02032005MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Thursday, February 3, 2005, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor J. Dal Snipes, Mayor Pro -Tem Donnie Olds, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Billy R. Godwin, Jr. and Joey Tart. Also present was City Manager Michael Uskiewicz, Assistant City Manager/Public Works Director Ronnie Autry, Human Resources/Safety Officer Moses Gallion, Code Enforcement Officer Steven King, Recreation Director Perry Hudson, Police Captain Morry Denning, City Engineer Ed Powell, City Attorney P. Tilghman Pope, City Clerk Debra West, and Daily Record Reporter Lisa Farmer. INVOCATION Mayor Snipes opened the meeting at 7:00 p.m. and asked Council Member Godwin to give the invocation. Afterwards, the pledge of allegiance was repeated. PRESENTATION Mayor Snipes informed the council that due to inclement weather, Mr. Skip Alston, President of the North Carolina NAACP was unable to attend tonight's meeting to make his presentation but he has requested to be placed on the March council agenda to request that the council amend their agenda policy to allow citizens to speak on non - agenda items at each council meeting. Mayor Snipes closed the regular meeting and opened public hearings at 7:03 p.m. PUBLIC HEARINGS DEMOLITION OF HOUSE 104 N. WASHINGTON AVE. Mayor Snipes stated that the public has been notified that oral and written comments will be heard and received concerning the demolition of the dwelling owned by Troy Rollins and located at 104 N. Washington Avenue. He added that the public hearing was duly advertised on January 18, 2005 and January 25, 2005. Mayor Snipes asked if there was anyone present to speak for or against demolishing this structure. This property is located on the north side of W. Barrington St. from 180 feet west of N. Ellis Ave. (US Highway 301 North) to N. General Lee Ave. and Fairfield Circle. This public hearing was tabled at the January 6, 2005 council meeting due to lack of a quorum at the Planning Board meeting of January 4, 2005. The pubic hearing was duly advertised on January 18, 2005 and January 25, 2005. Mayor Snipes asked if there was anyone present to speak for or against this conditional use permit. Hearing none, he closed public hearing in reference to same. CODE AMENDMENT ARTICLE V, DIVISION 5 FATS, OILS AND GREASES CONTROL ORDINANCE Mayor Snipes stated that the public has been notified that oral and written comments will be heard and received concerning the request by the City of Dunn Public Works Department to amend the City of Dunn ( Code of Ordinances by adding a Fats, Oils and Greases Control Ordinance under Division 5. of Article V. - Sewer Use Regulations. The public hearing was duly advertised on January 20, 2005 and January 27, 2005. Mayor Snipes asked if there was anyone present to speak for or against this code amendment. Hearing none, he closed public hearing in reference to same. *At this point, Mr. Troy Rollins, owner of the structures located at 104 and 105 N. Washington Avenue entered the meeting and asked to speak about his properties before the public hearings closed Permission was granted for Mr. Rollins to speak, Mr. Rollins stated that he currently holds the deed of trust on these two properties but due to financial difficulties, he has not been able to repair these houses. He asked that the council grant him an extension of 30 -60 days to either repair or sell these houses. He added that he has been proactive in repairing several houses that he purchased two years ago. His funds are depleted and he is currently having a problem paying the note on these houses. If the note is not paid, the houses will be foreclosed on. Motion by Council Member Godwin, seconded by Council Member Galbreath to close public hearings and reconvene the regular council meeting at 7:08 p.m. Motion unanimously approved. CONSENTITEMS Mayor Snipes asked if there were any consent items that Council wished to pull for further discussion. Hearing none, the following items were considered by Council: Minutes - Council considered approval of minutes of the January 6, 2005 meeting. Tax Releases/Refunds- Council considered approval of Tax Releases/Refunds #43 - #52 and #69. Tar Releases/Refunds are filed in the ofce of the Tax Collector. Assessment Releases/Refunds- Council considered approval of Assessment Release/Refand #02. Assessment Releases/Refunds are filed in the office of the Tax Collector. Tax Liens - Council considered approval of advertising tax liens on March 22, 2005 for outstanding 2004 taxes on real property. Budget Amendments — Council considered approval of budget amendments #20, and #24 through #26. A Copy of BudgetAmendments #20, and #24-#26 is