10092012263 MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Tuesday, October 9, 2012, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tern N. Carnell Robinson, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Chuck Turnage and Billy Barfield. Also present was City Manager Ronnie Autry, Assistant City Manager Steven Neuschafer, Public Works Director Billy Addison, Public Utilities Director Dean Gaster, Finance Director Mark Stephens, Human Resources Director Anne Thompson, Chief Building Inspector Mike Blackmon, Planning Director Samantha Wullenwaber, Recreation Director Perry Hudson, Police Chief B.P. Jones, Librarian Mike Williams, City Engineer Michael Goliber, City Clerk Debra West and Daily Record Reporter Brian Haney. Absent: City Attorney P. Tilghman Pope INVOCATION Mayor Harris opened the meeting at 7:00 p.m. and asked Council Member Maness to give the invocation. Afterwards, the Pledge of Allegiance was repeated. AGENDA ADJUSTMENT AND APPROVAL Motion by Mayor Pro Tem Robinson and seconded by Council Member Billy Tart to adopt the October 9, 2012 meeting agenda with changes, if any, as listed below. PRESENTATIONS Proclamation Presentation — Triangle South Enterprise Center 25`h Year Anniversary Mayor Hams presented a Proclamation to the Dunn Committee of 100 President Abe Elmore, Secretary Trent Carpenter and Director Nancy Blackman, in recognition of the 25`h Anniversary of Triangle South Enterprise Center. A copy of Proclamation (P2012 -22) recognizing the 25`" Year Anniversary of Triangle South Enterprise Center is incorporated into these minutes as Attachment #1. President Abe Elmore provided the following brief history, mission and statistics for the Dunn Committee of 100: o Dunn Committee of 100 started in 1987 with $3500 o Harnett County leased the old Magnolia Avenue school building to Dunn Committee of 100 o 17 businesses are currently located in this building 0 129 businesses have gone through the building o Over 3500 jobs have been created o I IM has circulated, been collected and re -loaned since 1987 o Loans are currently available o Recognized Director Nancy Blackman for her 22+ years of hard work Proclamation Presentation - Nancy Blackman Director of Harnett Small Business Center of CCCC Mayor Harris presented a Proclamation to Director Nancy Blackman, in recognition of CCCC's Small Business Center receiving the Research Triangle Regional Center of Excellence Award and in recognition of Ms. Blackman's 22+ years of service as Director of Triangle South Enterprise Center, Harnett County Small Business Center of CCCC and Dunn Area Committee of 100, Inc. A copy of Proclamation (P2012 -23) recognizing CCCC's Small Business Center and Director Nancy Blackman is incorporated into these minutes as Attachment #2. Director Nancy Blackman thanked the Council and provided brief comments about CCCC's Small Business Center mission of keeping jobs, creating jobs and helping those who want to start a business. PUBLIC COMMENT PERIOD Mayor Harris opened the floor for a (30) minute public comment period. Hearing no comments, the public comment period was closed. Mayor Harris opened public hearings at 7:18 p.m. 264 PUBLICHEARINGS Rezoning RequestPZ -01 -12 Byron Johnson PIN #1516 -82- 2609.000 607 Jackson Road Mayor Harris stated that the public has been notified that oral and written comments will be heard and received concerning the request by Byron Johnson to rezone a parcel of land, totaling .24 acres + / -, located at 607 Jackson Road. This property is currently zoned RM; Multi - Family Dwelling District and is requested to be rezoned to C -3; Highway Commercial District. The public hearing was duly advertised on September 18'h and 25'h, 2012. Mayor Harris asked if there was anyone present who wished to speak for or against this rezoning request. Mr. Byron Johnson requested that the Council approve this rezoning request which will allow his brother to expand the parking lot of his existing body shop and generate additional jobs. Hearing no further comments, Mayor Harris closed the public hearing. Rezoning Request PZ-02 -12 Charles Tart, Sr. PIN #1517 -01- 4209.000 100 N. Powell Avenue Mayor Harris stated that the public has been notified that oral and written comments will be heard and received concerning the request by Charles Tart, Sr. to rezone a parcel of land, totaling 2 acres + / -, located at 100 N. Powell Avenue. This property is currently zoned I -10; Restricted Industrial District and is requested to be rezoned to C -3; Highway Commercial District. The public hearing was duly advertised on September 18'h and 25th, 2012. Mayor Harris asked if there was anyone present who wished to speak for or against this rezoning request. Ms. Kimberly Tart spoke in favor of this rezoning request. She stated that this will allow for the expansion of their current produce business which has been in Dunn for the past thirteen years and will enable them to hire additional employees. Hearing no further comments, Mayor Harris closed the public hearings at 7:23 pm Minutes — Council considered approval of minutes of the September 11, 2012 City Council meeting Budget Amendment - Council considered approval of Budget Amendment #4. A copy of BA #4 is incorporated into these minutes as Attachment #3. Proclamation - Council considered approval of a proclamation designating October 21 -27, 2012 as National Friends of Libraries Week. Council Member Barfield read the proclamation. A copy of Proclamation (P2012 -24) designating National Friends of Libraries Week is incorporated into these minutes as Attachment #4. Resolution — Council considered approval of a Resolution Authorizing Installment Financing with First Citizens Bank & Trust Company for Tyler Park Renovation. A copy of Resolution (R2012 -18) Authorizing Installment Financing with First Citizens Bank is incorporated into these minutes as Attachment #5. Resolution — Council considered approval of a Resolution Urging Residents of the City of Dunn to Observe a Safe and Courteous Halloween on Wednesday, October 31, 2012. Council Member Galbreath read the resolution. A copy of Resolution (R2012 -19) designating Trick -or- Treating on October 31, 2012 is incorporated into