Hamett County Tax Administrator requested approval to bar off $77,692.65 of 2007 taxes that can no longer be legally collected through forced collection procedures as of September 1, 2017. The amount of County taxes to be removed from the system on real and personal property is $17,423.42 and motor vehicles is $60,269.23. The Tax Department collects delinquent taxes through various processes and procedures including wage garnishment, bank attachment, sheriff executions, debt setoff, other county certifications, and foreclosure. 6. Hamett County Cooperative Extension requested permission to accept 2017-2018 CORE Services Block Grant for $30,400 from the Chatham County Partnership for Children (formerly Child Care Networks) for the continual programming of the Child Care Resource Program. 7. Hamett Regional Jetport Administrator requested approval of easement agreements that allows current 6 11 high-pressure gas lines to be moved from underneath runway to locations outside the perimeter jetport fence . Total compensation for moving gas line, abandoning current and installing new lines, and creating easement is $38,200. The easements will not be recorded until the final public comment period ends and are approved by FAA/NCDOT/DOA. 8. Hamett County Engineer requested adoption of a Resolution to Approve the Proposed Phase IV C&D Landfill Unit of the Anderson Creek Landfill Facility. (Attachment 5) 9 . Hamett County Engineer requested award of bid to Sanford Metal Building, LLC for the Anderson Creek Landfill Equipment Maintenance Facility. Hamett County Engineer also requested approval of contract with Sanford Metal Building, LLC in the amount of $380,064.35. This will use most of the remaining capital fund balance for this fiscal year and Solid Waste will defer capital purchases of a service truck, skid steer and additional compactor boxes to next fiscal year. 10 . Hamett County Health Director requested approval to increase the fee for CPT CODE 90662 Fluzone High Dose 65> to $74.00. 11. Hamett County Health Director requested approval to write-off fees in the amount of $3,896.95 . All appropriate attempts were made to collect these past due fees however, if the client returns to the Health Department for services, the fees will be reinstated. Harnett County Sheriffs Office requested approval to accept a grant in the amount of $20,347 from the Office of Justice Program under the FYI 7 Edward Byrne Memorial Justice Assistance Grant Program . The funds will be used to purchase data storage and/or other IT equipment and/or other investigative equipment to support the Sheriffs Office needs. There is no local match required. 13. Harnett County Finance Officer requested approval to establish a money market account for Harnett County with Regions Bank. Chairman Springle opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Joe Pike, owner of the Twisted Grape Restaurant in Cameron, asked about the Brunch Bill. He said many customers have asked about this and he would like to be able to offer alcohol with brunch. Elizabeth Crudup of 689 Silas Moore Road in Coats referenced JCI's recent presentation to the Board. She believes commissioners need to take the time and see for themselves the discrepancies and quality of services for people with special needs in Harnett County. Alan Longman said the the County needs to raise the bar regarding services for people with special needs in Harnett County. Vice Chairman Miller moved to approve the appointments listed below. Commissioner McKoy seconded the motion, which passed unanimously. HARNETT COUNTY JUVENILE CRIME PREVENTION COUNCIL Wendy Butcher, Carl Davis, Cincy Delgado, Dawn Doan, Resson Faircloth, LaShara Glover, Letitia Maynard, Aaron Meredith, Leslie Morris, Miranda Pearson, Alice Price, Cathy Ryals, A vis Smith, Mary Spell, Angie Wood and Marshal Woodall were appointed to serve on the council for a term of two years expiring October 31 , 2019. LOCAL FIREFIGHTER'S RELIEF FUND BOARD The following were appointed as trustees on the Local Relief Fund Board: John Hausfeld, Sprout Springs Emergency Services Donald Temple, Surnmerville/Bunnlevel Fire & Rescue, Inc. Everette Hurley, Summerville/Bunnlevel Fire & Rescue, Inc. There were no other recommended changes to membership. Mrs. Stewart presented Coats Area Chamber o f Commerce's request for refund of $530 for fees paid to Harnett County Central Permitting for their Annual Farmer's Day Celebration. The Chamber stated that the past two years have been incredibly difficult and unsuccessful and have caused a hardship for them. Mark Locklear, Harnett County Development Services, said the fees were for inspections of temporary electrical panels used for the event. After discussion, Commissioner Penny moved to reimburse Coats Area Chamber of Commerce $530 . Commissioner Elmore seconded the motion. C ommissioners stres sed they did not want to set a precedence with this. The motion passed unanimously. O ctober 16, 2017 Re gular Meeting Minutes Harnett County Board of Commissioners Page 5 of9 110617a HC BOC Page 7 Major Gary McNeill with the Hamett County Sheriffs Office requested approval of an additional position to be added to the Sheriffs Office and to accept a Governor's Highway Safety