09132011160 MINUTES CITY OF DUNN DUNN, NORTH CAROLINA The City Council of the City of Dunn held a Regular Meeting on Tuesday, September 13, 2011, at 7:00 p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Chuck Turnage and Joey Tart. Also present was City Manager Ronnie Autry, Assistant City Manager Steven Neuschafer, Public Works Director Billy Addison, Finance Director Mark Stephens, Human Resources Director Anne Thompson, Planning Director Samantha Lloyd, Chief Building Inspector Mike Blackmon, Police Chief B.P. Jones, Recreation Director Perry Hudson, Librarian Mike Williams, City Engineer Michael Goliber, City ( Attorney P. Tilghman Pope, and City Clerk Debra West. �-. Absent: Mayor Pro Tent N. Carnell Robinson. Mayor Harris stated that Mayor Pro Tem N. Carnell Robinson received an excused absence from the meeting due to his hospitalization. INVOCATION Mayor Harris opened the meeting at 7:00 p.m. and asked Police Chaplain Reverend Roy Johnson to give the invocation. Afterwards, the Pledge of Allegiance was repeated. AGENDA ADJUSTMENT AND APPROVAL Motion by Council Member Galbreath and seconded by Council Member Joey Tart to adopt the September 13, 2011 meeting agenda with changes, if any, as listed below. Proclamation Presentation Mr. Gene Love Dunn United Ministerial Association Mayor Harris presented Mr. Gene Love, a proclamation recognizing his five years of service as Treasurer of the Dunn United Ministerial Association. A copy of Proclamation (P2011 -19) recognizing Mr. Gene Love is incorporated into these minutes as Attachment #1. Proclamation Presentation Reverend Hollis Fedrick Dunn United Ministerial Association Mayor Harris presented Reverend Hollis Fedrick, a proclamation recognizing his four years of service as President of the Dunn United Ministerial Association. A copy of Proclamation (P2011 -20) recognizing Reverend Hollis Fedrick is incorporated into these minutes as Attachment #2. Proclamation Presentation Dixie Youth NC All-Stars (12- Under) Boys State Champions Mayor Harris presented a proclamation recognizing the Dunn Recreation Department Dixie Youth NC All - Stars (12- under) Boys State Champions and their advancement to compete in the World Series in Carthage, North Carolina. A copy of Proclamation (P2011 -21) recognizing Dixie Youth NC All -Stars 12 -Under Boys State Champions is incorporated into these minutes as Attachment #3. PUBLIC COMMENT PERIOD Mayor Harris opened the floor for a (30) minute public comment period. Hearing no comments, the public comment period was closed. Mayor Harris opened public hearings at 7:24 p.m. 161 PUBLICHEARINGS Demolition of Structure (Storage Building) 1014 E. Edgerton Street PIN #1516 -95- 6297.000 Mayor Harris stated that the public has been notified that oral and written comments will be heard and received concerning the demolition of the storage building owned by Levi D. and Alberta L. Dixon and located at 1014 E. Edgerton Street. The public hearing was duly advertised on August 30 and September 6, 2011. r� \ Mayor Harris asked if there was anyone present who wished to speak for or against the demolition of this structure. Hearing no comments, Mayor Harris closed the public hearing at 7:25 p.m. CONSENTITEMS Minutes — Council considered approval of minutes of the August 9, 2011 City Council meeting Surplus Resolution — Council considered approval of a Resolution Authorizing the Disposition of Personal Property by electronic means through www.GovDeals.com. A copy of Surplus Resolution (82011 -28) is incorporated into these minutes as Attachment #4. Proclamation - Council considered approval of a proclamation designating September 17 -23, 2011 as Constitution Week. Council Member Maness read the proclamation. A copy of Proclamation (P2011 -22) designating Constitution Week is incorporated into these minutes as Attachment #5. Destruction of Municipal Records — Council considered approving the destruction of Library Department records which have exceeded the required retention time pursuant to the Municipal Disposition Schedule. A list of those records that have exceeded the required retention schedule and approved for destruction is incorporated into these minutes as Attachment #6. Proclamation — Council considered approval of a proclamation designating the month of September, 2011 as Lyme Disease Awareness Month in the City of Dunn. A copy of Proclamation (P2011 -23) designating the month of September as Lyme Disease Awareness Month in the City of Dunn is incorporated into these minutes as Attachment #7. / Motion by Council Member Billy Tart and seconded by Council Member Tumage to approve all consent items. Motion unanimously approved. ITEMS FOR DECISION Consideration of Ordinance to Demolish Structure (Storage Building) 1014 E. Edgerton Street PIN #1516 -95- 6297.000 Manager Autry stated that Chief Building Inspector Mike Blackmon has conducted an inspection at 1014 E. Edgerton Street and based upon his observations, the structure failed to comply with the minimum standards of fitness established by the minimum housing code of the City of Dunn. The Building Inspector also found the structure dangerous or prejudicial to the public health or public safety and is a nuisance in violation of N.C.G.S. 160A -193. He