these minutes as Attachment #6 Surplus Resolution — Council considered approval of a Resolution Authorizing the Disposition of Personal Property by electronic means through www.GovDeals.com. A copy of Surplus Resolution (R2012 -20) is incorporated into these minutes as Attachment V. Motion by Council Member Barfield and seconded by Council Member Turnage to approve all consent items. This property is currently zoned RM; Multi- Family Dwelling District and is requested to be rezoned to C -3; Highway Commercial District. The Planning Board met on September 25, 2012, to review the request and ask for comments from the public. After hearing comments from the public and the request from the applicant, the Planning Board voted unanimously to recommend approval of this request. Motion by Council Member Galbreath and seconded by Council Member Maness to approve the request from Byron Johnson to rezone a parcel of land (PIN #1516 -82- 2609.000) totaling .24t acres and located at 607 Jackson Road from RM; Multi- Family Dwelling District to C -3; Highway Commercial District based on the following justification: 1) The City of Dunn Land Use Plan identifies this area as commercial on the future land use map. This property is located in area three of the Land Use Plan. 2) The amendment is not inconsistent with the adjoining and surrounding land uses which are commercial. 3) The permitted uses in the C -3 District are not considered detrimental to the area and would be beneficial to the entire community. Consideration of Service Agreement between City of Dunn and DataMax Corporation d/b /a Interstate Credit Collections (ICC) Mayor Harris explained that the Council is being asked to authorize the service agreement between the City of Dunn and DataMax Corporation d/b /a Interstate Credit Collections (ICC) to collect accounts placed for collection by the City of Dunn. Finance Director Mark Stephens stated that during the budget work sessions, discussion was held about efforts to collect delinquent accounts, specifically weedy lots. After his research with other municipalities and counties, DataMax was highly recommended. He explained the advantages of this company which turns the debtor over to the credit rating company. This company will start with collecting weedy lot fees and will eventually expand to collect other debts. Currently, there is approximately $70,000 in uncollected weedy lot fees. Motion by Mayor Pro Tem Robinson and seconded by Council Member Barfield to authorize the service agreement between the City of Dunn and DataMax Corporation d/b /a Interstate Credit Collections (ICC). Motion unanimously approved. A copy of the Service Agreement between the City of Dunn and DataMax Corporation d/b /a Interstate Credit Collections (ICC) is incorporated into these minutes as Attachment #8. 266 ITEMS FOR DISCUSSION AND /OR DECISION Financial Report Finance Director Mark Stephens provided the following financial report for the period ending August 31, 2012: • As of August 31, 2012, the City had $1.9M in cash in the General Fund and $1.9M in the Water - Sewer Fund. In August of 2011 the City had $1.4M in the General Fund and $2.1M in the Water - Sewer Fund. • Investment earnings are in the .15 % -.08% range. • Building permit fees were $30,449 or 67.67% of budget. Benchmark for this month is 16.67% of budget. • Water and sewer revenues were $760,821 or 16.48% of budget. Benchmark for this month is 16.67% of budget. • Average fuel cost in August for unleaded was $2.85 per gallon and diesel was $3.19 per gallon. The City budgeted $3.35 per gallon. • Sales tax distribution was $148,494 or 10.92% of budget. Benchmark for this month is 8.33% of budget. • Expenditures were 15.02% of budget in the General Fund and 13.11% of budget in the Water and Sewer fund. The benchmark for this period is 16.67% of budget. ADMINISTRATIVE REPORTS Motion by Council Member Billy Tart and seconded by Council Member Tumage to accept the Administrative Reports. Motion unanimously approved. ANNOUNCEMENTS The following announcements and/or comments were made. Mayor Harris: ➢ Tuesday, October 16, 2012 — 7pm — DACC will host a Candidates Forum in the Council Chambers at City Hall. ➢ 2012 North Carolina League of Municipalities Conference will be held on October 21 -23, 2012 in Charlotte, NC. ➢ Dedication Ceremony for the Downtown Revitalization Project is being planned for the spring of 2013. Date to be determined. ➢ "Trick or Treat" times will be observed in the City limits of Dunn on Wednesday, October 315` from early evening until 8:30 pm. ➢ 14`s Annual Touchstone Energy Cotton Festival will be held on Saturday, November 3`a from 10 am until 4 pm in Downtown Dunn. ➢ City offices will be closed on Monday, November 12`s in observance of Veterans Day. ➢ Sudan Temple Fall Ceremonial will be in Dunn on November 16 -17, 2012. ➢ Post 59 of the American Legion will hold a Veteran's Day Ceremony at the General Lee Museum at 2:00 pm on Sunday, November 11, 2012. ➢ The Council has been formally invited to attend the Police Department Explorer Post 421 awards promotion ceremony on October 29, 2012 from 6 — 8 pm at the Dunn Community Building. ➢ DACC Beautification and Image Committee will be hosting a Community Clean-up Day on Saturday, October 20, 2012 — Volunteers should meet at 8:30 am at Sherry's Bakery. ➢ The next regular City Council meeting is scheduled for Tuesday, November 13, 2012 at 7:00 pm. Council Member Tumage: ➢ Extended congratulations to Colonel Teddy Byrd in his recent retirement after 31 years of service to the US Army and Army Reserves. Council Member Barfield: ➢ The current political sign ordinance needs to be addressed and enforced. Manager Autry stated that this issue will be discussed during the next budget retreat/planning session. ➢ Requested that the next budget retreat/planning session be held in Dunn. Mayor Harris responded that the Council has been invited to hold their next budget retreat/planning session in the athletic building complex at Campbell University. With no further business to discuss, a motion was made by Council Member Barfield and seconded by Council Member Galbreath to adjourn the meeting at 7:50 p.m. Motion unanimously approved.
