Commissioner Miller led the pledge of allegiance and invocation. Central Carolina Community College (CCCC) Computer Integrated Machining Department Chair Edwin Thomas, Instructor Chris Jackson and students Kody Maness and Ian Estep presented commissioners with a metal plaque of the State seal they manufactured. Mr. Jackson and Mr. Thomas addressed the group. Mr. Jackson noted that the students executed the project on their own time with a piece of excess metal. He also noted production of the piece involved over eight hours of design time and 40 hours of machine time. Commissioners thanked them for their initiative and wished the students the best of luck in their endeavors. Chairman Burgin encouraged the audience and fellow commissioners to tour the CCCC campuses in Harnett, Lee and Chatham Counties as he and Commissioner Springle had recently. Chairman Burgin said CCCC is widely acclaimed and is state and nationally recognized. Vice Chairman Springle said he learned a lot about what the community college has to offer and believes it wonderful all the different skills they provide for our students to be able to provide to industry. Chairman Burgin called for additions and deletions to the published agenda. Mr. Jeffiies requested the addition of Tilghman Pope's presentation on behalf of the Citizens for Harnett Educational Fairness. Commissioner Miller moved to approve the agenda as amended. Tax refunds, rebates and release (Attachment 1) 4. Resolutions to add roads to state system (Attachment 2 -7) 5. Harnett County Sheriffs Office requested permission to reclassify an Administrative Support Specialist (pay grade 60) to an Administrative Assistant (pay grade 64) as the employee in this position is now crossed trained in Civil Process and Tax disbursement processes as well as being assigned additional duties. 6. Department of Social Services requested approval to hire an additional full time employee for Child Protective Services to be funded by the State. The NC General Assembly allocated funding to 30 counties to help reduce caseload sizes in Child Protective Services. Funds were allocated and the legislation specified these funds to be recurring. 7. Harnett County Public Utilities requested approval ofwrite-offs for the fourth quarter of · 2014 in the amount of$10,179.91. All of these accounts have been delinquent for more than three years. The facilitation of these write-offs is an important step in continuing efforts to manage collections and bad debt. HCPU is currently using the Local Government Debt Setoff Program and On-Line Collections, Inc. to help collect delinquent accounts. Public Utilities has recovered over $528,000 in bad debt previously written off through the Debt SetoffProgram. 8. Resolution in Support of Administering Federal Grant Funding for the District 11A Veterans Treatment Court (Attachment 8) 9. Public Utilities requested approval of an increasing engineering amendment for MBD Consulting Engineers, P.A. in the amount of$76,756. The amendment and contract is associated with the South Central Wastewater Project 1B2. The majority of this increase was caused by the contractor exceeding his allowable contract time thereby requiring March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 10 additional inspection services from the engineering company and the increase will be paid for by liquidated damages from the contractor. The final construction closeout resulted in a reducing change order resulting in a savings to the County of $198,801.27. 10. General Services requested approval of a Supplemental Agreement to the FY15 Community Transportation Program grant agreement 15-CT -040. This supplemental agreement to project 15-CT-040 will decrease Capital Funds by $113,000 and decrease the County's match by $11,300. This supplemental agreement to decrease 15-CT-40 is the result of Harnett County HARTS award from the American Recovery Reinvestment Act to fund the purchase of two 20' wheelchair vehicles. 11. Sheriff's Office requested approval to lease equipment from the Department ofthe Navy, Naval Surface·Warfare Center, Crane Division in the amount of$6,000. Equipment includes clip-on night vision weapon sights, night vision pocket scopes and night vision goggles. 12. Sheriff's Office requested approval of resolution to award Deputy Charles E. Peele his service weapon upon his retirement {Attachment 9) 13. Administration requested approval of an agreement between the Lillington Area Chamber of Commerce and the County of Harnett to waive the County's annual membership with the Chamber in exchange for the County waiving the room rental fee for the Chamber to use the commons area meeting room for its annual banquet. 