WHEREAS , the Town of Angier, County of Harnett, Town of Dunn, Town of Erwin, Town of Lillington, Hamett County, Mid-Carolina Rural Planning Organization, and Transportation Planning Branch of the North Carolina Department of Transportation have actively worked to develop a transportation plan for Harnett County; and WHEREAS, the County of Hamett and the Department of Transportation are directed by North Carolina General Statutes 136-66.2 to reach agreement for a transportation system that will serve present and anticipated volumes of traffic in and around town; and WHEREAS, it is recognized that the proper movement of traffic within and through the County of Hamett is a highly desirable element of the comprehensive plan for orderly growth and development of the town; and WHEREAS , after full study of the plan and the supporting documents presented, the Board of Commissioner of the County of Hamett feels it to be in the best interests of the County of Hamett to adopt a plan pursuant to NCGS 136-66.2; NOW THEREFORE BE IT RESOLVED that the Board of Commissioners of the County of Harnett hereby adopts the portion of the Harnett County Comprehensive Transportation Plan that is within its planning jurisdiction and endorses the remainder of the plan. This plan should serve as a guide in the development of the transportation system in Harnett County and the same is hereby recommended to the North Carolina Department of Transportation for its subsequent adoption. Improvements are needed to accommodate projected traffic volumes such that a minimum of Level of Service (LOS) D can be achieved. Justification of Need NC 55 is a major north-south corridor through Eastern Harnett County, connecting Dunn , Erwin, Coats and Angier with US 401 in Wake County to the north and Interstate 95 to the south . The connection with these major statewide routes makes NC 55 an important reg i onal connector for Harnett County . NC 55 is part of the regional tier of the NC Multimodal Investment Network (NCMIN). Regional tier facilities are similar to statewide 013117wsa HC BOC Page 4 facilities in that they serve long di stance trips and connect regional centers but they would also provide more accessibility and local access . NC 55 from Lisa Street/ Park Street to 0.1 mile south of Crawford Road (SR 2006) is currently a three lane facility with 12 foot lanes and center turn lane . By 2035 the facil ity is projected to be near capacity based on providing a LOS D. The Annual Average Daily Traffic (AADT) on NC 55 is projected to increase in range from 7,500 to 8,500 vehicles per day (vpd) in 2014 to a range of 10,400 to 11,000 vpd in 2035, compared to a LOS D capacity of 12,700 vpd. Community Vision and Problem History NC 55 connects downtown Coats with the towns in eastern Harnett County and Wake County to the north. As the main road passing through the town of Coats NC 55 has a significant economic value. Improving the capacity of this route will result in a better LOS for the mixed local and regional traffic stopping in and passing through downtown Coats. The 2011 Hamett County CTP identified NC 55 (R-2540) throughout Harnett County as a boulevard that needs improvement. 2011 Harnett County CTP was not adopted by town of Coats. In 2016 town of Coats requested NCDOT and Mid-Carolina RPO to analyze the NC 55 one-way pair scenario . CTP Project Proposal Project Description and Overview The 2011 Harnett County CTP recommendation R-2540 was to convert the existing three- lane major thoroughfare into a four-lane divided boulevard facility. The proposed amendment to the 2011 Harnett County CTP recommendation R-2540 is to convert NC 55 to a one way pair with Railroad Street. The project proposal (HARN0057-H) is to Improve NC 55 and Railroad Street to two-lane, one-way facilities from Crawford Road (SR 2006) to Lisa Street/ East Park Street. NC 55 is an existing other major thoroughfare through Coats . The project proposal is to create a "one-way pair" through downtown Coats with the objective of improving mobility on NC-55 while maintaining access to downtown businesses. Sidewalks and a multi-use path are also recommended along this facility . A crash assessment performed during the development of the CTP amendment identified 10 to 19 crashes between January 1, 2011 and December 31, 2015 at the intersection of NC 27 and NC 55 . The proposed improvements may reduce the number of crashes at this location. Relationship to Land Use Plans This section of NC 55 provides access to the heart of the town of Coats . The area surrounding NC 55 includes many different zoning classes such as Residential , Ne ighborhood Commercial , Central Business and even a small Industrial zone . This 013117wsa HC BOC Page 5 corresponds with many access points such as driveways and cross-streets throughout the corr idor. The Harnett County Land Use Plan (2008) classifies this portion of the NC 55 corridor as a Municipal Growth Area . Natural & Human Environmental Context Based on a planning level environmental assessment using available GIS data, the proposed project borders a watershed area. Multi-modal Considerations There are recommendations for a sidewalk and a multi-use path along this section of NC 55. There is also a proposed fixed route transit service along NC 55 through the town of Coats connecting Angier, Dunn , Erwin , Lillington , Coats, and Campbell University. Public/ Stakeholder Involvement Improvements to NC 55 were identified in a stakeholder survey of county and town offici als. Officials from the town of Coats worked with NCDOT and Mid-Carolina RPO in developing the "one-way pair" recommendation. 013117wsa HC BOC Page 6 Angier Bypass {NC 55} HARN0058-H: The Capital Area Metropolitan Planning Organization (CAMPO) Metropolitan Transportation Plan (MTP) October 2015 Amendment recommends a bypass around the town of Angier between the existing alignment of US 401 and NC 55 (CAMPO MTP Project ID A632a, A632b and A632c). Officials from the town of Angier met with CAMPO in September 2016 and proposed to update the alignment of the southern portion of the loop. The updated project proposal follows Tippet Road (SR 1507) before crossing NC 55 and Black River and meeting NC 210 to the east of Angier. There is a recommendation for a bicycle facility along proposed project. Highland School Road, Local ID: HARN0059H Access to Highland Elementary School and Highland Middle School is currently provided by Buffalo Lake Road (SR 1115). Fayetteville Are Metropolitan Planning Organization (FAMPO) submitted Highland School Road project under division needs catagory for SPOT 4.0. The project proposal is to construct a two-lane minor thoroughfare with 12 foot lanes from Buffalo Lake Road (SR 1115) to Tingen Road to the south of the school campus. This new facility will provide students and parents alternate access to the school campus. There is a recommendation for a sidewalk along the entire length of the proposed project. The proposed project is near national wetland areas and is zoned for compact mixed use in the Harnett County Land Use Plan (2008). Capital Area Metropolitan Planning Organization {CAMPO) Projects: CAMPO is the regional planning body for the Raleigh Metropolitan Area and includes northern Hamett County and the town of Angier. This amendment includes the projects proposed in the 2012 Southwest Area Study1 (SWAS) and 2040 MTP2 update. For more information about these projects