SUBSTITUTE TRUSTEE' S DEED
THIS DEED, made and entered into this the 15 day of CJ -7-1,. -Q , 2010, by and
between Alan B. Hewett, acting as Substitute Trustee as hereinafter stated, P. O. Box 369,
Selma, Johnston County, North Carolina 27576, party of the first part, and KS Bank, Inc., 1 O.
Box 661, Smithfield, NC 27577, party of the second part;
WITNESSETH:
WHEREAS, TPNTP, LLC, a limited liability company, and Travis Pollard and wife,
Tera S. Pollard executed to Harold T. Keen as Trustee for KS Bank, Inc., upon real property
located in Harnett County, NC, and being more particularly described below, that certain deed of
trust dated July 28, 2008, of record in Book 2538, pages 641 -658, in the office of the Register of
Deeds for Harnett County, North Carolina;
WHEREAS, a Substitution of Trustee, was recorded in Book 2708, pages 160 -163,
Harnett County Registry, whereby Alan B. Hewett was substituted as Trustee; and
WHEREAS, the indebtedness therein secured, being overdue and unpaid, the holder of
the indebtednesses, having called for foreclosure of the deed of trust, and after proper notice
given to those persons entitled by law to such notice, a hearing was held before the Clerk of
Superior Court of Johnston County, North Carolina, and an order entered by the Honorable Clerk
of Superior Court for Johnston County, directing the undersigned Substitute Trustee to proceed
with foreclosure of the Deed of Trust;
After due advertisement of the notice of sale as required by law and the terms of the Deed
of Trust, the Substitute Trustee offered for sale the lands described in the Deed of Trust at the
door of the door of the Harnett County Courthouse, Main Street Entrance, Lillington, North
Carolina, to the highest bidder for cash at 3:00 P.M. on the 23 day of March, 2010, when and
where KS Bank, Inc., became the Last and highest bidders at a price of $56537.11; and
WHEREAS, a report of the sale was filed with the Clerk of Superior Court by the
Substitute Trustee on the 23 day of March, 2010; and
WHEREAS, the bid remained open for more than ten (10) days, and no advance bid was
offered and no objection made; and
WHEREAS, the purchase price has been paid;
NOW, THEREFORE, ALAN B. HEWETT, acting as Substitute Trustee as aforesaid, and
under order of the Clerk of Superior Court of Johnston County, in consideration of the premises
and the sum of Ten and 00 /100 ($10.00) Dollars to him in hand paid, has bargained and sold and
by these presents, does grant, bargain, sell, and convey unto KS Bank, Inc., its successors and
assigns, the land as aforesaid, the same being more particularly described as follows:
All that certain tract or parcel of land „lying and being in Grove Township, Harnett
County, North Carolina, and being more particularly described as follows:
Being all of Lots 4 and 5 on a map entitled "Property of Suzanne Norris- Celey” dated April 17,
2001, and prepared by W. Stanton Massengill,IP.L.S. and recorded in Map Book 2001, at page
529, Hamett County Register of Deeds, reference to which is hereby made for a more complete
and accurate description.
The above - described property is subject to all unpaid taxes, restrictions, easements of
record, and assessments, if any.
TO HAVE AND TO HOLD, the lands and premises together with all privileges and
appurtenances thereunto belonging to the parties of the second part, its successors and assigns, in
as full and ample a manner as the Substitute Trustee has power to convey the same;
This conveyance is expressly made subject to unpaid City and County ad valorem taxes, if
any.
