Tax refunds, rebates and release (Attachment 1) 4. Resolution Directing the Publication of Notice of Intention to Apply to the Local Government Commission for Approval of Bonds (Attachment 2) 5. Information Technology (I.T.) requested permission to donate two county -owned computers to Harnett County Literacy. These computers are currently not in use and are located in the I.T. Department to be used as spares. Harnett County Literacy's office at Triangle South flooded recently and they lost all of their computers. 9. Cooperative Extension requested permission to accept 2014-2015 Adolescent Parenting grant from the NC Department of Health and Human Services Department in the amount of $60,000 in support of the Teen Pregnancy Prevention Initiative. A match of $14,000 consists of $405 County local cash, $10,800 County in-kind (office space), $895 Harnett Health Hospital, and $1,900 private donation volunteers. 10. Northwest Harnett Fire Department requested permission to purchase a used fire engine no to exceed $150,000. They have set aside the funding for this engine over several budget years. At this time, Northwest Harnett Fire Department is in the process of building a new sub -station to improve the insurance rating within their respective district. The purchase of this used fire engine would be needed to support their operating procedure. 11. Public Utilities requested award of the FY 14/15 chemical supply contracts. HCDPU wishes to award these supply contracts to the following chemical suppliers: Key Chemical, Sanco Industries, C&S Chemicals, Brenntag Southeast Inc., Water Guard Inc., Cape Fear Water Solutions, Southern States Chemical, Evoqua Water Technologies Inc., Oltrin Solutions Inc., and Univar USA Inc. Bid recommendations were provided by the Water Plant and Wastewater Plant Supervisors. A bid result summary sheet is attached. (Attachment 6) 12. Chairman Miller opened the floor for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. ■ Paul Long of 645 Old Buies Creek Road in Lillington said he is really concerned about HB 1108 which was alleged to protect the voters but does not. Mr. Long said the latest move by our state representative to sneak language on a Duplin County local bill; which is an insult, which basically takes several rights away from the County Board and School Board. Mr. Long said the Board did not discuss this matter, they did not promote it, they did not consult with the representative about it and they did not vote to do this. Mr. Long recommended a resolution asking to withdraw the language from HB 1108. Mr. Long said this was an attempt to micro -manage Harnett County. He also recommended that the County Manager require inquiries by elected officials to pass through the chain of command because we don't need commissioners working one on one with departments without the knowledge of the entire Board. Mr. Long said he likes our County Manager and recommended that they give him a contract immediately. Last, Mr. Long urged the Board to pass a tax increase. ■ Carolyn McDougal of 809 East Johnson Street in Dunn, who said she was speaking on behalf of the Harnett County and NC NAACP, said they think it is disgusting that Representative David Lewis continues to take attack on the people that they elected; to take the power away from the people that they elected such as the County Commissioners and Board of Education. She said they would continue to fight and will not stand for this. June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 11 • Joe Langley, 298 Kirk Adams Road in Angier, addressed HB 1108 saying he was puzzled at who would have initiated the language that would restrict the powers of the county commissioners and somewhat limit them to where they don't have full authority during their last 7 months. Mr. Langley asked for a show of hands by commissioners of that were aware of HB 1008. Mr. Langley said he would fight for each commissioner's right to serve their full term with full authority. Mr. Langley also asked what action does this board take on a meeting by meeting basis that does not affect the actions of the future board. ■ Sharlene Jones of Old Buies Creek Road pleaded with the Board to raise taxes. She said we can't continue in this county unless we raise taxes. Mrs. Jones suggested sending out a post card explaining to home owners and land owners "how to do the math" because it's not going to be that much money so we can get schools and get other things we need. Mrs. Jones said everybody has got to contribute to this. ■ Theresa Oudeh of Canterbury Drive in Dunn spoke on behalf of the Harnett County Democratic Party saying they are in opposition of HB 1108. Mrs. Oudeh said this should be a non-partisan issue. She said we need to keep the power in our county and give our county commissioners time to decide if decisions made at the State are correct for our county. ■ Susan Byerly of 407 Old Post Road in Erwin spoke regarding a pending bill saying we've lost all the teacher assistant positions in grades 2 through 3 if this bill goes forward and we have teachers who are going to have to either choose due process or take a pay increase. She said we need school and said Harnett County is one of the lowest in the state in per pupil expenditure. Mrs. Byerly said the Board of Commissioners and the Board of Education seem to have really tried to