THE CITY COUNCIL OF THE CITY OF DUNN HELD A REGULAR MEETING ON
THURSDAY, MAY 02, 2002, AT 7:00 P.M. IN THE DUNN MUNICIPAL BUILDING. PRESENT
WAS MAYOR ABRAHAM OUDEH, MAYOR PRO -TEM MIKE WOMBLE,
COUNCILMEMBERS TOBY SUMNER, GEORGE ROBINSON, JOEY TART, AND PAUL BASS.
ALSO PRESENT WAS INTERIM CITY MANAGER RONNIE AUTRY, CAPTAIN MORRY

INTERIM CITY MANAGER AUTRY STATED THAT ATTACHED THE COUNCIL WILL FIND A
PETITION REQUESTING A CONTIGUOUS ANNEXATION OF .53 ACRES OF PROPERTY
LOCATED ON SR 1719 (POWELL AVENUE). HE ADDED THAT JAMES A. GODWIN, OWNER OF
THE PROPERTY HAS REQUESTED A VOLUNTARY ANNEXATION OF HIS PROPERTY.
MR. AUTRY STATED THAT SHOULD COUNCIL WISH TO PROCEED WITH THE ANNEXATION
OF THIS PROPERTY, A RESOLUTION DIRECTING THE CLERK TO INVESTIGATE PETITION IS

MOTION BY COUNCILMEMBER ROBINSON, SECONDED BY COUNCILMEMBER TART TO
ADD RELEASE OF PROPERTY -500 NORTH MAGNOLIA AVENUE AS AN ITEM OF DECISION
TO THE AGENDA. MOTION UNANIMOUSLY APPROVED.
INTERIM CITY MANAGER AUTRY STATED THAT MR. WILLIE FAIRLEY PROPOSES TO
TRANSFER A VACANT LOT AT THE SOUTHEAST CORNER OF EAST COLE STREET AND
NORTH MAGNOLIA AVENUE TO MS. DAPHNE M. MANESS. HE ADDED THIS LOT IS PART OF
500 NORTH MAGNOLIA AVENUE WHICH WAS RENOVATED UNDER A COMMUNITY
DEVELOPMENT BLOCK GRANT PROJECT (CDBG).
MR. AUTRY STATED THAT ATTACHED IS A LETTER FROM THE NORTH CAROLINA
DEPARTMENT OF COMMERCE AUTHORIZING THE CITY OF DUNN TO RELEASE THE
VACANT LOT OF THE PROPERTY LOCATED AT 500 NORTH MAGNOLIA AVENUE.
JERRY HOFFMAN, GENERAL MANAGER OF HORTON HOMES STEPPED FORWARD AND
SHOWED THE COUNCIL A MAP OF THE PROPERTY. HE STATED THAT THERE WERE TWO
PIECES OF PROPERTY. HE ADDED THAT ONE PIECE OF PROPERTY ON MAGNOLIA AVENUE
TOOK UP 15' AND THE OTHER PIECE TOOK UP THE REMAINDER OF THE PROPERTY. HE
FURTHER STATED ATTORNEY RICK BUTLER HAD PREPARED A RELEASE DEED.
COUNCILMEMBER TART ASKED MR. HOFFMAN IF HE WAS ASKING FOR THE 15' PIECE OF
PROPERTY TO BE RELEASED. MR. HOFFMAN RESPONDED NO. HE STATED THAT THERE
WAS A 15' PIECE ON MAGNOLIA AVENUE AND ANOTHER PIECE WITH APPROXIMATELY
200'. HE ADDED THEY WANTED TO TAKE IN 120' TO 150' OF THE PIECE THAT HAS THE
DEED OF TRUST AGAINST IT AND INCORPORATE A SEPARATE DEED SO THEY CAN PLACE
A NEW MANUFACTURED HOME THERE. HE FURTHER STATED THE DEED OF TRUST WAS
ON 500 NORTH MAGNOLIA AVENUE WHICH ALREADY HAS A HOUSE ON IT.