14. Commissioner Miller seconded the motion which passed unanimously. AGRICULTURAL ADVISORY BOARD L.D. Black and C.H. Johnson (nominated by Vice Chairman Springle) were reappointed to serve additional two year terms ending July 1, 2016. Cindy Johnson and Henry Randolph, (nominated by Vice Chairman Springle) were appointed to serve three year terms ending March 1, 2018. Brian Stafford (nominated by Vice Chairman Springle) was appointed to serve a one year term ending March 1, 2016. March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 of 10 CENTRAL CAROLINA WORKS ADVISORY COMMITTEE Commissioner Abe Elmore (nominated by Chairman Burgin) was appointed to serve as a member of the Central Carolina Works Advisory Committee. Chairman Burgin opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. -Penny Christman of Quail Hollow in Cameron suggested that CCCC students make small metal medallions to sale. Dr. Marchant responded that as a state institution they are not allowed to make a profit and must be very careful that they don't compete with anyone. Deedee Clark of 447 Eilene Drive in Spring Lake, with NC Dog Rescue, said the Animal Services staff works great with the rescue groups. She noted rescue groups are pulling a high percentage of animals from Harnett County weekly. She said the dogs are getting pulled for rescue and are being vetted, spayed/neutered and adopted to great homes. Mrs. Clark said rescue groups are doing a lot to help Harnett County. She asked commissioner to consider extending the amount of time that rescue groups have to provide verification that they have had the animals they pulled spayed/neutered. The proposed policy requires verification be provided within 30 days of adopting the animal. Mrs. Clark said there is usually a two to three week waiting period at the Vass Spay/Neuter Clinic. Mrs. Clark also asked commissioners to consider waiving the $30 adoption fee for rescues; saying most other counties do not charge rescues to pull dogs. Chairman Burgin encouraged everyone to take a class at CCCC as he is doing now. He recognized Marty Clayton with Duke Energy and said they appreciate what he does for the County. Dr. Bud Marchant, CCCC President, distributed materials to the commissioners and recognized the Dean of Vocational and Technical Programs Dr. Stephen L. Athans, Harnett County Associate Provost Jon Matthews and Harnett County Provost Bill Tyson. Dr. Marchant said about two years ago, under the leadership of Kirk Bradley, CCCC approached their three counties with the idea of Central Carolina Works (CCW) which was to place counselors in all of the high schools in their three-county area with the purpose of getting students to enroll in college courses while they were still in high school. He noted North Carolina allows high school students to enroll in community college courses free of charge while they are in high school. Dr. Marchant said CCW has been extremely successful in its first two years and is now attempting to be copied statewide. Dr. Marchant introduced three of the four CCW Works Harnett County High School Advisors. Triton High School CCW Advisor Tracy Autry reported 54 students enrolled in the program this semester. Mrs. Autry also noted the CCW Advisor for Central Harnett High School has 53 students enrolled in the program this semester. Overhills High School CCW Advisor Latoya Parker reported 86 students enrolled in the program this semester and Western Harnett High School CCW Advisor Elvin James reported 29 students enrolled in the program this semester. Dr. Marchant said the advisors do a remarkable job educating students and parents about the program. Dr. Marchant thanked Commissioner Burgin for serving on the CCW Fundraiser Committee and said this has been a great example of a public-private partnership that is truly March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 6 of 10 working for the betterment of students in Harnett County. Chairman Burgin said families are thankful for getting the first year of college free, which is also a great way for students to transition from high school to college. Mr. Tighlman Pope, representing Citizens for Harnett Educational Fairness, addressed the group and distributed handouts. Mr. Pope said this group was formed out of concern about how the School Board was handling the redistricting process and its refusal to implement redistricting in a legal manner that would end segregation at Dunn Middle School. He said his group has and will continue to address the School Board regarding these issues. Mr. Tighlman gave an overview of where he said the School Board has been on these issues as well as the opinions of his group. Commissioner McKoy asked if Citizens for Harnett Educational Fairness had studied the travel time to transport students if redistricted. Mr. Pope responded that the committee formed by the School Board to look at redistricting issue did consider travel time when they provided three redistricting maps/plans. Mr. Pope said his group believes all three maps do a good job ofusing building capacity and demographic breakdowns. He said if the Board of Education does not redistrict middle schools then two middle schools will be at 50% capacity next year. Mr. Pope said Dunn Middle and Coats/Erwin Middle Schools are currently under capacity. Mr. Pope asked commissioners to send a message to the School Board that they will not allow the taxpayers of Harnett County to be "fleeced" by building facilities that are not needed when we have adequate facilities already available to educate the middle school population. He also asked commissioners to tell the School Board to implement redistricting that ends illegal segregation in our schools. Barry Blevins, General Services Director, requested approval to waive the spay/neuter voucher fee portion of the adoption fees for 'rescue groups'. The spay/neuter fee of$70 was approved in the FY 14/15 budget. Mr. Blevins gave a brief overview of the spay/neuter plan that Animal Services wishes to institute. The policy states persons adopting