incorporated into these minutes as Attachment #1. Proclamation -Black History Month - Council considered approval of a proclamation designating the month of February as Black History Month. Mayor Snipes read the proclamation. A copy of this proclamation (P2005 -04) is incorporated into these minutes as Attachment #2. Proclamation- Rotary's Centennial- Council considered approval of a proclamation designating February 23, 2005 as Rotary International Day and commemorating Rotary's Centennial. Mayor Snipes read the proclamation and presented it to the president of the Rotary Club of Dunn, Mr. Don Davis. Several members of the Rotary Club were recognized at the meeting. Mr. Don Davis thanked the Mayor and the City of Dunn for this special honor. A copy of this proclamation (P2005 -05) is incorporated into these minutes as Attachment #3. Motion by Council Member Joey Tart, seconded by Council Member Billy Tart to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION DEMOLITION OF HOUSE 104 NORTH WASHINGTON AVENUE Mayor Snipes opened the floor for discussion and/or a motion to adopt an ordinance to demolish the structure located at 104 N. Washington Avenue. Mayor Pro -tern Olds stated that although he is sympathetic to Mr. Rollins' financial difficulties, he questioned why no work has been done on this house since a hearing was held with the Building Inspector in September, 2004. Mr. Rollins stated that 104 N. Washington Ave. was occupied up until about two weeks ago. He has also talked with investors about buying these properties. Council Member Galbreath stated that numerous complaints have been received from residents of this neighborhood about this house. When the last tenant was removed from the house, the contents of the home were thrown in the yard and street for a number of days. He added that the council should proceed with the demolition. Many individuals living on the streets have stayed in the house as well. Council Member Maness questioned why Mr. Rollins did not accept certified mail from the City of Dunn. Mr. Rollins stated that he received the letter via regular mail and he did attend the public hearing held in the office of the building inspector. i Further discussion was held about the condition of this property. Council Member Joey Tart asked Code Enforcement Officer Steven King if Mr. Rollins was given a sixty - day (60) extension by the council, could improvements be made to this property. Mr. King responded that if Mr. Rollins was unable to sell the properties, then he thought Mr. Rollins would try to repair the houses himself. Mr. Joey Tart asked Mr. King if Mr. Rollins had worked well with the inspections department in the past. Mr. King responded yes. City Manager Uskiewicz asked Mr. Rollins how many properties did he own. Mr. Rollins responded thirty-six (36). Out of the thirty-six (36) owned, nineteen (19) of these houses are located in Dunn. Mr. Uskiewicz asked Mr. King how many of Mr. Rollins' houses were under violation notice. Mr. King responded four (4) are pending and four (4) additional are in the process. Mr. Uskiewicz pointed out that eight (8) of the nineteen (19) homes are in dilapidated condition and Mr. Rollins has already professed that he is having difficulty in maintaining these properties. He added that it would be difficult for Mr. Rollins to sell these properties under their current condition. Council Member Godwin stated that although he sympathized with Mr. Rollins' financial difficulties, no progress has been made on these houses since September, 2004. Motion by Council Member Galbreath, seconded by Council Member Godwin to approve the ordinance directing the Building Inspector to remove or demolish the structure at 104 N. Washington Avenue. " Mayor Snipes asked if there was further discussion. Council Member Joey Tart stated that he would not want to demolish a house that has been vacant for such a short time without giving the owner an opportunity to make the necessary repairs. He added that he is in favor of giving the owner 45 -60 days to make the repairs. Motion carried 5 -1. WASHINGTON AVENUE Mayor Snipes opened the floor for discussion and/or a motion to adopt an ordinance to demolish the structure located at 105 N. Washington Avenue. Motion by Mayor Pro -tem Olds, seconded by Council Member Galbreath to approve the ordinance directing the Building Inspector to remove or demolish the structure at 105 N. Washington Avenue. Motion unanimously approved. Code Amendment - Section 22 -461 (2) Code Amendment - Adding Section 22 -58 Conditional Use Permit - Warren Realty, LLC -North side of W. Barrington St. 180 ft. west of N. Ellis Ave. to N. General Lee Ave, and Fairfield Circle CODE AMENDMENT SECTION 22 -461 (2) This