Grant that would partially fund the cost of the new Deputy position, vehicle and equipment for three years. The County will be responsible for 100% of the cost of the deputy's position after the third year. Over the three-year period, the grant will provide $184,965 and the County will provide $71 ,935. Sheriff Coats was also present. Major McNeill said they feel the position is needed. He noted there have been 29 fatalities in the county so far this year. He also noted in the last five years Hamett County has been 12th overall in the state in total fatalities; 10th in alcohol related fatalities and 15th in unrestrained (seatbelt) fatalities. Major McNeill said this position will be dedicated primarily for traffic enforcement. Commissioner Elmore moved to approve the request as presented. Vice Chairman Miller seconded the motion that passed unanimously. Larry Smith, Harnett County Transit Program Manager, petitioned the Board for a public hearing on transportation needs and the proposed FYI 9 NC DOT 5311 Community Transportation Program application for Hamett Area Rural Transit System (HARTS). Mr. Smith noted the total FYI9 funding request is $488,449; consisting of$278,449 Administrative and $210,000 Capital, with a mandatory county match of $62,767. Mr. Smith said this is something they do every year and confirmed the county match is included in the current budget. Chairman Springle called to order a public hearing on the matter and opened the meeting for comments from the public. -Elizabeth Crudup of 689 Silas Moore Road in Coats said there is concern for those who have lost their drivers licenses and cannot attend court ordered treatment because there is no public transportation. She said the county would benefit from having a much improved public transportation system not just a medical transportation system. Seeing no one else move, Chairman Springle closed the public hearing. Regarding Section 5311 program 's intent to enhance the access of people in non-urbanized areas to health care, shopping, education, employment, public services and recreation; Mr. Smith responded they are looking at expanding benefits. He said they are asking to replace four existing outdated vehicles with four enhanced and higher capacity vehicles. Commissioner Elmore moved to approved the HARTS application to apply for FY19 funding, a resolution to apply, enter an agreement with NCDOT and provide the necessary assurances and required match. Vice Chairman Miller seconded the motion, which passed unanimously. Chairman Springle asked staff to provide an update on HAR TS at an upcoming meeting. Randy Baker, Hamett County Problem Properties Administrator, petitioned the Board for a public hearing regarding the condition and abatement status of the condemned structure located at 365 Betts Road, Problem Properties Case #1601, RA-30 zoning district, Buckhorn Township, 0.72 acres containing a stick built single-family dwelling, owners of the property are Kenneth James Bigda and Carol Ann Bigda. I 53A-368 and NC G.S. 153A-369. He said this property was posted as condemned on April 13 , 2016. County staff conducted a hearing on April 28, 2016, and the owners, persons in interest , agents or attorneys did not appear to submit evidence or participate. Based on the examination of the structure and the absence of evidence or argument from the owners, a formal order was issued to demolish the structure with a compliance date of June 30, 2016. Mr. Baker noted no significant progress has occurred to demolish the structure, and it remains in a similar condition as noted in April 2016. Commissioners viewed photos showing the current condition of the structure. Mr. Baker responded that if the Board determines that it is now necessary for the County to proceed with the demolition of the single-family residence at 365 Betts Road in Holly Springs, the low bid for the demolition and removal of debris and materials of the single-family residence is $6,295. He noted this cost does not include tipping fees at the landfill. Mr. Baker explained once they have a total of abatement costs, the property owners will be given a notification of that amount and will have at that time the ability to satisfy the debt to keep the property free and clear. The cost incurred by the County shall be a lien against the owners and the real property. If the debt is not paid then the Board will be able to instruct their attorney to move forward with foreclosure proceedings. Chairman Springle called to order a public hearing on the matter and opened the meeting for comments from the public. Seeing no one move, Chairman Springle closed the public hearing. Commissioner Elmore moved to adopt the Ordinance Authorizing Demolition of 365 Betts Road (Single Family Residence) and Imposition of Lien to Recover County Costs. Commissioner McKoy seconded the motion, which passed unanimously. Mr. Baker petitioned the Board for a public hearing regarding the condition and abatement status of the condemned structure located at 3254 Old Stage Road South, Problem Properties Case #1606, RA-30 zoning district, Grove Township, 5.26 acres containing a stick built single-family structure condemned due to fire damage and two abandoned manufactured homes