04102018385 MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Tuesday, April 10, 2018, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tem Frank McLean, Council Members Buddy Maness, Dr. Gwen McNeill, Billy Tart, Chuck Turnage, and Billy Barfield. Also present was City Manager Steven Neuschafer, Finance Director Mark Stephens, Public Works Director Dean Gaster, Police Chief Chuck West, Recreation Director Brian McNeill, Human Resources Director Anne Thompson, Librarian Mike Williams, Attorney Tilghman Pope, City Clerk Jennifer Fortin, and Executive Assistant Blake Lassiter. INVOCATION Mayor Harris opened the meeting at 7:00 p.m. and asked Reverend Floyd Ray, Pastor of Mt Zion Missionary Baptist Church in Dunn, a promoter of the Dunn Area of Churches, and an active member of the Dunn Rotary Club, to give the invocation. Afterwards, the Pledge of Allegiance was repeated. AGENDA ADJUSTMENTAND APPROVAL Motion by Council Member Maness and seconded by Council Member McNeill to adopt the March 13, 2018 meeting agenda with changes, if any, as listed below. Agenda Items Added. • ITEM FOR DECISION - Approval of Contract with Lorman, Inc. and Budget Amendment #13 for Emergency Sewer Line Repairs at Clinton Avenue and Pope Street Agenda Items Removed: • none Motion unanimously approved. PRESENTATIONS Mayor Harris presented the Certificate for Excellence in Financial Reporting to the Finance Department from the National Finance Officers Association (NFOA) for the ninth consecutive year. Finance Director Stevens thanked his staff, Mayor, Council, City Manager, and Department Heads for their support PUBLIC COMMENT PERIOD Each speaker is asked to limit comments to 3 minutes, and the total comment period will be 30 minutes. Citizens must sign up and register on a sign-up sheet available on the podium within the City Council Chambers prior to the start of the meeting. Mayor Harris read the City of Dunn City Council Public Comment Policy. Rodney Johnson — Discussed education in Harnett County — the school system is suffering. There is a high dropout rate for young men of color. We need to focus more on the education system than a dog park or pot holes. We need to work together and help the schools. Mayor Harris closed the Public Comment portion of the agenda. PUBLIC A7 annvG Demolition of Storage Building 1001 N. Fayetteville Avenue PIN# 1517-70-7318.000 The public has been notified that oral and written comments will be heard and received concerning the demolition of the storage building located at 1001 N. Fayetteville Avenue. The public was duly advertised on March 29, 2018 and April 3, 2018. Hearing no comments, Mayor Harris closed the public hearing. CONSENT ITEMS Minutes — Council considered approval of the minutes of the March 13, 2018 City Council Meeting Minutes — Council considered approval of the minutes of the March 20, 2018 City Council Budget Retreat/Planning Session Minutes Proclamation—National Library Week—A copy of Proclamation P2018-06 is incorporated into these minutes as Attachment #1. Budget Amendment #12 —BA #12 —Police Vehicles -A copy of BA #12 is incorporated into these minutes as Attachment #2. 2018 Community Waste Reduction and Recycling Grant Program acknowledgement of grant application Motion by Council Member Tart and seconded by Council Member Tumage to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION Consideration of Ordinance to Demolish Storage Building 1001 N. Fayetteville Avenue PIN# 1517-70-7318.000 Chief Building inspector Steven King has conducted an inspection at 1001 N. Fayetteville Avenue and based upon his observations, the storage building failed to comply with the minimum standards of fitness established by the Minimum Housing Code of the City of Dunn. The Building Inspector also found the storage building dangerous or prejudicial to the public health or pubIic safety and is a nuisance in violation of G.S. §160A-193. The owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S- §160A-443, the City Council has the power to proceed with the demolition of this property. Motion by Council Member Barfield and seconded by Council Member Tumage to adopt the ordinance directing the Chief Building Inspector m proceed with the demolition of the storage building located at 1001 N. Fayetteville Avenue, PIN #1517- 70-7318. Motion unanimously approved. A copy of Ordinance (02018-01) is incorporated into these minutes as Attachment #3. Proposed Summer Hours City Manager Neuschafer stated that these operating hours are being referred to as Proposed Summer Hours since they coincide closely with Daylight Saving Time. These seasonal hours have worked very well during the past fourteen (14) years. Motion by Council Member Maness and seconded by Council Member McNeill to approve the Proposed Summer Hours. Motion approved 5-1 with Council Member Barfield being in opposition. Consideration of Time Frame to Start Foreclosure Proceedings on Properties At the recent Budget Retreat/Planning Session, the City Council directed City Staff to start foreclosure procedures on properties with past due demolition/weedy lot fees. The City has an agreement with Pope Law Group, PA to foreclose on properties. City Staff is requesting direction from Council when to begin the foreclosure process at either two (2) or five (5) years past due. Council Member Tumage recommended prioritizing by either the amount owed or the number of years for non-payment Council Member Maness recommended starting with the largest outstanding balances regardless how many years and prioritize based on the largest outstanding balance and work our way down. Council Member Tart stated that some of these lots have been neglected for some five (5) — ten (10) years and it may not be one of the highest balances owed but the neighbors have to sit there and look at it. If we do the highest amount owed that is fine but we should also include a minimum of at least five (5) years or even reduce to three (3) years. Council Member Maness suggested sending a letter to the property owner notifying them that the City will be proceeding with the foreclosure process. Motion by Council Member Maness and seconded by Council Member McNeill to direct the City Manager and City Staff to begin the foreclosure process on properties with past due demolition/weedy lot fees beginning