MR. HOFFMAN STATED THE EXISTING HOUSE WITH THE DEED OF TRUST AGAINST IT IS
ON THE CORNER AND WILL REMAIN INTACT ON THIS PROPERTY. HE ADDED THAT BASED
ON INFORMATION RECEIVED FROM ATTORNEY RICK BUTLER AND THE NC DEPARTMENT
OF COMMERCE DIVISION OF COMMUNITY DEVELOPMENT, THERE IS NO REASON THE
PROPERTY VALUE OF THE EXISTING HOME WILL DECREASE BY CUTTING AWAY THIS
PORTION OF LAND AND IT WILL NOT AFFECT THE DEED OF TRUST. HE FURTHER STATED
THIS DEED OF TRUST WILL CEASE IN TWO YEARS. MR. HOFFMAN STATED THIS DEED OF
TRUST IN THE AMOUNT OF $17,500.00 WAS TAKEN OUT IN THE YEAR 1997. HE ADDED
$2,500.00 HAS BEEN PAID EVERY YEAR AND IN JULY, 2002 THE BALANCE WILL BE $5,000.00.
HE FURTHER STATED NEXT YEAR THE BALANCE WILL BE DOWN TO $2,500.00.
MR. HOFFMAN STATED THEY WERE ASKING FOR THIS PROPERTY TO BE DIVIDED TO
ALLOW A NEW MANUFACTURED HOME TO BE PLACED THERE. MAYOR PRO -TEM
WOMBLE ASKED MR. HOFFMAN IF THEY RELEASED THIS PARTICULAR PIECE, THEN WHAT
WOULD BE LEFT. MR. HOFFMAN RESPONDED THE HOUSE AND LOT ON THE CORNER OF
MAGNOLIA AND CLEVELAND. HE ADDED THEY WANT TO PUT A NEW MANUFACTURED
HOUSE ON THE CORNER OF MAGNOLIA AND CARR.
INTERIM CITY MANAGER AUTRY STATED HE HAD TALKED WITH DAVE HOLMES, WHO
WAS ONCE THE COMMUNITY DEVELOPMENT COORDINATOR. HE ADDED THAT MR.
HOLMES SAID THIS WAS ROUTINELY DONE THROUGHOUT THE STATE AND IT WAS HIS
RECOMMENDATION TO RECEIVE THE LETTER FROM THE DEPARTMENT OF COMMERCE
FOR THE RELEASE. HE FURTHER STATED THE LETTER FROM THE NC DEPARTMENT OF
COMMERCE AUTHORIZES THE CITY TO RELEASE THE VACANT PROPERTY BUT THE
HOUSE AND 100' X 120' LOT WOULD REMAIN INTACT WITH THE DEED OF TRUST UNTIL IT
IS PAID OFF.
MAYOR PRO -TEM WOMBLE ASKED MR. HOFFMAN IF THERE WERE ANY OTHER DEEDS OF
TRUST AGAINST THIS PROPERTY. MR. HOFFMAN RESPONDED THAT A TITLE SEARCH
REVEALED NONE.
MOTION BY MAYOR PRO -TEM WOMBLE, SECONDED BY COUNCILMEMBER BASS TO
AUTHORIZE THE MAYOR TO SIGN THE DOCUMENT PREPARED BY ATTORNEY RICK
BUTLER AND THE COUNCILMEMBERS WILL SIGN AS TRUSTEES TO RELEASE THE VACANT
LOT OF THE PROPERTY LOCATED AT 500 NORTH MAGNOLIA AVENUE. MOTION
UNANIMOUSLY APPROVED. (ATTACHMENT #6)
DUNN ERWIN TRAIL
INTERIM CITY MANAGER AUTRY STATED THAT MR. JOHN SNIPES, VICE - CHAIRMAN OF
THE EXECUTIVE COMMITTEE OF THE DUNN ERWIN TRAIL HAS REQUESTED TO APPEAR
BEFORE THE CITY COUNCIL TO GIVE AN UPDATE ON THE STATUS OF THE DUNN ERWIN
TRAIL.