is a proposed code amendment to section 22 -461 (2) which will allow the following additional uses by conditional use permit for the R -10 zoning district: (2) R -10 single - family dwelling district. d. Bed and Breakfast e. Small conference, meeting or banquet facility on a minimum of two acres, and located 100 feet from any adjacent lot used or zoned for residential purposes. The Planning Board met on January 25, 2005 and made a minor revision (as listed above) to the recommendation presented by the Planning Director. Council Member Godwin stated that he would like to propose an amendment to the language under (2) (e) to clarify the ambiguity with regard to the 100 fl. requirement. The current proposal does not specify where to measure the 100 feet from. Is it from the lot line or from the facility itself? In order to clarify this proposal he is recommending that language be inserted so that the amendment will read: (2) R -10 single - family dwelling district. e. Small conference, meeting or banquet facility on a minimum of two acres, and the facility must be located 100 feet from any adjacent lot used or zoned for residential purposes. (adding the words the facility must be) City Attorney Pope concurred with Mr. Godwin's recommendation. This new language will clear any ambiguity to clarify the intent of this code amendment. Motion by Council Member Godwin, seconded by Council Member Maness to approve the proposed code amendment with the added language to Section 22 -461 (2). Motion unanimously approved. Ordinance (02005 -03) filed in Ordinance book. CODE AMENDMENT SECTION 22 -58 This is a proposed code amendment which adds Section 22 -58 (Development Standards) for Fencing and Walls and is applicable to all districts. The Planning Board met on January 25, 2005 and made a minor revision to the recommendation presented by the Planning Director. The revision allowed provisions for barbed wire only in cases of being installed on top of a galvanized fence not less than six feet high measured from the highest adjacent grade. Motion by Council Member Joey Tart, seconded by Mayor Pro -tem Olds to approve the proposed code amendment as revised by the Planning Board to the City of Dunn Code of Ordinances by adding Section 22 -58 (Development Standards) (Fencing and Walls). Motion unanimously approved. Ordinance (02005 -04) filed in Ordinance book. CONDITIONAL USE PERMIT — CUP O1 -05 WARREN REALTY, LLC NORTH SIDE OF W. BARRINGTON ST. FROM 180 FEET WEST OF N. ELLIS AVE. TO N. GENERAL LEE AVE. AND FAIRFIELD CIRCLE PORTIONS OF PIN #1517-62-6194,1517-62- 8128,1517-62-8110,1517-61-8939,1517-61-7939,1517-61-6938,1517-614990,1517-61-6666,1517-61- 3741, 1517-61-2774 A request was received from Warren Realty, LLC to allow a Bed and Breakfast, small conference, meeting or banquet facility as a conditional use of a property zoned R -10 Residential. This property is located on the north side of W. Barrington Street from 180 feet west of N. Ellis Ave. (US Hwy 301 N) to N. General Lee Ave. and Fairfield Circle. Mayor Snipes pointed out that retired judge and former City Attorney Wiley Bowen is representing Mr. Warren and he is present in the audience, should council have questions. Motion by Council Member Godwin, seconded by Council Member Maness to approve the conditional use permit for Warren Realty LLC (owner) to allow a Bed and Breakfast, small conference, meeting or banquet facility as a conditional use of a property zoned R -10 Residential and located on the north side of W. Barrington Street from 180 feet west of N. Ellis Ave. to N. General Lee Ave. and Fairfield Circle and consisting of approximately 4.5 acres based upon findings referenced in Chapter 22, Section 22 -485 (b) of the City of Dunn Code of Ordinances. Motion unanimously approved. CODE AMENDMENT ARTICLE V, DIVISION 5 FATS, OILS AND GREASES CONTROL ORDINANCE This is a new code provision to the City of Dunn Code of Ordinances which will allow for a Fats, Oils and Greases Control Ordinance. The City Attorney has reviewed this code provision. Mayor Pro -tem Olds asked that Mr. Autry explain this ordinance. Assistant City Manager/Public Works Director Ronnie Autry stepped forward and stated that presently, the fats, oils and greases are controlled by the state plumbing code and is enforced through the building inspections office. Mr. Autry stated that the state has directed all municipalities to adopt their own local policy to stay in compliance with the state building and plumbing code. With this ordinance, the City will be looking at all the restaurants throughout the City. The plumbing code stipulates that a grease /oil separator will be required before it enters into the local sewer system. If not, then it