04051971459 MINUTES OF THE REGULAR MONTHLY MEETING OF COUNTY COMMISSIONERS - April 5, 1971 REGULAR MEETING CALL TO ORDER GERALD ARNOLD REPRESENTATIVE The regular monthly meeting of the Board of County Commissioners convened on Monday April 5, 1971, with the following present: Chairman M. H. Brock, Vice Chairman D. P. Ray, Jr., members C. E. McLamb, W. J. Cotton, Jr., and Gilbert Brown. Also present were H. D. Carson, Jr., Clerk to the Board and Edward H. McCormick, County Attorney.. Chairman Brock called the meeting to order at 9:20 A. M. and Commiss- ioner Brown offered the morning prayer. Gerald Arnold, Representative, visited the meeting for a brief time. The Board discussed mine stripping and County Coroner with Attorney Arnold. Chairman Brock expressed the appreciation of the Board for th work and cooperation that Representative Arnold was doing and offering in behalf of our county and this area. MINUTES The minutes of the March 1971 meeting were read and approved. EARL GRAY HARNETT CO. PARKS AND RECREATION COMMITTEE Mr. Earl Gray of Harnett County Parks and Recreation Committee appear- ed before the Board and presented the 1971 Summer Recreation Program. Chairman Brock commended Mr. Gray for his program and informed Mr. Gray that the Board would support the program again this year as well as they had the last year. W. EARL JONES TAX COLLECTOR Mr. W. Earl Jones, Tax Collector, presented the report of his depart- ment. He Also presented the following resolution: THOMAS ALLEN TAX SUPERVISOR HARNETT COUNTY NORTH CAROLINA To the Honorable Board of County Commissioners In Accordance with G.S. 105 -387 I respectfully submit to you, the governing body of Harnett County, this report of delinquent taxes for 1970 which are liens on real property. I furthermore respectfully request that you pass the following resolution: "Be it resolved that the Governing Body of Harnett County hereby orders and directs the Tax Collector to conduct A tax Lien Sale at the courthouse door on the first Monday in May 1971 between the hours of 10:00 A.M. and 2:00 P. M. (1000 to 1400 hours) pursuant to G.S. 105 - 387." Respectfully submitted, W. Earl Jones Tax Collector. This the 5th day of April, 1971. ACTION: Commissioner Cotton made a motion to adopt the foregoing resolution, Commissioner McLamb seconded the motion and it carried- Mr. Thomas Allen, Tax Supervisor, appeared before the Board for approval of the following requests for refunds: Wandean 0. Cephus D. & Georgia Baker - Ave. Twp. $ 5.11 13.92 7.52 ACTION: Commissioner Cotton made a motion to approve the foregoing requests, Commissioner Ray seconded the motion. It carried unanimously DATES FOR EQUALIZATION AND REVIEW By unanimous decision, the dates for the meetings of the Board of equalization and Review were set to be held in the Commissioners Room, Courthouse, Lillington, 10:00 o'clock on the following dates: First meeting Second meeting Third meeting April 29, 1971 May 13, 1971 May 27, 1971. Mr. Allen informed the Board that the revaluation of rural property was approximately 65% complete. DELMON WILLIAMSON, PRES. DUNN CHAMBER OF COMMERCE Mr. Delmon Williamsgn, President of Dunn Chamber of Commerce, and Mr Walton, came before the Board with the following resolution: MINUTES OF APRIL MEETING CONTINUED Commissioners, Harnett County Lillington, N. C. WHEREAS, The Dunn Area Chamber of Commerce is requested to advise indus trial prospects regarding the City of Dunn and County of Harnett with resp to the installation and maintenance of water and sewage lines to industria sites; and WHEREAS, the Chamber has deligently attempted to secure this informatio from time to time but has been unable to obtain information upon which an industrial prospect could rely; therefore BE IT RESOLVED, that the Dunn Area Chamber of Commerce respectfully request the City of Dunn and the County of Harnett to furnish the follow- ing information by duly adopted resolution. 1. Will the City of Dunn and County of Harnett provide water and sew facilities to the industrial sites on US 301 south of Dunn marked on the attached map? 2. If so, when, and under what conditions? 