03041969264 March 4, 1969 REGULAR MEETING CALL TO ORDER READING OF MINUTES BUSINESS LAW AND ORDER RESOLUTION PETITION TO BUIES CREEK FIRE DISTRICT The regular monthly meeting of the Harnett County Board of County Commissioners convened on Monday, March 3, 1969 in the Commissioners' Room, Courthouse, Lillington, North Carolina. Pres were: Messrs. M. H. "Jack" Brock, Chairman, W. J. Cotton, C. E. M D. P. Ray, Jr., Gilbert Brown, members, and County Attorney, Geral Arnold and County Auditor and Clerk to the Board, Herbert Carson. Mr. Brock, Chairman of the Board, called the meeting to order at 9:25 a.m. Mr. Fletcher Hubbard offered the morning prayer. The minutes of the February meeting were read and approved. Item 1. Mr. Frank Lewis appeared before the Board and explained the county participation in the Omnibus Crime Control and Safe Streets Act of 1968. After a discussion period, Mr. Lewis presented the followin resolution for consideration and adoption: nt Lamb, s RESOLUTION WHEREAS, the city /county of Harnett recognizes t e (Name of city /county) value of planning for the improvement of law enforcement and the criminal justice system in North Carolina; and WHEREAS, the Omnibus Crime and Safe Streets Act of 1968 provides matching funds to permit planning for the future of law enforcement and the criminal justice system; and WHEREAS, these planning funds are available to local governme planning units through the Governor's Committee on Law and Order i North Carolina: BE IT, THEREFORE, RESOLVED THAT THE city /county of Harnett t (Name of does agree to participate in joint law enforcement and city /county criminal justice planning efforts in cooperation with other units local government in this area of North Carolina through the (here the name of the local planning agency, if such name is available. Cott.n,Jr. above resolution was duly adopted. Motion carried unanimously. Item 1 -a. Mr. Lewis rendered a progress report on fire districts and garbage disposal areas. Item 2. A petition from people in Neill's Creek and Grove Townships, who are not in any fire district, to come into the Buies Creek Fir District was presented. North Carolina Harnett County PETITION We, the undersigned resident freeholders residing in Neil Creak, Black River, and Grove Townships, Harnett County, North Carolina, do hereby request your Board, pursuant to Chapter 69 -251 of the General Statutes of North Carolina, to add our properties to the Buies Creek Fire District for Fire Protection and the levying of a 265 TAX AND WELFARE IEN REPORT special tax on all taxable property in said area not to exceed ten cents (.10) on the one hundred dollars ($100.00) valuation of property for the purposes of providing fire protection in said district. Motion: Mr. McLamb moved that the petition be accepted. Mr. Brown seconded the motion. Motion carried unanimously. Action: Mr. Brock instructed the county attorney to do whatever is necessary to implement the petition. Item 3. Stewart is a recipient of Disability Assistance authorized under North Carolina General Statute 108 - 73.12.1 and that a lien was filed by the Director of Public Welfare for Harnett County against the real property owned by the said Rubert C. Stewart, and said lien was recorded properly in lien docket book 5, page 48, office of the Clerk of Superior Court; and whereas, it has been made to appear that said Rubert C. Stewart owned an undivided one fifth (1/5) interest in a farmland tract of land formerly owned by his father, Calvin A. Stewart, in Grove Township, Harnett County, North Carolina; and whereas, said tract of farmland was sold in May, 1966, pursuant to orders of the Clerk of Superior Court in a partition proceeding for a purchase price of $10,200.00; and whereas, the purchase price after deduction of expenses of sales, was paid to the administrator of Calvin A. Stewart, deceased, and subsequently, after payment of debts, disbursed to the heirs at law; and whereas; it has been made to appear that the distributive share of said Rubert C. Stewart amounts to $1,061.20; and whereas, the amount of the welfare lien for money paid up to May, 1966, was $1,097.00; NOW THEREFORE, BE IT RESOLVED by the respective Boards that the hereinafter described tract of farmland be released upon the payment of the said recipient, Rubert C. Stewart's distributive share of the sales proceeds of said tract pursuant to the partition proceeding; said tract being described as a 32 acre tract of land in Grove Township, Harnett County, North Carolina, and more fully described in a deed from Neill McK. Ross, Commissioner to Clester P. Johnson and wife, Ruby Lee Johnson, dated April 25, 1966, and recorded in Book 486, page 118, Harnett County Registry. Acted upon this day of March, 1969. Earl Jones, Tax Collector, presented the February Report of the tax collections from his department. AGRICULTURE Item 5 AGENT'S Mr. C. R. Ammons, County Agent, presented the following reports REPORT to the Board: "A Summary of Total Farm Sales For 1968" and "A Summary of Quality Feeder Pig Sales For 1968 ". TAX SUPERVISOR'S Item 6. REPORT Mr. Thomas Allen, Tax Supervisor, presented the February Report of the Tax Supervisor's Office. ERWIN MILLS REFUND ROAD PETITIONS Item 6 -a. It was brought to the attention of the Board that the tax ratio and assessment must be established and a certified copy sent to the State Office, prior to the meeting of the Board of Equalization & Review. Item 6 -b. Pursuant to the request which has been made to Mr. Brock, the Board approved a refund in the amount of $49.09 relative to a fifty (50) acre tract of land belonging to Erwin Mills and double listed with Norwood Brick Company, George M. Norwood, and Mary Lee H. Lewis. Action: Mr. Cotton moved, seconded