Tart, Alex Cameron, W A (Bill) Warren, worth Lee Byrd. Also present were the Clerk to the Board, the Auditor and W. A. Taylor, Attorney, acting as County Attorney in the absence of J. R. Motion carried. Upon recommendation of Archie Taylor, Solicitor of this District, the Board appointed Jake T. Lamm, Assistant Solicitor, for Harnett County, to begin his duties for a term of one year beginning January 1st. 1959 at a salary of $200.00, per month . Whereas there is a shortage of funds in the County Aid account of the Welfare Department and whereas there is a surplus of funds in the General Account of this s8xtkta department and whereas the Board of Commissioners of Harnett County is of the opinion that it is for the best interest of the county and necessary for the satisfactory operation of the County welfare department that said funds be so transferred. Now, therefore, be it resolved for the purpose of carrying out the provisions of this resolutions that the auditor of Harnett County be and he is hereby ordered to transfer $2000.00 from the general Assistant account to the County aid account. Upon motionof Alex Cameron, seconded by Worth Lee Byrd, the above resolution was adopted. d FORM OF AGREEMENT BETWEEN THE OWNER AND ARCHITECT THIS AGREEMENT, Made the 5 day of January, Nineteen Hundred and Fifty -Nine by and between the Harnett County Board of Commissioners, Lillington, N. C., hereinafter called the Owner, and Frank B. Simpson, Raleigh, N. C., hereinafter called the Architect. WITNESSETH, that whereas the Owner intends to erect anf addition to the existing Courthouse, of approximately 15,000 sgaure feet, two stories and basement, and certain renovations in the existing building, hereinafter called the work. NOW, THEREFORE, the Owner and the Architect, for the considerations here- inafter named, agree as follows: The Architect agrees to peform, for the above named work, professional services as hereinafter set forth. The Owner agrees to pay the Architect for such services a fee of 6% (Percent) of the coat of the work, 1% of which will become due upon the completion of, and approval of the preliminary drawings. A payment of 3% to be made the Architect upon the award and signing of the contracts with the low accepted bidders. The remaining 2% to be paid the Architect from time to time as the work progresses based upon the monthly estimates submitted by Contractors for payment, until the project is brought to a completion. The parties hereto further agree to the following conditions: 1. The Architect's Services - The ARchitect's professional services consist of the necessary conferences with the Owners, the preparation of the preliminary drawings, working drawings, specifications, large scale and full size detail drawings, structural, plumbing, heating, electrical, air conditioning and other mechanical plans and specifications, assistnace in the drafting of forms of proposals and contracts; the issuance of certificates of payment; the keeping ofaccounts, the general administration of the business and the supervision of the Construction of the Work. SUPERVISION OF WORK- The Architect will by general supervision and by general supervision of an Inspection Engineer guard the Owner against defects and deficiencies in the work of all contractors, but does not guarantee the performance of their contracts. The general supervision of the Architect and his Engineer is to be distinguished from the continuous on -site inspection of a Clerk -of -the- Works When authorized by the Owners, a clerk -of- the -works acceptable to both Owner and the Architect shall be engaged by the Architect at a salary satisfac- tory to the Owner and paid for by the Owner, upon presentation of the Architect's monthly statements. OWNERSHIP OF DOCUMENTS Drawings and specifications as .instruments of service are the property of the Architect Whether the work for which they are made be ex- -ecuted pr not, -and are not to be used pn pt er work except by agreement with the Architect. SUCCESSORS AND ASSIGNMENTS- The Owner and the Architect, each bind himself, his partners, successors, legal representatives, and assigns_to the otherparty to this agreement, and to the partners, successors, legal representatives and assigns of such ether party in respect of all covenants 82 this agreement. Except . as above, neither the Owner nor the Architect shall assign, sublet or transfer his interest in this agreement without the written consent of the other. ARBITRATION- All questions in dispute under this agreement shall be submitted to arbitration at the choice of either party, in accordance with the provisions, then obtaining, of the Standard Form of Arbitration Procedure of the American Institute of Architects. The Owner and the Architect hereby, agree to the full performance of The Covenants contained herein. Whereas, by G. S. Section 153.9 (39) the Board of County Commissioners of Harnett County is authorized and empowered to provided for the organization, equipment, maintenance, and the governing of fire companies; and Whereas, the Board of Commissioners of Harnett County is of the opinion and have found and determined that it is for the best interest and necessary for the protection of the citizens of said county and their property to es- tablish a fire commission, and to encourage the equipment, maintenance, operation, and government of volunteer fire departments in said County for purposes of civil defense and for the protection of buildings, hospitals and farm buildings, aryl to encourage the establishment of a protective volunteer fire fighting organization for the protection of the public school buildings and