11032005MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Thursday, November 3, 2005, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor J. Dal Snipes, Mayor Pro -Tern Donnie Olds, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Billy R. Godwin, Jr. and Joey Tart. Also present was City Manager Mike Uskiewicz, Asst. City Manager/Public Works Director Ronnie Autry, Librarian Mike Williams, Recreation Director Perry Hudson, Police Chief Tim Benware, Fire Chief Austin Tew, City Engineer Ed Powell, City Attorney P. Tilghman Pope, City Clerk Debra West, and Daily Record Reporter Gregory Phillips. INVOCATION Mayor Snipes opened the meeting at 7:00 p.m. Scout Troop 780 of Divine Street United Methodist Church presented the colors and led in the Pledge of Allegiance. Council Member Billy Tart gave the invocation. PUBLIC COMMENT PERIOD Mayor Snipes opened the floor for a (30) minute public comment period. Mr. Michael Bethea spoke about public intoxication and drug dealing in the areas of N. Washington Avenue and E. Broad Street. He lives in this area and is constantly picking up beer bottles. His neighborhood is constantly disrupted by those activities. He has been promised more police patrol but nothing has happened. He gave an instance of an individual lying in the middle of the road intoxicated and the police moved him to the side of the road, allowing him to remain there. He stated that he did not want this in his neighborhood and he didn't think it would be tolerated in other areas of town. Young individuals walk across Highway 421 in the middle of traffic refusing to move out of the road. Funeral services and church services in this area are being disrupted. Individuals congregate and stand on the corner at 3:00 a.m. A lot of these individuals do not live in that area. He asked why can't the streets be taken back and move these folks out. Mayor Snipes thanked Mr. Bethea and stated the council shares his concern. He assured Mr. Bethea that he would receive a response. Mayor Snipes closed the regular meeting and opened public hearings at 7:08 p.m. PUBLICHEARINGS CONDITIONAL USE PERMIT — CUP 03 -05 CAROLINA DRIVE 4.5 ACRES OF PIN #1526 -29 -1792 The public has been notified that oral and written comments will be heard and received concerning the request by Daystar United Pentecostal Church to allow a church as a conditional use of an undeveloped property consisting of 4.50 acres located on the south side of Carolina Drive approximately 200 feet east of the intersection with Johnson Street. This property is currently zoned R -M Residential Multi - Family. The public hearing was duly advertised on October 18, 2005 and October 25, 2005. Mayor Snipes asked if there was anyone present to speak for or against this conditional use permit request. Hearing none, motion by Mayor Pro -Tem Olds, seconded by Council Member Maness to close the public hearing and reconvene the regular council meeting at 7:09 p.m. Motion unanimously approved. CONSENTITEMS Mayor Snipes asked if there were any consent items that Council wished to pull for further discussion. Hearing none, the following items were considered by Council: Minutes- Council considered approval of minutes of the October 6, 2005 Council meeting. Tax Releases/Refunds- Council considered approval of Tax Releases/Refunds 478 - #82. Tax Releases /Refunds are filed in the office of the Tax Collector. Motion by Council Member Joey Tart, seconded by Council Member Godwin to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION CONDITIONAL USE PERMIT — CUP 03 -05 CAROLINA DRIVE 4.5 ACRES OF PIN #1526 -29 -1792 77 A request was received from Daystar United Pentecostal Church for a conditional use permit to allow a church on 4.5 acres of undeveloped property. This property is located on the south side of Carolina Drive 78 approximately 200 feet east of the intersection with Johnson Street and identified by Hamett County Tax Records as PIN #1526 -29 -1792. This property is currently zoned R -M Residential Multi- Family District. Churches are allowed in this zoning district by a conditional use permit provided there be a minimum land area of two (2) acres. The Planning Board met on October 25, 2005 and unanimously recommended approval of this conditional use permit. Motion by Council Member Galbreath, seconded by Mayor Pro -Tern Olds to approve the conditional use permit for Daystar United Pentecostal Church to allow a church on 4.5 acres of PIN 41526 -29 -1792 based upon findings referenced in Chapter 22, Section 22 -485 (b) of the City of Dunn Code of Ordinances. POLICE DEPARTMENT ACCEPTANCE OF NFL GRANT THROUGH NATIONAL PAL Police Chief Benware explained that this grant funding will allow PAL to buy a fully equipped concession trailer to sell hotdogs, hamburgers, sodas, etc. at different types of events and put the money that is earned back into the program. This will generate money from year to year. This NFL Grant has been awarded through the National Association of Police Athletic Leagues in Florida. The grant was awarded to all P.A.L. to allow the PAL Football Program to become self - sustaining. Dunn P.A.L. will work in partnership with the local area high schools, middle schools and also the local recreation department with it football program initiatives. Dunn P.A.L. currently has over 350 youth on its roster, and has a continual need to provide after school athletic and education programs to youth in Harnett County. The City of Dunn has received $10,000 in grant revenues. Dunn PAL placed a 25% match of $2,500 through fundraising, which has already been satisfied and an additional 15% match of $1,500 from Private Organization Sponsorships, which will be a work in progress plan with its own board raising that money. The City is not required to match the grant with any cash. Upon acceptance, this grant will become effective November 3, 2005 and will continue until December 29, 2005. Motion by Council Member Godwin, seconded by Council Member Billy Tart to accept the NFL Grant through National PAL and approval of budget amendment #8. Motion unanimously approved. A copy of budget amendment #8 is incorporated into these minutes as Attachment #1. Council Member Maness commended PAL for coming up with their own match money through fundraisers and private organization sponsorships. POLICE DEPARTMENT ACCEPTANCE OF MID- CAROLINA COPS PASS - THROUGH GRANT FUNDING The City of Dunn Police Department has been advised by the Mid - Carolina Council of Governments that funding is available that will enable the Dunn Police Department to purchase one Mobile Data Terminal on a reimbursement basis. This funding allows every town in our region $5,482.00 for the purchase of this equipment. No local match is required. Motion by Council Member Galbreath, seconded by Mayor Pro -Tem Olds to accept the pass - through grant funding by the Mid - Carolina Council of Governments and approval of budget amendment #10. Motion unanimously approved. A copy of budget amendment #10 is incorporated into these minutes as Attachment 42. POLICE DEPARTMENT BANK FINANCING -BID PROPOSALS A request for financing proposals was submitted to all local financial institutions for the purchase of seven (7) Police Vehicles (3 ea. 2006 Chevrolet Impalas, 3 ea. 2005 Chevrolet Impala Program Cars, and 1 ea. 2002 Ford Crown Victoria w/22,000 miles) as well as seven (7) Police Packages. The estimated cost of this equipment is $105,000. �1 Manager Uskiewicz explained that this is a budgeted item. The proposals received are as follows: Financial Institution Tenn Rate OrieinationFee Annual Pavments BB & T 5 yrs 3.72% none $23,400.63 RBC 5 yrs 3.99% $100.00 $23,579.22 SunTmst 5 yrs 4.00% $250.00 $23,585.85 New Century 5 yrs 5.50% none $24,642.08 It is recommended by City staff that the financing be awarded to BB & T at a rate of 3.72% with five (5) annual payments of $23,400.63. Motion by Mayor Pro -Tem Olds, seconded by Council Member Joey Tart to adopt the resolution approving the financing terms with BB & T at a rate of 3.72% with (5) annual payments of $23,400.63 for the purchase of (7) Police Vehicles and (7) Police Packages. Motion unanimously approved. A copy of the Resolution (82005 -18) approving the financing terms with BB & T for the purchase of (7) Police Vehicles and (7) Police Packages is incorporated into these minutes as Attachment #3. FIRE DEPARTMENT ACCEPTANCE OF WAL- MART'S SAFE NEIGHBORHOOD HEROES GRANT A Wal -Mart Safe Neighborhood Heroes Grant has been awarded to the Dunn Fire Department through the Wal -Mart Foundation. This grant was awarded to the Dunn Fire Department to purchase a multimedia system which will be installed in the classroom at Station #1 on Powell Avenue. This will eliminate the need to borrow a multimedia projector for classes held in the Fire Station. The City has received $2,000 in grant funds. This grant does not require a local match. Upon acceptance, the grant will become effective November 3, 2005 and will continue through December 31, 2005. Motion by Council Member Joey Tart, seconded by Council Member Billy Tart to accept the Wal -Mart's Safe Neighborhood Heroes Grant and approval of budget amendment #9. Motion unanimously approved. A copy of budget amendment #9 is incorporated into these minutes as Attachment #4. CERTIFICATE OF SUFFICIENCY BRUCE DRIVE CURB & GUTTER PETITION PRELIMINARY ASSESSMENT RESOLUTION BRUCE DRIVE CURB AND GUTTER Manager Uskiewicz asked that the above two items of business be tabled until the December council meeting to allow time for a ruling from the North Carolina League of Municipalities based upon two parcels of property that may need to be calculated into this project. Motion by Mayor Pro-Tern Olds, seconded by Council Member Maness to table agenda items "Certificate of Sufficiency Bruce Drive Curb and Gutter Petition" and "Preliminary Assessment Resolution Bruce Drive Curb and Gutter ". Motion unanimously approved. ITEMFOR DISCUSSION AND /OR DECISION PAVING PROJECTS/PROJECTED COSTS Assistant City Manager/Public Works Director Ronnie Autry has identified certain streets within the City which need to be resurfaced or paved. It is estimated to cost $70,000 - $75,000 to pave /resurface all