work together for the betterment of this county. She said it absolutely appalls her that someone in Raleigh thinks that they can take away the right of the citizens that have elected the commissioners and their right to make the best decisions for this county. Mrs. Byerly said she hopes they will have a resolution that does away with this. ■ Donna Parker, 1139 Larrington Road in Lillington, said as a farmer's wife they do own all the acreage and where she doesn't like paying taxes she believes we have got to raise them. Mrs. Parker said when it comes time to vote for taxes, we need schools and we need to be able to hire teachers. She echoed Mrs. Byerly's concerns regarding Representative David Lewis. Mrs. Parker said Commissioner Hill is her representative and she lets her vote for her and frowns upon anyone that take her power away. ■ Penny Christman of Quail Hollow in Cameron said she agrees so far with what is being said. She said she would like to see growth come to Harnett County because we need businesses here to help us with our tax base. Mrs. Christman said she was glad to see Wal-Mart is opening up a store on Hwy 87. She said she has been doing a lot of leg work and has been contacting companies trying to get them to see the potential here but she need helps help as they are asking her to send proposals. She said she would gladly pay a higher tax base but if we can get these stores to recognize us and come here we will get the schools and our children will get the education they so deserve. Mrs. Christmas said there is a lack of communication and we need to do something better. ■ Ben Slaughter of Chalybeate Springs said HB 1108 was a sly, devious trick to put absolute power in a very small number of people. Mr. Slaughter said this is Pandora's June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 5of11 Box and will hopefully be stopped. He said it was a disgrace to try to circumvent democracy and likened it to the rise of Adolf Hitler. ■ Pastor Felton Smith, from the Riverside community, said he would be remiss if he did not give voice to some of the atrocities that have been perpetrated against us as a people. He said this entire mess is about exploiting our differences and denying our commonalities. Pastor Smith said we need people in office that are going to do the right thing because it's right and not for the right reason; when it becomes the right reason it is agenda based and not for the benefit of the people. Pastor Smith said asked elected officials to stand on principal and have some integrity and be willing to do what is right in the face of adversity. ■ Goldie Pryor, 1503 McLean's Chapel Road in Bunn Level, said she is very disappointed regarding HB 1108 because when we elect people to state office we want them to work at the state level and leave the county level alone. Mrs. Pryor said we have county commissioners and Board of Education members that we elect and think they can do the job and want them to be able to do their job. She said we do need some kind of tax increase but it needs to be for everybody in Harnett County, including renters, because everyone is interested in the education of the kids. She said it doesn't just need to be a property tax, it needs to be other ways of bringing in income too so it will not be such a heavy burden on land owners and businesses. She said Economic Development needs to move faster and we need to promote shopping locally. Mrs. Pryor also thanked commissioners for the employee insurance with co -pays. ■ Daniel Glover of Old Stage Road in Coats said HB 1108 was nothing more than to try to give full control to a certain few. He said it is dirty politics. Mr. Glover said he started a blog called Harnett Dispatch and will give them more transparency than they ever wanted. He said if you are not the Chairman, if you are not in charge, you do not try to dictate what is going to happen in the next course. Mr. Glover said we elected these officials who should represent us the rest of their turns. He said HB 1108 is an overreach of government. Commissioner Hill said she feels an injustice has been done to the people of this County as well as a part of this Board. She said she understand the statement was made a few months ago "I am making changings in Harnett County and I am going to undo some things that were done" and said maybe that's what they are attempting to do now. Commissioner Hill asked if anyone wanted to pass a bill why was it not discussed with this Board instead of being done behind the board's back. She said she hopes the public is not holding some of this board responsible for what one or two other board members did. Commissioner Hill said she feels we need a tax increase. She said this county is in trouble and if all of the board members cannot agree on a tax increase then let the state come down and let them put a tax on the county. Vice Chairman House moved to approve the appointment listed below. Commissioner Springle seconded the motion which passed unanimously. Harnett County Department of Social Services Board Melody McGee (nominated by Vice Chairman House) was reappointed to serve a second term on the DSS Board as the Fifth Member. Her three years will expire June 30, 2017. June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 6 of 11 Chairman Miller alerted the audience that there are vacancies on