PRESENT WAS MAYOR ABRAHAM OUDEH, MAYOR PRO -TEM MIKE WOMBLE AND COUNCILMEMBERS TOBY SUMNER, GEORGE ROBINSON, PAUL BASS, JOEY TART AND CAROLYN MCDOUGAL. ALSO PRESENT WAS CITY MANAGER CARL DEAN, CITY CLERK JOYCE VALLEY, CITY ATTORNEY BILLY GODWIN, PUBLIC WORKS DIRECTOR TIM HOLLOMON, ASSISTANT PUBLIC WORKS DIRECTOR JOE CAMPBELL, CITY ENGINEER RANDY MCNEIL, RECREATION DIRECTOR PERRY HUDSON, CODE ENFORCEMENT OFFICER ALONZA VANN, FIRE CHIEF AUSTIN TEW AND CAPTAIN MORRY DENNING. ABSENT WAS FINANCE DIRECTOR RENEE' DAUGHTRY INVOCATION MAYOR OUDEH OPENED THE MEETING AT 7:00 P.M. AND ASKED COUNCILMEMBER JOEY TART TO GIVE THE INVOCATION. AFTERWARD, THE PLEDGE OF ALLEGIANCE WAS REPEATED. MAYOR OUDEH CLOSED THE REGULAR MEETING AND OPENED PUBLIC HEARINGS AT 7:02 P.M. PUBLIC HEARINGS CODE AMENDMENT - REPEAL SECTION 22 -121, 22- 122,AND 22 -123 CITY MANAGER DEAN STATED THAT THE PUBLIC HAS BEEN NOTIFIED THAT ORAL AND WRITTEN COMMENTS WOULD BE HEARD AND RECEIVED CONCERNING A REQUEST BY THE CITY OF DUNN TO REPEAL CHAPTER 22 -121 (PRINCIPAL PERMITTED USES), 22 -122 (ACCESSORY USES), AND 22 -123 (DIMENSIONAL REQUIREMENTS) OF THE DUNN CITY CODE. HE ALSO STATED THAT THE PLANNING BOARD MET ON APRIL 18 ", 2000 AND RECOMMENDED APPROVAL OF THIS RE( AND THE PUBLIC HEARING WAS DULY ADVERTISED ON APRIL 20 AND APRIL 27 , 2000. HEARING NONE, MAYOR OUDEH CLOSED THE PUBLIC HEARING IN REFERENCE TO SAME. 526 REZONING REQUEST - BOBBY WELLONS (R -20 TO R -M) CITY MANAGER DEAN STATED THAT THE PUBIC HAS BEEN NOTIFIED THAT ORAL AND WRITTEN COMMENTS WOULD BE HEARD AND RECEIVED CONCERNING THE REQUEST FROM MR. BOBBY WELLONS TO REZONE PROPERTY LOCATED OFF ASHE AVENUE BETWEEN ASHE AVENUE AND FRIENDLY ROAD FROM R -20 TO R -M. THE PROPERTY CONSISTS OF APPROXIMATELY 50.09 ACRES AND HAS A FRONTAGE OF 1615 FEET AND A I DEPTH OF 1646 FEET. r HE ALSO STATED THAT THE PLANNING BOARD MET ON APRIL 18 2000 AND RECOMMENDED APPROVAL OF THE REZONING REQUEST AND THE PUBLIC HEARING WAS DULY ADVERTISED ON APRIL 20 AND APRIL 2 7TH , 2000. MAYOR OUDEH ASKED IF THERE WAS ANYONE PRESENT TO SPEAK FOR OR AGAINST THIS REQUEST. HEARING NONE, MAYOR OUDEH CLOSED THE PUUBLIC HEARING IN REFERENCE TO SAME. CONDITIONAL USE PERMIT - BOBBY WELLONS CITY MANAGER DEAN STATED THAT THE PUBLIC HAS BEEN NOTIFIED THAT ORAL AND WRITTEN COMMENTS WOULD BE HEARD AND RECEIVED CONCERNING THE REQUEST FROM MR. BOBBY WELLONS TO OBTAIN A CONDITIONAL USE PERMIT TO BUILD MULTI- FAMILY DWELLINGS IN THE R -M ZONING DISTRICT. HE ADDED THAT THE PROPERTY IS LOCATED OFF ASHE AVENUE BETWEEN ASHE AVENUE AND FRIENDLY ROAD AND CONSISTS OF 50.09 ACRES AND HAS A FRONTAGE OF 1615 FEET AND A DEPTH OF 1646 FEET. MAYOR OUDEH ASKED IF THERE WAS ANYONE PRESENT TO SPEAK FOR OR AGAINST THIS ' REQUEST. \�J ATTORNEY DWIGHT SNOW, REPRESENTING MR. WELLONS, STATED THAT HE WAS OFFERING SUPPORT OF MR. WELLONS' INTEREST IN RECEIPT OF A CONDITIONAL USE PERMIT. HE FURTHER STATED THAT MR. WELLONS AND ENGINEER JOE GODWIN ARE PRESENT TO ANSWER ANY QUESTIONS FROM COUNCIL. HE ADDED THAT SINCE THE SPECIAL, CALL PLANNING BOARD MEETING, MR. WELLONS HAS MET WITH THE CITY ENGINEER AND THE CITY MANAGER REGARDING THIS MATTER AND HAVE WORKED OUT VARIOUS DETAILS CONCERNING THE DEVELO ?MENT. COUNCILMEMBER PAUL BASS ASKED WHAT MR. WELLONS PLANS TO BUILD ON THE PROPERTY. ENGINEER JOE GODWIN AND MR. BOBBY WELLONS SHOWED COUNCIL PLANS OF DUPLEX UNITS FOR THE ELDERLY. MR. WELLONS STATED THAT THERE WERE ONE AND TWO BEDROOM UNITS SIMILAR TO THOSE AT ROLLINGWOOD. HE ALSO STATED THAT THEY WERE PLANNING TO EXPAND POWELL AVENUE AS WELL AS BUILD A CLUBHOUSE FOR THE UNITS. COUNCILMEMBER ROBINSON STATED THAT HE FELT THIS DEVELOPMENT WOULD BE GOOD FOR THE ELDERLY RESIDENTS OF DUNN. WITH NO FURTHER DISCUSSION, MAYOR OUDEH CLOSED THE PUBLIC HEARING IN REFERENCE TO SAME. REZONING REQUEST (C -0 TO R -M) CITY MANAGER DEAN STATED THAT THE REZONING REQUEST WAS TABLED BY THE PLANNING BOARD AT THEIR APRIL 18, 2000 MEETING; THEREFORE, THIS PUBLIC HEARING HAS BEEN CANCELED. ZONING- ETJ/MOBILE HOMES CITY MANAGER DEAN STATED THAT THE PUBLIC HAS BEEN NOTIFIED THAT ORAL AND WRITTEN COMMENTS WOULD BE HEARD AND RECEIVED CONCERNING THE REQUEST BY TILE CITY OF DUNN TO AMEND THE CODE TO ALLOW SINGLE FAMILY SINGLE -WIDE MOBILE HOMES IN THE EXTRA TERRITORIAL JURISDICTION (ETJ). 527 HE ALSO STATED THAT THE PLANNING BOARD MET ON APRIL 18 2000 AND RECOMMENDED DENIAL OF THIS REQUEST PENDING FURTHER RESEARCH OF THE ISSUE. HE ADDED THAT THE PUBLIC HEARING WAS DULY ADVERTISED ON APRIL 20 AND APRIL 27 2000. COUNCILMEMBER MCDOUGAL ASKED FOR AN EXPLANATION OF THIS REQUEST. CITY ATTORNEY GODWIN STATED THAT THE PLANNING BOARD WAS ASKED TO AMEND THE CODE TO ALLOW SINGLE FAMILY SINGLE -WIDE MOBILE HOMES IN THE EXTRA TERRITORIAL JURISDICTION (ETJ) AND THE PLANNING BOARD DENIED THE REQUEST DUE TO THE BROAD SCOPE OF THE LANGUAGE AND TABLED THE REQUEST FOR FURTHER RESEARCH OF THE CITY CODE TO LOOK AT POSSIBLY AMENDING THE CODE TO ALLOW SINGLE FAMILY SINGLE -WIDE MOBILE HOMES WITH SOME RESTRICTIONS OR COVENANTS IN THE EXTRA TERRITORIAL JLRISDICTION. MAYOR OUDEH ASKED IF THERE WAS ANYONE PRESENT TO SPEAK FOR OR AGAINST THIS REQUEST. MR. JOHN PARKER, OF 1625 LANE ROAD IN DUNN, STATED THAT HE WANTED TO PUT A SINGLE -WIDE MOBILE HOME ON HIS PROPERTY WHICH IS LOCATED IN THE EXTRA TERRITORIAL JURISDICTION AND IS ON FARMLAND. HE STATED THAT HIS REQUEST WAS APPROVED BY THE BOARD OF ADJUSTMENTS SEVERAL YEARS AGO;.HOWEVER, HE WAS TOLD THAT APPROVAL