05112006MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Special Call Meeting on Thursday, May 11, 2006, at 5:00 p.m. in the Dunn Municipal Building. Present was Mayor J. Dal Snipes, Mayor Pro Tem Donnie Olds, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Billy R. Godwin, Jr. and Joey Tart. Also present was Interim City Manager Ronnie Autry, Human Resources Officer Moses Gallion, City Attorney P. Tilghman Pope, and City Clerk Debra West. INVOCATION Mayor Snipes opened the meeting at 5:00 p.m. and asked Council Member Maness to give the invocation. Afterwards the Pledge of Allegiance was repeated. ITEMS .FOR DECISION CONSIDERATION OF RESOLUTION AUTHORIZING THE ADVERTISEMENT OF AN OFFER TO PURCHASE CERTAIN PROPERTY — CITY PARHING LOT LOCATED ACROSS FROM THE DAILY RECORD City Attorney Pope explained that this proposed resolution is relative to the parking lot parallel to the railroad track on West Broad Street and West Edgerton Street which the Council discussed at their last meeting. In order for the ten day upset period to begin accumulating, the Council is being asked to adopt this resolution which will direct the City Clerk to publish the notice of intent to sell the property pursuant to the terms set forth in the resolution. This resolution declares certain property surplus to the needs of the City and authorizes the City to receive and negotiate an offer (present offer of $92,000) to purchase the property described in the attached resolution (parking lot located across from The Daily Record). Upset bids must be submitted within 10 days after the date of publication and must raise the bid which is being considered by at least 10% of the first thousand dollars and 5% of the remainder. This procedure must be repeated until such time as no upset bid is submitted within 10 days after the last publication. At that time, the governing body may accept the highest offer. Motion by Council Member Maness, seconded by Mayor Pro Tem Olds to adopt the resolution authorizing the advertisement of an offer to purchase certain property (city parking lot located across from the Daily —✓ Record) and authorize the City Clerk to advertise the offer for upset bids. Motion unanimously approved. A copy of Resolution (R2006 -10) authorizing the advertisement of an offer to purchase certain property is incorporated into these minutes as Attachment #1. ABC ADVISORY BOARD MEMBER STATUS Mayor Snipes explained that the Council received information today relevant to this matter Motion by Mayor Pro Tem Olds, seconded by Council Member Galbreath to remove Mr. Lewis Bell and rescind his appointment to the Dunn ABC Commission and its system of operation as a result of correspondence and reports of incidents received from the NC ABC Commission and the National Alcoholic Beverage Control Association. Motion unanimously approved. Interim City Manager Autry was asked to send notification to Mr. Bell with reference to the action of the City Council. FY 2006 -2007 BUDGET Interim Manager Autry presented the Council with the proposed 2006 -2007 budget. Mr. Autry asked that the Council contact himself or Finance Director Renee' Daughtry with any questions they may have with regard to this proposed budget. The next budget work session is scheduled for May 23, 2006 at 4:00 p.m. 127 128 CLOSED SESSION 5:05 p.m. Motion by Council Member Godwin, seconded by Council Member Billy Tart to enter closed session to hear a report from the City Attorney regarding the applications for the City Manager position. Motion unanimously approved. Closed Session Motion by Mayor Pro Tern Olds, seconded by Council Member Billy Tart to approve the minutes of the closed session as recorded by City Attorney Pope.
