The City Council of the City of Dunn held a Regular Meeting on Tuesday, April 13, 2010, at 7:00
p.m. in the Dunn Municipal Building. Present was Mayor Oscar N. Harris, Mayor Pro Tem N.
Carnell Robinson, Council Members Buddy Maness, Bryan Galbreath, Billy Tart, Chuck Turnage
and Joey Tart. Also present was City Manager Ronnie Autry, Finance Director Mark Stephens,
Police Chief B.P. Jones, Planning Director Steven Neuschafer, Chief Building Inspector Mike
Blackmon, Librarian Mike Williams, City Attorney P. Tilghman Pope, City Clerk Debra West, and
Daily Record Reporter Reece Murphy.
INVOCATION
Mayor Harris opened the meeting at 7:00 p.m. and asked Council Member Galbreath to give the invocation.
Afterwards, the Pledge of Allegiance was repeated.

Proclamation
Dunn Crime Stoppers
Mayor Harris and Police Chief Jones presented Mrs. Lib Smith, president and Mr. John Riley, vice -
president of Dunn Crime Stoppers, a proclamation recognizing the active role and presence of this
organization in the City of Dunn. A copy of proclamation (P2010 -04) recognizing Dunn Crime Stoppers is
incorporated into these minutes as Attachment #1.
Mr. Riley spoke of the success and history of Dunn Crime Stoppers. He recognized each board member
that was present in the audience.
Mrs. Lib Smith, president of Dunn Crime Stoppers, thanked her board; adding that this is the best board she
has ever worked with and she also thanked the City Council for this presentation.

Dunn Crime Stoppers
Mayor Harris and Police Chief Jones presented Sgt. Regina Autry, a plaque from the Southeastern Crime
Stoppers Association in recognition of the local success of Dunn Crime Stoppers.
Mayor Harris and Police Chief Jones presented Sgt. Regina Autry, a plaque from the City of Dunn, in
appreciation of her guidance, d and devotion as police liaison with Dunn Crime Stoppers.
Dunn Area Chamber of Commerce
Beautification and Image Committee
Ms. Pat Fitzgerald, representative of the Dunn Area Chamber of Commerce Beautification and Image
Committee, gave a presentation with regard to a Citywide Clean Up Day they have scheduled for Saturday,
May 22, 2010 and asked for the support of the City. They requested that the City provide staff and
volunteers to assist and promote this effort. They also requested that the City proclaim May 22, 2010 as
( "Dunn Community Clean Up Day ".
She thanked City Planner Steven Neuschafer and Public Works Director Billy Addison and their team for
partnering with the DACC in improving the appearance and image of the City of Dunn.
Mayor Harris recognized the Chamber of Commerce representatives in the audience. He thanked this
committee for their commitment and hard work.

Mayor Harris stated that the public has been notified that oral and written comments will be heard and
received concerning the request by William Becker for a conditional zoning district for a parcel of land,
totaling .54 acres + / -, located at 1409 & 1411 W. Cole Street.
This property is currently zoned R -20; Single Family Dwelling District and is requested to be rezoned to R-
20; (CZD); Residential Single Family Conditional Zoning District, to allow the subdivision of a duplex.
This approval would allow for zero lot line zoning, legally splitting the parcel through the existing fire wall
inside the structure. If approved, the conditional zoning district will be recorded and the land subdivided.

Conditional Uses of the Zoning Ordinance
Mayor Harris stated that this is a request to hereby amend Chapter 22, Zoning Ordinance, of the City of
Dunn Code of Ordinances; Article I, Definitions and Article IX; Division 1, Conditional Uses.
This amendment will add a new definition for Electronic Gaming Operations to the zoning ordinance and
as a conditional use to the C -2 and C -3 zoning districts.
The public hearing was duly advertised on March 16th, 30 and April 6'", 2010.
Mayor Harris asked if there was anyone present to speak for or against this ordinance amendment.
Mr. Rick Lashmit, 715 Westbrook Avenue, Dunn, NC — He stated that when this issue was brought before
the Planning Board, there was one issue that needed to be addressed. He agrees with the proposed
ordinance with the exception of restricting the operating hours. He stated that if there is not an alcohol,
safety or noise issue, then this type of business should not have restricted hours.