3. The policy for providing water and sewage to industries locating in the present city limits. 4. The policy for providing water and sewage facilities to industrie locating within the planning area of the City of Dunn. 5. The policy for providing water and sewage facilities to industrie locating within one mile of the outer limits of the planning area of the City of Dunn. 6. The date of expiration of policies. THIS, the 15 day of March, 1971. /s/ Delmon F. Williamson Delmon F. Williamson, President Dunn Area Chamber of Commerce, Inc. Chairman Brock called to the attention of the Board and Mr. Williamson That Harnett County had already answered many of the questions and had indicated that the County would comply, as he read from a document dated November 13, 1970, signed by the Chairman of Board of Commissioners, and is presently being contained in the files of the Chairman. Mr. Williamson suggested that a study be made to determine the policies that would apply to firms seeking to locate in the County. Also, he suggested that representation from the Board attend the city meetings to discuss details deemed necessary. Chairman Brock assured Mr. Williamson that the resolution would be taken under consideration. SOIL CONSERVATION SERVICE SUPERVISORS Mr. J. A. Senter, W. A. Buie, J. C. Harrington, Dan Andrews, Roger Montague and F. M. Puryear appeared before the Board in behalf of the Soil Conservation Services and its Supervisors. They presented a report as to activities of their department, and requested the Board to allocate funds in the next fiscal year to provide their department with a part -time secretary. Chairman Brock informed the group that this request would be placed in the Budget materials. TOM LANIER, ASSISTANT FIRE MARSHAL Tom Lanier, Assistant Fire Marshall, along with Charles Nordan came before the Board and presented a list of places over the county where he had personally determined to be in need of changes or modifications to further prevent fire. He also informed the Board that a new fire district is bein formed and will be called the Flat Branch Fire District. Chairman Brock suggested that Mr. Lanier continue work on the fire codes. He expressed appreciation to Charles Nordan for taking the time to work with and train Mr. Lanier further in fire detection. Brock further stated that the Board would endeavor to compensate Mr. Nordan for his assistance. TAX AND WELFARE LIEN ATTORNEY Marshall Woodall, Tax and Welfare Lien Attorney presented the following report to the Board: INDEX SYSTEM Collection on Taxes: Alex Covington Stewart's Creek Twp. SD 3511 $190.00 $30.00 Atty. fee For information, Mr. Woodall reported that the agreed down - payment and the first monthly installment of $2,500. had been received from Wellons Candy Company by the Tax Collector. Mr. Woodall asked the Board to consider a new type of computer -index syste for the Register of Deeds Office. The Board had previously requested Mr. Woodall to do research on the subject. Chairman Brock suggested that he come before the Board at a later date, prepared to quote prices and have someone to explain the method more fully. ct ge 490 MINUTES OF APRIL MEETING CONTINUED RESOLUTION FROM 3AR ASSOC. A resolution from the Harnett County Bar Association was read to the Board as follows: RESOLUTION Whereas, the Harnett County Bar Association is of the opi that all instruments that are filed for recordation in the Harnett Co Register of Deeds Office should be marked for filing at the precise moment the instrument is handed over to the Registrar of Deeds; and Whereas, the Harnett County Bar Association is of the opi that a time clock could be utilized in the Harnett County Register of office for the purpose of marking all instruments presented for recor in that office; 1 • . on ty on eeds tion THEREFORE, be it resolved that the Harnett County Bar Association urge the Harnett County Register of Deeds Office to purch..e a time clock to be used in the marking of all instruments presented fo recordation. /s/ Wiley F. Harnett County Bar Associatio ACTION: Commissioner Ray made a motion that a time clock be purchased and