please contact CAMPO. Fayetteville Area Metropolitan Planning Organization (FAMPO) Projects: FAMPO is the regional planning body for the Fayetteville Metropolitan Area and includes southern Harnett County. This amendment includes the projects proposed in 2040 MTP3 . For more information about these projects please contact FAMPO. Minor Widening Improvements The following routes were identified as candidates for upgrading to NCDOT design standards. Potential locations for park-and-ride lots were identified in Angier, Dunn , Erwin, Lillington , Coats and Campbell University (Buies Creek). We started that with the move of our office to our new location at 817 S gth Street in Lillington. This facility gives us more office space, conference room and a computer area where we can assist Veterans with access to new Department of Veterans Affairs Online application programs. In addition, we are able to display a replica of the USS Harnett County for Veterans to view and enjoy. We also have been an integral part of starting the 1st Veterans Treatment Court in North Carolina and we support the court weekly. To continue towards our goal of making Harnett County one of the most "Veteran Friendly" county in North Carolina we need to increase outreach to ensure all our Veterans are fully aware of benefits that they may be eligible for from the Department of Veterans Affairs, North Carolina, and Harnett County. The Department of Veterans Affairs has moved toward a totally "paperless" claim system. Much of this is done online which expedites the claims process. We must ensure Harnett County Veterans are aware of this process and how to access it. Many of our Veterans are elderly and unable to navigate their way through this process. They need our assistance. In order to increase outreach, I am requesting a new Veterans Services Specialist position to meet this need. This is currently a pay grade 64. Mid-point of the salary range is $39,305. I would like to have a satellite location in the western part of Harnett County and in the Dunn/Erwin area. The new position would allow me to have a Veterans Services Specialist in these areas one day a week. We are also receiving requests from nursing homes to visit and assist the Veterans and Widows in their facilities. In addition I want to plan outreach events in Harnett County that brings in Department of Veterans Affairs personnel that can rate their claims on the spot and ensure they are enrolled in the Department of Veterans Affairs healthcare system. I am attaching copies of the Department of Veterans Affairs Geographic Distribution of VA Expenditures (GDX) reports for FY 13, 14, 15 and the projected population for Harnett County for 2013-2043. These reports reflected the continued growth of the Veterans population in Harnett County into the future. The GDX reports show the $$ that Veterans and Widows are receiving annually in Harnett County. FY 13-13,787 Veterans received $82,662,000 FY 14-14,034 Veterans received $99,804,000 FY 15-14, 279 Veterans received $107,592,000 The above numbers show a steady increase in our Veterans population and SS received by these Veterans. This is in large part due to the efforts of Harnett County Veterans Services staff. NOW THEREFORE, be it resolved by the Harnett County Board of Commissioners as follows: 1. It is declared to be the intent of the Harnett County Board of Commissioners to approve the "Township Boundary Map," attached hereto as Exhibit A, which contains the new township boundaries, and the "Boundary Guidelines," which shall be used for any future township boundary modifications. The Boundary Guidelines require township boundaries to follow land parcel lines, road centerlines or natural boundaries such as creeks or rivers. In situations in which land parcels are combined within the county boundaries, the larger land parcel, according to acres, will determine the newly combined land parcel township boundary. Land parcels that are annexed by a municipality shall maintain their current township boundary unless a written township boundary change request letter is submitted by the municipality. 2. A public hearing on the proposed township boundaries and guidelines shall be conducted by the Harnett County Board of Commissioners at 7:00 p.m . on the 20th day of February, 2017, at which time said Board shall hear all interested persons who appear with respect to whether the adoption of the new township boundaries and guidelines would be detrimental to the public interest or to any individual property rights. Applicability of Rules. These rules apply to all meetings of the Board of Commissioners of Harnett County at which the Board is empowered to exercise any of the executive, quasi-judicial, administrative, or legislative powers conferred on it by law. II. OPEN MEETINGS Rule 2. Meetings to be Open. The public policy of North Carolina and of Harnett County is that the hearings, deliberations, and actions of this Board and i·ts committees be conducted openly. Rule 3. Closed Sessions. (a) It is the policy of Harnett County that closed sessions shall be held only when required to permit the Board of Commissioners to act in the public interest as permitted in this section. The list includes: 1. To prevent the disclosure of information that is privileged or confidential pursuant to the law ofthis state or of the United States, or not considered a public record within the meaning of Chapter 132 of the General Statutes (The Public Records Law). 2. To prevent the premature disclosure of an honorary degree, scholarship, prize, or similar award. 3. To consult with an attorney employed or retained by the Board in order to preserve the attorney-client privilege between the attorney and the Board, which privilege is hereby acknowledged. This subdivision prohibits discussion of "general policy matters" in closed session and declares that it shall not be construed to permit a public body to close a meeting that otherwise would be open merely because an attorney employed or retained by the Board is a participant. The subdivision permits the Board to consider and give instructions to an attorney concerning the handling or settlement of a claim, judicial action, or administrative procedure, with terms of any settlement to be made public within a reasonable time. 4. To discuss matters relating to the location or expansion of industries or other businesses in the area served by the Board. 5. This subdivision prohibits discussion of "general personnel policy issues" or considerations of the qualifications, competence, performance, character, fitness , appointment, or removal of a member of the Board or another body or consideration of ( or filling of) a vacancy among its own membership in closed session. 7. To plan, conduct, or hear reports concerning investigations of alleged criminal misconduct. The Board may go into closed session only upon motion made and adopted at an open meeting. The motion shall state the permitted purpose of the closed session and if the closed session is to consult with an attorney in order to preserve the attorney-client privilege, the motion must identify the parties in each existing lawsuit which the Board expects to receive advice during the closed session. The motion must be approved by a majority of those Board members present and voting. Minutes shall be kept of all closed sessions of the Board, but may be withheld from public inspection so long as public inspection would frustrate the purpose of the closed A~ tt> ~ ~~~ J -t .. 