10112016270 MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Tuesday, October 11, 2016, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tem Billy Tart, Council Members Buddy Maness, Gwen McNeill, Frank McLean, Billy Tart, Chuck Turnage and Billy Barfield. Also present was City Manager Ronnie Autry, Finance Director Mark Stephens, Public Works Director Dean Gaster, Planning Director Samantha Wullenwaber, Police Captain Robert Jenkins, Recreation Director Brian McNeill, Human Resources Director Anne Thompson, Librarian Mike Williams, Attorney P. Tilghman Pope, City Clerk Jennifer Fortin, Deputy City Clerk Melissa Dudley, and Daily Record Reporter Melody Brown -Peyton. INVOCATION Mayor Harris opened the meeting at 7:00 p.m. and asked Pastor Gerald Blake, Police Chaplain and Pastor of the Daystar Tabernacle to give the invocation. Afterwards, the Pledge of Allegiance was repeated. Mayor Harris addressed the aftermath of Hurricane Matthew. AGENDA ADJUSTMENT AND APPROVAL City Attorney Pope requested a State of Emergency Proclamation be added to the agenda as item # 15A under Items for Decision. Motion by Council Member Maness and seconded by Council Member Tart to adopt the October 11, 2016 meeting agenda with changes, if any, as listed below. Agenda Items Added: • Proclamation for State of Emergency — Hurricane Matthew Agenda Items Removed: • none Motion unanimously approved. PUBLIC COMMENT PERIOD Each speaker is asked to limit comments to 3 minutes, and the total comment period will be 30 minutes. Citizens must sign up and register on a sign-up sheet available on the podium within the City Council Chambers prior to the start of the meeting. Mayor Harris read the City of Dunn City Council Public Comment Policy. Robert Jordan, 1101 W. Cole Street provided Council with a copy of a statement he read to the public. (Copy of letter on file in Clerk's Office) PUBLIC HEARINGS Voluntary Annexation ANX-01-16 Cottages at Gleneagles Phase II Robert P. Wellons and Su Lou O. Wellons 8.18 acres, PIN# 1517-04-6110.000 The public has been notified that oral and written comments will be heard and received concerning the question of voluntary contiguous annexation of 8.18 acres — PIN# 1517-04-6110.000 located on Powell Avenue and owned by Robert P. Wellons and Su Lou O. Wellons. The Public Hearing was duly advertised on September 29, 2016. There were no public comments at this time. Rezoning RequestRZ-09-16 Aho Properties (applicant & owner) 1841 US 301 North PIN# 1517-83-8793.000 The public has been notified that oral and written comments will be heard and received concerning the request by Aho Properties, LLC to rezone approximately 3.7 +/- acres located at 1841 US 301 North. The property is currently zoned R-20; Single Family Dwelling District and is proposed to be rezoned to O & I; Office & Institutional District. The public hearing is the opportunity for the Council to hear comments and opinions from the public to include any party for or against the request. The Public Hearing was duly advertised on September 20, October 4 & 11, 2016. Attorney Dwight Snow for the applicant stated the rezoning request had gone before the Planning Board and was approved. (R2016-21; Attachment #2) Proclamation — National Friends of Libraries Week— Read by Council Member Barfield. (P2016-18; Attachment #3) Motion by Council Member Barfield and seconded by Council Member McLean to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION Consideration of Ordinance to Extend the Corporate Limits of the City of Dunn Voluntary Annexation Petition ANX-01-16 Received Under G.S. 160A-31; Gleneagles Phase II Robert P. Wellons & Su Lou O. Wellons 8.18 +/- acres, PIN# 1517-04-6110.000 This is a request to approve an ordinance to extend the corporate limits of the City of Dunn by voluntary contiguous annexation of 8.18 acre, more or less. This 8.18 acres, more or less and identified by the Harnett County Register of Deeds as PIN# 1517-04-6110.000 is located on Powell Avenue. This property is owned by Robert P. Wellons & Su Lou O. Wellons Motion by