Ordinance Amendment OA -02 -10

Mayor Harris stated that this is a request to hereby amend Chapter 22, Zoning Ordinance, of the City of
Dunn Code of Ordinances; Article III, Division 11 and 12.
This amendment will revise the text for the I -10; Restricted Industrial and the I -100; Industrial Districts of
the zoning ordinance.

received concerning the dwelling located at 211 W. Harnett Street as being unfit for human habitation
pursuant to N.C.G.S. 160A -441, ET SEQ.
This property is owned by Elwyn and Mary Dudley.
The public hearing was duly advertised on March 30, 2010 and April 6, 2010.
Mayor Harris asked if there was anyone present to speak for or against this property being unfit for human
habitation.
Mr. William "Billy" Barfield, 1304 Guy Avenue, Dunn, NC — He stated he is against tearing this house
down. This is one of the oldest houses in Dunn and used to be a beautiful house. This house is full of birds
and has been ruined by neglect. He thanked the Council for helping to clean the neighborhood up. He
regrets to see this house torn down.

ITEMS FOR DECISION
Conditional Zoning Request CZ -01 -10
William Becker

1409 & 1411 W. Cole Street
The public has been notified that oral and written comments will be heard and received concerning the
request by William Becker for a conditional zoning district for a parcel of land, totaling .54 acres
located at 1409 & 1411 W. Cole Street.
This property is currently zoned R -20; Single Family Dwelling District and is requested to be rezoned to R-
20; (CZD); Residential Single Family Conditional Zoning District, to allow the subdivision of a duplex.
This approval would allow for zero lot line zoning, legally splitting the parcel through the existing fire wall
inside the structure.
The Planning Board met on March 23, 2010, to review the request and ask for comments from the public.
After hearing comments from the public and the request from the applicant, the Planning Board
recommended unanimously to approve this request.
Council Member Turnage asked City Planner Neuschafer, if this would set a good precedence for future
situations like this. Mr. Neuschafer responded that a conditional zoning approval is based on a case by case
basis and this will not set a precedence. This ordinance that allows for a conditional zoning district was
made for and was adopted for the added ability to be flexible in certain circumstances. The Planning
Board felt that in this circumstance, this was an appropriate use of the ordinance.
Council Member Turnage asked if the intent is to separate these two properties to allow the applicant to sell
each unit individually. Mr. Neuschafer responded yes, it would allow the owner the ability to sell either
side of the duplex.
Council Member Maness asked Mr. Neuschafer if the City already has a zoning district that provides the
ability to do this. Mr. Neuschafer responded that a conditional use permit through a residential multi-
family zoning would allow for this same scenario to create zero lot line development. Currently that is the
only zoning district that would allow this process.
Council Member Maness asked Mr. Neuschafer that if a developer built a community of duplexes and
townhomes, then they would have to be in that type of zoning district to sell their units individually. Mr.
Neuschafer responded that is correct. Mr. Maness questioned if there were individually owned duplexes
that are not allowed to be sold separately, then they could request a conditional zoning under this process
and this seems a way to circumvent having the property zoned correctly from the start. Mr. Neuschafer
said he would agree with Mr. Maness to a limit that a zoning change is appropriate for a large development
whereas if a single half acre lot is requested to be rezoned to something else then it may appear to be spot
zoned. He added this conditional zoning district allows the zoning to stay the same for the general
neighborhood without changing the approved uses but still allowing a condition that this one property
would be eligible to take advantage of. Mr. Maness stated that he understands the intent but his concern is
that this does provide a means to have everybody else's converted to a CZD. Mr. Neuschafer stated that
they could apply for a CZD. Mr. Maness stated he does not know how the Council could deny a CZD. Mr.
Neuschafer stated that in looking at each application for a CZD separately, they would look at traffic,
location, surrounding neighborhood conditions, and approximate distance to different uses.
Mr. Neuschafer stated that this conditional use zoning request is located across from an industrial
development and is not located in a like zone area where it is all one zoning district. He added there are
varied amounts of factors to consider with each application that will deem them to be different and
from each other without being able to lump all conditional zoning requests for the subdivision of a duplex
into one basket.
Council Member Maness stated that he would just like to see them zone property the right way the first
time if it is the owner's intent and desire to be able to do this.
Mayor Pro Tern Robinson stated that this request accommodates a structure which has already been built
less than two years ago. He added that in this particular case, it would be advantageous to the neighborhood
if in fact this could happen rather than having people in and out of it. /^
Mayor Harris stated that he sees a conditional zoning request as just that. In other words, it is a special
setting, special situation, facts and circumstances. The owner has an opportunity to sell one portion of the
complex to one of the tenants for home ownership.
Council Member Turnage stated that he wants to see it right so that the Council does not have to re -visit
this issue every time a conditional zoning request comes before them. He added it is time to set a
precedence. Mr. Neuschafer stated that when he drafted the ordinance and when it was discussed by the
Planning Board, it was not the intent and it should not be construed as being the intent of any conditional
zoning district or conditional use permit, that they be lumped in the same basket. It is not the idea of that
type of ordinance, but the idea to visit each application separately. To say that it is setting a precedence,
does not fit with the spirit of where they were going with the ordinance in the beginning.

