11181974MINUTES OF NOVEMBER MID -MONTH MEETING HELD ON NOVEMBER 18, 1974. 11 REGULAR SESSION 1CALL TO ORDER PRAYER MINUTES !RECREATION DEPT. Lonker & Stewart The Harnett County Board of Commissioners met in regular mid -month session Monday, November 18, 1974. The following members were pres -I ent: Chairman M. H. Brock, Commissioners Bobby R. Etheridge, W. J. Cotton, Jr. and Gilbert Brown. Commissioner McLamb did not attend because of a conflicting meeting. Also present were H. D. Carson, Jr., Clerk to the Board and Edward McCormick, County Atty. The Chairman called the meeting to order at 7:30 p.m. Chairman Brock offered the evening prayer. The minutes of the previous meeting were read and approved. Mr. Lonker, Chairman of the County Recreation Program, and Neil Stewart, Director of the Recreation Department for the County, gave a report as to the recreational plans and goals for each age seg- ment of the county. This report is duly filed in the files of the County. MOORE GARDNER & ASSOC. Spainhour Mr. Roy Spainhour with Moore, Gardner and Associates, Inc., appear- ed before the Board and presented a resolution relating to the County calling a bond referendum in the amount of $4,500,000. to finance a County Plater System. The matter was tabled until a later date. DIRECTOR OF SOC. SERVICE Mrs. Crews Mrs. Helen Crews appeared before the Board requesting the County Commissioners to allow her to hire two eligibility specialists. She said the Department of Social Services is behind in their overdues because of the increase n the number of people coming into the agency and to the increase of applicants for food stamps. Also, Mrs. Crews requested an addressograph machine and equipment to be used issuing food stamp cards. Mrs. Crews added that it is taking one employee three - fourths of the month to do this job and with the machine, that time now spent on preparation of food stamp cards would be drastically cut. ACTION: Commissioner Brown moved that the purchase of the address graph machine and equipment be granted for the Social Services Address. Machine Department, and that it be paid for out of Revenue Sharing Funds. Commissioner Cotton seconded the motion and it passed. Commiss- ioner Etheridge amended the motion that the equipment and the add- ressograph machine be new. Mrs. Crews had an estimate of the cost of the new machine and equipment of approximately $7,000. Elig. Spec. Commissioner Brown moved, on behalf of the Social Services Board, that the Social Services Budget be amended from the General Fund for the hiring of the two eligibility specialists. Commissioner Etheridge seconded the motion and it passed. NO DEPT. NAT. RESOURCES J. Kier Mr. James N. Kier with the N. C. Department of Natural & Economic Resources appeared before the Board and gave them a questionaire on Planning and Community Development that would serve as a format from which to begin a method of communication between the Commssioner and the people in his district. Commissioners Cotton and Etheridge': both agreed with Mr. Kier, and suggested the forums be held in the district. Commissioner Etheridge suggested he contact Dr. Stumpf from Buies Creek before finalizing the plans. LBC & W PAYMENT for sub - contr. LANDFIL SITES REFERENCE BOOKS Co. Library He was accompanied by John Lynch, the Planner from the Department for the Town of Lillington. Bill Gwinn, Architect with LBC & W in Greensboro, approved the final payment to Air Comfort, Inc., a sub- contractor for the new county office building for air conditioning. Commissioner Cotton moved that the final payment be made to Air Comfort, Inc., as approved by the Architect, in the amount of $3,788.40, Commissioner Etheridge seconded the motion The motion carried unanimously. It was suggested by Commissioner Cotton that Bill Meyer and Rob Rowland look for additional land for a.landfill site in the Dunn - Erwin area and Commissioner Etheridge seconded the motion. Passed. Margaret Randall made a request that certain reference books for the Harnett County Library and it's municipal divisions be pur- chased using funds from the Revenue Sharing Fund. Commissioner Etheridge moved that the Board grant Mrs. Randall's request for the reference books at a cost of up to $6,000., and that the funds be taken from Revenue Sharing Funds, Commissioner Cotton seconded and the issue passed. RES. FROM BD. OF ELECTIONS Re: Results of election Commissioner Cotton moved that the Commissioners receive the res- olution from the Board of Elections relating to results of the election held on November 5, 1974, and that the resolution be filed with the Clerk to the Board and that it be made a part of the offic ial record of the County Commissioners actions, Commissioner Eth- eridge seconded and it passed. The County Board of Elections of Harnett County, North Carolina, net in special session at the County Courthouse, in Lillington, North Carolina, at 11:00 a.m., on November 7, 1974, with the following members present: Chairman Thad H. Pope pre- siding, and Mrs. Helen McFarland, Secretary and Mr. William H. Randall. At 11:00 a.m., the County Board of Elections of Harnett County met and received from the registrar and judges of election for the Black River Precinct in the County of Harnett the returns of the special property tax referendum held in said Angier -Black River Ambulance and Rescue Squad Service District on November 5, 1974, upon the question of issuing a special property tax referendum not in excess of 15¢ on the $100.00 valuation. After said returns had been canvassed by the County Board of Elections, William H. Randall introduced the following resolution, which was read: RESOLUTION RELATING TO THE CANVASS OF RETURNS OF THE SPECIAL PROPERTY TAX REFERENDUM IN THE ANGIER -BLACK RIVER AMBULANCE AND RESCUE SQUAD SERVICE DISTRICT OF