'l5 session. The County Manager, Assistant County Manager, Finance Officer, and the County Attorney shall attend the closed sess ion, unless e xpressly ex cluded in the motion. Other persons shall not attend the closed session unless expressly included in the motion or otherwise called i nto the session. III. ORGANIZATION OF THE BOARD Organizational Meeting. On the first Monday of December following a general election in which County officers are elected, the Board shall meet at the regular meeting time and place. The order of business s hall be: (a) The Board shall approve the minutes of its prior meeting and other items of business. (b) The newly elected members of the Board shall take and subscribe the oath of office. (c) With the Clerk to the Board presiding, the Board shall elect a Chairman and a Vice Chairman from its members. Pag e 2 o f 12 013117wsa HC BOC Page 49 Rule 5. Election of Chairman. The Chairman and Vice Chairman of the Board shall be elected annually for a term of one year and shall not be removed from the office of Chairman or Vice Chairman unless he/she becomes disqualified to serve as a Board member. IV. REGULAR AND SPECIAL MEETINGS Rule 6. Regular and Special Meetings. (a) Regular Meetings: The Board shall hold regular meetings as follows: First Monday of each Month at 9 a.m. Third Monday of each Month at 7 p.m. If a regular meeting day is a holiday on which county offices are closed, the meeting shall be held on the next business day or such succeeding day as may be specified in the motion adjourning the immediately preceding regular meeting. Regular meetings are held in the County Administration Building. The Board may change or cancel the place or time of a particular regular meeting or of all regular meetings within a specified period by resolution adopted, posted, and noticed at least seven days before the change takes effect. Such a resolution shall be filed with the Clerk to the Board and posted at or near the regular meeting place, and copies shall be sent to all persons who have requested notice of special meetings of the Board. (b) Special Meetings. The Chairman or a majority of board members may at any time call a special meeting of the Board by signing a notice stating the time and place of the meeting and the subjects to be considered. The Clerk shall cause the notice to be posted on the bulletin board in the courthouse, on the door of the meeting room, and delivered to the Chairman and all other Board members or left at the dwelling place of each Board member at least 48 hours before the meeting. In addition, the notice shall be mailed or delivered to individual persons and news organizations that have requested such notice as provided in subsection (e) below. Only items of business specified in the notice may be transacted at a special meeting. ( c) Emergency Meetings. The Chairman or a majority of members may call an emergency meeting to deal with an unexpected circumstance requiring immediate consideration. The person or persons calling the emergency meeting shall cause notice of the meeting to be given to the other Board members and the public. Local news organizations, having requested notice of special meetings as provided in subsection (e), below, shall be notified of such emergency meetings by the same method used to notify Board members. Only business connected with the emergency may be discussed at the meeting. (d) Work Sessions, Retreats, and Committee Meetings. The Board may schedule work sessions, retreats , forums , conventions, association , and committee meetings, or other information meetings of the Board or of a majority of its members at such times and Page 3 of 12 013117wsa HC BOC Page 50 concerning such subjects as may be established by resolution or order of the Board. A schedule of such meetings held regularly shall be filed in the same place and manner as the schedule of regular meetings. Work sessions and other informal official meetings not held regularly are subject to the same notice requirements as special Board meetings. (e) Sunshine List. Any individual and/or newspaper, radio station, and television Station desiring notice of all special meetings of the Board shall file a written request with the Clerk to the Board of Commissioners. Rule 7. All Meetings Within the County. (a) All meetings shall be held within the boundaries of Harnett County, except as otherwise provided by statute or herein. (b) A joint meeting with the Governing Board of any other political subdivision of this or any other state may be held within the boundaries of either subdivision as may be specified in the call of the meeting. At any such joint meeting, this Board reserves the right to vote separately on all matters coming before the joint meeting. ( c) A special meeting between the Board of Commissioners and its local legislative delegation during a session of the General Assembly; provided, however, that at any such meeting, the members of the Board of Commissioners may not vote upon or otherwise transact public business except with regard to matters directly relating to legislation proposed to or pending before the General Assembly. ( d) A special meeting called in connection with a retreat, forum, or similar gathering may be held solely for the purpose of providing members of the Board with general information relating to the performance of their public duties; provided, however, that the members of the Board shall not vote upon nor otherwise transact public business while in attendance at such a gathering. ( e) While in attendance at a convention, association meeting, or similar gathering, a special meeting may be held; provided, however, that any such meeting may be held solely to discuss or deliberate on the Board's position concerning similar issues that are not legally binding upon the Board of Commissioners or its constituents. Rule 8. Broadcasting and Recording of Meetings (a) Except as provided in this rule, any radio or television station may broadcast all or any part of an official Board meeting required to be open to the public. Any person may photograph, film, tape -record, or otherwise reproduce any part of a meeting required to be open. (b) Any radio or television station wishing to broadcast any portion of any portion of an official Board meeting shall so notify the County Manager no later than two business days before the meeting. If the number of requests or the quantity and size of the Page 4 of 12 013117wsa HC BOC Page 51 necessary equipment is such that the meeting cannot be accommodated in the designated meeting room and no suitable alternative site is available, the County Manager may require the news media to either pool equipment and personnel or to secure and pay the costs of an alternative meeting site mutually agreeable to the Board and the media representative. V . AGENDA Rule 9. Agenda (a) (b) (c) (d) (e) The County Manager shall prepare the agenda for each regular, special, and emergency meeting. A request to have an item of business placed on the agenda for a regular meeting must be received by Monday noon of the week preceding the regular meeting day. Any Board member may, by a timely request, have an item placed on the agenda. A request to place an item on the agenda from other than a Board member shall be at the discretion of the County Manager and Chairman of the Board. The