Mayor Harris asked Mr. Neuschafer when a building permit is originally issued, does he see any intent to
circumvent the City's zoning ordinances in this particular transaction. Mr. Neuschafer responded they
can't suppose someone means to as long as their information is legitimate they issue the permit; they don't
see in the future and try to suspect that somebody is going to deceive the ordinance. Mr. Neuschafer added
that at the time this was approved, this opportunity was not even a legal ordinance for the City.
Motion by Council Member Galbreath and seconded by Council Member Joey Tart to approve the request
from William Becker for a conditional zoning district for a parcel of land (PIN #1517 -22- 9059.000)
totaling .54± acres and located at 1409 & 1411 W. Cole Street from R -20; Single Family Dwelling District
to R -20 (CZD); Residential Single Family Conditional Zoning District based on the following justification:
1) The City of Dunn Land Use Plan identifies this area as residential use on the future land use map.
This property is located in area one of the Land Use Plan.
2) The amendment is not inconsistent with the surrounding land uses which are residential and zoned
R -20.
3) The permitted uses in the R -20 (CZD) District are all residential and they are not considered
detrimental to the area and would be beneficial to the entire community.
Motion carried 4 -2 with Council Member Turnage and Maness voting against.
Ordinance Amendment OA -01 -10
Chapter 22; Article I, Definitions
and Article IX; Division 1
Conditional Uses of the Zoning Ordinance
Mayor Harris stated that this amendment will add a new definition for Electronic Gaming Operations to the
zoning ordinance and as a conditional use to the C -2 and C -3 zoning districts.
The Planning Board met on March 23, 2010 and conducted a hearing. A motion was made to remove the
restricted hours of operation to allow these facilities to operate on a 24 -hour basis and thus recommend
approving this ordinance amendment request upon removing the restricted hours of operation (a)(i). The
motion was passed with 4 votes in favor and 2 votes against.
Mr. Neuschafer provided to the Council, a brief list showing how other communities are addressing
electronic gaming operations. Presently there are approximately six electronic gaming operations in the
City of Dunn. In comparing to other communities, the City of Dunn's proposed ordinance is similar to the
Town of Aberdeen. Mr. Neuschafer stated that the City of Dunn was approached approximately two years
ago for an application for an internet caf6 and at that point and time, it was thought of as a cafd but
obviously it is a different type of business. The City did not have a specific definition in place. Recently,
the City has been inundated with requests for this type business, which prompted the City to develop this
ordinance.
Mr. Neuschafer explained that the proposed ordinance requires that a conditional use permit be granted for
any electronic gaming operation. Existing locations would be grandfathered and future requests would
require a conditional use permit in the C -2 shopping center district and C -3 highway commercial district.
Mayor Harris asked Mr. Neuschafer if this is the gainers response to video poker under a different disguise.
Mr. Neuschafer responded that according to many news sources, yes.
Mayor Harris stated that this is a state issue, and will be addressed when the legislature convenes.
Mayor Pro Tem Robinson asked Police Chief Jones if there are any legal or disturbance type issues with
the hours of operation of the existing electronic gaming businesses. Chief Jones responded that due to the
location of some of the existing gaming businesses, their operation should be limited to 11:00 pm due to the
noise created by cars.
The Council discussed that hours of operation may vary according to the location. If an establishment is in
an area surrounded by residential then the hours of operation may be limited as opposed to one located in a
shopping center. This can be determined with each conditional use permit application.
Motion by Council Member Maness and seconded by Council Member Turnage to approve OA -01 -10 with
hours of operation from 8:00 am until 11:00 pm. Motion carried 5 -1 with Council Member Galbreath
voting against. A copy of ordinance (02010 -03) is incorporated into these minutes as Attachment #7.

