09021969328 Regular Meeting September 2, 1969 'Regular Meeting CALL TO ORDER MINUTES ORDER OF BUSINESS REPORT: TAX & WELFARE LIEN ATTORNEY REPORT: TAX COLLECTOR The regular monthly meeting of the Board of County Commissioners convened on Tuesday, September 2, 1969 at 9:15 a.m. in the Commissioners' Room, Courthouse, Lillington, North Carolina. Those present were: Messrs. M. H. Brock, Chairman; D. P. Ray, Jr., Vice Chairman; C. E. McLamb, Member and Gilbert Brown, Member. Also present, Messrs. Gera d Arnold, County Attorney and Herbert D. Carson, Jr.,Clerk to the Board Chairman Brock called the meeting to order at 9:15 a.m. and Mr. Earl Jones offered the morning prayer. The minutes of the August 4 regular meeting and the August 7 special meeting were read and approved. Item 1. Mr. Earl Jones, Tax Collector presented the monthly report of hi department. The following order to the Tax Collector was approved an and made a matter of record: NORTH CAROLINA HARNETT COUNTY 1969 TAXES TO: W. EARL JONES, HARNETT COUNTY TAX COLLECTOR You are hereby authorized, empowered and commanded to collect the taxes set forth in the tax books filed in the office of the Harnett County Tax Supervisor and in the receipts herewith delivered to you, and in the amount and from the taxpayers therein set forth, (and also, all other taxpayers and taxes represented by official tax receipts for years other than the current year) and such taxes are hereby declared to be a first lien on all real property of the respective taxpayers in Harnett County and this order shall be a full and sufficient authority to direct, require and enable you to levy on and sell any real or personal property of said taxpayers, for and on account thereof in accordance with law. The following road petition was presented: Request for black top on #1110 in Johnsonville tow'ship (one mile with nine occupied homes) ACTION: Upon a motion by Mr. Ray, seconded by Mr. McLamb, approval was given to above petition. SHERIFF'S Item 4. low DEPARTMENT Upon a motion by Mr. Ray, seconded by Mr. Brown, the Board authorized the $150 per year of insurance premiums of the rural policemen to be made in two equal installments of $75 each, payable upon receipt of authorized bill from the Sheriff's Department and that payment be contingent upon a six month's period of service. CENTRAL CAROLINA Item 5. TECHNICAL INSTITUTE Mr. Shepherd Rice, Director of Adult Education & Extension REQUEST FOR: Service for Central Carolina Technical Institute submitted a request ($ewing machines & for three (3) sewing machines and janitorial service for two (2) janitorial service)hours per week at the rate of $1.60 per hour for the extension class at Maple Grove School. RESCUE SQUADS Erwin, Dunn & Lillington (Presentation of Ohecks) ACTION: Upon a motion by Mr. Brown, seconded by Mr. Ray, approval of the request was granted. Item 6. Representatives of the Erwin, Dunn and Lillington Rescue Squads appeared before the Board and a check in the amount of $500 was pre- sented to each Squad. Representing the Erwin Rescue Squad, Mr. R. M. New, Chief and Mr. Lewis Joseph; representing the Dunn Rescue Squad, Mr. Gaines Wullenwafer; representing the Lillington Rescue Squad, Mr. Ray Adcock, Chief. UNITED DAUGHTERS Item 7. OF THE CONFEDERACY An invitation was received from the United Daughters of the (Invitation. 9/20/69 Confederacy to attend a luncheon on September 20, 1969 at tresentation of Campbell College. The annual check to this organization in the check) amount of $O00 will be presented at this time. RAVEN ROCK PARK PROJECT Item 8. Mr. Gerald Arnold discussed with the Board financing of the Raven Rock Park project. No action was taken. REPORT OF AUDIT Item 9. OF COUNTY BOOKS Mr. John E. Ingraham rendered a report of the audit of the (John E. Ingraham) county books. Mr. Ingrahmam recommended that a cash receipts book be maintained on all funds not concerned with the General Fund. TAX SUPERVISOR'S Item 10. REPORT Mr. Thomas Allen, Tax Supervisor, presented the report of his department. The following refund was presented for approval: Refund to: Henry H. Sandlin,Box 189, Dunn, N. C. Refund on a true value of $2000 Error in addition Amount of refund = $17.42 ACTION: Upon a motion by Mr. McLamb, seconded by Mr. Ray above refund was granted. COUNTY ATTORNEY'S Item 11. REPORT Mr. Gerald Arnold, County Attorney, discussed the following matters with the Board: Z2AW AND ORDER RESOLUTION PUBLIC HEARING Buies Creek Fire District Proposed Extension of Boundaries 1. The telephone situation in the county. 2. The livestock arena in Dunn. Item 12. The Law and Order Resolution was held in abeyance, pending further study. Notice being duly given, a public hearing was held at 11:Q0 a.m. to consider the proposed extension of the Buies Creek Fire District. No one appeared in opposition to the proposal. 