OF THIS BY THE BOARD OF ADJUSTMENTS WAS UNLAWFUL, SO THE ISSUE WENT BACK TO THE PLANNING BOARD WHO PREVIOUSLY DENIED THE REQUEST. HE ALSO STATED THAT THE PANNING BOARD RECOMMENDED THAT THE REQUEST GO BACK TO THE ATTORNEY TO BE RE- WRITTEN AND WOULD GO BACK TO THE PLANNING BOARD BUT IT WAS NOT RECORDED IN THE MINUTES TO THAT EFFECT. HE FURTHER STATED THAT THE PLANNING BOARD DENIED THE REQUEST AS WRITTEN, BUT WANTED TO FURTHER RESEARCH THE CITY CODE. MAYOR OUDEH ASKED WHO PREPARED THEE PLANNING BOARD MINUTES. CITY MANAGER DEAN READ THE MOTION BY THE PLANNING BOARD, WHICH DID NOT INCLUDE A VOTE. CITY CLERK JOYCE VALLEY STATED THA�7 DEPUTY CLERK TINA SILLS PREPARED THE PLANNING BOARD MINUTES WHICH HAVE NOT YET GONE TO THE PLANNING BOARD FOR APPROVAL; HOWEVER, CHAIRMAN ROB J014ES WAS PRESENT WHO COULD CONFIRM THE MOTION AND VOTE BY THE PLANNING BOARD. CHAIRMAN ROB JONES STATED THAT THE PLANNING BOARD DENIED THE REQUEST AS PRESENTED TO THEM; HOWEVER, THE MOTION WAS TO DENY THE CODE MODIFICATION AND RESEARCH THE CITY CODE TO MAKE IT MORE USER FRIENDLY FOR SINGLE -WIDE SINGLE FAMILY MOBILE HOMES IN THE ETJ AND BRING THE ISSUE BACK TO THE PLANNING BOARD. HE ADDED THAT THE MOTION WAS UNANIMOUS WITH A 5 -0 VOTE. MAYOR OUDEH ASKED IF THE ISSUE WOULD BE DISCUSSED AT THE NEXT PLANNING BOARD MEETING. CHAIRMAN JONES RESPONDED THAT THE PLANNING BOARD WOULD NOT MEET AGAIN UNTIL JUNE. HE STATED THAT HE WAS NOT SURE IF THE CODE WAS TO BE REVIEWED BY THE PLANNING BOARD, THE CITY ATTORNEY, CITY ADMINISTRATION OR A COMMITTEE. COUNCILMEMBER MCDOUGAL QUESTIONED WHAT TYPE OF MOBILE HOME WAS LOCATED ON NORTH CLINTON AVENUE. PUBLIC WORKS DIRECTOR TIM HOLLOMAN RESPONDED THAT THE MOBILE HOME ON NORTH CLINTON AVENUE WAS NOT A SINGLE -WIDE MOBILE HOME. HE STATED THAT HE WOULD NEED TO CHECK THE STICKER ON THE MOBILE HOME, BUT IF THERE WAS AN ORANGE STICKER LOCATED ON THE MOBILE HOME, IT MEETS STATE REGULATIONS FOR A MODULAR HOME WHICH MUST BE PERMITTED BY THE CITY. ATTORNEY GODWIN STATED THAT THERE WERE TWO RECOMMENDATIONS MADE BY THE PLANNING BOARD, ONE BEING THE DENIAL OF AMENDING THE CITY CODE TO ALLOW SINGLE FAMILY, SINGLE -WIDE MOBILE HOMES IN THE ETJ AND THE OTHER BEING TO RESEARCH THE CITY CODE TO MAKE IT MORE USER FRIENDLY FOR SINGLE -WIDE, SINGLE FAMILY MOBILE HOMES IN THE ETJ. MAYOR OUDEH APPOINTED CITY ATTORNEY GODWIN, COUNCILMEMBER BASS AND COUNCILMEMBER MCDOUGAL TO RESEARCH THE CITY CODE TO DETERMINE HOW TO MAKE IT MORE USER FRIENDLY FOR SINGLE -WIDE, SINGLE FAMILY MOBILE HOMES IN THE EXTRA TERRITORIAL JURISDICTION. 