and large amount of debris, owner of the property is Jimmy D. Johnson. Mr. Baker reviewed steps taken by staff in accordance with NC G .S. 153A-368 and NC G.S. 153A-369. He said this property was posted as condemned on September 7, 2016. County staff conducted a hearing with owner Jimmy D. Johnson on January 19, 2017, and he was advised that a formal order would be issued to demolish the structure with a compliance date of March 24, 2017. Mr. Baker noted Mr. Johnson did not appeal the order and no significant progress has occurred to demolish the structure, and it remains in a similar condition as noted in September 2016. Commissioners viewed photos showing the current condition of the structure. Mr. Baker note the low bid for the demolition, including asbestos abatement and removal of debris and materials of the single-family residence is $7,050. He noted this cost does not include tipping fees at the landfill . Mr. Baker clarified they are only asking for removal of the stick built single-family structure condemned due to fire damage at this time. Mr. Baker noted the property owner was in attendance. He reported the owner has secured a demolition permit however, there has been no noticeable evidence of any kind of deconstruction at this time. The cost incurred by the County shall be a lien against the owners and the real property. If the debt is not satisfied then the Board can move forward with foreclosure. Mr. Baker reminded the Board that they have the ability to either continue to allow or to pass the ordinance to order demolition. Chairman Springle called to order a public hearing on the matter and opened the meeting for comments from the public. Jimmy Johnson, owner of 3254 Old Stage Road South, said he is in the process of trying to take the property down. He said if they would allow him two months he would have it on the ground and in the process of getting it gone. Mr. Johnson said he occupies one of the manufactured homes on the property as he is back and forth between this address and Willow Springs. He also responded that he should be able to make arrangements for the asbestos abatement. Chad Massengil of 3298 Old Stage Road said it is a hazard and his main concern is property values. Mr. Massengil said he is all for giving Mr. Johnson time to do what he needs to do but this has been going on for a while. Linda McDonald of 3340 Old Stage Road said she believes Mr. Johnson has had ample time to start cleaning it up. She said the property is and eye sore and it is not fair to the neighbors. April Johnson, daughter of the property owner, said the family had hardships over the past year but have made a lot of progress on the property. She said there are three generations of stuff in the house. Patsy Carson from Erwin, who said she visits the neighbors of the property often, said they take great pride in their home and property and this needs to be cleaned and cleared up as fast as possible. Lane Massengil of 3298 Old Stage Road in Erwin said they want this to be resolved as it is an eye sore and they take pride in their home and yard. She asked that Mr. Johnson be given a fair shot but that someone follow up regarding the disposal of the asbestos siding. Discussions continued. Mr. Baker responded that you must allow a property owner 60 days to demolish a home. He said Mr. Johnson did obtain a demolition permit on May 24, 2017, however repeated inspections have not yielded that the actual demolition of the structure has commenced. Mr. Baker also reported that there are special techniques to properly remove and dispose of asbestos and the State would have to inspect the removal. He said the cost of $2100 for professional removal of the asbestos is included in the $7,050 low bid for the demolition and removal of debris and materials of this structure. Seeing no one else move, Chairman Springle closed the public hearing. Commissioner McKoy moved to adopt the Ordinance Authorizing Demolition of 3254 Old Stage Road (Single Family Residence) and Imposition of Lien to Recover County Costs but to allow the Johnsons 30 days from today's date to remove their belongs from the property before proceeding with demolition. Commissioner Elmore seconded the motion, which passed unanimously. The Board discussed their upcoming meeting schedule and will consider cancelling their November 20, 201 7 regular meeting. There was no new business. Commissioner McKoy moved that the Board go into closed session for the following purposes: (1) To consult with the County's legal staff in order to preserve the attorney-client privilege concerning the handling of certain claims and litigation including the following cases: a. Anderson Creek Partners, et als. vs. County of Harnett Harnett County Superior Court File No. 17 CVS 363; and b. P .F . Development Group, LLC vs. County of Harnett Harnett County Superior Court File No. 17 CVS 1361 This motion is made pursuant to N.C. General Statute Section 143-318.1 l(a)(3). The future Phase JV landfill unit is located within the previously approved landfill facility boundary (approximate 223 acre tract owned by the County) as shown the attached Figure 1. Please submit additional clarification on number of proposed units that will be assisted with grant funds. The application indicates potentially 30 units, but lacks specificity if units will also be rehabilitated. 