H. Brock, Vice Chairman D. P. Ray, Jr., members C. E. McLamb, W. J. Cotton, Jr., and Gilbert Brown. Also present were H. D. Carson, Jr., Clerk to the Board and Edward H. McCormick, County Attorney. CALL TO ORDER Chairman Brock called the meeting to order at 9:20 A. M. and called upon Gilbert Brown to offer the morning prayer. MINUTES The minutes of the February meeting were read and approved. EAGLES STORES The Board decided to send a message to Attorney Bryan, Dunn, regard- ing Eagles Stores, Inc., informing him that no decisions had been reached concerning the request made and recorded in the minutes of the February 1, 1971 Commissioners Meeting, the matter being still under consideration. Furthermore, The Commissioners agreed to make a final decision upon receipt of letters from other Tax Supervisors indicating their action taken regarding the computation of back taxes. GERALD ARNOLD REPRESENTATIVE Attorney Gerald Arnold, State Representative, visited in the meeting for a brief time. The Board discussed in general some topics, namely the reinstatement of Constables in the County and the poss- ibility of a state -wide referendum on the sales tax issue. TAX AND WELFARE LIEN ATTORNEY AUCTION SALE Chairman Brock commended Representative Arnold on the job that he is doing in the Legislature and extended an invitation for him to visit again at wil -. Attorney Woodall presented a report of the auction sale of lot that had been offered at public auction. The lot was bid off at $750. The Commissioners decided, due to the fact that the County owed the City of Dunn between 5 & 6 hundred dollars in assessments, the sale would put but very little money into the treasury, that the Board would reject this offer, this done by a move by Commissioner Brown and a second of Commissioner Ray. The vote carried unanimously. RESOLUTION ELMORE BROS. Attorney Woodall recommended that the following resolution be adopted and entered into the minutes: That, whereas, William Elmore and Steve Elmore have offered the sum of Two Hundred and Fifty dollars ($250.) for the interest owned by the County in the hereinafter described tract of land and 480 MINUTES OF MEETING CONTINUEDPMARCH 1, 1971 REGION M LAW & ORDER Whereas, the County of Harnett acquired this interest in said trac of land by deed from H. Paul Strickland, Commissioner, said deed dated January 7, 1939, and recorded in Book 247, Page 258, Harnett County Registry, which said tract of land has been condemned to be sold under tax foreclosure suit, and Whereas, it has come to the attention of the Board of County Com- missioners that its title to said property is questionable, and Whereas, the Board of County Commissioners find the following fact 1. That the sale of the County's interest in said lot is in the best interest of the inhabitants of the County of Harnett since: A. The property is not in use for County purposes and is not income producing. B. A sale would place money in the County treasury. C. A sale would transfer the property to a private individual, hence, be taxable by both the County of Harnett and the Town of Dunn. 2. That said property is not presently held for County purposes or use and that its sale would not tend to embarrass or prevent the perfor ance of duties owed by the County of Harnett to the public since other more suitable land is presently held by the County for County purposes, and Whereas, the Board of County Commissioners has been advised that t Town Board of Commissioners for the Town of Dunn has agreed to convey the interest of the Town of Dunn unto William Elmore and Steve Elmore at the price of Two Hundred Fifty Dollars ($250.). Now, therefore, it is resolved and ordered by the Board of County Commissioners of Harnett County that a quitclaim deed conveying the interest of Harnett County in and to that certain tract of land des- cribed in that deed from H. Paul Strickland, Commissioner, to the Count of Harnett dated January 7, 1939, and recorded in Book 247, Page 258, Harnett County Registry, be executed unto William Elmore and Steve Elmo upon payment of Two Hundred and Fifty Dollars ($250.00) unto the County of Harnett. ACTION: Commissioner Brown moved to adopt the foregoing resolution, Commissioner Ray seconded the motion and it carried unanimously. Attorney Woodall informed the Board that operating expenses of the Region M, Law and Order Organization was discussed at their last meeting and that the best possible method of paying an equal share of these expenses would be on the cost - benefit basis. Further discussion was tabled. DELMON F. WILLIAMSON PRES. DUNN CHAMBER OF COMMERCE Delmon F. Williamson, President of Dunn Chamber of Commerce, appeared before the Board, along with Norman Dalton, Chairman of Dunn Area Ed- ucation Committee, and presented the following document: State of North Carolina Harnett County, Board of Commissioners Harnett County, Board of Education WHEREAS, the Education Committee of the Dunn Area Chamber of Commerce is vitally concerned with the improvement of the educational opportunities in the Harnett County area; and WHEREAS, publicity has been given to the immediate school needs in the Anderson Creek, Boone Trail and Benhaven communi- ties; and WHEREAS, this publicity appears to have been either at the instigation or approval of the Harnett County Commissioners and the Harnett County Board of Education; and WHEREAS, for several