528 WITH NO FURTHER DISCUSSION, MAYOR OUDEH CLOSED THE PUBLIC HEARING IN REFERENCE TO SAME. LAW ENFORCEMENT BLOCK GRANT CITY MANAGER DEAN STATED THAT THE PUBLIC HAS BEEN NOTIFIED THAT ORAL AND WRITTEN COMMENTS WOULD BE HEARD AND RECEIVED CONCERNING THE ALLOCATION OF THE LOCAL LAW ENFORCEMENT BLOCK GRANT RECEIVED FROM THE U.S. DEPARTMENT OF JUSTICE. l HE ALSO STATED THAT THE PUBLIC HEARING WAS DULY ADVERTISED ON APRIL 18 i 2000. HE YIELDED TO CAPTAIN MORRY DENNING FOR COMMENTS. CAPTAIN DENNING STATED THAT THE GRANT WAS IN THE AMOUNT OF $45,990.00 WITH THE CITY'S MATCH IN THE AMOUNT OF $5,110.00. HE STATED THAT THE PRELIMINARY PLANS WERE REVIEWED AND THE FOLLOWING COMMENTS WERE MADE AND AGREED UPON BY THE DEVELOPER AND ENGINEER: • DOT AND CP &L WILL RESOLVE THE POWELL AVENUE -ASHE AVENUE INTERSECTION WITH THE DEVELOPERS ENGINEER. • 2" WATER MAINS WILL BE ALLOWED ON CUL -DE -SACS PROVIDED ALL HOUSING UNITS ARE WITHIN 500 FEET OF HYDRANTS ON 6" MAINS MEASURED ALONG ACCESS /^ ROADS. 2" MAINS WILL BEGIN AT THE LAST HYDRANT ON STANDARD MAINS. • 4" SEWER SERVICES WILL BE LIMITED TO 100 FEET FROM PROPERTY LINE CLEAN OUTS. • PAVED LANES WILL BE 11 FEET MINIMUM. THERE WAS A CONCENSUS OF COUNCIL TO HOLD A BUDGET WORKSESSION ON MAY 18, 2000 IN THE DUNN MUNICIPAL BUILDING. INFORMATION MAYOR OUDEH ADVISED COUNCIL THAT ADMINISTRATIVE REPORTS WERE IN THEIR AGENDA PACKETS FOR REVIEW. MAYOR OUDEH STATED THAT HE WANTED CITY COUNCIL TO ALWAYS LOOK POSITIVELY AT TRYING TO HELP THE COMMUNITY. 535 COUNCILMEMBER BASS STATED THAT HE !NEW THE CITY HAD STARTED MOVING SOME CARS BUT THERE WERE STILL SOME PLACES THAT LOOK BAD AND SOMETHING NEEDED TO BE DONE ABOUT IT. CODE ENFORCEMENT OFFICER ALONZA VA.NN STATED THAT HE HAD SENT OUT 60 TO 70 LETTERS AND THAT HE HAS TO GIVE THE PROPERTY OWNERS SEVEN DAYS BEFORE ANYTHING CAN BE DONE BY THE CITY. HE ADDED THAT PUBLIC WORKS WILL BEGIN CUTTING VACANT LOTS NEXT WEEK. COUNCILMEMBER BASS STATED HE WAS TALKING ABOUT THE JUNKYARDS, HE WAS NOT TALKING ABOUT THE GRASS OR THE VEHICLES. COUNCILMEMBER ROBINSON ASKED IF THE CITY CAN CUT THE GRASS AND CHARGE THE OWNERS OF THE PROPERTY. CITY MANAGER DEAN RESPONDED THAT IT CAN BE DONE WITH A BUSHHOG.. COUNCILMEMBER ROBINSON STATED THAT HE THOUGHT THEY NEEDED TO RAISE THE FEE FOR GRASS CUTTING BECAUSE IT WAS TOO CHEAP. COUNCILMEMBER MCDOUGAL STATED THAT CAROLYN FORDHAM HAD RECEIVED THREE INVOICES FOR CURB AND GUTTER WITH INTEREST ADDED. CITY MANAGER DEAN STATED HE THd`JGHT THAT MS. FORDHAM HAD SIGNED A PETITION TO HAVE THE WORK DONE, BU7 HE WOULD CHECK INTO THE MATTER AND HAVE SOMEONE CONTACT MS. FORDHAM. CITY MANAGER DEAN STATED THAT THE SOLID WASTE BIDS WOULD BE IN ON MAY 10 AND THE COMMITTEE WILL MEET AFTER THAT TO REVIEW BIDS. WITH NO FURTHER DISCUSSION, THE FOLLOWING BURIAL RIGHTS WERE EXECUTED: 1. MR. JOHN B. PEARSON, JR & HIS HEIRS, LOT 41, BLOCK AA, SPACE(S) 1,2,5 & 6 IN MEMORIAL CEMETERY.