properties; NOW, THEREFORE' be it resolved for the purpose of carrying out the terms and provisions of this resolution a commission be and it is hereby created, known as the Harnett County Fire Districts Commission to be composed of three members - the chairman of the Board of County Commissioners of Harnett County shall be ex- officio a member of said commission and shall be known as Fire Commissioner- one member, who shall be appointed by the Board of County Commissioners of Harnett County shall be a fire chief of an incorporated town in Harnett County, or fire chief of an incorporated volunteer fire department serving a fire district; one member, who shall be appointed by the Board of County Commissioners of Harnett County, shall be a public spirited citizen residing in an established fire district within Harnett County (nothing herein is to be construed to prevent a member of the Board of County Commissioners of Harnett County from serving as the public spirited citizen from an established fire district in Harnett County). This board shall be appointed for a period of one year. The Fire Commissioner shall be chairman of the board, andone of the other members secretary. The powers and duties of this board shallbe as apecified in this resolution; and all reports made to the Harnett County Commissioners. (a) When any volunteer department owning fire equipment meeting the Fire Insurance Standard, requirements of the North Carolina fire insurance rating bureau of a Fire District shall make application to the Bard of County Commissioners of Harnett County to approve a Fire Distric£7to receive aid from said County under this resolution, the said Commission shall inspect the said fire department, its equipment, personnel, and organization, and method of operation, and shall file written report to the said Board of County Commissioners signifying whether or not such volunteer department meets the minimum requirements and specifications therein referred to, which specifications are hereby by re- ference made a part of this resolution and are taken from the minimum requirements of the North Carolina Fire Insurance Rating Bureau; (b) The said Commission will make annual inspection to determine if said fire departments are continuing to meet the minimum standards as specified, and shall notify the Board of County Commissioners and the Fire Insurance Rating Bureau as outlined hereunder; continuing failure, as outlined, will terminate the financial agreement or support of Harnett County. Said Commission, shall, from time to time, review the specifications as set out in this resolution, and shall recommend to the Board of County Commissions any amendments or changes which the said Commission may deem advisable. SECTION 1. In consideration of any Fire District that might subsequent hereto qualify under this resolution, carrying out the standards as specified therein, Harnett County will, as of the next County fiscal year beginnf}tehe qualification and approval of such Fire District, offer financial aid for the general maintenance and operation of such fire department, within the limit herein specified, or as may hereafter be fixed by resolution of the Board of Commissioners duly adopted. The financial aid to be offered the Fire Department of a Fire District qualifying hereunder shall be not in excess of the sum of $10.00 annually. Provided, however, that no individual volunteer shall receive any renumeration for fire fighting under these benefits. (a) Each department receiving any funds from Harnett County must carry liability insurance on its firemen and equipment, leaving the county free from any responsibility of damages or claims against said fire deaprtment, or any of its personnel. (b) If any fire department does not meet the minimum standards as set forth, the payments hereunder will be withheld under the following procedure: 232 (b -1) Dn making an inspection, if deficiencies are found, the Fire Commission must notify the Fire Chief and at least two (2) members of the corporation of the local department in writing, by registered mail, and a time limit of fifteen .(15) days will be allowed to correct such. deficiencies ;_ (b -2) A second inspection must be made after a period of fifteen (15) days to determine if these deficiencies have been corrected. If not, the Fire Department will be taken off Harnett County standby and maintenance funds, and the Fire Commissioner will notify the North Carolina Fire Insurance Rating Bureau as to the conditions that ekist in the said community fire department, for whatever action they may deem necessary in regard to fire insurance or reductions; (o) Each Fire Department must have a fire chief and other necessary officers and men as needed to properly maintain equipment and fight fires; (d) Egon department must have a minimum of ten (10) active members; a list of all members with the addresses and telephone numbers must be given to the Fire Commissioner in "Jaly,of each year; (e) All deaprtments are required to carry out an organized training program as approved by the Harnett County Fire Commission. (f) Each department must participate in one drill per month; and thefire truck shall be driven a minimum of ten miles per month. (g) Each volunteer Fire Department must be incorporated under the laws of the State of North Carolina; (h) No one but members of the fire department shall ride the fire truck when they are on fire call; (i) Only members of volunteer fire departments shall.drive fire trucks, These drivers should be listed with the membership of the department; (j) All fire chiefs are responsible to keep adequate and accurate records of all calls and all