by Mr. Ray that the refund be granted. Motion carried. Item 6 -c. Refund to Bernice Wood, Dunn, North Carolina, Duke Township in the amount of $11.55 on a pick -up incorrectly listed. Action: Upon a motion by Mr. Cotton, seconded by Mr. McLamb, the the refund was granted. Motion carried. Item 7. The following road petition was presented for approval: Road located in area off N.C. 55 in Duke Township between Erwin and Coats near Gentry School. Action: Mr. Ray moved, seconded by Mr. Cotton that the Board appro the above petition. Motion carried. ADAMS KINTON Item 8. PETITION Mr. Edward McCormick, appeared before the Board and requested that the Board receive the following petition from the AdamsKinton Nursing Home e 267 Contrd ADAMS KINTON PETITION NORTH CAROLINA HARNETT COUNTY COUNTY OFFICE BUILDING TO: THE HARNETT COUNTY BOARD OF COMMISSIONERS PETITION The undersigned, Adams Kinton Nursing Home, of Route Two, Lillington, North Carolina, situated in Neill's Creek Township, Har- nett County, North Carolina, respectfully petitions the Board ID relocate it in the Buies Creek Fire District for the following reasons: 1. Since 1966 the undersigned Adams Kinton Nursing Home has been paying into the Harnett County Tax Collector assessments which have been appropriated for the Buies Creek Fire District. 2. That the Summerville Fire District was organized and the petitioner's property in Neill's Creek Township was mistakenly in- cluded in that fire district. 3. That as of this time no taxes have been paid to the Harnett County Tax Collector for the Summerville Fire District. 4. That the undersigned has always desired to be, and considered itself to be in the Buies Creek Fire District and has called upon the Fire Department there on a number of occasions; that in response to calls the fires have been put out by the Buies Creek Fire Department. 5. That the Buies Creek Fire Department investigated the pre- mises and made the necessary report so that the undersigned nursing home could become qualified for medicare and other welfare procedures. 6. That the undersigned nursing home is 1.4 miles closer to the Buies Creek Fire Station than it is to the Summerville Fire Station. 7. That the two districts have in effect different rates of taxation. 8. That the two fire districts adjoin one another. 9. That the recommendations as required by law will be furnished the Board upon request. WHEREFORE, the petitioner requests: 1. A hearing as prescribed by North Carolina General Statutes 69- 25.11. 2. An order by the Board transferring the territory owned by Adams Kinton Nursing Home from the Summerville Fire District to the Buies Creek Fire District. This 26th day of February , 1969. Mr. Gerald Arnold, County Attorney, presented and discussed with Board members several possible approaches for a county office building; he related these plans, some of which are in operation in other local- ities, to the situation in Harnett County. After discussion, it was decided to proceed with plans for the building under a joint financing plan with county and governmental participation. Mr. Arnold pointed out that the Local Government Commission would be very helpful in guiding the county through this program. Action: Mr. Ray moved that Mr. Carson and Mr. Arnold proceed with the arrangements for securing financing of the project under the Local Government Commission's guidance and recommendations Motion was seconded by Mr. Cotton and carried. SHERIFF's Item 10. EPARTMENT Mr. McLamb commended Mr. Stewart and his force for their work in (Salaries) the county. He pointed out that the present salary of deputies is not sufficient to attract good men and further stated that there has been considerable difficulty in filling the present vacanW which exists 268 AMBULANCE EMERGENCY SERVICE ORDINANCES (Mr. Love) BUILDINGS AND GROUNDS COMMITTEE WRITTEN REPORTS NEW BUSINESS COUNTY MANAGER (Acting) LUNCHEON INVITATION TERMINAL LEAVE CLERK'S OFFICE (Desk & chair) LIVESTOCK ARENA ADJOURNMENT MARCH MEETING March 4, 1969 in the Dunn area due to the inadequacy of salary. Action: Motion was made by Mr. Brown, "that the Board grant a raise for deputies up to $396.00 per month as starting salary and that Mr. Stewart fill the present vacancy in Dunn at this figure." Motion was seconded by Mr. McLamb and carried. Item 11. Mr. McLamb moved that the Board appoint Mr. Brock to investigate ambulance service being given and grant authority to him to continue emergency service and payment of same at his discretion Motion was seconded by Mr. Ray. Voting For: Mr. McLamb and Mr. Ray Voting Against: Mr. Cotton and Mr. Brown Mr. Brock cast a favorable vote. Motion carried 3 to 2. Item 12. Mr. Jimmy Love discussed with the Board pending legislation set forth in Bulletin #4 dealing with the granting of authority to County Boards to pass ordinances. Item 13. The building and grounds reported no new developments. Item 14. Written reports of the departments were submitted. Item 15. It was moved by Mr. Ray, seconded by Mr. Cotton that Mr. Brock be appointed acting county manager. Motion carried. Item 16. The Board received an invitation to a luncheon on Tuesday, March 11 at the new hospital in Dunn. The invitation was accepted. Item 17. Terminal leave re: J. T. Lamm from the minutes of February meeting Action: Mr. Ray moved that this matter be tabled. Motion carried. Item 18. A request for a desk and chair for the Clerk's office was presented Action: Mr. Ray and Mr. Brown will attend to this matter. Item 19. Livestock arena re: Payment of insurance on barn. Action: Mr. Arnold was instructed to check into this and to advise Mr. Carson as to the obligation of the county. There being no further business, the meeting adjourned at 12:33 p.m ATTEST: H. D.
