment 1) 3. Harnett County Finance Officer requested approval of a Resolution Declaring the Intent of the County of Harnett to Issue Approximately $28,000,000 General Obligation School Bonds to Finance NW Harnett Elementary School, as requested by the Board of Education, and to Reimburse Itself for Capital Expenditures Incurred in Connection with the Acquisition and Construction of NW Harnett Elementary School from the Proceeds of Such General Obligation School Bonds Executed to be Issued in Fiscal Year 2020. (Attachment 2) 4. Harnett County Finance Officer requested approval of the Erwin Elementary School Project Capital Project Ordinance totaling $23,481,723. (Attachment 3) 5. Harnett County Finance Officer requested approval of a Resolution Declaring the Intent of the County of Harnett to Issue Approximately $23,500,000 General Obligation School Bonds to Finance Erwin Elementary School, as requested by the Board of Education, and to Reimburse Itself for Capital Expenditures Incurred in Connection with the Acquisition and Construction of Erwin Elementary School from the Proceeds of Such General Obligation School Bonds Executed to be Issued in Fiscal Year 2020. (Attachment 4) 6. Administration requested approval of a Capital Project Ordinance for the "Shawtown Area Community Center Feasibility Study" that will be funded through a $10,000 grant. This project will include preparation of a conceptual site plan, development of a rendered site plan and building elevation plan, and preliminary estimation of construction costs for a Community Center to be constructed by the Shawtown Alumni Association on the property donated by Harnett County behind the former Shawtown School. No County funds are included in the Feasibility Study. (Attachment 5) 7. Harnett County Fire Marshal requested approval of the Carolina Lakes Fourth of July fireworks permit application. 8. Harnett County Cooperative Extension requested approval to accept a Pesticide Container Recycling Grant in the amount of $1,845 from the North Carolina Department of Agriculture and Consumer Sciences, Structural Pest Control and Pesticides Division. Grant funds will enhance the pesticide container -recycling program and the recycling of properly prepared containers. 9. Proclamation — 2019 Elder Abuse Awareness Day June 3, 2019 Regular Meeting Minutes Harnett County Board of Commissioners Page 3 of 7 10. Harnett County Health Director requested approval to add the new fee of $30 for Total Serum Bilirubin CPT Code 82247. 11. Harnett County Health Director requested approval of the revised Clinical Patient Fees, Eligibility and Bad Debt Write Off Policy. Revision made on Page 11, VII. Instructions for Determining Eligibility for Sliding Scale Fee Discount: #4 - regarding immunization only. 12. Administration requested approval of contract documents to accept $10,000 grant-in-aid from the North Carolina Department of Commerce to fund the Shawtown Area Community Center Feasibility Study. No county funds are included in this project. Harnett County Health Director John Rouse presented the Governor's Award for Volunteer Service to James & Carolyn Cox and to Amanda Burke. Chairman Springle presented the 2019 Elder Abuse Awareness Day Proclamation to Edwin Bass with Harnett County Adult Services. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following citizens addressed the Board: Floyd Hein of 1814 Rainy Drive in Spring Lake voiced his frustration with Harnett County Public Utilities. He also suggested having a table/chair available for handicap people to speak. Don Godfrey, Vice Chairman of the Harnett County Board of Education, asked the Board to consider allocation an additional $1.5 Million to cover a pay raise for classified employees of Harnett County Schools. Mr. Godfrey said this request was included in their budget request following a recent salary study. Kristina Perris, Amanda Smith and Tiffany Johnson, with Lillington and Anderson Creek Kidney Centers, voiced issues they are having with HARTS Transportation for their dialysis patients and asked for help. Commissioner Miller moved to approve the appointment listed below. Vice Chairman Penny seconded the motion that passed 4-0. Cemetery Board Of Trustees Michele Temple was reappointed to serve on this board for a term of three years expiring June 30, 2022. Home and Community Care Block Grant Committee Pamela Williams was appointed to serve on this committee. Triangle South Workforce Development Board (TSWDB) Angie Stewart was reappointed to serve on this Board for a term of four years. Her new term will be effective July 1, 2019 to June 30, 2023. Michelle Muir was reappointed by TSWDB Chair to serve on this Board to fulfill the role as the State Employment Service Representative. Her new term will be effective July 1, 2019 — June 30, 2023. June 3, 2019 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 7 Allison DeLong, District Administrator of the 11th Judicial District Guardian ad Litem (GAL) Program, provided an overview of the GAL Program for District 11 for Harnett, Lee and Johnston Counties. The mission of the North Carolina GAL program equips community volunteers to serve abused and neglected children by advocating for