fires. The Fire Chief will also be responsible for-filing with the Fire Commissioner any additional reports which are aequired either locally or by the Fire Insurance Rating. Bureau; (k) Fire Truck drivers shall drive with caution, keeping the truck "under control at all times, and it will be the responsibility of the Fire Chief to stress "safety" throughout the Department, especially the firemen driving their own automobiles to the scene of the fire, and also conduct attending the fires; (L) All recognized members of good standing in each department.. should have se some identification such as a,card, badge, hat or car plate to identify that they are "bona fide" firemen. No one other than "bonafide" firemen in good standing should be allowed these identifications in any community; (m) A telephone should be available at all times during the day and night to receive the :alarms, and notify members of the fire department. Each member of the fire department shall be furnished with a copy of the names and telephone numbers of all members; (n) It is especially recommended that an electric siren be mounted within the community for the notification of all firemen, and preferably installed so that it can be operated from a public place; (o) Each department shall give full cooperation to other fire district depart- ments and the fire departments of incorporated Towns within Harnett County and shall cooperate with fire departments situated within neighboring counties, upon such basis as may be agreed upon with such fire departments. (p) Each department shall have a traffic department trained in the handling of traffic, and if possible all members of said fire departments -- should' be given a basis course in Red Cross First Aid. (q) Fire Chief, or associate, wil make full investigation of each fire to determine, if possible, the cause. If any evidence of arson is suspected, the - Harnett County Fire Commist &over shall be notified immediately and also other proper authorities and insurance engineers; (r) All carelessly -set grass or brush fires shall be handled in the discre- tion of the local Fire Chief. (s) Each department shall have the following minimum equipment as Grade A Communities, and this equipment shall be kept in good condition at all times-and operative at all times, barring accidents or acts or God. Harnett County Fire Commissioner will accept any minor deviations from this equipment which is allowed within the discretion of the North Carolina Fire Insurance Rating Bureau; 233 \' One or more motorized fire trucks equipped with a water tank Of 200 to 500 gallons capacity and a pump with a capacity of at least 60 gallons per minute against not less than 100.pounds when taking suction from tank. Two reels, each with 200 feet of 3/4 inch of 1 -inch rubber hose, kept connected to water tank with suitable nozzle attached. Two combination spray (fog type) and straight stream nozzles. Nozzles should be of the shut -off type and of a size suitable for above mentioned hose. One 24 -foot extension ladder One 12 -foot roof ladder One 10 -foot pike pole One axle One Claw tool One Crowbar Two Lanterns 100 feet 5/8 inch manila rope Four 5- gallon hand pump tanks (knapsack type) One 2i gallon foam extinguisher or the equivalent, suitable for oil fires. Two small extinguishers suitable for electrical fires Four 12 -quart buckets Two scoop shovels SECTION 2. It will be necesary as to each department qualifying under this resolution as a Harnett County Fire District and the volunteer fire department offering services within such District, that a copy of this re- solution must be signed by the President of theCorporation, Treasurer of the Corporation, and the Fire Chief of the department, and that all other agree- ments previously made will be concluded and ended as of that date; SECTION 3. When and if the said fire department operating within specified fire districts have been investigated and meet the minimum requirements of the North Carolina Fire Insurance Rating Bureau, the district will be so designated as a Fire District on the Minutes of the Board of County Commissioners showing date of the establishment of said Fire District. Following the passage by the Board of the above Resolution, the following were appointed by the Board to serve on the Harnett County Fire District Commission, each to serve for one year and until fits successor is appointed: W. Matthews, C S C -- *** ***** *;tii** ***** *: ************ *****381 * ** * -- RESOLUTION DESIGNATING THE BOUNDARIES OF THE ERWIN FIRE DISTRICT OF HARNETT COUNTY. THAT WHEREAS, at the regular monthly meeting of the Commissioners of Harnett County held on January 5, 1959, the matter of fixing and declaring the boundaries of the Erwin Fire District of Harnett County was duly presented to the Board; and it appearing to the Board that the Erwin Fire Department, Inc., of said Fire District, has complied with the provisions of the Resolution providing for the establishment of fire districts in Harnett County, which said Resolution was duly adopted by the Board of County Commissioners Gust prior to the consideration d' this matter, has met the minimum requirements for personnel and equtpment re- quired by said Resolution and will apply for financial assistance from the county in accordance with the terms of said Resolution, and the said Fire District hav- ing been fixed and established by metes and bounds in accordance with the standards pros cribed by the Fire Insurance Rating Bureau for Grade AA communities, and duly submitted to the County Board of Commissioners for approval, it was thereupon, upon motion of Commissioner Byrd, and seconded by