some committees in case they know of anyone that would like to volunteer their time. Chairman Miller read the proposed Resolution Requesting that the North Carolina General Assembly Include Harnett County on an Act to Establish a Moratorium on Filing of Actions by Certain Local Boards of Education Challenging the Sufficiency of Local Funds Appropriated by Boards of County Commissioners for Public Schools. Chairman Miller said he believes we have a good relationship with our School Board but he does know some school boards and commissioners in other counties that have spent thousands upon thousands of dollars fighting each other. Chairman Miller said he agrees mitigation is better than litigation. Vice Chairman House moved to approve the resolution as presented. Commissioner Hill seconded the motion which passed unanimously. (Attachment 7) Melinda Bethune, Risk Management and Safety Coordinator, addressed an issue that came up during the previous special session regarding the cost of the Third Party Administrator (TPA) for our workman's comp coverage with Key Risk. Mrs. Bethune said it was staffs error to include the cost of this contract under Surry Insurance on a spreadsheet prepared and provided to commissioners. Mrs. Bethune said it is her understanding that whoever is the Broker of Record for the excess workman's comp coverage is also Broker of Record for the TPA. Mrs. Bethune said she does have a Change of Broker Record letter on hand if the Board approves to move the TPA services under Surry Insurance. Commissioner Springle moved to bring the issue off of the table for consideration. Commissioner Burgin seconded the motion which passed unanimously. Commissioner Springle moved to accept staff's recommendation to move TPA services under Surry Insurance. Commissioner Burgin seconded the motion which passed unanimously. Mr. Burns presented the following FY 2014-2015 Budget Message. Commissioners were previously provided a copy of the FY 2014-2015 proposed budget. TO: Board of Commissioners and citizens of Harnett County FROM: Tommy R. Burns, County Manager RE: FY 2014-2015 Budget Message In accordance with the North Carolina Budget and Fiscal Control Act, submitted for your review and consideration is the Proposed FY 2014-2015 Budget plan. The budget plan attempts to remain consistent with fiscal policies of the County and State Guidelines for General Fund operations, and contains the following particular elements: • The proposed tax rate would increase 5.5 cents per $100 valuation, to total 78.0 cents per $100 valuation. • This proposed tax rate increase would be used to offset lagging revenues, increasing debt service, budget increases to law enforcement, reduced Medicaid and Medicare reimbursement and increased appropriations to the Harnett County School System. The proposed increase is also consistent June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 7of11 with the October 2013 recommendation of the county's financial advisor, Davenport & Company, that the county will need new revenue sources to fund increased debt service. • The impact of the proposed tax increase on a $150,000 house in Harnett County is $6.88 a month ($82.50 a year). • The General Fund would have a fund balance appropriation of $2.2M. • There is no cost of living increase for County employees within this budget. • There are five new positions for public safety dispatchers to accommodate the City of Dunn's request to consolidate the City's 911 dispatch operations with the County communications system, one new position in Information Technology to provide computer and software support to the City of Dunn Police, Fire and EMS dispatch operations, a new position within the Soil and Water Conservation department (supplemented by state dollars up to $23,000), one new nine-month position to staff the newly opened Anderson Creek County Park, along with reorganization in the IT Department. • The County appropriation to the Harnett County School System will increase by an additional $5M (Local expense increase from $20,523,700 to $21,523,700 and an increase in capital outlay of $4.1M). In addition, the School System has also requested that County Commissioners consider a $100M Bond referendum on the November ballot. The proposed budget plan is a comprehensive attempt to continue to do more with less from an operational standpoint. The budget was substantially reduced from the original departmental requests. This has presented a very challenging circumstance for the County because of the rapid growth that continues in Harnett County. The 2000 Census listed 91,025 residents in Harnett County, the 2010 Census listed 114,132. The current projected Census for 2014 lists 124,987 residents in Harnett County (U.S. Census Data). This substantial growth has placed a tremendous demand on services and the ability to continue to meet the needs of the citizenry has become very challenging in many areas. This maintenance budget provides no new services and attempts to shore up existing service levels in several areas, including law enforcement, HARTS, Department of Social Services, Information Technology, among others. County staff continues to look for any reasonable solutions to make departments operate more efficiently without substantially impacting the expected service provision of the departments. Funding for the General