Council Member Maness and seconded by Council Member Turnage to adopt the proposed Ordinance to extend the corporate limits of the City of Dunn Voluntary Annexation ANX-01-16 received under G.S. 160A-31; Gleneagles Phase II, Robert P. Wellons and Su Lou O. Wellons; 8.18+/- acres PIN #1517-04-6110.000. Motion unanimously approved. A copy of Ordinance (02016-10) is incorporated into these minutes as attachment #4. Voting Delegate for 2016 NCLM Business Meeting The Advocacy Goals Conference 2017-2018 Biennium will be held from 11:00 a.m. — 4:00 p.m. on Sunday, October 23, 2016 at the Raleigh Convention Center, Raleigh, NC. The Annual Business Meeting of the. North Carolina League of Municipalities will be held at 4:15 p.m. on Monday, October 24, 2016 AT THE Raleigh Convention Center, Raleigh, NC. Any Municipality that plans to attend must have their governing board authorize a voting delegate and an alternate voting delegate to attend this meeting in order for them to cast a vote. Assistant City manager Neuschafer and Council Member Barfield will be attending the NCLM Annual Conference. City Manager Autry recommended to designate Assistant City Manager Neuschafer as voting delegate and Council Member Barfield as alternate voting delegate. Motion by Council Member Barfield and seconded by Council Member Mclean to designate Assistant City Manager Neuschafer as voting delegate and Council Member Barfield as alternate voting delegate for the 2016 NCLM Annual Conference. Motion unanimously approved. Motion unanimously approved Rezoning Request RZ-09-16 Aho Properties (applicant & owner) 1841 US 301 North PIN# 1517-83-8793.000 This is a request to rezone a parcel of land totaling 3.7+/ -acres located at 1841 US 301 North. The property is zoned R-20; Single Family Residence and is proposed to O & I; Office & Institutional District. The Planning Board met on September 27, 2016, to review the request and ask for comments from the public. The Planning Board voted unanimously to approve the request. Motion by Council Member Barfield and seconded by Council Member Tart to approve the rezoning request RZ-09-16 with the following justifications: • The City of Dunn Land Use Plan identifies this areas as a mixture of various development on the future land use map. The property is located in area one of the Land Use Plan. • The amendment is not inconsistent with the adjoining and surrounding land uses which are residential, industrial, commercial and office. • The permitted uses in the O & I District are not considered detrimental to the area or undesirable to the community. Motion approved unanimously Temporary Blocking of Streets — NC Cotton Festival M&A The NC Cotton Festival is requesting that the following streets be close for the IP Annual NC Cotton Festival on November 5, 2016: Friday November 4' from 7.00 p.m. until after the festival on November 5`h at 8:00 n.m. • Wilson Avenue from Edgerton Street to the Fire Station on Harnett Street. Saturday, November 5`^ from 6:00 a.m. until 6:00 p.m. • Broad Street from Clinton Avenue to Layton Avenue • Edgerton Street from Clinton Avenue to Fayetteville Avenue • Wilson Avenue from Cumberland Street to the driveway of the Fire Station • Railroad Avenue from Cumberland Street to Harnett Street • Lucknow Avenue to Broad Street • Fayetteville Avenue from Cumberland street to Edgerton Street • King Avenue from Cumberland Street to Edgerton Street • Layton Avenue from Cumberland street to Edgerton Street In addition, they also ask for assistance from city personnel (police, public works and parks and recreation) and that the street sweeper come through after the event on Saturday. Motion by Council Member McLean and seconded by Council Member Maness to approve the streets closing request from the NC Cotton Festival Motion unanimously approved. Consideration of Resolution by Governing Body of the Applicant The City Council is being asked to adopt a Resolution to authorize the Mayor to file an application with the Building Reuse Grants Program — Vacant Building Category for grant