330 RESOLUTION: ERWIN Item 13. BRIDGE The following resolution relative to the Erwin bridge was presen for adoption: September 4, 1969 HARNETT COUNTY NORTH CAROLINA R E S O L U T I O N ed Whereas, the existing bridge at NC 217 crossing at Erwin, North Carolina is the only crossing between the Town of Lillington and the City of Fayetteville; and, Whereas, this bridge is vital to the economy of this area of the county serving as a route for many school buses, mail carriers and as a vital link to Fort Bragg for military personnel and civilians employed at Fort Bragg and Fayetteville and serves the many people employed by Burlington Industries in Erwin, and provides access to our banking facilities, hospital facilities and the trading centers of the area; and, WHEREAS, this bridge bears heavy traffic and supports tremendous tonnage from the gravel pits of the Hello L. Teer loading points in Erwin; and, WHEREAS, said bridge is approximately thirty -five (35) years old and has . been determined in an unsafe condition with hazardous approac and, WHEREAS, a number of accidents have occurred at this point and t bridge has been closed to traffic many times in the past two (2) year for repairs at great inconvenience to the public; and, WHEREAS, the Highway Commission has at great expense replaced th bed at least three (3) times in the past two (2) years and new steel has been placed at each end of the bridge; and, WHEREAS, all attempts to improve the bridge have proven unsatis- factory; therefore, RESOLVED: That the Harnett County Board of Commissioners hereby respectfully request that a new bridge be constructed at NC 217 cross south of Erwin, North Carolina as expeditiously as possible. s/t M. COUNTY PLANNING The following report of the Harnett County Planning Board was BOARD submitted: TO: Harnett County Board of Commissbners FROM: Harnett County Planning Board R E P O R T The following report is requested to be filed in the minutes of the Harnett County Board of Commissioners' records: 1. The Commission held its first meeting Thursday evening, May 12, 1966, at 7:00 p.m., in Conference Room of Carl's Drug, Erwin, N. C. 2. The Harnett County Planning Board met June 9, 1966, at Porte Restaurant in Dunn, N. C. The announced purpose of the meeting was to discuss the possibil of preparing official comprehensive plans for the guidance of the future development of water and sewer systems in Harnett County. The enclosed resolution was formulated and placed before the board for study. Mr. Eugene Smith made a motion that the resolution be adopted The motion carried and the Planning Board authorized Mr. Howard Watki to proceed with presenting the resolution through the Farmers Home es; e ng 's ty s 331. Administration, United States Department of Agriculture to all proper channels. Mr. Frank Lewis was recognized and stated that henceforth the organization will be known as "Harnett County Planning Board" as officially designated under General Statutes 153 -9 (40). 3. The Harnett County Planning Baord met August 5, 1966, at Johnson's Barbecue in LiLington, N. C. Discussion of Proposed Rules and Regulations for the Planning Board followed. Dr Marshbanks made a motion for adoption. Mr. Thomas seconded the motion. Mr. Eugene Smith suggested that an additional statement be included in the rules emphasizing that activities of the Boarc be coordinated with any interested municipal planning board or similar boards in surrounding counties. Dr. Marshbanks amended his motion to include this change and the Pro- posed Rules and Regulations were adopted by the Harnett County Planning Board. 4. The fifth meeting of the Harnett County Planning Board was held at Johnson's Barbecue in Lillington on September , 1966. Chairman Fowler announced that the Board's petition for a federal survey grant had been approved in full and that an official notice would be given immediately. The grant was for $12,200.00. The Board acted favorably on a grant agreement for rural area water and sewer planning. Chairman Fowler read the prepared agree- ment. Mr. Miller made a motion that the Board enter into this agreement with the United States Government, and Mr. Thomas seconded. The motion carried. A copy of this agreement is now on file along with the minutes of this meeting. 5. The Harnett County Planning Board met on November 30, 1967 in the conference room of the Farmer's Home Administration Offices. The meeting was called by Chairman Fowler to review the preliminary reports compiled by Moore - Gardner Associates relative to the establis ment of a county -wide water system. Mr. Spainhour and Mr. Moore represented Moore - Gardner Associates The report was made by Mr. Moore on all preliminary work accomplished The Planning Board discussed at length with Mr. Moore and Mr. Spainhour each division of the report. A motion was made by Mr. Theron Miller, seconded by Mr. Gattis Thomas that the Board accept this preliminary report and authorize the engineers to proceed with their work, carrying all material to the printers. 6. Item 2, Minutes of County Board of Commissioners Regular Session held January 6, 1969, page 244. Action: Mr. Cotton made the motion that the recreational progran be placed under the Planning Board; the motion was seconded by Mr. Brown and it carried. 