months there has been considerable publicity regarding the critical needs of the schools in Western Harnett County; and WHEREAS, it appears that the Boards of Commissioners and education are attempting to project the substandard Western Harnett Schools as a critical situation requiring drastic measures to correct, when in fact, the schools throughout all Harnett County are, and have been substandard for years; and WHEREAS, the publicity appears to indicate that the Boards of Commissioners and Education are contemplating immediate action; and WHEREAS, the news article seems to suggest that the Board of Commissioners are considering the possibility of building a new school in the Anderson Creek, Benhaven and Boone Trail area with the State School Contribution Funds of approximately $1,120,000 plus other county funds; and nd e 481 MINUTES OF MARCH 1, 1971 MEETING CONTINUED r ELMON F.WILLIAMSON RES. DUNN CHAMBER OF OMMERCE, con't WHEREAS, it has been suggested that if the people in Western Harnett County secure their new school without additional taxes then they will have no reason to vote for a county bond issue which has been promoted as the only feasible way to promote the educational needs of our children throughout all Harnett County; and WHEREAS, the Education Committee of the Dunn Area Chamber of Commerce is of the opinion that our children have long suffered from the short- sighted, piecemeal, emergency solutions to our educational problems, and the time has come for long - rang comprehensive programs which will be meaningful to all the children in Harnett County; therefore, BE IT RESOLVED, that the Education Committee of the Dunn Area Chamber of Commerce does hereby recommend to the Harnett County Board of Commissioners and the Harnett County Board of Education that (1) The educational needs of all the shcool children throughout Harnett County be considered, therefore serious consideration be given to the feasibility of constructing three comprehensive high schools, rather than the construction on one school in one section of the county. (2) The Harnett County Commissioners and Harnett County Board of Education actively promote a long -range comprehensive program designed to remove our school system from its substandard classification. (3) The people of Harnett County be informed and educated of the fact that the Harnett County Commissioners intend to lead in improvement of our school system, if this is a fact; and that the Harnett County Com- missioners are empowered to levy sufficient tax funds to meet the educational needs of our children. (4) The people of Harnett County begiven an opportunity to be informed of the educational needs of all the school children, and they should likewise be asked for their suggestions for improvement. BE IT FURTHER RESOLVED, that this committee, upon request of the Harnett County Commissioners, will make its service avail- able for any ta8k directed toward the improvement of the oppor- tunities of our children to secure a meaningful education at least equal to, if not better than, the children in the adjoining counties. EPORT FROM IRPORT COMMITTEE Before any discussion on the foregoing topic, Bob Leak, Chairman of the Airport Committee, presented a resolution endorsing the building of an airport within the county and is as follows: STATE OF NORTH CAROLINA HARNETT COUNTY, BOARD OF COMMISSIONERS DUNN, NORTH CAROLINA, CITY COUNCIL WHEREAS,the Dunn Area Chamber of Commerce recognizes the need for building a new airport to attract new business, offer better airport services, and increase utilization; and WHEREAS, a site has been selected on the Cape Fear River about two miles south of the Erwin Airport which should meet the requirements of the Federal Aviation Administration; and WHEREAS, Local, state and federal funds will be needed to construct this new facility; and WHEREAS, the Dunn Area Chamber of Commerce wishes to express its support for, and also wishes to encourage the Dunn City Council and othe civic and governmental agencies to support, the construction of the new airport facility; therefore, BE IT RESOLVED that the Dunn Area Chamber of Commerce does hereby endorse the proposed airport and respectfully request the Dunn City Council and other interested governmental and civic agencies and groups to support this progressive action. Williamson, President DUNN AREA CHAMBER OF COMMERCE, INC. 4 C') Chairman Brock commended Mr. Williamson and Mr. Leak for their display of interest in the activities within the county, and for their interest in the progress and growth of the county. He extended them an invitatio to come before the Board at their pleasure. PAUL DREW, CORONER Paul Drew, Harnett County Coroner, appeared before the Board with some remarks regarding the new Medical Examiner System. Eldon R. Collins, Secretary and Treasurer of the Lillington Rescue Squad also appeared before the Board. He informed the Board of some of the problems that the Squad were experiencing in their normal operation or function under this new system. TAX COLLECTOR W. EARL JONES F.C. HUBBARD SOC. SERVICES TAX REFUNDS Chairman Brock offered his appreciation and that of the Board for their appearance, information and interest in the functions of the County. Mr. Earl Jones, Tax Collector, rendered the report of his office. Mr. Hubbard, Director Social Services, presented the following letter that he