MR. SNIPES STEPPED FORWARD AND PROVIDED COPIES OF THE POWER POINT
PRESENTATION TO THE COUNCIL. MR. SNIPES ADDRESSED MAYOR OUDEH AND THE CITY
COUNCIL BY STATING THAT HE REPRESENTED THE NORTH CAROLINA RAIL TRAILS AND
THE DUNN ERWIN TRAIL EXECUTIVE COMMITTEE. HE ADDED THAT HE WOULD LIKE TO
SPEAK TO THE MAYOR AND CITY COUNCIL ABOUT THE DUNN ERWIN TRAIL AND
ULTIMATELY ASK FOR A RESOLUTION OF ENDORSEMENT FOR THIS PROJECT.
MR. SNIPES STATED THAT HE WANTED TO BRING THE COUNCIL UP TO DATE ON HOW THE
TRAIL STARTED, WHERE THE TRAIL IS PRESENTLY AND WHERE IT IS HEADED. HE ADDED
THAT THE DUNN ERWIN TRAIL WAS THE FIRST RAILROAD CORRIDOR IN NORTH
CAROLINA TO BE PLACED IN A LAND TRUST. HE FURTHER STATED THAT UNDER THESE
FEDERAL GUIDELINES, ABERDEEN ROCKFISH RAILROAD GAINED TAX INCENTIVES BY
ENTERING INTO AN AGREEMENT WITH THE NC RAIL TRAILS.
MR. SNIPES STATED THIS AGREEMENT PROVIDES FOR NON - MOTORIZED RECREATIONAL
USE OF THE CORRIDOR WHILE ALSO PRESERVING THE CORRIDOR FOR FUTURE RAIL
TRANSPORTATION IF NEEDED. HE ADDED THAT IN THE SPRING OF 2000, WITH THE HELP
AND SUPPORT OF THE COUNTY AND BOTH AREA CHAMBERS OF COMMERCE, A
COMMITTEE WAS FORMED AND THE DEVELOPMENT OF THE TRAIL BEGAN MOVING
FORWARD. HE FURTHER STATED THAT BY FEBRUARY, 2001 THE RAILS AND TIES WERE
REMOVED AND PROCEEDS FROM THE SALE AND RECYCLING OF THESE ITEMS WERE
PROVIDING FUNDS FOR THE INITIAL TRAIL BED PREPARATION ALONG THE 5.3 MILE
CORRIDOR.
MR. SNIPES STATED THAT A CANADIAN COMPANY PERFORMED THE INITIAL
PREPARATION OF THE TRAIL BED BY USING A NEW MACHINE NEVER USED IN THIS PART
OF THE COUNTRY. HE ADDED THAT THIS MACHINE CRUSHED AND COMPACTED THE
RAIL BED AND PROVIDED AN INITIAL TRAIL SURFACE MAKING FUTURE PAVING EASIER
AND LESS COSTLY. HE FURTHER STATED THE USE OF THIS NEW MACHINE RESULTED IN
MEDIA EXPOSURE THROUGHOUT THE STATE FOR DUNN, ERWIN AND HARNETT COUNTY.
MR. SNIPES STATED THIS EXPOSURE GAVE A POSITIVE IMPRESSION OF SMALL TOWN
NORTH CAROLINA. HE ADDED THAT IN THE SPRING OF 2001, HARNETT COUNTY IN

CONJUNCTION WITH A SMALL GRANT FROM ADOPT -A- TRAIL, SPONSORED A PROPOSAL
TO BE DRAWN BY THE LANDSCAPE AND ARCHITECTURE GRADUATE CLASS OF NC STATE
UNIVERSITY.
MR. SNIPES STATED A PUBLIC MEETING WAS HELD IN THE ERWIN COMMUNITY BUILDING
WHICH ALLOWED THE CITIZENS OF HARNETT COUNTY TO SHARE THEIR IDEAS
CONCERNING THE TRAIL WITH THE GRADUATE STUDENTS OF NC STATE. HE ADDED
THAT THE STUDENTS THEN TOOK BACK INFORMATION AND DEVELOPED WHAT IS NOW
THE DUNN ERWIN TRAIL MASTER PLAN. HE FURTHER STATED THAT SINCE THE MASTER
PLAN IS DEVELOPED, ADDITIONAL FUNDING WAS NEEDED TO KEEP THE PROJECT
MOVING FORWARD.