2. Flood Insurance: Property owners assisted through the recovery programs will be required to acquire and maintain flood insurance if located in a FEMA designated floodplain . North Carolina will follow HUD guidance to ensure all structures meet guidelines spell out in 44 CFR 59.1. A lien will be placed on all property improved with State funding for a period of no later than 5 years. As a condition for release of the lien, the owner will need to maintain flood insurance and property taxes. 3. Floodplain Condition : No funds may be obligated or expended on any project activity until the Lead Entity provides Emergency Management with a certification that the project area is not in a floodplain or with certification that the recipient participates in the flood insurance program. All properties assisted in the project will be covered for flood insurance prior to beginning construction on the property and will comply with applicable floodp lain regulations . Counties may opt to provide flood insurance at the time of application for a period not to exceed two years . Thereafter, all properties assisted with state and federal funds must maintain insurance coverage. 4 . The State's Division of Emergency Management has procured Construction Managers at Risk (CM R's) and will administer in coordination with county staff, all construction related projects including housing rehabilitation and reconstruction . The CM R's will take the lead for developing rehabilitation specifications, bid outreach, contract execution, and construction management. The State may consider permitting the County to oversee the construction process upon written approval from the State which will be based on subm ittal of qualified housing rehabilitation construction managers. 5 . Please document potential agreement with Town of Erwin. The County will need to document sub-grantee agreement between Harnett County and the Town of Erwin. All grant agreements and conditions from the State must be incorporated into such an inter-local agreement. 6. Proposed engineering estimate was provided in 2015 . This was voted on and passed unanimously by our Board on March 16, 2017. In addition, the Board would like to establish the position of Natural Resource Conservationist that will be responsible for providing technical assi stance in planning, engineering design and implementation of natural resources best management practices for clients. To educate and advocate on behalf of Hamett County's women and youth . To acknowledge and honor women and their role as vital contributors to Hamett County. As well as working to nurture Harnett County's youth as a way to prepare them for their future. To collaborate with groups and individu als in volved in activities on the status of women and youth . To provide information to the Hamett County Board of Commissioners on the needs and the issues important to Hamett County's women and youth. To seek support from the Hamett County Board of Commissioners for program funding and the passage of ordinances relating to the needs of women and youth . ARTICLE Ill-MEMBERSHIP Section 1. The HCCWY will consist of no more than 13 citizens appointed by the Hamett County Board of Commissioners. a. One member shall be appointed from each of the five Commissioners' Districts, and be a resident of that district. These members shall be appointed for three-year terms. b . Up to eight members shall be appointed from Harnett County "at large." These members m ay live or work in Harnett County and shall likewise be appointed for three-year terms. Section 2. Any member wishing to resign from the HCCWY shall do so by submitting a letter to the Harnett County Board of Commissioners . The resigning member shall supply a copy of the resignation letter to the HCCWY Chair. If possible, the resigning member shall provide a 30 day notice to allow for the appointment of a replacement. If a member does not attend in a calendar year at least75°h of the scheduled meetings of HCCWY, she may be asked to resign by the Harnett County Board of Commissioners . Failure to attend at least75°h of such scheduled meetings in a calendar year shall constitute cause for removal by the Board if the individual refuses to resign. Such absences shall also be a consideration by the Hamett County Board of Commissioners in whether an individual may be re-appointed to a position . This provision does not apply to an absence due to illness or in jury of the member, an illness or injury to a member's immediate family, active military service, or the birth or adoption of the member's child for 90 days after the event. The chair of HCCWY shall make regular reports (at least one report every six months) to the clerk of the Hamett County Board of Commissioners of membership attendance . A member shall notify the Chair or officer prior to a scheduled HCCWY meeting, or no later than three days following the meeting of the reason for an absence. ARTICLE IV -OFFICERS The officers shall be Chair, Vice Chair, Secretary, and Treasurer . Secretary and Treasurer may be a combined office if no members will accept a nomination