Fund is based on a tax valuation of $7,740,462,643. The proposed tax levy, at 78 cents per $100 valuation, is projected to be $60,375,609. One cent on the tax rate will generate $774,046. The recommended current appropriation to the Harnett County School Board has been increased $1M to $21,523,700. The recommended capital outlay funding for the School System is increased by approximately $4.1M and includes $2.2M in available QSCB authorizations, and approximately $1.9M in additional capital derived from the sale of certain County properties and new sales tax authorizations. Capital Outlay for the departments has been severely limited within this proposed budget plan and is primarily focused on public safety with the replacement of eighteen (18) patrol vehicles for the Sheriff's Office. June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 8 of 11 There are several noted increases in the General Fund budget for increases in valuation for the Fire districts, EMS increases to cover additional requests for service operation, increased employee insurance costs, increased gas, utilities and supply costs in some departments, and substantially increased debt service (911 VIPER Communications project, School Bond (QSCB) debt service and increased lease payments on certain properties). The fee schedule of the General Fund remains essentially unchanged. There are several additional fees listed for Health Department procedures. The Public Utilities budget contains rate increases for certain bulk purchase customers and maintains all other established rates at the current levels. This budget is balanced and will continue to provide sufficient funds to service the approximately $90M debts in this fund. The Solid Waste budget is balanced and contains no recommended increases to the current solid waste fees of the County. Conclusion The FY 2014-2015 proposed budget plan has been prepared with an effort to maintain fiscal constraint but is also realistic in consideration of the impacts that rapid growth has on service provision and the ability to continue to serve growing county needs. The staff is to be commended on the tireless effort and countless hours put into this budget. Most, not all, of the County's departments realize the very difficult financial position the County has been in for several years and proved to be very realistic in the budget requests from their respective departments. Special mention should be given to Kimberly Honeycutt for her work on her first budget as Finance Director. Other appreciated contributions were made by Deputy County Manager Joseph Jeffries. Our management team would welcome the opportunity to discuss this proposed budget with the Board of Commissioners and answer any questions that the Board may pose. Per statute, the County is required to have a public hearing and adopt a budget ordinance on or before June 30, 2014. Thank you for your time and consideration on this very difficult budget. Respectfully Submitted, Tommy R. Burns County Manager Mr. Burns noted the group would discussed the proposed budget at their upcoming work session. Mr. Burns exercised a moment of privilege to offer comments regarding the recent amendment to HB 1108 which only affects Harnett County. Mr. Burns shared his disappointment regarding the amendment and the Representative Lewis handled it; saying this was not good government. Mr. Burns discussed on-going rumors regarding termination of his employment. He said there June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 9of11 He said there had been no mention, by himself or this board, regarding a contract and prior to the amendment he had felt secure in job. Mr. Burns said he wants to serve the people that he cares about and do something good for his county; he wants things to be open and transparent and wants this county to move forward. Mr. Bums said he tries to recommend what he thinks is the best course for the county and is open to any good, clear and concise direction from the Board. Commissioner Hill said we are not going to let one individual run this county or run this Board. She said this county would stand behind Mr. Burns because he has been good and has tried to do his job. Chairman Miller called for any new business. Chairman Miller offered comments regarding HB 1108 and said he really appreciated the NCACC alerting us about it. He said he finds it really hard to believe that Representative Lewis knew enough to write this bill on his own. Chairman Miller read for consideration a proposed Resolution Opposing Harnett County's Inclusion in House Bill 1108 and said if it passes he wants it taken straight to Raleigh. Chairman Miller said HB 1108 undermines the Board of Commissioners, the Board of Education and the citizens of Harnett County because it takes away the voting rights for some members. Chairman Miller moved to approve the resolution as presented. Commissioner Hill seconded the motion. Commissioner Burgin questioned why the resolution was not shared with all of the commissioners prior to this meeting given staff helped prepare the proposed resolution. Commissioner Burgin recognized Gregory Gebhardt from Representative Lewis's Office and asked him if anyone on this Board discussed this amendment with Representative Lewis's Office prior to the day it was read which Mr. Gebhardt said they had not. Commissioner