MINUTES OF THE MID -MONTH MEETING OF THE BOARD OF COMMISSIONERS
Mid -month meeting The mid -month meeting of the Board of Commissioners
was held on Monday, September 15, 1975, in the Comm-
issioners Room, New County Office Building, Lillington,
N. C. The Chairman called the meeting to order at
7:30 P. M. with the following present; Commsg: sioners
M. H. Brock, Jesse Alphin, and W. J. Cotton, Jr.
H. D. Carson, Jr., Clerk and Edward H. McCormick,
County Attorney were present for the meeting.
PRAYER Commissioner Alphin led the evening prayer.
READING AND APPROVAL
OF MINUTES The minutes were read by the Secretary and approved.
REPORT ON BIDS FOR SURPLUS
PROPERTY Commissioner Cotton reported on the bids for the
sale of the surplus automobiles, which were opened
on the 2nd day of September, 1975. As spokesman
for the Committee, his recommendation was that
the bids be rejected.
MASSAGE PARLORS
POLICY PRESENTED
County Attorney, Edward McCormick spoke on massage
parlor matters, indicating that enforcement of the
ordinance to regulate massage parlors would commence
on September 20, 1975, and during this time, admin-
istrative matters could be cleared up.
The County Attorney presented a proposed policy for
donsideratbn and action by the Board entitled --
POLICY ON COLLECTING AND REFUNDING FEES FOR MASSAGIST
LICENSES AND MASSAGE PARLOR LICENSES. The proposed
policy follows:
POLICY ON COLLECTING AND REFUNDING FEES FOR
MASSAGIST LICENSES AND MASSAGE PARLOR LICENSES
THAT, WHEREAS, the Sheriff has requested that the County
collect the license fee for Massagists and for Massage Par-
lors required by "An Ordinance Regulating the Business of
Massage and Massage Parlors';'; and
WHEREAS, It is the desire that the County's policy on
this beta matter of record that can be made available to the
public upon request;
NOW, THEREFORE, THE BOARD OF COMMISSIONERS ESTABLISH THE
FOLLOWING ADMINISTRATIVE PROCEDURE:
1. APPLICATION FORM. Applicants for either a massagist
license or Massage Parlor license may obtain application forms
from either the Office of the Harnett County Tax Collector
or the office of the Harnett County Sheriff.
2. TENDER OF LICENSE FEE. An applicant for a massagist
license or massage parlor license may tender the required fee
to the Harnett County Tax Collector or his authorized repres-
entative who shall issue a receipt for the amount of the fee
and indicate thereon that the money was tendered in payment
of allicense fee for either a massagist or massage parlor.
3. SUBMISSION OF APPLICATION FORM AND RECEIPT TO THE
SHERI FF. The applicant may present to the Sheriff or his
authorized representative the application for a license
and the receipt provided to him at the Tax Collectors
office.
4. ACCEPTANCE OF THE LICENSE FEE AND ISSUANCE OF LICENSE.
If the applicant meets the eligibility requirements for a lic-
ense set out in the County's ordinance regulating the business
of massage and massage parlor and incorporated in the form
"Apllication for Massagist's License /Massage Parlor License ",
then the Sheriff shall issue the license and upon issuance of
a license pursuant to the ordinance, the fee tendered by
the applicant is deemed accepted as payment for the license.
The license shall expire one (1) year after the date of
issuance.
5. REFUND PROCEDURE UPON NON- ISSUANCE OF LICENSE. If
the applicant does not meet the eligibility requirements for
a license as provided for in the ordinance regulating the bus-
iness of massage and massage parlors and incorporated in the
form "Application for Massagist License /Massage Parlor License ",
then the Sheriff shall make the following entry on the receipt:

"No license issued" and sign the same. The applicant
may return the receipt to the Tax Collector and the Tax
Collector may void the receipt and return the payment
if no deposit of the funds has been made; if a deposit
of the funds has been made or if the Tax Collector is other-
wise unable to make a refund, then the Tax Collector shall
make the following entry on the receipt: "No refund Made"
and sign the same. The applicant may take the receipt with
the proper notations from the offices of the Sheriff and
Tax Collector to the County Finance Officer and obtain
a refund of the amount paid by the applicant.

before introduced and entered, Commissioner Cotton
seconded and the motion carried, unanimously.