had received. Chairman Brock read the letter to the Board: Town of Lillington Lillington, N. C. Mr. M.H. Brock, Chairman Harnett County Board of Commissioners Lillington, N. C. Dear Mr. Brock: I want to take this opportunity to express the appreciation of myself and the other members of the Town Board of the Town of Lillington to the Harnett County Board of Commissioners for the excellent job which has been done by the County in providing modern, spacious new quarters for the Harnett County Social Services Department. This new building has added much to the beauty of our Town and has gone a long way to alleviate some of the parking problems which the Town had prior to the completion of the new building. The Town Board of the Town of Lillington is concerned about the plans that the County has for the old Welfare Office building and the mobile building adjacent to it on the north side of the courthouse. For many years this old building and the mobile building have been allowed to remain in the fire dis- trict of the Town of Lillington notwithstanding the fact that such buildings were in violation of the Town and State Fire Code and notwithstanding the fact that such buildings con- stituted a real fire hazard in the fire district. As you will recall, the Town Board called this to the attention of the County Board of Commissioners approximately five or six years ago and the County Board of Commissioners promised our Board of Commissioners that these buildings would be removed within a period of no more than two years. We realize the difficulty that the County has had in completing the new building, but now that the new building has been completed we want to take this opportunity to urge the County Board of Commissioners to take immediate action to have these fire hazards removed from the courthouse square and our fire district. The removal of these buildings from the fire district will not only contribute to the safety in the area but it will do so very much to beautify the courthouse square and our entire town. If our Board can be of any assistance to you in this matter or in any other matter which the two Boards can cooperate to achieve some desirable objective, please feel free to call upon us and let us know how we may assist you. Lewis, Jr. Mayor ACTION: The Board decided that the Chairman be allowed to write to the Town of Lillington, requesting an extension regarding the buildings aforementioned for the purpose of housing the revaluation. This extension is to be requested for a few months. Mr. Hubbard informed the Board that permission was requested to erect a ball goal on the lower edge of the paved parking lot of the Social Services Department. The Board chose not to grant this permission. Thomas Allen, Tax Supervisor, was not able to appear before the Board to request refunds, however, he had left them with the chairman and he read them to the Board as follows: j 483 MINUTES OF REGULAR MEETING OF MARCH 1, 1971 cont'd. ACTION: Commissioner Cotton moved to grant these requests for refunds, Commissioner McLamb seconded the move and it carried unanimously. RESOLUTION TAX RATIOhi 1971 The following resolution was presented to the Board: ROAD PETITIONS NORTH CAROLINA HARNETT COUNTY WHEREAS, in accordance with General Statute 105 -294, all property, real and personal, shall as far as prac- ticable be appraised or valued at its true value in money, and, WHEREAS, THE Board of County Commissioners shall select and adopt some iniform percentage of the amount at which property has been appraised as the value to be used in taxing property, and THEREFORE, due notice heretofore having been given to representatives of municipalities within the county and due considerations and deliberations made, BE IT RESOLVED THAT, the Board of County Commissioners do, hereby, establish and adopt the assessment ratio at sixty -five (65 %) per cent of true value for both real and personal property for the County of Harnett for the year 1971. DULY ADOPTED THIS 1ST DAY OF MARCH 1971. /s/ M. H. GARBAGE DISPOSAL GRANT Chairman Brock informed the Board that the grant for the garbage dis- posal project had passed the clearing house. He announced that there will be a meeting on the 25th of March, 1971, at the FHA office here in Lillington between the Board and Officials representing the Air, Water and Resources Department. MEETING AT DOROTHEA DIX HOSPITAL Chairman Brock informed the Board of a meeting to be held at Dorothea Dix Hospital on March 11, 1971, with Lee County Board of Commissioners, Lee and Harnett Mental Health Authority, Representatives Love and Arnol Senator Staton and Attorney General Robert B. Morgan. R.A. GRAY BOARD OF EDUCATION Alton Gray, Superintendent of Schools, appeared before the Board. The Chairman called a brief executive session. MEDICAL EXAMINER SYSTEM, DR. ISRAEL Chairman Brock requested that Dr. Ray Israel appear before the Board for a discussion on the recent operation of the new Medical Examiner System. Some of the volunteer departments within the County had experienced unnecessary delays in going about their normal duties of service. Dr. Israel said that this should not happen. After a lengthy discussion it was decided that a joint meeting between the 8 medical examiners of the county, the Board of Commissioners, Jim Bullock from the Attorney General's Office and the Chief Medical Examin:�r from Raleigh, Dr. Hudson.