their best interests in court. Robert Hewett, Chairman of the Friends of Raven Rock State Park, presented information to the Board regarding a shortage of funded positions at Raven Rock State Park. He highlighted some of the approved changes coming to the park that he said would greatly impact the park and assigned staff. Mr. Hewett sought the Board's support to encourage legislators to increase funding for additional park staff. Harnett County Habitat for Humanity Executive Director Mike Blackmon requested a waiver of all of the necessary fees, up to $8,575.00, associated with the lot preparation and construction of a house to be located at 807 Rosemary Street in Erwin. Commissioner Miller moved to approve the request as presented. Commissioner McKoy seconded the motion that passed 4 — 0. Vice Chairman Penny moved to approve the increasing budget amendment as presented. Commissioner McKoy seconded the motion, which passed 3-1 with Commissioner Miller opposing. Brian Haney, Assistant County Manager, updated the Board on the Shawtown renovations, which he said should be complete this month with occupancy anticipated in August 2019. He said there are plans to hold an open house as well as meet with the community to discuss the future of the campus. Mr. Haney shared a preliminary schematic of assigned spaces for partner agencies within the renovated building. He announce that the County had been approached by the Boys and Girls Club of Central Carolina again expressing interest in putting a Boys and Girls Club in Harnett County. Mr. Haney stated that Deputy Mark Hornsby with Harnett County PAL said he would be willing to allow the Boys and Girls Club the use of four PAL classrooms if approved. Mr. Haney responded to questions and comments from commissioners. June 3, 2019 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 of 7 Daniel Simmons, CEO of Boys and Girls Clubs of Central Carolina, and Harnett County Advisory Board member George Womble said they have toured the Shawtown facility and appreciate Deputy Hornsby offering to share space designated for his program if approved. Mr. Womble reported they currently have $225,000 in donated funds to start the program. He said he has 17 citizens serving on the Harnett County Advisory Board for this program as well as the Shawtown Alumni Association supporting this effort. Mr. Simmons requested an initial lease of 10 years for space in the Shawtown facility to be used for a Boys and Girls Club for $1 a year. He said they would cover their share of utility expenses, insurance, internet, operational costs, etc. Commissioner McKoy moved to authorize staff to proceed with developing an agreement with the Boys and Girls Clubs of Central Carolina. Vice Chairman Penny seconded the motion that passed 4 — 0. Harnett County General Services requested approval of the Project Ordinance for the Former Boone Trail Elementary School Demolition Project. The former Boone Trail Elementary School was condemned because of the fire damage and unsafe conditions and anticipated expenses for this project are $239,000. Mr. Blevins said the structure is very unstable and loaded with asbestos. Commissioner Miller moved to approve the project ordinance as presented. Commissioner McKoy seconded the motion that passed 4 — 0. This project ordinance was approved by a majority of the Board and shall be considered at the next regular meeting of the Board. Harnett County General Services requested approval of an award of the base bid of $175,000 to A-1 Salvage and Demolition, Inc., for the demolition of the old Boone Trail School that is condemned as a result of fire damage and unsafe conditions. A-1 Salvage and Demolition, Inc. of Archdale NC was the lowest bidder. Staff is negotiating additional work to try to save the community valued `Boone Trail High School' and other asbestos free materials not to exceed $190,000. This project will be funded by General Fund contingency funds. Mr. Blevins believes this project will go quickly and at this point, all they can do is attempt to remove and save the sign. Vice Chairman Penny moved to approve the award of bid to A-1 Salvage and Demolition, Inc., up to $190,000 for the demolition of the old Boone Trail School. Commissioner McKoy seconded the motion that passed 4 — 0. (Attachment 6) The Board will discuss Commissioner Miller's request to have a structural engineer look at the condemned property before it is demolished during their upcoming work session. Mrs. Stewart presented the following reports: - Harnett County DSS Monthly Report — April 2019 - Interdepartmental Budget Amendments There was no new business. Commissioner Miller moved that the Board go into closed session for the following purposes: 1) To discuss certain Economic Development Matters; and 2) To instruct the County staff concerning the position to be taken by the county in negotiating a contract for the acquisition of reap property; and June 3, 2019 Regular Meeting Minutes Harnett County Board of Commissioners Page 6 of 7 3) Consultation with the County's Legal staff in order to preserve the attorney-client privilege concerning the handling of a certain claim; and 4) To discuss certain personnel matters. This motion is