04062006MINUTES CITY OF DUNN DUNN, NORTH CAROLINA 113 The City Council of the City of Dunn held a Regular Meeting on Thursday, April 6, 2006, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor J. Dal Snipes, Mayor Pro Tem Donnie Olds, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Billy R. Godwin, Jr. and Joey Tart. Also present was Interim City Manager Ronnie Autry, Assistant Public Works Director Billy Addison, Finance Director Renee' Daughtry, City Planner Steven Neuschafer, Librarian Mike Williams, Recreation Director Perry Hudson, Police Chief Tim Benware, City Engineer Ed Powell, City Attorney P. Tilghman Pope, City Clerk Debra West, and Daily Record Reporter Lisa Farmer. INVOCATION Mayor Snipes opened the meeting at 7:00 p.m. and asked Council Member Godwin to give the invocation. Afterwards the Pledge of Allegiance was repeated. PRESENTATION Mayor Snipes presented Chief Wastewater Treatment Plant Operator Bobby E. Burnette a retirement plaque in recognition and appreciation of his 36 years of service to the City of Dunn. PUBLIC COMMENT PERIOD Mayor Snipes opened the floor for a (30) minute public comment period. Hearing no comments, the public comment period was closed. Adjustment of Agenda Motion by Mayor Pro Tem Olds, seconded by Council Member Galbreath and unanimously approved to add 2006 Spring Litter Sweep Proclamation to consent items: CONSENTITEMS Mayor Snipes asked if there were any consent items that Council wished to pull for further discussion. Hearing none, the following items were considered by Council: Minutes - Council considered approval of minutes of the Special Call Budget Retreat February 22, 2006 Council meeting. r Minutes- Council considered approval of minutes of the March 2, 2006 Council meeting. Minutes - Council considered approval of minutes of the Special Call March 9, 2006 meeting. Minutes - Council considered approval of minutes of the Special Call March 15, 2006 meeting Budget Amendments- Council considered approval of Budget Amendments #46 - #61 and #79 - #82. A copy of Budget Amendments #46 - #61 and #79 - #82 is incorporated into these minutes as Attachment #1. DOT Mowing Agreement - Council considered approval of the 2006 mowing agreement between the NC Department of Transportation (DOT) and the City of Dunn for mowing state right -of -ways within the City Limits. A copy of this DOT mowing agreement is incorporated into these minutes as Attachment #2. Proclamation - Council considered approval of a proclamation designating April 23 -29, 2006 as Relay for Life Week. Mayor Snipes read the Proclamation. A copy of Proclamation (P2006 -04) Relay for Life Week is incorporated into these minutes as Attachment #3. Proclamation - Council considered approval of a proclamation designating April 30 through May 6, 2006 as Municipal Clerks Week. Mayor Snipes read the Proclamation and recognized City Clerk Debra G. West. A copy of Proclamation (P2006 -05) Municipal Clerks Week is incorporated into these minutes as Attachment #4. Resolution -ABC Permit Notification - Council considered approval of an ABC Permit Notification Resolution which designates the City Manager as the official who will make recommendations to the ABC Commission on each ABC permit application. A copy of this ABC Permit Notification Resolution (R2006 -08) is incorporated into these minutes as Attachment #5. Proclamation - Council considered approval of a proclamation designating April 17 -30, 2006 as Spring Litter Sweep. Mayor Snipes read the Proclamation. A copy of Proclamation (P2006 -06) Spring Litter Sweep is incorporated into these minutes as Attachment #6. Motion by Council Member Joey Tart, seconded by Council Member Maness to approve all consent items. Motion unanimously approved. 114 ITEMS FOR DECISION FINAL PLAT APPROVAL WILLOW RUN SUBDIVISION The City of Dunn Planning Board recommended approval of the Final Plat for the Willow Run Subdivision, which contains (17) building lots, at their last regular meeting. The plat does show a drainage easement and stormwater structure on City owned property to the west of the subdivision. This structure is to mitigate stormwater from the development per the stipulations of the Planning Board meeting for the preliminary plat approval held in March of 2005. Motion by Council Member Joey Tart, seconded by Council Member Godwin to approve the Final Plat for Willow Run Subdivision. Motion unanimously approved. AUDIT CONTRACT The F/Y 2005 -2006 Audit Contract proposal has been received from Petway, Mills & Pearson, PA. The proposed audit price is not to exceed $20,300. Motion by Council Member Godwin, seconded by Council Member Maness to enter into a contract with Petway, Mills & Pearson PA in an amount not to exceed $20,300 for auditing