for either position. Members who have served on the HCCWY for at least one year sha ll be eligible for nomination as Chair. All other members shall be eligible for nomination to other offices, after completing six months as a member. Officers shall be nominated, elected and serve as follows: a. Any member may nominate any eligible committee member for officer positions. b . The Chair shall take nominations from the membership, each May. c. Officers shall be elected by a simple majority of votes cast by members present and voting at the June meeting. Members shall vote by a show of hands . d. Officers shall serve one-year terms which begin in July of the year of their election and end on the last day of June of the following year or until their successors are elected or appointed. Perform other duties needed to carry out the work of HCCWY. The Secretary shall : a. Distribute monthly agendas for scheduled HCCWY meetings on the Thursday prior to the meeting . Take the minutes of the HCCWY meetings, email copies of minutes from previous month's meetings, on the Thursday prior to the next month's scheduled meeting, and provide hard copies at monthly meeting. b. Oversee registration and distribution of materials at HCCWY events. c. Keep a record of member attendance. d. Tally and record the election votes. e. Advise members of mailings, activities, problems, or events pertaining to HCCWY. f . Perform other duties needed to carry out the work of HCCWY. The Treasurer shall: a. ARTICLE VI-MEETINGS HCCWY meetings shall be held monthly except when otherwise ordered by the Chair. The Chair may not call a meeting in addition to regularly scheduled meetings more than once a quarter unless the meeting is required to comply with a statutory deadline or a deadline established by the Board of Commissioners. Committee meetings shall be called by the Committee Chairs as needed. In accordance with the laws of the State of North Carolina, all HCCWY meetings shall be open to the public. A simple majority of member's present shall constitute a quorum . If a quorum does not convene within a half hour of the posted time, then the meeting shall not be held . To be effective, a HCCWY action must be adopted by an affirmative vote of the number of members necessary to provide a quorum . If only a quorum is present at a meeting, a HCCWY action is adopted by an affirmative vote of two-thirds of the quorum. The Chair has the same voting privilege as any other member. If a member has a conflict of interest with any item on the agenda, the member shall neither participate in the discussion nor vote on that agenda item . ARTICLE VII-EXECUTIVE COMMITTEE The HCCWY elected officers and previous term chair shall constitute the Executive Committee. A majority of the Executive Committee members shall constitute a quorum. The Executive Committee sha II hold at least two meetings during the year, a winter and a summer meeting. Special meetings may be called by the Chair or at the written request of two Executive Committee members. The Chair may invite to the meeting other members needing to be present to execute HCCWY business. The Executive Committee shall: a. ARTICLE VIII -COMMITTEES The Standing Committees shall be Program, Public Relations, Legislative, Communications, and Grants. The newly elected Chair shall appoint Standing Committee Chairs and members following the June election of officers, except when directed otherwise in the Bylaws. Each Committee shall make an annual report to the HCCWY. The Program Committee shall consist of at least three members. The Chair shall present at the September HCCWY meeting a proposal of projects and programs for the ensuing year. The Committee will coordinate and oversee these, unless otherwise directed by the HCCWY Chair. The Public Relations Committee shall consist of at least three members. It shall review the Directory, update it annually, and sha 11 carry out activities that promote and facilitate the work of the HCCWY. The Communications Committee shall consist of three members. It shall work closely with the HCCWY, Harnett County Board of Commissioners, Hamett County Department of Social Services, and other groups. It shall maintain contact with members as directed by the Chair and shall assist with maintaining the HCCWY website. The Legislative Committee shall consist of three members. It shall inform HCCWY offederal, state, and local legislation that may be important to women and youth, and shall recommend appropriate action to be taken by HCCWY. It shall consider partnering with non-partisan groups to develop opportunities to learn more about legislation that may be important to women, youth, and HCCWY. It shall review the HCCWY Bylaws annually and shall receive, consider, and initiate revisions and amendments. The Grant Committee shall consist of three members. It shall work to identify grant opportunities that align with the mission, strategic planning goals, and resource needs of the HCCWY. ARTICLE IX -PARLIAMENTARY AUTHORITY The rules in Robert's Rules of Order Newly Revised shall govern the HCCWY in all cases in which they are app licable and in which they are not inconsistent with these Bylaws and those of the Hamett County Board of Commissioners .