agenda packet shall include the agenda document, any proposed ordinances or amendments to ordinances, and supporting documentation and background information relevant to items on the agenda. A copy of the agenda packet shall be available to each Board member not later than Wednesday of the week preceding the regular meeting day. The Board may, by unanimous vote of the members present, add or delete an agenda item. The agenda shall be published in a newspaper of general eireulation prior to the day of the seheduled regular meeting. Deleted by resolution 9-19-11 The County Manager may propose a consent agenda as part of the main agenda. The consent agenda shall contain those routine items of business that do not normally invol ve debate. The Board may approve all items on the consent agenda by adopting one ( 1) motion. The Board may transfer an item from the consent agenda to the main agenda upon a majority vote of the members present and voting. A motion to transfer should normally be made at the beginning of the meeting. The consent agenda may include, but is not limited to, the following routine items of business : I . Approval of minutes from the prior meeting. 2 . Budget amendments/revisions. 3. Disposition of surplus personal property to other governmental agencies. 4 . Granting to North Carolina Department of Transportation road right-of- way easements on County property. 5. Resolution s of appreci ation, support, and recognition. 6. Resolutions requesting road additions to the state highway secondary road system. 7. Tax releases , tax refunds. Pag e 5 of 12 013117wsa HC BOC Page 52 VI. CONDUCT OF DEBATE Rule 10. Powers of the Chairman. The Chairman shall preside at all Board meetings. In the absence of the Chairman, the Vice Chairman shall preside at Board meetings. If the Vice Chairman is absent, members present may appoint someone to Chair the meetings. To address the Board, a member must be recognized by the Chairman. The Chairman shall have the following powers: (a) To rule on points of parliamentary procedure, including the right to rule out of order any motion offered for patently obstructive or dilatory purposes; (b) To determine whether a speaker has gone beyond reasonable standards of courtesy in his or her remarks and to entertain and rule on objections from other members on this ground; (c) To call a brief recess at any time; (d) To adjourn in an emergency. Rule 11. Action by the Board. The Board shall proceed by motion. Any member, including the Chairman, may make a motion. Rule 12. Second Required. A motion shall require a second. A motion shall be ruled dead by the Chairman if a second is not received within a reasonable period of time. Rule 13 . One Motion at a Time. A member may make only one motion at a time. Rule 14. Substantive Motion. A substantive motion is out of order while another substantive motion dealing with another subject matter is pending. Rule 15. Substitute Motion. A substitute motion (an amendment) dealing with the same subject matter as the original substitute motion is in order and shall be acted upon prior to action on the original motion . Page 6 of 12 013117wsa HC BOC Page 53 Rule 16. Debate. The Chairman shall state the motion and then open the floor to debate. Rule 17. Adoption by Majority Vote. A motion shall be adopted if approved by a majority of the votes cast, unless otherwise required by these rules or North Carolina laws. Rule 18. Procedural Motions. (a) In addition to substantive proposals, the procedural motions listed in subsection (b) of this rule, and no others shall be in order. Unless otherwise noted, each motion is debatable, may be amended, and requires a majority vote for adoption. (b) In order of priority, the procedural motions are: • To adjourn. The motion may be made only at the conclusion of action on a pending matter; it may not interrupt deliberation of a pending matter. • To Recess. • To Call to Follow the Agenda. The motion must be made at the first reasonable opportunity or it is waived. • To Suspend the Rules, the motion requires a two-thirds (2/3) vote of the members present. • To Divide a Complex Motion and Consider it by Paragraph. • To Defer Consideration. A substantive motion whose consideration has been deferred expires unless a motion to revive consideration is adopted within one hundred ( I 00) days after deferral. • To Postpone to a Certain Time or Day. • To Refer to Committee. Sixty (60) days after a motion has been referred to committee, the introducer may compel consideration of the measure by the entire Board, regardless of whether the committee has reported the matter back to the Board. • To amend. An amendment to a motion must be germane to the subject of the main motion, but it may not achieve the opposite effect of the main motion. There may be only one amendment to the motion. A motion to amend shall require a second. Any amendment to a proposed ordinance shall be reduced to writing. • To Revive Consideration. The motion is in order at any time within one hundred (I 00) days of a vote deferring consideration. • To Prevent Reconsideration for Six Months. The motion shall be in order only immediately following the defeat of a substantive motion. It requires a vote equal to a quorum and is valid for six (6) months or until the next regular election of County Commissioners, whichever occurs first. Page 7 of 12 013117wsa HC BOC Page 54 Rule 19. Renewal of Motion. A defeated motion may not be renewed at the same meeting. Rule 20. Withdrawal of Motion. A motion may be withdrawn by the introducer any time before the Chairman puts the motion to a vote. Rule 21. Duty to Vote. (a) It is the duty of each member to vote unless excused by a majority vote according to law. The Board may excuse members from voting on matters involving their own financial interest or official conduct. A member wishing to be excused from voting shall so inform the Chairman, who shall take a vote of the remaining members. A member who fails to vote, not having been excused, shall be recorded as voting in the affirmative. (b) Tie Vote. The effect of a tie vote is that the motion did not carry. Rule 22. Prohibition of Secret Voting. No vote may be taken by secret ballot. The Clerk shall record the vote of each member in the minutes. Rule 23. Action by Reference. The Board shall not deliberate, vote, or otherwise act on any matter by reference to an agenda, or document number unless copies of the agenda or documents being referenced are available for public inspection at the meeting and are so worded that people at the meeting can understand what is being discussed or acted on. Rule 24. Introduction of Ordinances, Resolutions, and Orders. A proposed ordinance shall be deemed introduced at the first meeting where it is on the agenda, regardless of whether it is actually considered by the Board, and its introduction shall be recorded in the minutes. Rule 25. Adoption, Amendment, or Repeal of Ordinances. To be adopted at the meeting where it is first introduced, an ordinance or an action with the effect of an ordinance, or any ordinance amending or repealing an existing ordinance ( except the budget ordinance, a bond order or another ordinance requiring a public hearing before adoption) must be approved by all members of the Board of Commissioners. If the proposed measure is approved by a majority, but not by all the members of the Board, or if the measure is not voted on