MR. SNIPES STATED WITH RECENT BUDGET CONSTRAINTS, HE KNEW THAT CITY AND
COUNTY FUNDS WERE LIMITED SO IN JULY, 2001, HIS COMMITTEE TURNED TO THE
J NATIONAL PARKS AND RECREATION SERVICE FOR A $50,000.00 GRANT. HE ADDED THIS
GRANT WAS CONTINGENT UPON A LOCAL MATCH OF $12,500.00. HE FURTHER STATED
THE EXECUTIVE COMMITTEE PROVIDED THIS MATCH THROUGH MANY VOLUNTEER
HOURS.
MR. SNIPES STATED THAT THE NC DEPARTMENT OF TRANSPORTATION DONATED
$40,000.00 WORTH OF SIGNAGE. HE ADDED THAT DOT PROVIDED THE ENGINEERING,
CONSTRUCTION AND PLACEMENT OF ALL THE SIGNS AT EACH TRAIL INTERSECTION.
HE FURTHER STATED THAT IN MARCH OF 2002, ANOTHER ADOPT -A -TRAIL GRANT IN THE
AMOUNT OF $5000.00 WAS RECEIVED.
MR. SNIPES STATED THIS GRANT ENABLED THEM TO BEGIN THE GRANITE SCREENING
PROCESS. HE ADDED THE GRANITE SCREENINGS ARE A THIN LAYER OF GRANITE FINES
ALMOST AS HARD AS CONCRETE. HE FURTHER STATED THIS WILL MAKE FUTURE
PAVING OF THE TRAIL LESS COSTLY.
MR. SNIPES STATED THIS IS A SHORT SUMMARY OF THE PROGRESS OF THE TRAIL IN THE
LAST TWO YEARS. HE ADDED THAT MANY CONTRIBUTIONS HAVE BEEN GIVEN BY MANY
INDIVIDUALS AND BUSINESSES INCLUDING DUNN AND ERWIN CHAMBERS, DUNN AND
ERWIN PUBLIC WORKS, HARNETT COUNTY, THE DAILY RECORD, THE COMMUNITY
LEADER, WELLS CONSTRUCTION, HARNETT TRACTOR COMPANY, MANY PRIVATE
BUSINESSES AND ESPECIALLY THOMAS JERNIGAN OF THE DUNN PUBLIC WORKS
DEPARTMENT.
MR. SNIPES SHOWED THE COUNCIL A SLIDE PRESENTATION OF BEFORE AND AFTER
i PHOTOS OF THE TRAIL.
MR. SNIPES STATED THIS TRAIL IS AN EXAMPLE OF HOW THINGS CAN GET DONE WHEN
LOCAL CITIZENS WORK WITH THEIR LOCAL GOVERNMENTS AND EACH OTHER TO
ACHIEVE GOALS. HE ADDED THAT THE DUNN ERWIN TRAIL HAS A POSITIVE IMPACT ON
THE COMMUNITY WITHOUT CREATING A FINANCIAL BURDEN ON THE CITY COUNCIL
AND MUNICIPALITIES. HE FURTHER STATED THEIR FUTURE GOALS INCLUDED
COMPLETION OF THE GRANITE SCREENINGS ALONG THE REST OF THE TRAIL AND TO
ASPHALT THE ENTIRE TRAIL.
MR. SNIPES STATED THE ADOPT -A -TRAIL PROGRAM WILL START SOON WI-IICH WILL
ENABLE A BUSINESS OR INDIVIDUAL TO SPONSOR A PORTION OF THE TRAIL AND BE
RESPONSIBLE FOR CLEANING AND MAINTAINING THAT PORTION. HE ADDED THAT
LANDSCAPE ENHANCEMENTS ARE PROPOSED AND THEY HAVE BEEN SELECTED TO BE A
PART OF THE EAST COAST GREEN -WAY WHICH WILL CONNECT MAINE TO FLORIDA. HE
FURTHER STATED THIS IS AN ONGOING NATIONAL PROJECT THEY ARE PROUD TO BE A
PART OF THAT COULD POTENTIALLY HAVE A HUGE IMPACT ON TOURISM IN THIS AREA.