made pursuant to N.C. General Statute 143-318.11(a)(4)(8)(3)&(6). Vice Penny seconded the motion that passed 4 — 0. Commissioner McKoy moved that the Board come out of closed session. Vice Chairman Penny seconded the motion, which passed 4-0. The Board reconvened in work session to discuss the proposed 2019/2020 budget. Mrs. Stewart updated the Board on the proposed budget. She stated charter school funding would need to be increased to $682,384, which is per pupil funding for around 598 students. Mrs. Stewart said staff was previously provided the wrong numbers to use for the charter school funding calculations included in the budget. Mrs. Stewart reported that District Attorney Vernon Stewart still hopes to get funding from the County for an Assistant District Attorney position. She said if not, he plans to move the current staff person into one of the additional district attorney positions added by the State. Mr. Stewart asks that the County continue to fund this position for approximately 3 months until he can get it moved. It was the consensus of the Board to still do away with the position but to continue to fund it for approximately three additional months Mrs. Stewart noted she would be meeting with several emergency services soon to discuss their budgets in more detail. Vice Chairman Penny requested the fund balance for the different emergency services. He also requested the unrestricted fund balance for each towns. Staff responded to questions from commissioners Commissioner Miller asked if the County migh get a letter from the LGC for using $1.9 million appropriation from the General Fund balance to balance this budget. Commissioners and staff talked about trying to build the General fund balance and the County Manager's hiring freeze. Staff mentioned the difficulties encountered in projecting some of the revenues and tracking trends in spending with the new financial software. Official Declaration of Intent. The officers of this unit are hereby directed to proceed with the capital project within the terms of the loan documents and the budget contained herein. Section 3. The Budget Officer is directed to include a detailed analysis of past and future costs and revenues on this capital project in every budget submission made to this Board. Section 9. Copies of this capital project ordinance shall be furnished to the Clerk to the Governing Board, and to the Budget Officer and the Finance Officer for direction in carrying out this project. WHEREAS, the Board of Education of the County of Harnett (the "Board of Education") has requested that the Board of Commissioners (the "Board") of the County of Harnett, North Carolina (the "County") issue approximately $23,500,000 of tax-exempt general obligation school bonds (the "Bonds") in order to finance the acquisition and construction of Erwin Elementary School (the "Project"), pursuant to the bond order adopted by the Board on July 21, 2014 and effective on approval by the voters of the County at a referendum duly held on November 4, 2014; and WHEREAS, the County intends to proceed with the Project and expects to incur and pay certain expenditures in connection with the Project prior to the date of issuance of the Bonds (the "Original Expenditures"), such Original Expenditures to be paid for originally from a source other than the proceeds of the Bonds, and the County intends, and reasonably expects, to be reimbursed for such Original Expenditures from a portion of the proceeds of the Bonds to be issued at a date occurring after the dates of such Original Expenditures; PPAB 3139930v1 NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett, North Carolina as follows: Section 1. Official Declaration of Intent. The County presently intends, and reasonably expects, to reimburse itself for the Original Expenditures incurred and paid by the County on or after the date occurring 60 days prior to the date of adoption of this Resolution from a portion of the proceeds of the Bonds. The County reasonably expects to issue the Bonds in the fiscal year ending June 30, 2020, and the maximum principal amount of Bonds reasonably expected to be issued by the County to pay for all or a portion of the costs of the Project, which amount is subject to change, is expected to be approximately $23,500,000. Section 2. Compliance with Regulations. The County adopts this Resolution as a declaration of official intent under Section 1.150-2 of the Treasury Regulations promulgated under Section 103 of the Internal Revenue Code of 1986, as amended, to evidence the County's intent to reimburse itself for the Original Expenditures from proceeds of the Bonds. Section 3. Itemization of Capital Expenditures. The Finance Officer of the County, with advice from special counsel, is hereby authorized, directed and designated to act on behalf of the County in determining and itemizing all of the Original Expenditures incurred and paid by the County in connection with the Project during the period commencing on the date occurring 60 days prior to the date of adoption of this Resolution and ending on the date of issuance of the Bonds. Section 4. Effective Date. This Resolution is effective immediately on the date of its adoption.