added that the owner of the property has failed to comply with the Building Inspector's order and according to N.C.G.S. 16A -443, the City Council has the power to proceed with demolition of this property. Motion by Council Member Galbreath and seconded by Council Member Turnage to adopt the ordinance directing the Building Inspector to proceed with the demolition of the storage building located at 1014 E. Edgerton Street (PIN #1516 -95- 6297.000). Motion unanimously approved. A copy of Ordinance (02011 -10) to demolish the storage building at 1014 E. Edgerton Street is incorporated into these minutes as Attachment #8. Award Bid for Bank Financing 2011 Police Cars Manager Autry stated that a request for financing proposals was submitted to local financial institutions for the financing of the following equipment approved for Fiscal Year 2011 -2012: (6) Police Cars Principal $125,000 162 The debt service payments will begin in September of 2012 with a five (5) year pay -back. Finance Director Mark Stephens recommends award be granted to BB & T. The proposals received are as follows: BB & T 1.73% 6,561.65 125,000 $131,561.65 First Citizens 2.20% 8,369.66 125,000 $133,369.66 RBC Bank 2.47% 9,413.15 125,000 $134,413.15 New Century 2.75% 10,498.95 125,000 $135,498.95 Motion by Council Member Joey Tart and seconded by Council Member Maness to award bid for financing to BB & T at a rate of 1.73 %. Motion unanimously approved. 1 Voting Delegate for 2011 NCLM Business Meeting Manager Autry explained that the North Carolina League of Municipalities will hold their annual business meeting on Monday, October 24, 2011 at 2:15 p.m. at the Raleigh Convention Center in Raleigh, NC. Any municipality that plans to attend must have their governing board authorize a voting delegate and an alternate voting delegate to attend this meeting in order for them to cast a vote. Mayor Harris, Council Member Turnage, Manager Autry and Assistant Manager Neuschafer will be attending the NCLM Annual Conference. Motion by Council Member Galbreath and seconded by Council Member Billy Tart to designate Council Member Turnage as a voting delegate and Assistant City Manager Neuschafer as an alternate voting delegate representing the City of Dunn, NC at the 2011 North Carolina League of Municipalities annual business meeting. Motion unanimously approved. ITEMS FOR DISCUSSION AND /OR DECISION Financial Report Finance Director Mark Stephens provided the following financial report for the period ending July 31, 2011: • As of July 31, 2011, the City had $2.1M in cash in the General Fund and $2.5M in the Water- Sewer Fund. In July of 2010 the City had $1.9M in the General Fund and $2.3M in the Water - Sewer Fund. • Investment earnings are in the .35 %.20% range. This is within the budgeted range. • Building permit fees were $6,765 or. 8.46% of budget. Benchmark for this month is 8.33% of budget. • Water and sewer revenues were $439,814 or 10.11% of budget. Benchmark for this month is 8.33% of budget. • Average fuel cost in July for unleaded was $2.92 per gallon and diesel was $3.27 per gallon. The City budgeted $3.00 a gallon. Thru July, the City is $4,083 over budget which is attributed to usage during these summer months. • There was no sales tax distribution to report. The first sales tax distribution for the fiscal year will be September 15, 2011. • Expenditures were 7.24% of budget in the General Fund and 7.29% of budget in the Water and Sewer fund. The benchmark for this period is 8.33% of budget. • The audit fieldwork was completed in August. A draft audit report will be ready by the first week of October. The audit report will be filed with the LGC by October 31, 2011. ADMINISTRATIVE REPORTS Motion by Council Member Maness and seconded by Council Member Joey Tart to approve the Administrative Reports. Motion unanimously approved. ANNOUNCEMENTS - The following announcements and/or comments were made. Mayor Harris: ➢ Thursday, September 29"— 7:00 pm — Dunn Area Chamber of Commerce will host a Candidates Forum for the Mayor and six Council Members in the Council Chambers at City Hall. ➢ A non - partisan election will be held on October 11, 2011 to elect a Mayor and six Council Members. Polls will open from 6:30 am until 7:30 pm. The polling place will be at the Dunn Community Building, 205 Jackson Road, Dunn NC and the Wayne Avenue Elementary School Multi- Purpose Room, 910 W. Harnett Street, Dunn, NC. All residents of the City of Dunn who are registered to vote with the Harnett County Board of Elections may vote in this election. For additional information, call the Harnett County Board of Elections at 910 - 893 -7553. ➢ The next regular City Council meeting is scheduled for Thursday, October 13, 2011 at 7:00 pm. ➢ He recognized Midway High School students Christian Jackson, Luke Clark and Taylor Calcutt who were present in the audience observing a Council Meeting for their Civics Class. 163 Manager Autry: ➢ Announced and introduced newly hired Human Resources Director Anne Thompson; adding he was pleased to have her on the City team. With no further business to discuss, a motion was made by Council Member Turnage and seconded by Council Member Joey Tart to adjourn the meeting at 7:40 p.m. Motion unanimously approved.