7. Planning Board Meeting of March 24, 1969. A meeting of the Harnett County Planning Board was called to consider a request from Campbell College for aid in filing a petition with the federal government for a grant to be used for the installa- tion of a badly needed sewer system. Chairman Fowler opened the meeting with welcome to all visitors. The meeting was then turned over to Attorney Johnson, who was repre- senting Campbell College. Mr. Johnson explained the reason for his request that the Planning Board convene for this meeting. "Campbell College is in critical need of a new sewer system." He then presente a plan to the Board whereby a petition could be filed with the federa government for a grant. He further stated that it is the intention of the college to build a sewer system which can be added to and used by community citizens. Mr. Theron Miller asked whether this meant all citizens. Mr. Johnson answered again that this sewer system would be available to every citizen in the Buies Creek area. Mr. Small, college business manager, added that the only criteria needed by any citizen to qualify for use would be a simple request. Mr. Fowler stated that in his opinion the Board should take into consideration the Comprehensive Study made by the County and adopted by the County Board of Commissioners. He also said that it is the duty of the Planning Board to consider the overall good of Harnett County. 332 Attorney Johnson replied that the college does not wish to work "cross section with the county" but he also pointed out that nothing has surfaced thus far that would offer any help. "Surveys have not s any possible help. "The college has no other choice but to take an alternate route." He asked those present if they had any otherideas for a plan the college could develop ". own At this point B. P. Marshbanks explained the Planning Board's sympathy for the college's situation, but further explained the Planni g Board's responsibility is for the overall good of Harnett County. Be cause of this respondibility the group needed to confine the discussi n to the colleges request as related to the Comprehensive Study already adopted by the county. Dr. A. R. Burkot, Vice - president of Campbell College, was recogn zed. He stated that college personnel have always felt that they were not accepted as a part of Harnett County. He pointed out how valuable th is to the surrounding area and pleaded for consideration of t is request by the Planning Board. Mr. Frank Lewis was recognized. He stated that the Planning Board had always considered Campbell College's best interests. He also poin ed out that the college had been working on its sewer system for two yea s and that it should give the Planning Board a few hours to consider th request since this is the first the Board has heard about it. He further stated that there is a question of legality: "Who holds titl to the system ?" "Who gets the grant ?" "Who is liable in case of lit igation ?" Attorney Johnson replied that, in his opinion, the plan is legal. s Mayor Godfrey Beasley of Coats was recognized. He explained tha' his town is now making a study preparatory to installing a sewer syst m. His one question would be "If Campbell College does receive a grant, would it have nay adverse effect on another application filed by the town of Coats since these communities are only four miles apart ?" Attorney Johnson explained that, in his opinion, this would not be a problem. Dr. Marshbanks again suggested that all discussion be confined t the application as related to the Comprehensive Study. At this point maps were studied by those present. Plant capacit es were discussed and Campbell College's proposed sewer lines were compa ed with those proposed by Moore - Gardner Associates. Attorney Johnson th n asked Mr. Roy Spainhour, engineer for Moore - Gardner, whether the pro- posed sewer plant by Campbell College would fulfill all requirements Moore - Gardner had set forth in its study. Mr. Spain hour stated that in his opinion, it would. He further stated that in the event a much larger and more complex system would be needed later, this system as proposed by Campbell College could be integrated into it without seve,e financial loss. In light of Mr. Spainhour's statement, Dr. Marshbanks made a motion that the Planning Board approve the application and pass it on to the; County Commissioners. Mr. Thomas seconded. Motion passed. 8. On April 29, 1969, the Harnett County Planning Board met at the Harnett County Courthouse with the Harnett County Parks and Recreational Committee. Chairman Fowler reported on a discussion recently held with Attorney J. T. Lamm relative to the 8" water main being installed sou of Buies Creek on Highway 421. Mr. Fowler reported that he explained to Mr. Lamm that the Comprehensive Study calls for a 12" line and tha in the event that the county system is installed the 8" line cannot b used. Mr. Lamm told Mr. Fowler that he knew this was true and that t 8" line would have to be considered a loss if this occurred. Attorne Lamm further stated that he was completely familiar with the recent survey. h e In the annual election of officers, Mr. Smith nominated Chairman, Fowler for re- election; Theron Miller seconded: Mr. Fowler re- elected by acclamation. Mr. Miller nominated Mr. Eugene Smith for vice - chair &an he was re- elected by acclamation. Mr. Smith nominated Dr. Marshbanks for secretary; he was re- elected by acclamation.