MR. SNIPES STATED THAT OVER 5,000 VISITORS CAME TO THE AVERASBORO
BATTLEFIELD RE- ENACTMENT A FEW WEEKS AGO AND THIS TRAIL CAN HELP TO
ENHANCE TOURISM. HE ADDED HE IS NOT ASKING FOR MONEY, BUT FOR SUPPORT AND
PARTICIPATION. HE FURTHER STATED THE DUNN ERWIN TRAIL COMMITTEE WILL BE
HOSTING ANOTHER COUNTY -WIDE MEETING TO PRESENT THE OFFICIAL DUNN ERWIN
TRAIL MASTER PLAN TO THE PUBLIC AT THE ERWIN COMMUNITY BUILDING ON MAY 16,
2002 AT 5:30 P.M. HE EXTENDED AN INVITATION TO THE CITY COUNCIL TO ATTEND THE
MAY 16 MEETING AND AT THAT SAME TIME, HE WOULD LIKE TO PRESENT THE CITY OF
DUNN WITH A COPY OF THE FINALIZED OFFICIAL TRAIL MASTER PLAN.
MR. SNIPES INVITED THE COUNCIL TO THE OFFICIAL GRAND OPENING AND RIBBON
CUTTING OF THE TRAIL TO BE HELD ON SATURDAY, JUNE 15, 2002 FROM 9:00 A.M. UNTIL
12:00 NOON. HE ADDED THAT AFTER JUNE 15, 2002 THE TRAIL WILL BE OPEN FOR PUBLIC
USE. HE FURTHER STATED DURING THIS EVENT, THE CHAIRMAN OF THE EAST COAST
GREEN -WAY WILL GIVE A SPEECH.
MR. SNIPES ENCOURAGED THE COUNCIL TO PARTICIPATE IN THESE EVENTS. HE ADDED
THAT HARNETT COUNTY AND THE PREVIOUS ERWIN CITY COUNCIL HAS ENDORSED THIS
PROJECT AND IT IS HIS HOPE THAT THE DUNN CITY COUNCIL WILL ALSO ENDORSE THIS
PROJECT. HE FURTHER STATED THAT WITH THE CITY'S ENDORSEMENT, IT WILL MEAN
THAT BOTH DUNN AND ERWIN AS WELL AS THE COUNTY SUPPORTS THIS PROJECT AND

WILL GIVE THE TRAIL THE BEST CHANCE TO RECEIVE OTHER PUBLIC FUNDS THAT ARE
AVAILABLE AND SPECIFICALLY INTENDED FOR NON - MOTORIZED RECREATIONAL
PURPOSES.
MR. SNIPES STATED THAT THE FUNDS THE RAIL TRAIL IS APPLYING FOR ARE NOT FUNDS
INTENDED FOR ROADS OR MOTORIZED USES. HE ADDED THE FUNDS ARE STRICTLY FOR
TRAILS. HE FURTHER STATED THAT THEY NEEDED THE ENDORSEMENT OF THE CITY
COUNCIL.
MR. SNIPES THANKED THE COUNCIL FOR THEIR CONSIDERATION AND STATED HE WOULD
ANSWER ANY QUESTIONS THEY MAY HAVE.
COUNCILMEMBER SUMNER STATED HIS INITIAL CONCERN WAS SAFETY. MR. SNIPES
STATED THAT SAFETY IS NOT AN ISSUE ANY MORE THAN ON A PUBLIC STREET OR
PUBLIC PARK. HE ADDED THEY WOULDN'T CONDONE SOMEONE WALKING THE TRAIL AT
NIGHT ANYMORE THAN WALKING DOWN A PUBLIC STREET OR BEING IN A PUBLIC PARK
AT NIGHT.
MR. SNIPES STATED THAT A $50,000.00 GRANT FROM THE NATIONAL PARKS AND
RECREATION WAS EARMARKED FOR SAFETY DEVICES. HE ADDED THERE WILL BE EMT
SIGNAGE AND MILE MARKERS SO THAT EMERGENCY VEHICLES WILL KNOW WHERE
THEY CAN ENTER THE RAIL TRAIL FOR EMERGENCIES.