at that meeting, it shall be considered at the next regular meeting of the board. If it then or at Page 8 of 12 013117wsa HC BOC Page 55 any time thereafter within one hundred (100) days of its introduction receives a majority of the votes cast, the measure is adopted. Rule 26. Quorum. A majority of the Board membership shall constitute a quorum. The number required for a quorum is not affected by vacancies. If a member has withdrawn from a meeting without being excused by majority vote of the remaining members, he/she shall be counted as present for the purposes of determining whether a quorum is present. The Board may compel the attendance of an absent member by ordering the Sheriff to take the member into custody. Rule 27. Public Hearing Time Limits. (a) The time limits for speakers at zoning public hearings shall be ten (10) minutes for the proponent and ten (10) minutes for the opponent; the time may be apportioned among speakers for that side. The time limits for speakers at other public hearings shall be three (3) minutes per speaker. (b) The Board of Commissioners reserves the right to limit the length of public hearings. After the Chairman announces the close of a public hearing, no member of the public may address the issue to the board. ( c) Persons desiring to speak at a public hearing must register with the Clerk to the Board prior to the commencement of the meeting. Rule 28. Quorum at Public Hearings. A quorum of the Board must be present at all public hearings required by law. Rule 29. Minutes. Minutes shall be kept of all Board meetings. Rule 30. Appointments. The Board shall fill County Commissioner vacancies in accordance with G. S. 153A-27. The Board shall fill a Register of Deeds vacancy in accordance with G . S. 161-5 and a Sheriff vacancy in accordance with G.S. 162-5. The Board shall use the following procedure to make appointments to fill vacancies in other Boards, Commissions, and Committees over which the Board has power of appointment. (a) Any U.S. citizen who is a resident of Harnett County is eligible to serve on appointed Boards/Commissions/Committees of the County where such appointment is not prohibited by state statute. ( c) All appointments will be made in accordance to the Statute or Ordinance that created the Board/Commission/Committee. (d) No citizen may serve more than two appointed positions simultaneously. (e) No eiti:z:en may serve more than three conseeutive terms on any Board/Committee/Commission unless the term is 3 years or under. No member of any Board/Committee/Commission may serve more than nine eonseeutiYe years. The following amendment was unanimously adopted on May 2, 2016: (e) No citizen may serve more than three consecutive terms on any Board/Committee/Commission unless the term is less than three (3) years. No member of any Board/Committee/Commission may serve more than nine (9) consecutive years, unless waived by the Board of Commissioners by a majority vote. Any waiver issued by the Board for a consecutive term over nine (9) consecutive years for an individual is limited to two (2) waivers. Any individual may be reappointed to the same Board/Committee/Commission after remaining off said Board/Committee/Commission for at least one year. (f) If a person i s appointed to fill someone's unexpired term and serves less than half of a full term, he/she is eligible to serve three full terms. (g) If an appointee has unexcused absences which constitute more than 25% of the Board meetings in any calendar year which he or she is required to attend pursuant to his or her appointment, he or she is obligated to resign. Excused absences are defined as absences caused by events beyond one's control. If the individual refuses to resign, he or she may be dismissed by action of the Board of County Commissioners subject to state or local law. A calendar year is to be defined as a 12-month period beginning on the date of appointment. (h) Each County Commissioner will have availabl e to him or her a binder containing a list of all county appointments, with the following data provided: • Name of the board, commission, committee, or authority • Brief on the functions • Statute or cause creating board, commission, committee or authority • Number of members and terms of office • Current members and terms of office, including number of terms serviced • Regular meeting day, time, and location, if determined Page 10 of 12 013117wsa HC BOC Page 57 (i) Procedures for filling vacancies for appointed positions: 1. Notification of available appointments A. A list of available positions stating terms of office, requirements for office, and duties of positions will be published in the newspapers of Harnett County thirty (30) days prior to the month of appointments being made. This procedure will be carried out by the Clerk to the Board of County Commissioners. B. Thirty (30) days prior to the terms expiring, the Clerk to the Board will mail a notice to each person who is eligible for reappointment requesting information on his or her interest in continuing to serve. If an application is not on file, one will be requested at this time. If an individual is not eligible for reappointment, he or she will be notified and given reason for being ineligible . C . If, because of policy or otherwise, an individual is unable to be reappointed, he or she will be sent a letter of appreciation by the Chairman of the Board of Commissioners at the expiration of his or her term thanking him or her for the past services rendered. 2. Selection Process 3. A. Six (6) days prior to the date a vacancy occurs, all applications for a particular position will be given to the County Manager. The Manager will check each for eligibility. B. A list of all names submitted will be sent to all Commissioners with those who are ineligible noted and the reasons for ineligibility given. C. T he Clerk to the Board shall be given a copy of the information to be placed on the agenda as the "Appointments" for action at the next meeting of the County Board of Commissioners. Notification of Appointment A. The County Manager shall prepare a letter of notification to the appointee and a copy of the affected board, notifying each of the appointment. This letter will include a congratulation statement, the time, date, and place of the first meeting he or she is to be sworn in, if this is required. B. The County Manager shall require the appointee to certify that he or she has read and understands Rule 30. The County Manager shall mail a self-addressed, stamped envelope for the convenience of the appointee in returning the signed affirmation of understanding. Applications All applications received shall be retained for at least two (2) years. Applications shall be kept on file for all active appointees. All the above data shall be maintained as confidential for County Board of Commissioners' use only. Changes to Rules of Procedure. The Board may change these rules of procedure upon a vote by two-thirds (2 /3) of the members of the Board. Changes shall be effective at the next regular meeting. Each official must find within his or her own conscience the touchstone by which to determine what conduct is appropriate. CODE OF ETHICS The purpose of this Code of Ethics is to establish guidelines for ethical standards of conduct for the Hamett County Board of Commissioners and to help determine what conduct is appropriate in particular cases. It should not be considered