an animal that meets age and sex requirements will pay additional adoption spay/neuter fee of $70 with the total adoption fee being $106. The adoptee will receive a certified voucher redeemable at participating veterinarians. The adoptee is responsible for any additional costs imposed by their selected veterinarian. Veterinarians, in tum, will return the original certified voucher to Animal Services to redeem payment of the $70 voucher. The waiver for rescue groups would require that they show proof of adopted animals' spay/neuter within 30 days of adoption. He said this waiver proposal is to maintain positive relationships with partner animal welfare groups and help reduce euthanasia rates. Mr. Blevins also requested approval to move forward with the spay/neuter voucher program as presented. Mr. Blevins noted all of the local vets throughout the county have agreed to participate in the voucher program. He also noted vet prices for spay/neuter vary throughout the County and again, the adoptee is responsible for any additional costs over the $70 voucher imposed by their selected veterinarian. Mr. Blevins said if a particular group does not abide by the agreement, March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 7 of 10 which is 30 days spay/neuter, Animal Services would then revoke their waiver however staff is willing to work with any rescue group having difficulties moving forward; being delayed by backlog at vets. Chairman Burgin asked what kind of money we would be looking at if we did waive the $30 adoption fee for rescue groups. Mr. Blevins was uncertain of the amount but responded that it costs Harnett County Animal Services $71.50, based on state formula, for every animal they receive. Animal Services by law must keep any animal they take in for three days. Animal Services does not distinguish between rescue and adoption. Mr. Blevins said he does not recommend waiving the $30 adoption fee because of the costs involved. He said the total fee for adoption is comparable to surrounding counties. Mr. Blevins said everything they do is at bare minimum to meet costs. Mr. Blevins said the spay/neuter policy will make a difference long- term to reduce the number of stray animals and euthanasia rates. Commissioners discussed the need for state mandatory spay/neuter. Kristen Perry, HA WC, said mandatory spay/neuter does not work because people do not want the government telling them they have to get their pet spayed/neutered. Vice Chairman Springle moved to approve the spay/neuter voucher policy including the spay/neuter waiver for rescue groups. Commissioner Elmore seconded the motion which passed unanimously. Anna Peele, General Services Finance Technician, petitioned the Board for a public hearing regarding the performance of the FY11 Community Development Block Grant Scattered Site Housing Performance. This public hearing will complete close-out actions for the NC Department of Commerce, Rural Economic Development Division's 2011 Scatted Site Housing grant. Mrs. Peele reported that the $400,000 Community Development Block Grant assisted four Harnett County families with housing rehabilitation efforts. Mr. Blevins pointed out that this is our last block grant for rehabilitation leaving the NC Housing Finance Agency as the sole provider of funds to repair homes. Mrs. Peele reviewed the rehabilitation efforts of the four homes and shared before and after pictures with the group. Mrs. Peele explained the application process for this program. Mr. Blevins said staff will continue to look for other community development funding sources. He said they are moving forward with the Single Family Rehab. Program and just completed the Urgent Repair Program. Chairman Burgin called to order a public hearing on the matter and opened the meeting for comments from the public. Seeing no one move, Chairman Burgin closed the public hearing. Mr. Jeffries presented the following reports: -January 2015 Summary Financial Reports -Harnett County Veteran Affairs Activities Report-January 2015 -Harnett County Public Health Activities Summary-January 2015 -Harnett County Planning Services Report -January 2015 -Interdepartmental budget amendments -CCPT Annual Report Mr. Jeffries discussed selection of the CCCC Board of Trustees. Commissioners were provided a recommended draft detailing the 16 member Board membership. Chairman Burgin explained March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 8 of 10 that recently CCCC's Attorney Jimmy Love determined that there needed to be an adoption by each County Board that they agreed that a Board member could be appointed as a CCCC Trustee by the Board for each County. Commissioner McKoy moved to adopt the CCCC Trustee Membership. Vice Chairman Springle seconded the motion which passed unanimously. Commissioners discussed the county's top legislative priorities. Senator Ron Rabin and Representative Brad Salmon have both recently requested specific priorities they can assist with. Commissioner Elmore moved to approve the following as priorities for Harnett County: ~ Four lane U.S. 401 corridor in Harnett County; ~ Authorize counties to operate natural gas as an enterprise; ~ Authorize additional staff for District Attorney's Office; ~ Expand Broadband in rural Harnett County communities; ~ Allow counties to use E-911 funds for E-911 needs other than equipment; and );> Continue