05051958148 MAY 5th. 1958 The Board of Commissioners met in regular session on Monday, May 5th. 1958, at 10:00 A. M., with all members present. Also present were the County Attorney, the Auditor and the Clerk to Board. The Following Reports were approved: Elizabeth Matthews D. P. Ray Inez Harrington Kyle Harrington L. B. McLean Earl H. Sellers Roy Godwin Clerk Superior Court Tax Collector Register of Deeds Clerk Recorders Court Veterans Service Officer Dog Warden Electrical Inspector Electrical Inspector A delegation of citizens from Buckhorn Township appeared before the Board with respect - to the condition of that certain road leading North from the Duncan - Corinth Highway to a dead end at the residence of F. T. Tutor in Wake County, a total distance of approximately .8 of a mile. The delegation pointed out that said road is a school bus route and mail route,.s,erves eight to ten 2 famIlteSAmaU is now and has been for sometime in an extremely bad condition, to wit, sandy, slick and bumpy and very hazardous for school bus use. The delegation requested that sand -clay gravel be applied to this road in order to eliminate the defects and hazards presently existing. After hearing said delegation, upon motion of Commissioner Currin, seconded by Commissioner Womble, the Board adopted the following resolution by unanimous vote: Be it resolved by the Board of Commissioners of Harnett County that the North Carolina Highway Commission be and it is hereby requested to apply, as soon as possible, sand -clay gravel to the road running from the Duncan- Corinth Highway to a dead end at the residence of F. T. Tutor in Wake County and take such other action as may be necessary to adequately improve the present condition of said road, eliminate existing hazards and place said road in a satisfactory condition. B. Jackson appeared before the Board on behalf of Calvin Thomas with respect to the property formerly owned by Calvin Thomas and acquired by Harnett County in tax foreclosure Judgment No. A 1572 by deed recorded in Book 247, at page 351, Harnett Cpunty Registry. Mr. Jackson stated that Thomas desired to redeem this property and offered to pay to Harnett County all accrued taxes, penalities, interest and court cost due in connection therewith. Thereupon, on motion of Commission Currin, seconded by Commissioner Pleasant, the Board voted unanimously to convey to Calvin Thomas its interest in the lands acquired in Tax Foreclosure Judgment No. A -1572 by deed recorded in Book 247, at page 351, Harnett County Registry, upon the payment to the County of the sum of $180, the same representing all taxes, penalties, interest and Court cost due on said lands and in connection with said foreclosure, and upon the further condition that the said Calvin Thomas list said lands for taxes for the year 1958 and pay the taxes thereon, and authorize the commission to execute a deed, to be attested by the Clerk conveying the County's interest in said lands to the said Calvin Thomas upon compliance of the terms hereof by him. Upon motion of Commissioner Pleasant, seconded by Commissioner Currin, the Board by unanimous vote adopted for the fiscal year 1958 -59 the privilege license schedule in effect for Harnett County during the fiscal year 1957 -58. Commissioner Womble called to the attention of the Board the recent death of Mr. L. R. Byrd and introduced the following resolution: WHEREAS, Mr. L. R. Byrd, for many years an outstanding citizen of Harnett County, passed away on May 3, 1958; and WHEREAS, the said L. R. Byrd served for many years as a member of the Board of Commissioners of Harnett County during which time he unselfishly devoted his time and ability for the good of the county and in so doing rendered valuable and lasting service to said County and its citizenship; and WHEREAS, the Board of Commissioners feels a distinct loss in his passing and desires to express to his family its sympathy as well as its appreciation for Mr. Byrd's many contributions to Harnett County; NOW, THEREFORE, be it resolved that the Harnett Commissioners sincerely regrets the loss of this public extends to his family its heart felt sympathy, and that closed at 4:00 P. M. on May 5, 1958 during the funeral out of respect for his memory; And be it further resolved that a copy of this resolution be furnished to the family of L. R. Byrd and that copies thereof also be made available to the Harnett County Press. Upon motion of Commissioner Womble, seconded by Commissioner Pleasant, the Board adopted the foregoing resolution by unanimous vote. County Board of servant and citizen and the County offices be of the said L. R. Byrd Representatives of the Buies Creek Rural Fire Protection District appeared before the Board, stated that the owners of a protion of the property ins aid fire district desired to have their property removed therefrom as pro- vided in Section 69.25 -11 of the General Statutes of North Carolina, presented the application of said owners with the unanimous recommendation of the Commiss- ioners of the fire protection district and the approval of the Bard of Directors of the Buies Creek Rural Fire Department attached thereto, and requested the Boarrd to approve the removal of said territory from the district and to revise the boundaries thereof as as to effect such removal. The application of said owners, the recommendation of the Commissioners of said Fire Protection District and the approval of said Board of Directors read as follows: PETITION AND APPLICATION To the Commissiones'of the Buies Creek Rural Fire Protection District, the Board of.Directors of the Butes Creek Rural Fire Department, Inc. and the Board of Commissioners of Harnett County; The undersigned, being the owners of certain property situate within the ;boundary of the Butes Creek Rural Fire Protection District as presently constitu- ted, do hereby, pursuant to the provisions of Section 69 -25.11 of the General Statutes of North Carolina, respectfully request and petition your respective bodies to recomment and approve the decrease of the present area-of said District by relocating the boundaries thereof in such manner and to such an extent as may be necessary to remove our property therefrom. We understand that upon the re- moval of our property from said fire district we shall no longer be required to pay to the special taxes levied in said fire district for fire protection and will not be entitled to the rights and privileges now vested in us by reason of o present