Consideration of Ordinance
Declaring Property Unfit for Human Habitation
211 W. Harnett Street

Chief Building Inspector Blackmon conducted an inspection at 211 W. Harnett Street and found the
structure in a deteriorated condition that does not meet the requirements of the City of Dunn Minimum
Housing Code (MHC).
If the owner of the property has not repaired, altered or improved the property to bring it into compliance
with Section 4 -31 of the Dunn City Code within (12) months of the adoption of this ordinance, the Building
Inspector is directed to bring the matter back before the City Council for further consideration of remedies
available to the City of Dunn under N.C.G.S. 160A -443.
Motion by Council Member Turnage and seconded by Mayor Pro Tern Robinson to adopt an Ordinance
Declaring the Property located at 211 W. Harnett Street (PIN #1516 -68- 0246.000) as Unfit for Human
Habitation pursuant to N.C.G.S. 160A -441, ET SEQ. Motion unanimously approved. A copy of
Ordinance (02010 -05) to declare property Unfit for Human Habitation is incorporated into these minutes
as Attachment #9.
Council Member Maness stated that in light of comments made tonight, there is nothing that this City
Council did or could have done to have mitigated or made this house any better. He doesn't know of any
time that this Council did not work with homeowners and it is not their desire to tear any structure down
but to have it brought up to the minimum housing code to provide good and affordable housing for the
citizens of Dunn.
Consideration of Ordinance
to Demolish House
822 E. Cumberland Street

Chief Building Inspector Blackmon conducted an inspection at 822 E. Cumberland Street and based upon
his observations, the structure failed to comply with the minimum standards of fitness established by the
City of Dunn MHC.
The Council met on December 8, 2009 to consider an appeal by Mr. Lorenzo King, from the order of the
Building Inspector, giving him 60 days to bring the structure into compliance with the code. At that
meeting, the Council affirmed the Building Inspector's Order.
Motion by Council Member Galbreath and seconded by Council Member Turnage to adopt the ordinance
directing the Building Inspector to proceed with the demolition of the dwelling located at 822 E.
Cumberland Street. Motion unanimously approved. A copy of Ordinance (02010 -06) to demolish 822
E. Cumberland Street is incorporated into these minutes as Attachment #10.

Consideration of Ordinance
Adopting a New Business Category
and Amending the Fee Schedule
for Privilege License.
Electronic Gaming Operations
This ordinance will create a new category of business "Electronic Gaming Operations" to be included in
the City of Dunn Privilege License taxes and the City of Dunn Fee Schedule.
Manager Autry stated that in researching other municipalities, the proposed flat fee of $2600.00 is being
proposed.
Tax Collector Shannon McIntyre provided the Council with information with regard to the fees charged by
other municipalities; adding that some municipalities charge a flat rate while others charge by the number
of machines.
Discussion was held by the Council about their ability to limit the number of machines in a business
whenever they grant a conditional use permit as long as there is a logical rational basis for the Council
limiting the number of machines. This could be dependent upon location, size of building, and parking
space.
Motion by Council Member Turnage and seconded by Council Member Galbreath to adopt the ordinance
adopting a new business category Electronic Gaming Operations and amending the fee schedule for
privilege license with the fee being $2600.00. Motion unanimously approved. A copy of Ordinance
(02010 -07) adopting a new business category "Electronic Gaming Operations" and fee is incorporated
into these minutes as Attachment #11.
Temporary Blocking of Street

Burn Training Exercise
A request has been received from Fire Chief Austin Tow of Dunn Emergency Services, to close the
following streets on Saturday, April 24, 2010 from 7:00 am until 4:00 pm for the purpose of holding a Live
Burn Training Exercise:
• W. Vance St. at N. Fayetteville Ave.
• W. Vance St. at N. King Ave.
N. King Ave. from W. Harnett to W. Vance St.
• Close half of the intersection of W. Harnett St. and N. King Ave.
Motion by Council Member Galbreath and seconded by Council Member Maness to approve the temporary
street closing as requested by Dunn Emergency Services. Motion unanimously approved.
Council Member Maness suggested advertising via water bills and other sources to make the citizens of the
area aware of this live burn exercise.
Mayoral Appointments to
Betsy Johnson Regional Hospital
Board of Trustees
(Mayoral Appointment)
Mayor Harris re- appointed Mr. Ray Weeks and appointed Mr. Wiley Pope to the BJRH Authority with
terms beginning April 1, 2010 and expiring March 31, 2013 or until such time that the new Harnett Health
System, Inc. Board assumes governing authority. He also concurred with the BJRH Board of Trustees
recommendation that an exception be made to the bylaws to allow Mr. Ray Weeks to remain on the present
board even though he has completed two full terms and technically is not eligible for re- appointment with
anticipation that a new board will be formed and seated during 2010.