services for F/Y 2005 -2006. Motion unanimously approved. A copy of the FIY2005 -2006 audit contract is incorporated into these minutes as Attachment #7. BULLETPROOF VEST PARTNERSHIP PROGRAM Police Chief Benware explained that under this program, jurisdictions with 100,000 or less population will receive 50% back on the purchase price on bulletproof vests ordered. The Dunn Police Department is requesting to purchase twelve (12) bulletproof vests at a cost of $7,500. Fifty percent of the purchase price will be refunded after the vests are ordered and received. Motion by Mayor Pro Tern Olds, seconded by Council Member Galbreath to approve the purchase of twelve (12) bulletproof vests at a cost of $7,500. Motion unanimously approved. Council Member Godwin asked if these funds have been allocated in the budget. Chief Benware responded yes. Funds are deducted from the uniform allowance. This grant will enable the Police Department to update old vests. TECHNOLOGY TRANSFER PROGRAM-EQUIPMENT GRANT The Dunn Police Department has the opportunity to apply for an equipment grant. The grant is through the Office of National Drug Control Policy, Counterdrug Technology Assessment Center and is named Technology Transfer Program. The grant is at no cost to the City. The equipment being applied for is a new wireless color camera to be used by the Tactical Narcotics Team to further their ability to apprehend and prosecute local drug dealers. Motion by Council Member Galbreath, seconded by Council Member Billy Tart to approve the Technology Transfer Program Grant to allow the Police Department to purchase a wireless color camera system for the Tactical Narcotics Team. Motion unanimously approved. AWARD BID SEWER LATERAL CAMERA Interim City Manager Autry requested this item be tabled. Motion by Council Member Galbreath, seconded by Mayor Pro Tern Olds to table award of bid for Sewer Lateral Camera. Motion unanimously approved. TEMPORARY STREET CLOSING HARNETT STREET FROM ORANGE TO WATAUGA , Betsy Johnson Regional Hospital's Relay for Life Team has requested that Harnett Street from Orange Avenue to Watauga Avenue be closed from 7:00 a.m. —10:30 a.m. on Saturday, May 13 to hold a Road Race/Fun Run benefiting the American Cancer Society. Motion by Council Member Godwin, seconded by Council Member Billy Tart to approve the request to temporarily close Harnett Street from Orange to Watauga to allow Betsy Johnson Regional Hospital's Relay for Life Team to hold a Road Race/Fun Run on May 13' from 7:00 a.m. —10:30 a.m. Motion unanimously approved. 115 BOARD APPOINTMENTS -BETSY JOHNSON REGIONAL HOSPITAL (BJRH) AUTHORITY - (MAYORAL APPOINTMENTS) Mayor Snipes made the following re- appointments to the BJRH Authority with terms beginning April 1, 2006 and expiring March 31, 2009 or until such time that the new Harnett Health System, Inc. Board assumes governing authority: Mr. Dwight W. Snow Dr. Venkata Sanka BOARD APPOINTMENTS -BETSY JOHNSON REGIONAL HOSPITAL (BJRH) BOARD OF TRUSTEES Motion was made by Council Member Galbreath and seconded by Mayor Pro Tern Olds to reappoint Mrs. Mary W. Dafford and Mr. Walter A. Massey, Sr. to the BJRH Board of Trustees with terms beginning April 1, 2006 and expiring March 31, 2009 or until such time that the new Harnett Health System, Inc. Board assumes governing authority. Motion unanimously approved. BOARD APPOINTMENT LIBRARY BOARD Motion was made by Mayor Pro Tern Olds and seconded by Council Member Joey Tart to appoint Renee B. Daughtry (to fill the unexpired term held by the late Mr. George Williams) as liaison to represent the City of Dunn on the Harnett County Public Library Board of Trustees with a term ending January 1, 2007 Motion unanimously approved. HABITAT FOR HUMANITY LAND CONVEYANCE The City Council is being asked to consider a resolution conveying a 190'x 120' parcel of property containing .360 acres, more or less and located at 511 E. Johnson Street (corner of Johnson and Surles diagonally across from the PAL Building) to Habitat for Humanity of Harnett County, Inc. The City is authorized to convey real property to a not for profit organization which carries out a public purpose. Interim Manager Autry explained that the City acquired this property from the Dunn Housing Authority in 1979. Motion by Council Member Godwin, seconded by Council Member Maness to adopt a resolution to convey the property at 511 E. Johnson Street after due notice and advertisement as required by law to Habitat for Humanity of Harnett County, Inc. Motion unanimously approved. A copy ofResolution (R2006 -09) conveying the property at 511 E. Johnson Street to Habitat for Humanity of Harnett County, Inc. is incorporated into these minutes as Attachment #8. The proposed habitat house