COUNCILMEMBER TART ASKED MR. SNIPES WHAT DID HE FORESEE AS CITY
EXPENDITURES FOR THE TRAIL. MR. SNIPES RESPONDED MINIMAL LANDSCAPING. MR.
SNIPES STATED THE INITIAL SET -UP FEE, PAVING FEE AND INITIAL COST HAS NOT BEEN
PASSED ON TO THE CITY AND HE WAS HOPING THE CITY WOULD TAKE THIS AS PART OF
THEIR CITY MOWING WHICH WOULD BE MINIMAL.
COUNCILMEMBER TART ASKED MR. SNIPES IF HE THOUGHT THERE WOULD BE ENOUGH
FUNDING TO CONTINUE PAVING THE TRAIL TO DUNN. MR. SNIPES RESPONDED YES, BUT
IT WAS IMPERATIVE TO HAVE A RESOLUTION OF ENDORSEMENT FROM EACH
MUNICIPALITY AND THE COUNTY TO LET THE HOLDERS OF THE GRANT KNOW THERE IS
SUPPORT FROM NOT ONLY THE CITIZENS BUT THE AREA CITIES AND COUNTY.
COUNCILMEMBER SUMNER STATED HE THOUGHT THIS WAS A GREAT PROJECT BUT
ASKED IF THERE WOULD BE A PROBLEM PROTECTING THE RAIL TRAIL. INTERIM CITY
MANAGER AUTRY STATED HE DID NOT SEE A PROBLEM IN THE CITY OF DUNN'S PORTION
OF THE TRAIL. HE STATED THIS AREA IS WIDE OPEN FROM GLEN EAGLES SUBDIVISION
BACK TO LAYTON AND MCKAY AVENUE. HE ADDED HE DID NOT SEE THIS AS A MAJOR
ISSUE AS THE COUNTY AREA MAY HAVE.
MAYOR OUDEH ASKED MR. SNIPES IF THERE WOULD BE ANY OBJECTIONS FROM THE
DUNN ERWIN TRAIL IF THE CITY ENDORSED THIS PROJECT BUT THE CITY COUNCIL BE
KEPT INFORMED OF WHAT IS BEING DONE. MR. SNIPES RESPONDED HE WOULD BE HAPPY
TO GIVE AN ANNUAL REPORT.
COUNCILMEMBER ROBINSON ASKED MR. SNIPES WHAT HOURS WOULD THE TRAIL BE
OPEN. MR. SNIPES STATED IT WOULD BE OPEN DURING DAY LIGHT HOURS ONLY.
MS. JOY WILLIAMS, AN AUDIENCE MEMBER ASKED MR. SNIPES HOW WOULD SHE GET
HELP IF SHE NEEDED IT ON THE TRAIL, HOW MANY PEOPLE ARE EXPECTED TO USE THIS
TRAIL AND HOW OFTEN WOULD THE POLICE PATROL THE TRAIL. MR. SNIPES RESPONDED
THAT HIS FAMILY WALKED IN PAIRS AND SAFETY PHONES MAY BE INSTALLED ON THE
TRAIL. HE FURTHER STATED THAT HIS COMMITTEE ALONG WITH DUNN, ERWIN AND THE
COUNTY COLLECTIVELY WILL DO THEIR BEST TO ENSURE THE SAFETY ON THE TRAIL
AND ADEQUATELY PROTECT THE CITIZENS.
MAYOR OUDEH SUGGESTED IF THE AUDIENCE HAD ANY OTHER QUESTIONS, TO TALK
WITH MR. SNIPES AFTER THE MEETING.

HE HAS TALKED WITH THE ENGINEERS WHO HAVE GIVEN NOTICE TO PROCEED TO
JOHNSON BROTHERS. HE ADDED THAT A PRE- CONSTRUCTION CONFERENCE WILL BE
HELD NEXT WEEK TO CONFIRM THE GO -AHEAD FOR THE GRADING. HE FURTHER STATED
EVERYTHING IS GOING AS ANTICIPATED AND AS SOON AS GRADING IS COMPLETED,
RESURFACING WILL START.