to lobby for counties to receive the maximum allocation from lottery funds; Commissioner Miller seconded the motion which passed unanimously. Staff was directed to provide the list of priorities to all three legislators. Regarding District Attorney Vernon Stewart's request for the County to fund a position in his office, Mr. Jeffries said it is our preference to address this position with the budget however Mr. Stewart stressed the need for this position now and requested that the Board address the possibility of adding the position immediately. Mr. Stewart previously provided a 16-month proposal at a cost of $175,692. Mr. Jeffries said staff is looking at different options available because the County would be held responsible for unemployment, workers comp and liability insurance for this position even though it would be a state position. Commissioners expressed concern that if the County funds this position now that the State won't ever take it back. Commissioner Elmore moved to fund the position for 16 months and then reevaluate. Vice Chairman Springle seconded the motion which passed unanimously. Mr. Jeffries noted staff is working on the upcoming planning retreat agenda and has invited the Fort Bragg Garrison Commander to come discuss potential impact of changes taking place at Fort Bragg. He also noted that the proposed amendments to the Discharge Ordinance and Noise Ordinance will be on March 16, 2015 agenda in addition to Explosive Ordinance. Mr. Jeffries announced that Governor Pat McCrory has appointed Chairman Burgin to serve as a member of the North Carolina State Health Coordinating Council. Ms. Wheeler administered Mr. Burgin's Oath of Office. Chairman Burgin called for any new business. Commissioners made plans to attend the upcoming NCACC District meeting in Duplin County. Chairman Burgin said he has been reviewing our financials which are looking better as taxes are up over $1 Million and we are under budget right now. Mrs. Honeycutt said our Tax Department is one of the tops in collections in State. Mrs. Honeycutt also reported they have gone out for RFPs/RFQs for the refinancing and the bank proposals for the Public Utilities side look very promising. March 2, 2015 Regular Meeting Minutes Harnett County Board of Commissioners Page 9 of 10 Commissioner McKoy moved that the Board go into closed session for the following purposes: (1) consult with the County's legal staff in order to preserve the attorney-client privilege concerning the handling of certain claims and legal actions including that case entitled, "TL W Contractors, LTD. vs Harnett County" N.C. Property Tax Commission File No. 14 PTC 0340, and (2) to instruct the County's staff concerning the position to be taken by the County in negotiating the price and other material terms of a proposed contract for the acquisition of real property; and (3) to discuss matters relating to the location or expansion of industries or other businesses in Harnett County. This motion is made pursuant to N.C. General Statute Section 143-318.11 (a)(3)&(5)&(4). Commissioner Miller seconded the motion which passed unanimously. Explosives Detonation Ordinance” (hereinafter referred to as “Ordinance”). Section 2 Purpose The purpose of this Ordinance is to implement standards for the detonation of explosives that may cause injury, death or damage to personal property, whereas preserving the personal freedom to engage in such activities, while promoting public health, safety, welfare, comfort and prosperity of the citizens of Harnett County. Section 3 Authority and Enactment The Board of Commissioners of the County of Harnett, pursuant to the authority conferred by the General Assembly of the State of North Carolina in General Statutes Chapter 153A – 128 hereby ordains and enacts into law this Ordinance. Section 4 Jurisdiction Under the authority granted by North Carolina General Statute 153A-122, the county is hereby authorized to enact this Ordinance within the rural areas of the county and outside and beyond the corporate limits of any municipality of Harnett County. Section 5 Severability If any section of specific provision or standard of this Ordinance is found by a court to be invalid, the decision of the court shall not affect the validity of any other section, provision, or standard of this Ordinance. Section 6 Conflict with Other Laws It is not intended that this Ordinance repeal, abrogate, annul, impair, or interfere with any existing provisions of any other ordinances or laws. However, if the requirements of any other lawfully adopted rules, regulations, or ordinances of the County of Harnett conflict with this Ordinance, the more restrictive or that imposing the higher standards will govern. Section 7 Amendment This Ordinance may be amended from time to time by the Board of Commissioners of the County of Harnett on its own motion or on petition and after public notice and hearing. 