is being built by the Rotary Club in honor of Mr. Hoover Adams. All funds were raised in his namesake. Mr. Bill Cunningham, representative for Habitat for Humanity, stepped forward and stated that the Rotary Club is totally funding this project in honor of Mr. Hoover Adams. This will be the 12" house in Harnett County. Habitat was established in 1993. He stated that he has tried to acquire this lot for the past year and one -half and thanked Mr. Autry for his fast response in acquiring this lot for Habitat. He also thanked the Council for this donation. ITEMS FOR DISCUSSION AND /OR DECISION MUNICIPAL SERVICE DISTRICT Mayor Snipes explained that this is the legal name for downtown tax districts. In researching Municipal Service Districts, they found that if they establish this district they must work expeditiously to adopt it within the July l' deadline. Mr. Autry explained that the Council will see a timeline prepared by City Planner Neuschafer detailing the steps that must be taken to adopt this district. He asked'for'direction from the Council in directing staff to develop a report in accordance with G.S. 160A -536, including purpose and proposed district boundaries. The district must be adopted prior to July 1, 2006. City Attorney Pope pointed out that if the Council decides to adopkthis:district, it must be adopted by the end of this fiscal year to make the taxes applicable for the 2006 -2007 budget year. If the Council does not start this timeline to allow it to be completed in the 2005 -2006' fiscalyear, then the tax would actually not come into effect until the 2007 -2008 budget year. Motion by Council Member Godwin, seconded by Council Member Joey Tart to direct the Manager /staff to develop a report in accordance with G.S. 160A -536, including purpose and proposed district boundaries for consideration at the May 4" Council meeting. Mayor Snipes entertained further discussion. 116 Mayor Pro Tem. Olds questioned the area that will be affected by this district Mayor Snipes explained that the Council has the right to vote to establish this district. The affected citizens of the district do not vote, however, the public hearing will allow those citizens affected to come forward to express their opinions. City Attorney Pope further explained that if you own property within the affected district, you will get a mailing giving notice of a public hearing date. If you do not own property in the affected district, you will not get that mailing, however, any citizen would be eligible to speak at the public hearing. Motion unanimously approved. SUMMER HOURS Mayor Snipes stated that for the past two years, the City Council has approved summer operating hours for City offices. The summer hours of 7:30 a.m. — 4:00 p.m. begin June I" and end August 31 ". Mr. Autry stated that the city employees appreciate the opportunity to work these summer hours. It has worked tremendously well in the past. Motion by Mayor Pro Tem. Olds, seconded by Council Member Galbreath to adopt the summer operating hours of 7:30 a.m. — 4:00 p.m. beginning June I" and ending August 31" for the City of Dunn employees. Motion unanimously approved. The public will be notified via the Government Channel as well as posting a notice on the water bills. SET DATE FOR SPECIAL CALL MEETING/BUDGET WORK SESSION Motion by Mayor Pro Tem Olds, seconded by Council Member Joey Tart to set a Special Call Meeting/Budget Work Session for Thursday, April 27, 2006 at 5:30 p.m. in the Council Chambers. Mr. Autry proposes to submit a preliminary budget to the City Council prior to this meeting. He suggested that this meeting address the existing budget and policy procedures. Motion unanimously approved. ADMINISTRATIVE REPORTS Motion by Council Member Galbreath, seconded by Council Member Billy Tart to approve the Administrative Reports. Motion unanimously approved. EXECUTIVE REPORTS Council Member Joey Tart encouraged the adoption of animals from the City Animal Shelter Council Member Godwin announced Mayor Snipes' birthday on April 5 Council Member Maness invited everyone to attend the Easter drama at Glad Tidings Church on Sunday, April 9` at 6:30 p.m. Council Member Galbreath thanked the Dunn Police Department as well as Crime Stoppers for hosting the community watch forums on Tuesday, April 4 It was very well attended. Citizens can contact the Dunn Police Department to start a community watch program. Mr. Galbreath also informed the public of a plate sale at the PAL Center on May 5, 2006 and encouraged support of this fund raiser for the PAL program. Mayor Snipes welcomed City Clerk Debra West back from her recent absence due to an automobile accident. With no further business to discuss, the meeting was adjourned at 7:55 p.m Attest: �A.