of the identified streets, however, an exact cost will not be known until a contractor gives a quote. The budgeted amount for F/Y 2005 -2006 for paving/resurfacing is $70,000. Manager Uskiewicz identified the following streets as priority for paving or resurfacing: • Portion of E. Pearsall Street from S. Wilmington Ave. to S. Sampson Ave. • Jackson Road from Spring Branch Road to S. Elm Avenue • W. Wake Street from N. Fayetteville Ave. to RR Avenue -New Pavement • Rowan Street from Wellons Avenue to Brunswick Avenue • Brunswick Avenue from Rowan Street to Currituck Avenue Manager Uskiewicz asked that the council adopt this street paving list. Mayor Pro -Tem Olds asked Mr. Autry when they anticipate starting this project and also he questioned the requirements to pave parallel to the railroad at Wake Street. Assistant City Manager/Public Works Director Ronnie Autry explained that they anticipate this project to be complete by Christmas. He explained that to -pave the railroad right -of -way, a request would have to be submitted to the railroad asking for their permission to allow the City to pave that portion. All easements would have to be released. Motion by Council Member Galbreath, seconded by Council Member Maness to proceed with paving /resurfacing the recommended priority streets at a projected cost of $70,000 - $75,000. Motion unanimously approved. Mr. Autry advised that Resthaven Cemetery will also be paved ADMINISTRATIVE REPORTS 79 Motion by Council Member Galbreath, seconded by Council Member Joey Tart to approve the Administrative Reports. Motion unanimously approved. m EXECUTIVE REPORTS Council Member Joey Tart thanked the Downtown merchants, the Dunn Area Chamber of Commerce, Public Works Department and Scout Troop 780 for assisting in the city clean-up last weekend to prepare for the annual Cotton Festival. Council Member Godwin thanked the Public Works Department for assisting in the Averasboro Battlefield events last weekend. He announced the upcoming production "Dickens Christmas Carol' which will be held on November 17, 18, 19, and 20 at the Harnett Regional Theater. Council Member Billy Tart reminded everyone to come out to the Cotton Festival on November 4 -5, 2005. Mayor Snipes also announced the upcoming Cotton Festival and pointed out that festivities begin on Friday night, November 4` with amusement rides for the children. Mayor Pro -Tern Olds thanked the City of Dunn and the citizens for allowing him to attend the 2005 Annual North Carolina League of Municipalities Conference in Hickory. Council Member Galbreath recognized and thanked several groups (the Untouchables, boy scouts and girl scouts volunteers, the Beauty of Dunn, Masonic Lodge #155) as well as the youth from the PAL Program who assisted in the city clean-up on Saturday. Council Member Galbreath asked that the Administration and Inspections Department check a vacant lot in the 700` block of E. Divine Street that needs attention. He has received numerous phones calls from citizens in this neighborhood. This site needs immediate attention. Mr. Galbreath also voiced concerns with the areas of Washington and Broad Streets as mentioned earlier tonight by Mr. Bethea. He has talked with the Police Chief about the situation and it needs immediate attention as well. Answers and results should be provided to the citizens of these areas. Mayor Pro -Tern Olds also mentioned the negative appearance of the area around East Broad Street near City Hall. Manager Uskiewicz stated that studies are being done on this area to address some of the housing structures to get them up to code. Manager Uskiewicz presented the proposed 2030 Land Use Plan to the City Council for review. He informed the Council that the Planning Board will act on this plan at their November meeting. Mr. Jason Epley, Senior Planner with the NC Department of Commerce — Division of Community Assistance will be attending the November Planning Board meeting to give a presentation and discuss the proposed plan. Manager Uskiewicz announced that effective November 14, 2005, Mr. Steven Neuschafer will be the new Director of Planning and Zoning for the City of Dunn. Mayor Snipes announced the upcoming National League of Cities Meeting to be held in Charlotte in December and the Main Street Conference in Salisbury in January, 2006. Mayor Snipes asked that City Clerk Debra West remind each council member to submit a name from their district to form a committee to look into the future of the old Civic Center. He asked each council member to propose a citizen from their district and he will pick one at -large member from the City to form this seven (7) member committee at the December Council meeting. Mayor Snipes entertained a motion to go into closed session. 7:42 p.m. Motion by Council member Godwin, seconded by Council Member Maness to enter closed session to discuss a personnel and legal matter. Motion unanimously approved. Closed Session Motion by Council Member Maness, seconded by Council member Galbreath to approve the minutes of the closed session as recorded by City Attorney Tilghman Pope.