will generate a grease build -up, which causes substantial overflows. An inspection of the system will be performed in February and the City must have a policy in place. Mr. Autry stated that in reviewing the proposed ordinance, Council Member Billy Tart brought to his attention that within the proposed ordinance, it required that grease interceptors be removed every (30) days. He stated that in conferring with the City Attorney they propose to change this language. City Attorney Pope stated that he has put in place some language to the following section of the ordinance given to council: Sec. 21 -212 — in the third paragraph that begins with "All such grease Interceptors" — after thirty- days (30) insert the words extent as Drovided for herein. Sec. 21 -212 — in numbered paragraph (2) that begins with "Remove any accumulated grease" — after (30) days insert the words except as Drovided in Item 15 Sec. 21 -212 — in numbered paragraph (15) that begins with "Users shall empty'— after (30) days insert the words or as often as necessary to maintain minimum design cauability as determined by the Director of Public Works or his designee. Mr. Pope explained that with the added language in the three areas identified above, restaurants that have the capacity not to have to flush every (30) days, will only be required to flush as necessary as would be required to meet the minimum design capability. The City would still be in compliance with the state mandate; however, the City would also have some discretionary capabilities to assist restaurants that went to the expense of installing a larger than required system. Motion by Mayor Pro -tern Olds, seconded by Council Member Godwin to approve the proposed code amendment as revised to the City of Dunn Code of Ordinances by adding Division 5. (Fats, Oils and Greases Control Ordinance) to Article V. (Sewer Use Regulations). Motion unanimously approved. Ordinance (02005 -05) filed in Ordinance Book. BULLETPROOF VEST PARTNERSHIP PROGRAM Under this program, jurisdictions with 100,000 or less population will receive 50% back on the purchase price on bulletproof vests ordered. The Dunn Police Department is requesting to purchase eleven (11) bulletproof vests at a price of $5,499.89 plus S &H. Fifty percent of this amount will be refunded after the vests are ordered and received. Funding sources were appropriated in the current fiscal year. Motion by Council Member Galbreath, seconded by Mayor Pro -tern Olds to approve the bulletproof vest partnership program to allow the Police Department to purchase (11) bulletproof vests at a cost of $5,499.89. Motion unanimously approved. AMENDMENT BJRH BOARD OF TRUSTEES AND HOSPITAL AUTHORITY Mayor Snipes requested that the council table this agenda item. This issue may come before the council in the next thirty-days (30). Motion by Council Member Joey Tart, seconded by Mayor Pro -tern Olds to table the amendment to the Betsy Johnson Regional Hospital Board of Trustees and Hospital Authority to a later date. Motion unanimously approved. Mayor Snipes entertained a motion to add the following item to the agenda for decision: Award of Bid -McKay Ave. Sewer Replacement/Adoption of Capital Project Ordinance Motion by Council Member Maness, seconded by Council Member Joey Tart to add this item to the agenda. Motion unanimously approved. AWARD OF BID MCKAY AVENUE SEWER REPLACEMENT/ ADOPTION OF CAPITAL PROJECT ORDINANCE Manager Uskiewicz informed the council that the original bids as opened on January 25, 2005 for the McKay Avenue sewer project was higher than the budgeted amount of $800,000 for this Rural Center Grant #2. After receiving the low bid, a meeting was held with the low bid contractor, Central Builders, Inc. to negotiate the bid to downsize this project. The construction price was lowered to $698,350.00. When administration, engineering, technical services and contingencies are added, the total project cost total is $811,250.00. Mr. Uskiewicz stated that the council is being asked to award this bid to Central Builders, Inc. and to adopt the Capital Project Ordinance. Motion by Mayor Pro -Tent Olds, seconded by Council Member Joey Tart to award the bid for the McKay Avenue Sewer Replacement (Rural Center Grant 42) to Central Builders, Inc. Motion unanimously approved. A copy ofthe bid tabulation for this project is incorporated into these minutes as Attachment #6. Motion by Council Member Godwin, seconded by Council Member Billy Tart to adopt the Capital Project Ordinance for the McKay Avenue Sewer Replacement. Motion unanimously approved. A copy of the Capital Project Ordinance (02005 -06) for the McKay Avenue Sewer Replacement project (Rural Center Grant #2) is incorporated into these minutes as Attachment #6 ADMINISTRATIVE REPORTS Motion by Council Member Galbreath, seconded by Mayor Pro-tern Olds to approve the Administrative Reports. Motion unanimously approved. EXECUTIVE REPORTS Mayor Pro -Tern Olds stated that he has received a concern from a citizen about the need for a traffic light at the intersection of Dunn Erwin Road and Tilghman Drive. It was also suggested that the City look at relocating the traffic light at Dunn Erwin Road and Powell Avenue. 