031615a HC BOC Page 252 Draft #6 4 Section 8 Definitions Detonate Any action that will cause an explosive material or device to explode. Discharge To eject or release a projectile or object by a sudden release of tension or pressure. Encapsulate To enclose within an object or outer shell for the purpose of containment. Exploding Target A device that is utilized for the purpose of shot confirmation. This type of target is typically comprised of chemicals or materials that react in an explosive manner once impacted by a projectile or a detonating device. Explosion The sudden, loud, and violent release of energy that happens when something breaks apart in a way that sends parts flying outward. Explosive A material or combination of materials that have a likelihood of erupting in a violent manner creating an explosion. Permanent Building A building which is built, constructed, used or intended to support and/or shelter any use or occupancy that is attached to real property by means of permanent foundation, plumbing or electrical connection and is required to obtain a permit and undergo an inspection process in accordance with the North Carolina State Building Code. Public Gathering Places Locations that are subject to the assembly of a group of individuals for a uniform purpose. The following shall be considered as Public Gathering Places: Schools, Churches, Daycares, Parks, Playgrounds, Recreational Areas, Nursing Homes, Hospitals, Family Care / Group Homes, Governmental Buildings and Grounds. 031615a HC BOC Page 253 Draft #6 5 Section 9 Explosives Restrictions It shall be unlawful for any person to cause an explosion: A. Within fifteen hundred (1,500) feet as measured in a straight line from the point of detonation to the property line of any public gathering place ; or B. Without written consent of the owners or tenants of all residential dwellings or permanent buildings located within fifteen hundred (1,500) feet as measured in a straight line from the point of detonation; or C. Carelessly or heedlessly in wanton disregard for the safety of others; or D. Without due caution or circumspection and in a manner so as to endanger any person or property and resulting in the unlawful property damage or bodily injury of another; or E. In a manner resulting in projectiles or shrapnel leaving the property in which the detonation or explosion occurred ; or F. While under the influence of alcohol or a controlled substance (under the influence: determination by the investigating officer that the person is intoxicated by alcohol or a narcotic to the point where physical and mental faculties are appreciably diminished); or G. In the form of an exploding target when encapsulated therefore creating a projectile or shrapnel; or H. From the hours of sunset to sunrise. Section 10 Exceptions This Ordinance shall not be construed to rescind any of the state wildlife laws of North Carolina nor shall it be construed to prohibit the following: A. Officers and enlisted personnel of the armed forces of the United States while in the performance of their official duties and acting under orders requiring them to carry arms, weapons or explosives. B. Civil officers of the United States while in the performance of their official duties. C. Officers of the state or of any county, city, or town charged with the execution of the laws of the state when acting in the performance of their official duties. 031615a HC BOC Page 254 Draft #6 6 D. The detonation of an explosive at a properly permitted and approved firing range or facility operating as such prior to the adoption of this Ordinance. E. The performance of an historical ceremony or commemorative functions that are conducted involving the discharge of firearms or detonation of explosives that do not involve the release of projectiles. F. Any individual, group or company that possess a valid permit and is operating under all Federal, State and Local guidelines prescribed for such use. G. The use of pyrotechnics or fireworks meeting exempt specifications as referenced in North Carolina General Statutes. Section 11 Violations and Penalty Each violation of this Ordinance shall constitute a Class 3 misdemeanor and any person convicted of the same shall be fined not more than five hundred ($500.00) dollars and/or imprisonment not exceeding thirty (30) days. A violation of this Ordinance may be enforced by an appropriate, equitable remedy, including injunction and order of abatement issued from a court of competent jurisdiction in accordance with North Carolina General Statute 153A-123. Furthermore, a violation may cause a civil penalty to be recovered by Harnett County in a civil action in the nature of a debt. Each day’s continuing violation of this Ordinance shall constitute a separate and distinct offense. Section 12 Effective Date This Ordinance shall take effect and be in force upon adoption. Section 2 Purpose The purpose of this Ordinance is to implement standards for the discharge of firearms that may cause injury, death or damage to personal property, whereas preserving the personal freedom to engage in such activities, while promoting public health, safety, welfare, comfort and prosperity of the citizens of Harnett County. Section 3 Authority and Enactment The Board of Commissioners of the County of Harnett, pursuant to the authority conferred by the General Assembly of the State of North Carolina in General Statutes Chapter 153A – 129 hereby ordains and enacts into law this Ordinance. Section 4 Jurisdiction Under the authority granted by North Carolina General Statute 153A-122, the county is hereby authorized to enact this Ordinance within the rural areas of the county and outside and beyond the corporate limits of any municipality of Harnett County. Section 5 Administration The Sheriff of Harnett County, or his/her designee, shall be