with the highest amount down to the two (2) year past due balance. Motion unanimously approved. Consideration of Resolution for Adoption of the 2017 City of Dunn Local Water Supply Plan Public Works Director Dean Gaster stated that the 2017 Local Water Supply Plan (LWSP) cannot be considered compliant with the requirements of N.C.G.S. §143-335(1) until an adoption resolution is received by Linwood Peele, Supervisor for the North Carolina Division of Water Resources. A Resolution is required to be adopted every five (5) years by City Council - The City of Dunn Local Water Supply Plan was recently updated to include system information for 2017. The updated LWSF was submitted to the NC Division of Water Resources for review and was found to be complete and met the minimum criteria established in N.C.G.S. § 143-335(1) Motion by Council. Member Tumage and seconded by Council Member Barfield to adopt the Resolution for the 2017 Local Water Supply Plan for the City of Dunn Motion unanimously approved. A copy of Resolution (82018-02) is incorporated into these minutes as attachment #4. AND/ORDECISION Consideration of Pepsi Scoreboard Contract for the Parks & Recreation Department City Manager Neuschafer stated that the City is looking at doing a project for the Tart Park renovation and we are always looking for outside funding sources for Council to consider. This is mostly for information and not necessarily that we need to act on it. We wanted to make sure Council is aware that there are funding sources out there. Pepsi Bottling Venture has presented the City with a contract to sponsor funding of $18,500.00 for the purchase of scoreboards. The sponsorship will be under the agreement that Pepsi products are to be sold during park events and selected vending locations at the City of Dunn buildings. 387 The length of the contract is for ten (10) years with sales of 9,500 total cases (vending and concessions) or until goal case count is met, if not met within the ten (10) year time period. Pepsi Bottling Ventures will provide maintenance of the scoreboards throughout the duration of the ten (10) year contract Mayor Harris stated that it was premature in the re -designing of Tart Park to decide which way we will be going for financing. The contract is open ended as it states "ten (10) years or until you have met the required sates of 9,500 cases Recreation Director McNeill stated that there is no time frame of acceptance of the contract by the City. Mayor Harris has deferred action on this item. Board Appointments — Cemetery Board There are two (2) vacancies on the Cemetery Board. There was one application received for the Cemetery Board. Motion by Council Member Barfield and seconded by Council Member Tart to appoint John Frazee to the Cemetery Board. Motion unanimously approved. Financial Report Finance Director Stephens provided the following financial report for the period ending February 28, 2018: • The City as of February 28, 2018 had $4,753,599 in cash in the General Fund and $2,765,209 in the Water and Sewer Fund. In February 2017 the City had $4,321,516 in the General Fund and $2,597,607 in the Water and Sewer Fund. • Property Tax collections through February were $3,700,225 or 96.41% of budget Last year property tax collections through February were $3,714,070 or 97.23% of budget • Sales Tax Revenue is $1,270,566 or 66.00% of budget Benchmark for the month 58.33% of budget • Utilities Sales Tax is $540,123 or 72.68% of budget Benchmark for this month is 75.00% ofbudget • Building Permit Fees were $59,056 or 90.85% of budget Benchmark for this month is 66.67% of budget • Water and Sewer Revenues were $3,034,895 or 63.90% of budget Benchmark for this month is 66.67% of budget • Expenditures were 63.08% of budget in the general fund and 62.60% of budget in the water and sewer find. The benchmark for this period is 66.67% of budget Motion by Council Member Barfield and seconded by Council Member McLean to accept the Financial Report. Motion carried unanimously. Motion unanimously approved. Approval of Contract with Lorman, Inc. and Budget Amendment #13 for Emergency Sewer Line Repairs at Clinton and Pope City Manager Neuschafer stated that under the requirements of emergency bidding process, practices for the City of Dunn and the State of North Carolina have been followed, but the City does need to come up with a contract with the contractor so that we can ensure proper insurance and bonding is in place. We have a relationship with the general contractor and they have been able to rearrange their schedule to meet the City's emergency demand. We have worked with NCDOT and received the approvals from NCDOT for rerouting traffic as well as the information we had to get from the City Engineer's to come up with a proper repair plan. This is a specialized pipe that will be replaced. A 21 inch sewer line along Pope Street and Clinton Avenue collapsed and the City has been using a temporary bypass pump to maintain operations. The City has received the necessary NCDOT approval and received a contract from Lorman, Inc. to temporarily close Clinton Avenue and replace the sewer line. The contract is for $511,580 and requires a budget amendment The fonds will come from the City's existing budget, and will suspend all other scheduled water/sewer system improvements through the end of the budget year. Motion by Council Member Tumage and seconded by Council Member Maness to approve the contract with Lorman, Inc. in the amount of $511,580 for the sewer line repair at Pope Street and Clinton Avenue and Budget Amendment #13. Motion unanimously approved. A copy of the contract and Budget Amendment #13 are incorporated into these minutes as attachment #S. City Manager's Report City Manager Neuschafer stated that Clinton Avenue will be closing Thursday, April 12, 2018 and there will be a detour in place. The detour is already mapped out and approved by NCDOT. The detour will be activated Thursday and could be in place for up to thirty (30) days. Chief Building Inspector Steven ging gave a brief update from the Planing & Inspections Department 388 Council Member Tart stated that Council appreciates what the Planning & Inspections Department is doing and understands there can be a lot of demands. ANNOUNCEMENTS The following announcements and/or comments were made.