1 Public Works Director Ronnie Autry stated that a traffic light study for this area is already underway by the Department of Transportation and those findings should be reported during the month of February. Council Member Maness stated that he has received a concern from a citizen who drives a school bus for Harnett Primary. There have been numerous occasions that the bus driver has witnessed vehicles passing the school bus while the stop arm is out. Council Member Maness wanted to inform the public to be cognizant of the fact to give themselves enough time to come to a complete stop when the school bus stop arm is out. In the last two weeks, the bus driver has documented sixteen (16) cases where cars have failed to stop, the primary area being Broad Street. 10 Mr. Maness has asked Police Chief Benware to look into this matter and suggested that this bus route be observed. Mayor Snipes thanked Mr. Maness for bringing this matter to the attention of the public Council Member Galbreath commended the staff and management of St. Johns Terrace Apartments. Over the past two to three months, significant improvements have been made to this complex. Vinyl siding has been installed, one parking lot has been repaved, and the landscaping has been improved. He encouraged everyone to ride by to see these significant improvements. Council Member Godwin congratulated Mayor Snipes on being named "Man of the Year" by the Dunn Area Chamber of Commerce. This honor was well deserved. Council Member Godwin also congratulated the City of Dunn for receiving the `Beautification Award" for three consecutive years from the Dunn Area Chamber of Commerce. Mayor Snipes reminded the council of the upcoming congressional trip to Washington, DC. He encouraged council members to attend this meeting to make legislature contact. The dates are March 1I- 15, 2005. Mayor Snipes announced that City Manager Uskiewicz has been accepted into the UNC School of Government Public Executive Leadership Academy. This is the first such course offered by UNC and they were very selective in choosing candidates for this class. Mayor Snipes gave a state of the City overview of the accomplishments made during the councils' first year in office. Those accomplishments included: • Ward meetings held wherein citizens' concerns were heard. • Budget and Planning Retreat to determine short-tem and long -term goals • Numerous ordinance revisions to assist businesses and citizens • Many conditional use permits and re- zonings approved • 421 widening project • Economic Development - Approximately 315 jobs created by Cracker Barrel and businesses within East Point Shopping Center • Approximately 175 new jobs at Champion Hoist & Equipment as a result of the City and county economic incentive package • Recreation Center being constructed at Tart Park Completion of I -95 Lighting Project in partnership with Progress Energy, DOT and Dunn Area Tourism Authority • Restructured current bonded debt to save over 1 million dollars in interest • Part 1 crimes have decreased over 23% Several Police grants received for guns, vests, and equipment as well as grants to expand PAL programs • Reopened the Dunn Public Library on Saturdays • Entered into a water tower maintenance program • Equipment upgrades • Entered into an annexation study • Approved the Capital Improvement Plan • Received a Rural Center Grant of $400,000 for sewer replacement • Awarded $140,000 from DOT for Phase I — Juniper Creek drainage • Budgeted $135,000 to upgrade paving needs • Entered into a strategic study with the Division of Community Assistance with a no -cost grant to plan the future needs of the City • Increased employees' benefits package • Successful exchange with City of Harryda, Sweden- possibly locating their first US facility in Harnett County • Partnered with Dunn Area Chamber of Commerce on two banner projects • More than 25 substandard structures have been torn down • Aggressive in not tolerating weedy lots and junked cars • The City has received (3) Beautification Awards for projects from the Dunn Chamber In closing, Mayor Snipes stated that he and the Council are very proud of the past year, optimistic and eager about the future and are honored to be part of this great city.