responsible for the administration and enforcement of this Ordinance. Section 6 5 Severability If any section or specific provision or standard of this Ordinance is found by a court to be invalid, the decision of the court shall not affect the validity of any other section, provision, or standard of this Ordinance. Section 7 6 Conflict with Other Laws It is not intended that this Ordinance repeal, abrogate, annul, impair, or interfere with any existing provisions of any other ordinances or laws. However, if the requirements of any other lawfully adopted rules, regulations, or ordinances of the County of Harnett conflict with this Ordinance, the more restrictive or that imposing the higher standards will govern. Section 8 7 Amendment 031615a HC BOC Page 260 Proposed Amended Draft 4 This Ordinance may be amended from time to time by the Board of Commissioners of the County of Harnett on its own motion or on petition and after public notice and hearing. Section 9 8 Definition Firearm A handgun, shotgun, rifle, cannon or any device which is capable of expelling a projectile using an explosive charge as a propellant. Section 10 9 Firearm Restrictions It shall be unlawful for any person to discharge a firearm: A. On a parcel of property that contains 10,000 sq. feet or less in overall dimension; or B. Carelessly and heedlessly, so as to endanger any person or property; or C. Without due caution or circumspection and in a manner so as to endanger any person or property and resulting in the unlawful property damage or bodily injury of another; or D. In a manner resulting in the projectile crossing the property line of another person without written permission of the owner; or E. While under the influence of alcohol or a controlled substance (under the influence: determination by the investigating officer that the person is intoxicated by alcohol or a narcotic to the point where physical and mental faculties are appreciably diminished); or F. When discharged on, from, or across the traveled portion of any public street or highway; or G. Without a backstop or other method of containment that will adequately contain the projectile to the property upon which it was discharged. Section 11 10 Exceptions This Ordinance shall not be construed to rescind any of the state wildlife laws of North Carolina nor shall it be construed to prohibit the following: 031615a HC BOC Page 261 Proposed Amended Draft 5 A. Any citizen from discharging a firearm when lawfully defending his person or property. B. Officers and enlisted personnel of the armed forces of the United States while in the performance of their official duties and acting under orders requiring them to carry arms, weapons or explosives. C. Civil officers of the United States while in the performance of their official duties. D. Officers of the state or of any county, city, or town charged with the execution of the laws of the state when acting in the performance of their official duties. E. The discharge of a firearm at a properly permitted and approved firing range or facility operating as such prior to the adoption of the Ordinance. F. Any citizen from discharging a firearm when protecting against the attack of any dangerous or destructive animal or reptile. G. The discharges of a firearm while participating in a special event such as turkey shoots that hold a valid local county permit. H. The performance of an historical ceremony or commemorative functions that are conducted involving the discharge of firearms that do not involve the release of projectiles. I. The discharge of a firearm while in the process of lawfully hunting wild birds and/or animals in accordance with Chapter 113, Subchapter IV of the North Carolina General Statutes. J. Discharging a firearm into a device that is designed to receive and contain projectiles without risk of escape, which is located within the confines of an enclosed structure. Section 12 11 Violations and Penalty Each violation of this Ordinance shall constitute a Class 3 misdemeanor and any person convicted of the same shall be fined not more than five hundred ($500.00) dollars and/or imprisonment not exceeding thirty (30) days. A violation of this Ordinance may be enforced by an appropriate, equitable remedy, including injunction and order of abatement issued from a court of competent jurisdiction in accordance with North Carolina General Statute 153A-123. Furthermore, a violation may cause a civil penalty to be recovered by Harnett County in a civil action in the nature of a debt. Each day’s continuing violation of this Ordinance shall constitute a separate and distinct offense. 031615a HC BOC Page 262 Proposed Amended Draft 6 Section 13 12 Effective Date This Ordinance shall take effect and be in force upon adoption. It will be forwarded and presented to the Harnett County Commissioners on March 16, 2015. Ongoing  In respect to a NC Wildlife Resources Grant received by the County, Planning Staff is working with our specific contractors for each portion of the grant as well as providing hard data for their use. A curriculum has been formatted by Sustainable Sandhills, and children are currently being recruited to participate in these activities. Land Design, Inc. is approximately 80% complete on their tasks of interactive mapping and key area location. We anticipate both portions of this process to be complete within 4 months.