inclusion in said fire protection district. Parrish person APPROVAL AND RECOMMENDATION OF COMMISSIONERS OF BUIES CREEK RURAL FIRE PROT$CTION DISTRICT: The undersigned, being all of the Commissioners of the Buies Creek Rural Fire Protection District, having considered the foregoing - Petition and Application and being of the opinion that the request therein contained should be granted, do hereby unanimously recommend that the property owned by the signers of said peti- tion be removed from said fire protection district. Vail APPROVAL OF THE BOARD OF DIRECTORS OF BUIES CREEK RURAL FIRE DEPARTMENT, INC. - The undersigned, being all of the Directors of the Buies Creek Rural Fire Department, Inc., having - considered the foregoing Petition and the forego- ing Recommendation of the Commissioners of the Buies Creek Rural Fire Protection District, do hereby approve the removal from said fire protection district all of the property owned by the signers of sgid Petition and included within the boundaries of said fire protection district as presently constituted. Vail Thereupon, on motion of Commissioner Womble, seconded by Commissioner Curran, the Board- adopted by unanimous vote the following resolution: WHEREAS, Levi Jones, Jarvis Jones, Euna Jones, Sarah Lee Williams, C. R. Gregory, Mrs. T. L. Parrish and Maggie K. Parrish, owners of property situate in the Buies Creek Rural Fire Protection District as originally established, have made application to have their property removed from said district, which appli- cation has received the unanimous recommendation of the Commissioners of said district and the unanimous approval of the Board of Directors of the Butes Creek Rural Fire Department, Inc. this being the Corporation furnishing °ere protection to said District, all as will appear upon reference to saidpetition, recommehdatinn and approval as above set forth; and 151 WHEREAS, the Board of Commissioners of Harnett County is of the opinion that said application should be approved as requested and the boundaries of said fire protection district revised and re- located so as to decrease the area there - Of and remove therefrom the property of the signers of said application and peti- tion; and, WHEREAS, the provisions of Section 69- 25.11, subsection (b) of the General Statutes of North Carolina have been fully complied with; NOW, THEREFORE, be it resolved by the Board of Commissioners of Harnett County pursuant, to the authority contained in Section 69 -25.11 of the General Statutes of North Carolina: 1. That said application and petition be and the same is hereby approved and allowed, and the property owned by the signers thereof is hereby removed from said district. 2. That the area of the Buies Creek Rural Fire Protection District is hereby decreased and the boundaries thereof relocated so as to exclude there- from all property owned by the signers of said application and located within the boundaries of said district as originally constituted, and said property is hereby relieved of and released from all special taxes hereafter assessed upon property in said district for fire protection purposes. 3. That the boundaries of said district be revised and relocated so as to exclude from said district said property and that the boundaries of said dis- trict as revised and re- located be as follows: Beginning at the point where Thornton's Creek empties into the Cape Fear River and runs thence up the river and along the north bank thereof in a northwesterly direction to a point approximate- ly 2.1 miles down - stream, or southeast of the vehicular bridge presently crossing the Cape Fear River at Lillington; thence from the river northerly in a straight line and crossing U. S. Highway No. 421 to a point in the north margin of said highway and approx- imately 40 yards west of the point where the western margin of the Sexton Road intersects the northern margin of U. S. Highway No. 421; thence easterly along the north margin of U. S Highway No. 421, about 40 yards to the west margin of the right of way of said Sexton road; thence northerly along the west margin of the right of way of said Sexton road to a point approximately 0.5 miles north from the in- tersection of said road with U. S. Highway No. 421; thence leaving the Sexton Road and in a westerly direction to Dry Creek; thence up the run of Dry Creek in a northerly direction to a point where Dry Creek crosses the Lillington -Coats Road; thence northeasterly to a point in the Lillington -Coats Road 0.2 miles west of the intersection of said Lillington -Coats road and the Sexton road; thence along the southern right of way of the Lillington -Coats Road to a point 211 feet west of the aforesaid intersection; thence northwest and crossing said road approximately 150 yards to a point in the field and about 225 feet west of the Sexton Road; thence in an easterly direction and crossing the Sexton Road to a point in Buie's Creek approximately 320 yards north of the point where Buies Creek crosses said Lillington- Coats Road; thence up Buies Creek to a point approximately 0.4 mile down stream from the point where Buies Creek intersects the Black River Township line; thence in an easterly direction approximately 0,5 mile to a point in the Buies Creek- Angier Road, which point is approximately 3 miles north of the intersection of said Buies Creek - Angier Road and U. S, Highway No. 421; thence continuing in a northeasterly direction approximately 1.12 miles to a point in the Neill's Creek Township line approximately .3 mile southeasterly from the intersection of said township line and Ennis Road; thence in a southeasterly direction approximately .75 mile to a point in the Buies Creek- Barclaysville road where the Neill's Creek Town- ship line intersects said road; thence following the Neill's Creek Township line in a southeasterly direction to a point in the Wire Road approximately 1.1 miles northeast of the intersec- tion of the Wire Road and the Lillington -Coats Road; thence in a souteasterly direction to a point in Thornton's Creek approximately 0.8 mile north of the intersection of Thornton's Creek and the Lillington -Coats Road; thence down Thornton's Creek in a souther- ly direction to the point of beginning. That the above described area shall be and constitute the Buies -Creek Rural Fire Protection District from and after the adoption of this resolution and until such time as said area may hereafter be increased or decreased in the manner provided by law.