The following form was introduced by the County Attorney
for approval by the Board of Commissioners. Commissioner
Cotton moved that the form be approved for use, Comm-
issioner Alphin seconded the motion and the issue
carried unanimously. A reproduction of the form

I. Eligibility Requirements for a License.
If the answer to one or more of the following questions is "Yes ",
then you are not eligible for license either as a massagist
or a massage parlor operator:
1. Are you under 18 years of age?
2. Have you ever been convicted of violating an ordinance of
Harnett County entitled "An Ordinance Regulating the
Business of Massage and Massage Parlors ?"
3. Have you ever been convicted of a crime involving
sexual misconduct?
II. Further Requirements.
I consent to be fingerprinted and tender herewith a receipt
from the Tax Collector for the following (check one):

COMMENTS ON THE APPEARANCE BEFORE
UTILITIES COMMISSION The County Attorney commented on the appearance on
September 9, 1975, before the Utilities Commission,
stating that he, Chairman Etheridge and Commissioner
Alphin, had appeared to protest the increased rate
with no additional services for the County.

JURY COMMISSION
CHAIRMAN
John Ingraham, Certified Public Accountant, who audits
the books and records of the County, appeared before
the Board, presented copies of his "REPORT ON EXAM-
INATION OF ACCOUNTS FOR THE YEAR ENDED JUNE 30, 1975,"
and discussed with the Commissioners the important
aspects of the report. The Board accepted the
report with appreciation.
Graham Henry, Chairman of the Jury Commission, presented
statements for the Commission for their work in com-
piling the jury list as follows:

REQUEST FROM RED
CROSS
County Manager Brock made a report on the County Garage,
and presented estimates for fencing to enclose the
garage area, from three vendors as follows: Allison
Fence Company - $3,340.00 -- Acme Fence Company -
$3,190.00 -- with alternate proposal $281.00 -- Sears
Roebuck — $3,809.76. He suggested that a committee
be named to determine the best offer so that an
order could be placed for the fence. The Chairman
appointed a committee with the authority to decide
the best offer and to purchase the fence, this by
motion of Commissioner Alphin and second of Commiss-
ioner Cotton, and a unanimous vote. The persons
appointed to compose the committee were Commissioners
Cotton and Brock.
The Manager reported on the landfill container site,
in that construction would soon begin. He reported
that moving day to the new Tax Supervisor and Tax
Collector quarters to thebbasement area of the
Courthouse was set for October 1st.
He then talked with the Board about the activities
of the Sheltered Workshop and their expansion plans
and of the contracts for the construction of nut-
crackers. The Chairman stated that he would plan a
tour of the premises after the first Monday meeting
in October so the Commissioners could visit the
facility.
A request was presented from the Harnett County Chap-
ter of American Red Cross for the $1,000. that was
included in the present budget. Commissioner Cotton
moved that the request be honored, Commissioner Alphin
seconded and the issue carried.
RSVP request for
Letter of Intent A request from RSVP was made in that a letter of intent
to support the program was needed, for an amonnt of an
appropriation of $3,800. plus space and utilities, be
issed to the proper authorities by the Board of Comm-
issioners. Commissioner Alphin moved that a letter
of intent indicating continued support in the Amount
of $3,800. plus space and utilities be issued,
Commissioner Cotton seconded and the issue passed.
ELEVATING SCRAPER
PROPOSALS After presentation of two proposals to procure an
elevating scraper for the landfill program,
the Chairman appointed a committee,
composed of Commissioners Brock and Cotton, to meet
with the County Attorney to determine the most feas-
ible and equitable method to secure such a piece
of equipment. A tentative meeting was set for
September 16, 1975.