to be a substitute for the law or for a board member's best judgment. Section 1. Board members should take care to obey all laws applicable to their official actions as members of the board. Board members should be guided by the spirit as well as the letter of the law in whatever they do. At the same time, board members should feel free to assert policy positions and opinions without fear of reprisal from fellow board members or citizens. To assert that a board member is behaving unethically because one disagrees with that board member on a question of policy (and not because of the board member's behavior) is unfair, dishonest, irresponsible, and itself unethical. The board shall endeavor to keep up to date , through the board's attorney and other sources , about new or ongoing legal or ethical issues they may face in their official positions. Section 2. Board members should act with integrity and independence from improper influence as they exercise the duties of their office. Board members should use their best independent judgment to pursue the common good as they see it, presenting their opinions to all in a reasonable, forthright, consistent manner. They should be self-governing and not subject to improper influence, while at the same time being able to consider the opinions and ideas of others. At the same time, however, board members should recognize that they are part of a larger group and should act accordingly. They should respect their office and not behave in ways that reflect badly on it. They should treat other board members and the public with respect, and should honor the opinions of others even when they disagree. They should recognize that they are not generally authorized to act on behalf of the board , since the board must take official action as a body. Board members should avoid impropriety in the exercise of their official duties. Their official actions should be above reproach. Although opinions may vary about what behavior is inappropriate, this board considers impropriety in terms of whether a reasonable person who is aware of all the relevant facts and circumstances surrounding the board member's action would conclude the action was inappropriate. If a board member believes that his or her actions, while legal and ethical, may be misunderstood, the board member may seek the advice of the board 's attorney and may state on the record the facts of the situation and the steps taken to resolve it. Section 4. Board members should faithfully perform the duties of their offices. They should act as especially responsible citizens whom others can trust and respect. They should set a good example for others in the community, keeping in mind that trust and respect must continually be earned. Board members should faithfully attend and prepare for meetings. They should carefully analyze all credible information properly submitted to them. They should demand full accountability from those over whom the board has authority. Board members should be willing to bear their fair share of the board's workload . To the extent appropriate , they should be willing to put the board 's interests ahead of their own. Section 5. Board members should conduct the affairs of the board in an open and public manner. They should comply with all applicable laws governing open meetings and public records , recognizing that doing so is an important way to be worthy of the public's trust. They should remember when they meet that they are conducting the public 's business. They should also remember that local government records belong to the public and not the board members or their employees. In order to maintain strict compliance with the laws concerning openness, board members should make clear that an environment of transparency and candor is to be maintained at all times in their governmental unit. They should prohibit unjustified delay in fulfilling public records requests. They should take deliberate steps to make certain that any closed sessions held by the board are lawfully conducted and that such sessions do not stray from the purposes for which they are called. GENERAL PRINCIPLES UNDERLYING THE CODE OF ETHICS • The stability and proper operation of democratic representative government depend upon public confidence in the integrity of the government and upon responsible exercise of the trust conferred by the people upon their elected officials. • Governmental decisions and policy must be made and implemented through proper channels and processes of governmental structure. • Board members must be able to act in a manner that maintains their integrity and independence, yet is responsive to the interests and needs of those they represent. • Board members must always remain aware that at various times they play different roles: o As advocates , who strive to advance the legitimate needs of their citi zens o As legislators, who balance the public interest and private rights in considering and enacting ordinances, orders , and resolutions Code of E thi cs for the Harnett C ounty Board of Commission ers of the County of Ha m ett Page I 013117wsa HC BOC Page 64 o As decision-makers , who arrive at fair and impartial quasi-judicial and administrative determinations. • Board members must know how to distinguish among these roles, to determine when each role is appropriate, and to act accordingly. • Board members must be aware of their obligation to confirm their behavior to standards of ethical conduct that warrant the trust of their constituents. Each official must find within his or her own conscience the touchstone by which to determine what conduct is appropriate. CODE OF ETHICS The purpose of this Code of Ethics is to establish guidelines for ethical standards of conduct for the Hamett County Board of Commissioners and to help determine what conduct is appropriate in particular cases. It should not be considered to be a substitute for the law or for a board member's best judgment. Section 1. Board members should take care to obey all laws applicable to their official actions as members of the board . Board members should be guided by the spirit as well as the letter of the law in whatever they do. At the same time, board members should feel free to assert policy positions and opinions without fear of reprisal from fellow board members or citizens. To assert that a board member is behaving unethically because one disagrees with that board member on a question of policy (and not because of the board member's behavior) is unfair, dishonest, irresponsible, and itself unethical. The board shall endeavor to keep up to date, through the board's attorney and other sources, about new or ongoing legal or ethical issues they may face in their official positions. Section 2. Board members should act with integrity and independence from improper influence as they exercise the duties of their office. Board members should use their best independent judgment to pursue the common good as they see it, presenting their opinions to all in a reasonable, forthright, consistent manner. They should be self-governing and not subject to improper influence, while at the same time being able to consider the opinions and ideas of others. At the same time, however, board members should recognize that they are part of a larger group and should act accordingly. They should respect their office and not behave in ways that reflect badly on it. They should treat