Burgin said some people wrongly accuse others, both publicly and in the paper, that are just wrong. He said just because you think something true doesn't make it true. Commissioner Burgin said he understood what precipitated this was two years ago when a Board, after the primary, extended Scott Sauer's contract from a six month severance to a one year severance. Commissioner Burgin reminded Vice Chairman House that he voted against that extension. Commissioner Burgin also mentioned the recent extension of the Superintendent's contract. Commissioner Burgin said the amendment is not trying to dictate what other votes they can vote on; "all this affects is you can't change a contract with a Manager or a Superintendent in the window of time that you have people that have been replace or have decided not to run". He said the amendment also requires a unanimous vote if something happens to a Manager or a Superintendent. Commissioner Burgin moved to table the resolution because he believes staff erred in not sending the draft resolution out to all commissioners so they had a chance to look at it and talk about it. Commissioner Springle seconded the motion which failed 3 to 2. Chairman Miller also took issue with the amendment saying it takes the voting rights of this Board away if a member leaves office before their term expires. Chairman Miller said, as an example, if he was in a car wreck and died, the voting right would be given to the Executive Committee and in his case would be the Republican Party which he does not agree with at all. Chairman Miller told Mr. Gebhardt, other than taking the voting rights away from this Board, his main problem is the amendment was slipped in underhanded and nobody knew about it. June 2, 2014, Regular Meeting Minutes Harnett County Board of Commissioners Page 10 of 11 Chairman Miller stressed they are not asking for Duplin County's bill to be stopped but they want Harnett County's name taken off the bill. The Resolution Opposing Harnett County's Inclusion in House Bill 1108 passed 3 to 2 with Commissioners Burgin and Springle opposing. (Attachment 8) Vice Chairman House said that he did oppose the extension of Scott Sauer's contract because there were severe performance problems with Mr. Sauer. Vice Chaiinian House said we do not have that problem with Mr. Burns who received a very good evaluation after six months and has done nothing since that time to change his opinion. Commissioner Springle shared his concerns regarding information discussed in a recent closed session being shared on the internet the following day. Commissioner Springle said there are specific guidelines regarding closed sessions. He said he would be opposed to having a closed session unless the Board agrees to have any violation of the closed session rules result in the county attorney having an injunction against that individual. He said the injunction is a court order directing the named public official to stop violating the law. Commissioner Springle asked who is going to want to talk to us regarding economic development if everything they tell us is out in the public the next day. Commissioner Springle said he wanted to discuss this further and moved that the Board go in to closed session to: 1) Consult with the County legal staff in order to conserve the attorney-client privilege concerning the handling of certain claims including the following litigation: County of Harnett vs Christopher Shannon Holland, Harnett County File No. 14 CVS 922; 2) discuss certain personnel matters; 3) discuss matters pertaining to the location or expansion of industries or other businesses in Harnett County Concerning. B. Facts Supporting the Amount of Bonds Proposed. The sums estimated for these bonds are adequate and not excessive for the proposed purposes. Estimates for the proposed projects to be financed with such bonds have been carefully analyzed and determined by persons knowledgeable about the proposed projects. C. Past Debt Management Procedures and Policies. The County's debt management procedures and policies are excellent and have been carried out in compliance with law. The County employs a Finance Officer to oversee compliance with applicable laws relating to debt management. The Board requires annual audits of County finances. In connection with these audits, compliance with laws is reviewed. The County is not in default in any of its debt service obligations. The County Attorney reviews all debt -related documents for compliance with laws. D. Past Budgetary and Fiscal Management Policies. The County's budgetary and fiscal management policies have been carried out in compliance with laws. Annual budgets are closely reviewed by the Board before final approval of budget ordinances. Budget amendments changing a function total or between functions are presented to the Board at regular Board meetings. The Finance Officer presents financial information to the Board which shows budget to actual comparisons annually and otherwise as the County Manager deems necessary or as a member of the Board may request. E. Increase in Taxes; Retirement of Debt. The increase in taxes necessary to service the proposed debt will not be excessive. The schedule for issuance anticipates issuing all of the bonds in more than one series during calendar years 2015 through 2020. Upon motion of Commissioner Beatrice B.
