CITY OF DUNN
DUNN, NORTH CAROLINA
The City Council of the City of Dunn held a Special Call Meeting on Tuesday, February 17, 2004, at
7:00 p.m. in the Dunn Municipal Building. Present was Mayor J. Dal Snipes, Mayor Pro -Tern
Donnie Olds, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Billy R. Godwin, Jr.
and Joey Tart. Also present was City Manager Michael Uskiewicz, Human Resources /Safety Officer
Moses Galliion, City Planner Julie Reid, City Attorney P. Tilghman Pope, and City Clerk Debra
West.
INVOCATION
Mayor Snipes opened the meeting at 7:00 p.m. and asked Mayor Pro -Tem Olds to give the invocation.
�✓ Afterwards, the pledge of allegiance was repeated.
Mayor Snipes closed the regular meeting and opened public hearings at 7:03 p.m.
PUBLIC HEARINGS
REZONING REQUEST -DOUG GODWIN
PIN #1516 -66 -1766 (200 SOUTH WILSON AVE.)
The public has been notified that oral and written comments will be heard and received concerning the
request by Doug Godwin to rezone the property at 200 South Wilson Avenue.
This property is zoned C -O Office/Institutional and is - to be rezoned to C -1 Central Commercial
District.
The public hearing was duly advertised on February 6, 2004 and February 13, 2004.
Mayor Snipes asked if there was anyone present to speak for or against this rezoning. Hearing none, he
closed the public hearing in reference to same.
REZONING REQUEST -JOHN PRITCHER
PIN #1517 -83 -2287 (1505 NORTH ELLIS AVENUE)
The public has been notified that oral and written comments will be heard and received concerning the
request by John Pritcher to rezone the property at 1505 North Ellis Avenue.
This property is zoned R -10 Single Family Residential and is requested to be rezoned to R -M Multiple
Family Residential.
The public hearing was duly advertised on February 6, 2004 and February 13, 2004
Mayor Snipes asked if there was anyone present to speak for or against this rezoning. Hearing none, he
closed the public hearing in reference to same.
CONDITIONAL USE PERMIT -JOHN PRITCHER
PIN #1517 -83 -2287 (1505 NORTH ELLIS AVENUE)
The public has been notified that oral and written comments will be heard and received concerning the
request by John Pritcher to allow for a second residential unit on the property located at 1505 North Ellis
Avenue.
The public hearing was duly advertised on February 6, 2004 and February 13, 2004
Mayor Snipes asked if there was anyone present to speak for or against this conditional use permit.
Hearing none, he closed the public hearing in reference to same.
CONDITIONAL USE PERMIT -MIENG YANG WANG
PIN #1517- 014103 (1906 WEST CUMBERLAND STREET)
The public has been notified that oral and written comments will be heard and received concerning the
request by Wang Rentals LLC (owner) and George Nunez (tenant) to approve the sale of alcohol in
conjunction with a restaurant located at 1906 West Cumberland Street.
The public hearing was duly advertised on February 6, 2004 and February 13, 2004.
Mayor Snipes asked if there was anyone present to speak for or against this conditional use permit.
Hearing none, he closed the public hearing in reference to same.

CODE AMENDMENTS TO ZONING ORDINANCE, CHAPTER 22
The public has been notified that oral and written comments will be heard and received concerning the
request by the City of Dunn Planning Department to amend the City of Dunn Code of Ordinances, Chapter
22.
Revisions under consideration are:

The public hearing was duly advertised on February 6, 2004 and February 13, 2004
Mayor Snipes asked if there was anyone present to speak for or against these code amendments. Hearing
none, he closed the public hearing in reference to same.
Motion by Council Member Joey Tart, seconded by Mayor Pro -Tern Olds to close public hearings and
reconvene the regular Council meeting at 7:08 p.m. Motion unanimously approved.
ITEMS FOR DECISION
REZONING REQUEST -DOUG GODWIN
PIN #1516 -66 -1766 (200 S. WILSON AVE.)
A request was received from Doug Godwin to rezone the property located at 200 S. Wilson Avenue
(southwest corner of Cumberland Street and Wilson Avenue). This property is zoned C -O
Office/Institutional and is requested to be rezoned b C -1 Downtown Business.
The Planning Board met on February 10, 2004 and recommended approval of this request.
Motion by Mayor Pro -Tem Olds, seconded by Council Member Joey Tart to rezone 200 S. Wilson Avenue
from C -O Office/Institutional to C -1 Downtown Business, provided that property comply with applicable
regulations to the C -1 District. Motion unanimously approved.
REZONING REQUEST -JOHN PRITCHER
PIN #1517 -83 -2287 (1505 N. ELLIS AVE.)
A request was received from John Pritcher to rezone the property located at 1505 N. Ellis Avenue. This
property is zoned R -10 Single Family Residential and is requested to be rezoned to R -M Multiple Family
Residential.
The Planning Board met on February 10, 2004 and recommended approval of this request.
Motion by Council Member Godwin, seconded by Council Member Maness to rezone the property located
at 1505 N. Ellis Avenue from R -10 Single Family Residential to R -M Multiple Family Residential.
Motion unanimously approved.
CONDITIONAL USE PERMIT -JOHN PRITCHER
PIN #1517 -83 -2287 (1505 N. ELLIS AVE.)
A request was received from John Pritcher for a conditional use permit within a R -M Multiple Family
Residential District. This request is to allow a second dwelling unit (apartment above garage) on 7.8 acres
at 1505 N. Ellis Avenue.
The Planning Board met on February 10, 2004 and recommended approval of this request.
Motion by Mayor Pro -Tem Olds seconded by Council Member Galbreath, to approve the conditional use
permit for John Pritcher to allow a second dwelling unit (apartment above garage) on 7.8 acres at 1505 N.
Ellis Avenue based upon findings referenced in Chapter 22, Section 22 -485 (b) of the City of Dunn Code of
Ordinances. Motion unanimously approved.

CONDITIONAL USE PERMIT -MIENG YANG WANG
PIN #1517 -01 -4103 (1906 W. CUMBERLAND ST.)
A request was received from Wang Rentals LLC (owner) and George Nunez (tenant) for a conditional use
permit within a C -3 Highway Commercial District. This request is to allow the sale of alcohol in
conjunction with a restaurant located at 1906 West Cumberland Street.
The Planning Board met on February 10, 2004 and recommended approval of this request.
Motion by Council Member Galbreath, seconded by Council Member Godwin, to approve the conditional
use permit for Mieng Yang Wang (owner) and George Nunez (tenant) to allow the sale of alcohol in
conjunction with a restaurant located at 1906 W. Cumberland Street.
Council Member Galbreath amended his original motion, seconded by Mayor Pro -Tent Olds, by adding
"based upon findings referenced in Chapter 22, Section 22 -485 (b) of the City of Dunn Code of
Ordinances ". Motion unanimously approved.
Original motion as amended called to vote. Motion unanimously approved.
CODE AMENDMENTS- CHAPTER 22
Council discussed proposed code amendments to Chapter 22 (Zoning) of the City of Dunn Code of
Ordinances.
Motion by Council Member Maness, seconded by Council Member Galbreath to table all code amendments
until the next council meeting on March 4, 2004. Motion unanimously approved.
Due to the volume of code amendments being considered at the Council meetings, Council Member
Godwin suggested that at the same time Planning Board agendas are sent out, to also provide a copy to the
Council. This will give the Council more time to digest and know the issues before they are voted on.

Mayor Pro -Tem Olds suggested that the Council decide on the rules of procedures they wish to use;
Robert's Rules of Order or Suggested Rules of Procedure for a City Council provided by the Institute of
Government. Mayor Snipes agreed. This item will be placed on the March 4, 2004 agenda.
Mayor Snipes announced that the Wilkins Cemetery Committee has extended an invitation to celebrate
Black History Month at the Cemetery on Saturday, February 28 at 12:00 noon.

Mayor Snipes announced there will be a topping out ceremony for renovations at Betsy Johnson Regional
Hospital on Friday, February 20, 2004 at 11:30 a.m.
Council Member Godwin reminded the council of the dedication ceremony of the Dunn High School
monument on Sunday, February 22, 2004 at 1:00 p.m.
With no further business to discuss, the meeting was adjourned at 7:24 p.m.