A motion was made by Mayor Pro Tem Robinson and seconded by Council Member Maness to re- appoint
Dr. David Allison to the BJRH Board of Trustees with a term beginning April 1, 2010 and expiring March
31, 2013 or until such time that the new Harnett Health System, Inc. Board assumes governing authority
and to concur with the BJRH Board of Trustees recommendation that an exception be made to the bylaw
restrictions to allow Dr. Allison to remain on the present board even though he has completed two full
terms and technically is not eligible for re- appointment with anticipation that a new board will be formed

Financial Report
Finance Director Mark Stephens provided the following financial update to the Council:

• The City as of February 28, 2010 had $3.5M cash in the General Fund and $2.1M cash in the
Water /Sewer Fund.
• Investment earnings are in the .35% -.20% range.
• Building Permit Fees were $45,511 or 70.02% of budget. The City should be at 66.67% of
budget.
• The Sales Tax Revenue for February was $611,181 or 43.04% of budget. The City should be at
50.00% of budget.
• Water and sewer revenues were $23M or 67.46% of budget. The City should be at 66.67% of
budget.
• Fuel cost per gallon was $2.03 in February.
• Property taxes collected as of February 28, 2010 were 96.57% of budget. Same period last year,
the City had collected 93.48% of budget.
• Expenditures were 64.26% of budget in the general fund and 57.95% in water /sewer fund. The
benchmark for this period is 66.67 %.
Mr. Stephens reported that outside sales tax revenue, the City is currently meeting or exceeding the budget
in other revenues. He added that a year ago, the City was receiving approximately 6.35% of the sales tax
that came back to Harnett County whereas now the City is receiving 5.88% of the sales tax. This is directly
related to the City reducing the tax rate by .04 cents with the merger of Dunn Emergency Services.
Summer Hours
Manager Autry explained that for the past six years, the City Council has approved summer operating hours
for City offices. The summer hours of 7:30 am — 4:00 pm begin June I" and end August 31".
The transition to summer hours has worked very well during the past six years. To allow adequate time to
notify our citizens, the City Council is being asked to adopt these hours effective June 1'`.
Motion by Council Member Joey Tart and seconded by Council Member Billy Tart to adopt the summer
operating hours of 7:30 am — 4:00 pm beginning June ls` and ending August 31 for the City of Dunn
employees. Motion unanimously approved.
Set Date for Special
Call MeetingBudget
Work Session
Discussion was held about a suggested date for a Special Call meeting/Budget Work Session. The date of
May 18, 2010 at 8:30 am was recommended.
Motion by Council Member Joey Tart and seconded by Council Member Galbreath to set the special call �I
meeting/budget work session for May 18, 2010 beginning at 8:30 am in the Council Chambers. Motion
unanimously approved.

ANNOUNCEMENTS
The following announcements and/or comments were made.
Mayor Harris
➢ Reminded the Council members to mark their calendar for the Ethics Training class offered by the
NCLM on Tuesday, April 20" from 1:15 -3:30 pm in the Smithfield Recreation & Aquatics Center.
➢ The Mayor's Prayer Breakfast is scheduled for Thursday, May 6, 2010 at 7:30 am in the Gospel
Tabernacle Life Center. Also Mr. Curtin and Mr. Beasley's AP Government Class from Triton
High School will be participating in the Leaders of Tomorrow (Shadow) Program and mock City
Council meeting on this same date.
➢ The next City Council meeting is scheduled for Tuesday, May 11, 2010 at 7:00 pm.
➢ Reminded the Council members to check their calendar and let Debbie or Melissa know if they
will be attending Town Hall Day in Raleigh on Wednesday, June 16, 2010.
Council Member Turnage
➢ Offered condolences to the family of former Council Member Robbie Diemer in the death of her ^�

Council Members Maness and Joey Tart requested that the proclamations approved in the consent agenda

City Manager Autry
➢ Roofing contractors have begun work at the Public Library and once complete, will begin
replacing the roof at City Hall.
➢ Recycling carts will be distributed to the residents on Monday, April 19, 2010. Instructions will
be accompanied with the carts.

➢ The Harnett County NAACP cordially invites the Council to attend the 42n Annual Freedom
Fund Banquet on Saturday, April 24", 2010 at 7:00 pm at the Dunn Community Center, 205
Jackson Road. The theme is Bold Dreams and Big Victories.
Council Member Galbreath
➢ Thanked the Planning and Public Works departments for planting the beautiful trees along the
sidewalk on E. Broad Street just east of City Hall.