assistance for The Organic Butcher Shop, LLC, 219 E. Broad Street building renovation project. Planning Director Samantha Wullenwaber noted the match for the City is $2,500.00 and not to exceed $2,500.00. Skip Green noted the owners were not present. The applicants have purchased the vacant building at 219 E. Broad Street. The grant is to request a $50,000 building reuse grant. The business when it opens will have 5 full time jobs and they will have an average weekly wage of $553.46. Motion by Council Member Maness and seconded by Council Member Turnage to adopt the Resolution authorizing the Mayor to file an application with the Building Reuse Grants Program — Vacant Building Category not to exceed $2,500.00. Motion unanimously approved. A copy of the Resolution (R2016-22) is incorporated in to these minutes as Attachment #5. Proclamation State of Emergency Attorney Pope gave background to the Proclamation. A state of Emergency was put together late this afternoon in due to damage suffered during Hurricane Matthew. The primary purpose of adopting a State of Emergency makes us eligible for FEMA reimbursement in the event that Harnett County is added to that list. However, there are a couple of references in here and my recommendation to Council is rather than adopt what is before you would be to adopt an ordinance to authorize the Mayor to declare a State of Emergency relative to Hurricane Matthew under our applicable North Carolina General Statutes. Motion by Council Member Barfield and seconded by Council Member Tart to authorize the Mayor to declare a State of Emergency relative to Hurricane Matthew under our applicable North Carolina General Statutes. Motion unanimously approved. A copy of the Proclamation (P2016-19) is incorporated in to these minutes as Attachment #6 ITEM FOR DISCUSSION AND/OR DECISION Financial Report Finance Director Mark Stephens provided the following financial report for the period ending August 31, 2016: • The City as of August 31, 2016 had $1,538,095 in cash in the General Fund and $1,984,248 in the Water and Sewer Fund. In August 2015 the City had $1,486,284 in the General Fund and $1,900;223 in the Water and Sewer Fund. • Property Tax collections were $124,395 or 3.37% of budget. Last year property tax collections through July were $140,714 or 3.98% • Sales Tax Revenue is $174,769 or 10.43% of budget. Benchmark for the month is 8.33% of budget. • Utilities Sales Tax is $0.00 or 0.00% of budget. Benchmark for this month is 0.00% of budget. • Building Permit Fees were $11,448 or 17.61% of budget. Benchmark for this month is 16.67% of budget. • Water and Sewer Revenues were $840,048 or 18.67% of budget. Benchmark for this month is 16.67% of budget • Expenditures were 15.61% of budget in the general fund and 13.21% of budget in the water and sewer fund. The benchmark for this period is 16.67% of budget. Motion by Council Member McLean and seconded by Council Member Tart to accept the Financial Report. Motion carried unanimously. ADMINISTRATIVE REPORTS Tax Report Building Report, Planning, Recreation and Library Reports Police Report Motion by Council Member Turnage and seconded by Council Member Barfield to accept the Administrative Reports. Motion unanimously approved. ANNOUNCEMENTS 273 The following announcements and/or comments were made. Mayor Harris: ➢ "Trick or Treat" times will be observed in the City limits of Dunn on Monday, October 31, 2016 from 5:00 p.m. until 8:30 p.m. ➢ 18ih Annual North Carolina Cotton Festival will be held on Saturday, November 5, 2016 from 10:00 a.m. until 4:00 p.m. in Downtown Dunn ➢ The next regular City Council meeting is scheduled for Tuesday, November 8, 2016 @ 7:00 p.m. ➢ City offices will be closed on Friday, November 11, 2016 in observance of Veteran's day Council member Barfield noted the grass needs to be cut on Broad Street near the gas tanks as it is high. Tammy Williams from Dunn Area Chamber of Commerce noted the Candidates Forum will be at Triton High School on October 13, 2016 at 6:30 p.m. Gerald Owens from WRAL will be the moderator.