Commissioner Cameron resolved that the boundaries of the Erwin Fire District area to be served by dip Erwin Fire Department, Inc., be officially designated and fixed as follows: Beginning at a poxint where a branch crosses the old Lillington and Dunn road, commonly known as ttie "Black Hill" Road, leading out of Erwin on the northwest side, and runs as said road in a S. E. direction to where a single lane dirt road intersects said Black Hill or old Dunn and Lillington road; thence along a line of this single lane dirt road leading in a southerly direction around by the Dunn, N. C. water plant and on to another road northwest of Mirey Branch, near the Erwin, N. C. Air Port; thence along this last.mentioned. dirt road to South 18th Street and West "A" Street, thence along West "A" Street to south 17th Street;;thence along South 17th Street to a point 150 ft. south of West "A" Street; thanes parallel with West - -A" Street 150 ft. south of same, to the west line of Lot # 37 shown on Map "A" of Erwin - Mills, Inc., Subdivision made in 1953; thence along the_west.line of said lot 150 feet, to a corner; thence along the'south line of said lot, 330 ft. .to the center of a road at Mrs. R. C. Cates old store building; thence along the center of said road shown on Map "A" of Erwin Mills Subdivision to N. C. Motion by Commissioner Byrd, seconded by Commission Cameron, that the County of Harnett enter into the following contract with the Erwin Fire Department,, Inc., and that the Chairman of the Board of Commissioners of Harnett County, be and he is hereby authorized, empowered and directed to execute, in the name -of the County of Harnett, said contract, and that the Clerk to the Board of Commissioners be and she is hereby authorized, empowered and directed to attest the execution of the said contract, and impress the seal of Harnett County thereon. STATE OF NORTH CAROLINA HARNETT COUNTY THIS CONTRACT made and entered into in duplicate originals this 5 day of January, 1959, by and between Erwin Fire Department, Inc., a non - profit corpor- ation of Harnett County, State of North Carolina, hereinafter referred to as the "Department ", party of the first part, and Harnett County, a political sub , division of the State of North Carolina, hereinafter referred to as "County" party of the second part, WITNESSETH: THAT WHEREAS, The Department is organized and operating as a volunteer fire department in Harnett County, North Carolina, providing volunteer fire protection service to the Erwin Fire District, which District was heretofore duly eftablished and defined by Resolution of the Board ofCommissioners of Harnett County; and saidDepartinent has applied to the Board of Commissioners of Gaston Count to be declared eligible to receive from the County the aid provide for in said Resolu- tion adopted by the Board of Commissioners of said County at its regular meeting, which was held on January 5th. 1959; and whereas in accordance with the terms of said resolution the Harnett County Fire District Commission has determined and certified to the Board of Commissioners of said County that the Department has been organized and is now equipped and is being operated in accordance with the minimum requirements as set forth in the said Resolution and is qualified under the terms of the said Resolution to receive the said from the County provided for in said resolution, except for the proper execution of this Contract; - NOW THEREFORE, in consideration of the payment to -be made to it by the said County as hereinafter provided, the- Deaprtnient does hereby covenant and agree: with the County as follows, to -wit: A. That all funds paid to the Deaprtment by the Countypursuant to this contract shall be'applied to the extend available only to the. purchase, mainten- ance and repair of fire fighting equipment'for the "said D\eaprtment and parts there- for and In the costs involved in the operation and housing of such equipment and in the payment of debts contracted for the purchase of such equipment and parts, and in providing for a system of communications for the receipt and dispatch of calls to fight fires, and for no other purpose; and that -no part of such funds shall be used in the payment of any compensation to any of the personnel of said DDepartment . 235 B. That the Department shall and will equip, maintain, organize and operate its fire department in accordance with the minimum requirements as set forth in Resolution herein referred to, and that it will when called upon so to do prompt- ly answer calls to and fight fires in The Erwin Fire District of Harnett County. And in consideration of the premises, the County covenants and agrees that so long as the aforesaid Resolution shall remain in force -and effect and so long during such time as the Department shall be and remain qualified therefor under the terms of said Resolution, it will pay to the Department the sum of $1.00, One and no /100 Dollars, annually to be used only for the purposes herein - before set forth. This contract is made subject to all of the terms and conditions of the aforesaid Resolution of the Board ofCommissioners of said County, which Resolution in its entirety is made a part of this contract as if fully set forth herein. IN WITNESS WHEREOF the Department, pursuant to resolution duly adopted by its Board of Directors or governing body, has caused this instrument to be duly executed in its name by its duly authorized officers, and the County has caused this instrument to be duly executed in its name by the Chairman of the Board of Commissioners of said County, and attested by the Clerk to said Board, the day and year first above written.