other board members and the public with respect, and should honor the opinions of others even when they disagree. They should recognize that they are not generally authorized to act on behalf of the board, since the board must take official action as a body. Board members should avoid impropriety in the exercise of their official duties. Their official actions should be above reproach. Although opinions may vary about what behavior is inappropriate, this board considers impropriety in terms of whether a reasonable person who is aware of all the relevant facts and circumstances surrounding the board member 's action would conclude the action was inappropriate. If a board member believes that his or her actions, while legal and ethical, may be misunderstood , the board member may seek the advice of the board 's attorney and may state on the record the facts of the situation and the steps taken to resolve it. Section 4. Board members should faithfully perform the duties of their offices. They should act as especially responsible citizens whom others can trust and respect. They should set a good example for others in the community, keeping in mind that trust and respect must continually be earned. Board members should faithfully attend and prepare for meetings . They should carefully analyze all credible information properly submitted to them. They should demand full accountability from those over whom the board has authority. Board members should be willing to bear their fair share of the board's workload. To the extent appropriate , they should be willing to put the board 's interests ahead of their own. Section 5. Board members should conduct the affairs of the board in an open and public manner. They should comply with all applicable laws governing open meetings and public records, recognizing that doing so is an important way to be worthy of the public 's trust. They should remember when they meet that they are conducting the public's business. They should also remember that local government records belong to the public and not the board members or their employees . In order to maintain strict compliance with the laws concerning openness , board members should make clear that an environment of transparency and candor is to be maintained at all times in their governmental unit. They should prohibit unjustified delay in fulfilling public records requests . They should take deliberate steps to make certain that any closed sessions held by the board are lawfully conducted and that such sessions do not stray from the purposes for which they are called. A fiscal policy that is adopted, adhered to, and regularly reviewed is recognized as the cornerstone of sound financial management. Effective fiscal policy: • Contributes to the County's ability to insulate itself from fiscal crisis, • Enhances short term and long term financial credit ability by helping to achieve the highest credit and bond ratings possible, • Promotes long-term financial stability by establishing clear and consistent guidelines, • Directs attention to the total financial picture of the County rather than single issue areas, • Promotes the view of linking long-run financial planning with day to day operations, and • Provides the County Staff, the County Board of Commissioners and the County citizens a framework for measuring the fiscal impact of go vernment services against established fiscal parameters and guidelines. • This policy will be reviewed periodically by County staff and any changes will be approved by the Board of Commissioners. It is the responsibility of the County Board of Commissioners to provide for the capital facilities necessary to deliver municipal services to the citizens of the County, as well as facilities for the Harnett County Public Schools and the Central Carolina Community College system. 2. The County will consider all capital improvements in accordance with an adopted Capital Improvement Plan. 3. The Capital Improvement Plan is inclusive of Capital Improvements (renovations), Capital Replacement (vehicles and heavy equipment) and Major Capital Projects (new buildings). 4. The County will develop a five-year Capital Improvement Plan and review and update the plan annually. The Harnett County Public Schools and the Community College System will submit their respective five-year capital improvement requests annually and will provide a prioritization for the improvements within their request for the County Commissioner's review. 5. The County will enact an annual capital budget based on the five-year Capital Improvement Plan , while considering changes in population, changes in real estate development, or changes in assumptions in the capital budget projections. 6. The County, in consultation with the Harnett County Public School and Community College Systems, will coordinate development of the capital improvement budget with development of the operating budget. Future operating costs associated with new capital improvements will be projected and included in operating budget forecasts . 7 . The Capital Improvement Plan will include the estimated costs for the County to maintain all County, Public School and Community College assets at a level adequate to protect the public 's welfare and safety, the County's capital investment and to minimize future maintenance and replacement costs. The County, in consultation with the Harnett County Public School and Community College Systems, will identify the estimated costs and potential funding sources for each capital project proposal before it is submitted for approval. 9. The County will confine long-term borrowing to capital improvements or projects that cannot be financed from current revenues except where approved justification is provided. 2 . The County will take a balanced approach to capital funding utilizing debt financing , capital reserves and pay-as-you-go funding that will provide the least financial impact on the taxpayer. Pay-as-you-go funding will come from budgeted appropriations. 3 . When the County finances capital improvements or other projects by issuing bonds or entering into capital leases, it will repay the debt within a period not to exceed the expected useful life of the project. Target debt ratios will be annually calculated and included in the review of financial trends. 4 . Net debt as a percentage of estimated market value of taxable property shall not exceed 2.5%. Net debt is defined as any and all debt that is tax-supported . 5. Debt Service expenditures as a percent of total governmental fund expenditures should not exceed 15.0%. Should this ratio exceed 15%, staff must request an exception from the Board of Commissioners stating the justification and expected duration of the policy exception. Exceptions shall be reviewed and approved annually by the Board of Commissioners until compliance is achieved. 6. The County will retire tax anticipation debt, if any, annually and will retire bond anticipation debt within six months after completion of the project. 7. Payout of aggregate outstanding tax-supported debt principal shall be no less than 50 .0% repaid in 10 years. 5 013117wsa HC BOC Page 73 FISCAL POLICY GUIDELINES Harnett County, North Carolina RESERVE POLICIES 1. The County will maintain a mmunum Unassigned Fund Balance, as defined by the Governmental Accounting Standards Board, at the close of each fiscal year equal to 15% of General Fund Expenditures with a targeted Unassigned Fund Balance equal to 20% of General Fund Expenditures. 