installed in the Register of Deeds Office. He said he thought it was important and necessary. Commissioner McLamb seconded the motion and it carried unanimously. Authorization was granted to Mr. H. D. Carson and Commissioner Cotton to purchase the time clock. GRAND JURY REPORT The Grand Jury Report was read, discussed and ordered filed in the Records of the Chairman of the Board. RESIGNATION OF MRS. RACHEL SPEARS Chairman Brock brought to the Board a letter of resignation from Mrs. Rachel Spears from the Library Board. Commissioner Ray made a motion that the Board accept the resignation of Mrs. Spears. He added that the record show that it was with much regret. Commissioner Cotton seconded the motion and it carried. An appointment to fill the vacancy created on the Library Board by Mrs. Spears resignation was tabled until the May 1971 meeting. APPOINTMENT TO BOARD OF DEV. COMM. Commissioner Brown moved that Harrington Morrision be appointed to serve on the Development Commission Board, a vacancy created by the resignation of Mr. Alex Cameron. ROAD PETITIONS Commissioner Ray seconded the move and the move carried unanimously. Chairman Brock ordered that this information be sent to Mr. D. W. Denning, Chairman of the Development Commission Board, and that Mr. Morrison would take office immediately. COUNCIL OF AGING Mrs. Nobles reported progress and events from the Region M Coordinatin Council on Older Adults, Inc. REGION M BYLAWS ED MC CORMICK County Attorney, Ed McCormick, presented a resolution setting forth th bylaws of Region M Council of Governments as follows: RESOLUTION PROVIDING FOR THE CREATION OF A REGIONAL COUNCIL OF LOCAL OFFICIALS TO BE KNOWN AS THE REGION "M" COUNCIL OF GOVERNMENTS TO BE COMPOSED OF ELECTED REPRESENTATIVES FROM THE FOLLOWING GOVERNMENTAL UNITS OF THE COUNTIES OF CUMBERLAND, HARNETT, AND SAMPSON AND INCORPORATED CITIES AND TOWNS THEREIN. ment . WHEREAS, the North Carolina General Assembly, pursuant to G.S. 161 -77.1 through 160 -77.6, has authorized any two or more municipalities and co nties to create a regional council of local officials with such powers as ar spec- ified in the creating resolution or any amendments thereto; AND 491. WHhUhAS, the governing o•les o e coun ies o Cumberland, Harnett, Sampson, and certain cities and towns therein have expressed an interest in the creation of a regional council of local officials; and the Board of Commissioners of the County of Harnett finds that it would be in the best interest of the citizens of this county to join in the creation of such regional council of local officials; AND WHEREAS, a regional council of local officials would benefit the governmental units participating in such a council, would provide a forum in which the participating officials might study and discuss community problems of mutual interest and concern, and could lead to the making of recommendations for consideration by the participating governing bodies; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett joins with the governing bodies of the counties of Cumberland and Sampson and certain cities and towns therein in the formati n' and establishment of a regional council of local officials with the bylaws of said council being set forth below which are hereby made a part of this resolution. ACTION: Commissioner Cotton made a motion to adopt the foregoing resolutio "Region M. Council of Governments" upon recommendation of the County Attorney. Commissioner McLamb seconded the motion and it carried unanimously. MEDICAL EXAMINER SYSTEM BILLS Commissioner Ray made a motion that the budget of the Coroner be amended in the amount of $4,000. in order to be able to pay the bills that will be due in regards to the new Medical Examiner System. Commissioner McLamb seconded the motion and it carried. BIDS LANDSCAPE MENTAL HEALTH CENTER Two bids were received in connection with the landscaping of the Lee- Harne t Mental Health Building in Buies Creek. One from Angier Nursery and one from Melvin Weeks Gardens in Dunn. Commissioner Cotton made a motion that we employ and pay the nursery sel- ected with the help and advice of the Garden Club.