2. In the event that funds are available over and beyond the 20% targeted amount, those funds may be transferred to a capital reserve fund, a capital projects fund, to pay-down debt or to fund other one-time uses. Such transfers or uses shall be approved by the Board of County Commissioners in conjunction with a staff recommendation based upon a fund balance analysis to be completed within six months of the close of each fiscal year taking into consideration the prior year's financial statements, current year-to-date budget performance, current property tax valuations and the County's most recently adopted capital improvement plan. 3. The County Board may, from time-to-time, utilize fund balances that will reduce Unassigned Fund Balance below the 15% minimwn for the purposes of a declared fiscal emergency or other such purpose as to protect or enhance the long-term fiscal security of the County. In such circumstances, the Board will adopt a plan to restore the Unassigned Fund Balance to the target level within 36 months. The Budget Process will be compliant with the North Carolina Local Government Budget and Fiscal Control Act. 2. One-time or other special revenues will not be used to finance continuing County operations but instead will be used for funding special projects. 3. The County will pursue an aggressive policy seeking the collection of current and delinquent property taxes , utility, license, permit and other fees due to the County. 4 . County staff will generate reports that show actual revenues and expenditures compared to the budget and will present this to the County Board on a monthly basis . 5. It is the intent of the County to appropriate funding to the Board of Education to assure that the necessary resources are provided for current expense and to meet the low wealth funding requirements. 2. The County will provide current expense funding based upon the most recent known 2nd month average daily membership (ADM) times the most recent known Three-Year Average of Appropriations as determined by the NC Department of Public Instruction. 3. The County will provide funding for an annual classroom teacher supplement to those teachers who were employed as of September 1 of the preceding fiscal year. To remain eligible for the payment, the teacher must remain in the employment of the Harnett County School system, as a teacher, at the time the payment is made. For purposes of this funding, a Teacher is defmed as those individuals who are included in the Public School Personnel Summary provided by the NC Department of Public Instruction. 4 . The County will provide funds for Capital and Capital Maintenance. The source of funding will be a portion of the sales tax expansion basis and will be disbursed based upon the Board of Education's latest approved Capital Improvement Plan (CIP) at the discretion of the Board of County Commissioners. 5. The County will detail the amounts to be budgeted under this policy as part of the annual budget ordinance. 8 013117wsa HC BOC Page 76 FISCAL POLICY GUIDELINES Hamett County, North Carolina CASH MANAGEMENT I INVESTMENT POLICIES 1. It is the intent of the County that public funds will be invested to the extent possible to reduce the dependence upon property tax revenues . Funds wilJ be invested with the chief objectives of safety of principal, liquidity, and yield, in that order. All deposits and investments of County funds will be in accordance with N.C.G.S. 159. 2. Up to one-half (50%) of the appropriations to Non-County Agencies and to non debt-supported capital outlays for County Departments can be encumbered prior to December 31 . Any additional authorization shall require the County Manager's written approval upon justification. The balance of these appropriations may be encumbered after January 1, upon a finding by the County Manager that there is a reasonable expectation that the County's Budgeted Revenues will be realized. 3. The County will use a Central Depository to maximize the availability and mobility of cash for all funds that can be legally and practically combined. 4. Cash Flows will be forecasted and investments will be made to mature when funds are projected to be needed to meet cash flow requirements. 5. Liquidity: No less than 20% of funds available for investment will be maintained in liquid investments at any point in time. 6. Maturity: All investments will mature in no more than thirty-six (36) months from their purchase date. 7. Custody: All investments will be purchased "payment-verses-delivery" and if certificated will be held by the Finance Officer in the name of the County. All non-certificated investments will be held in book-entry form in the name of the County with the County 's third party Custodian (Safekeeping Agent). 8. Authorized Investments: The County may deposit County Funds into: Any Board approved Official Depository, if such funds are secured in accordance with NCGS-159 (31 ). The County may invest County Funds in: the North Carolina Capital Management Trust, US Treasury Securities, US Agency Securities specifically authorized in GS-159 and rated no lower than "AAA", and Commercial Paper meeting the requirements ofNCGS-159 plus having a national bond rating. 9. Diversification: No more than 10% of the County's investment funds may be invested in a specific company's commercial paper and no more than 25% of the County's investment funds may be invested in commercial paper. The Enterprise Funds will adhere to the County' Fiscal Policy with any exceptions being reported in this section. • These policies will allow for orderly expansion of services and to allow operation within the financial framework insuring efficiency while providing necessary services. • They promote long-term financial stability. • They insure the future viability of the system while providing for predictable and reasonable rate increases. Budget Policies: • Enterprise Funds will develop a multi-year capital improvement plan, which will be reviewed and updated annually. • Any improvements required to meet new regulatory requirements or to meet changes in the service demands will be included in either the capital improvement plan or the annual budget request. • Service rates will be reviewed annually as part of the budget process. • Service rates will be adjusted as needed to provide adequate funding for the proper operation, maintenance, and expansion of the system. • Service rates will be adjusted as necessary to meet bond covenants, debt service obligations, and Adopted Financial Policy Guidelines. Debt Policies: • The Enterprise Fund is responsible for setting rates and charges at such a level which maintains the "self-supporting" nature of the fund. • The County will target a minimum amount of equity funding of I 0% of the Enterprise Fund capital improvement plan on a five-year rolling average. • The Enterprise Fund will comply with all applicable bond covenants. These minimum requirements are summarized to be: o l .20x debt service coverage on Parity Indebtedness (Revenues for this measure may include 20% of the balance in the Surplus Account at the end of the preceding Fiscal Year) o 1.00x debt service coverage of Parity Indebtedness, General Obligation Indebtedness, Subordinate Indebtedness, Other Indebtedness, and any amount due to the Qualified Reserve Fund or Qualified Reserve Fund Substitute.