THE COUNTY OF HARNETT ON NOVEMBER 5, 1974 AND DETERMINING THE RESULT THEREOF. BE IT RESOLVED by the County Board of Elections of Harnett County: Section 1. The returns of the special property tax referendum held in the Angier -Black River Ambulance and Rescue Squad Service District of the County of Harnett on November 5, 1974 upon the question of authorizing the County of Harnett to levy annually a property tax at an effective rate not in excess of 15¢ on the $100.00 value in said district for emergency ambulance and rescue squad service, having been received from the proper election officers and having been canvassed, the Board has found and determined and does hereby declare: (a) That said registrar and judges for said referendum were duly qualified by law and had taken the necessary oath. (b) That the election officers had incorporated in their returns not only the number of votes cast for and against the question submitted, but also the number of voters registered and qualified to vote in said Black River Precinct in said referendum, this being the only precinct in said service district. (c) That at said referendum there was submitted to the qualified voters of said service district the following question: "Shall Harnett County be authorized to levy annually a property tax at an effective rate not in excess of fifteen cents ($.15) on eht One Hundred Dollars ($100.00) value in the Angier -Black River Emergency Ambulance and Rescue Squad Service District for the purpose of providing emergency ambulance and rescue squad service ?" (d) That no complaints have been made to this Board against the regularity of said referendum. (e) That said referendum and the registration therefore were duly and properly held in accordance with law. Section 2. The following correctly shows the designation of the precinct at which said referendum was held, the location of the voting place, the number of voters registered and qualified to vote, the number of votes cast in favor of the question submitted, the number of votes cast against the question, and the totals of such numbers: Precinct Black River Voters regis- Question Submitted tered and qual- Votes Votes Voting Place ified to vote for against Angier Town Hall 1770 632 256 ABSENTEE 4 3 TOTAL 636 259 Section 3. From the canvass made, this Board does hereby determine and certify: (a) That 1770 voters were registered and qualified to vote. (b) That at said referendum 636 votes were cast for the question hereinabove stated authorizing the County of Harnett "to lvey annually a if property tax at an effective rate not in excess of fifteen cents ($.15) on the One Hundred Dollars ($100.00) value in the Angier -Black River Emergency Ambulance and Rescue Squad Service District for the purpose of providing emergency ambulance and rescue squad service ", and 259 votes were cast against said question, and that a majority of the qualified voters of said service district who voted thereon at said referendum voted in favor of said question. Section 4. The Secretary of this Boerd is hereby directed to transmit immediately a certified copy of this resolution to the Board of Commissioners for the County of Harnett. Upon motion of W. H. Randall seconded by Helen R. CONCERNING "Statement of the Results of the Special Property Tax Referendum in the Angier -Black River Ambulance and Rescue Squad Service District of the County of Harnett on 11/5/74." County Attorney brought before the Board a resolution concerning the "Statement of the Results of the Special Property Tax Referendum in the Angier —Black River Ambulance and Rescue Squad Service District of the County of Harnett on November 5, 1974," for their consideration. Commissioner Cotton moved the resolution be adopted and Commissioner Etheridge seconded. Upon Motion by Commissioner Cotton, seconded by Commissioner Etheridge,the "Statement of the Results of the Special Property Tax Referendum in the Angier -Black River Ambulance and Rescue Squad Service District of the County of Harnett on November', 5, 1974," is declared and certified to be the results of said referendum and M. H. Brock, Chairman is authorized to sign said declaration on behalf of the County and the Clerk to the Board of Commissioners is hereby directed to cause a copy of the same to be published in the Harnett County News and a copy in the Angier Independent and to file a copy of the same in his office as required by G. S. 153A- 149(d); and to said statement there shall be appended the following statement: "Any action or proceeding challenging irregularity or validity of this tax referendum must be begun in thirty days after November 28, 1974, (date of Publication). "; and further, the Clerk shall obtain copies of the certification from each newspaper and file the same in his office. The Commissioners passed the foregoing Motion by 4 voting for and 0 voting against. DOG LEASE( ADJOURNMEN NORTH CAROLINA HARNETT COUNTY R E S O L U T I O N 34 4b The Harnett County Board of Commissioners and the Harnett County Board of Social Services, acting jointly and after investigation, make the following findings of facts and resolve as follows: THAT WHEREAS, Henry Minter was a recipient of Aid to the Aged authorized under North Carolina General Statutes and that a lien was filed by the Director of Social Services for Harnett County, North Carolina, against any real property owned by the said Henry Minter and said liens were recorded properly in the Office of the Clerk of Superior Court; and \JHEREAS, at the time of the filing of said lien, Henry Minter had already sold a certain lot in Shawtown, Lillington Township, Harnett County, North Carolina, and the deed conveying said lot was not recorded in the Harnett County Registry until after the assistance lien had already been recorded in the Clerk's office; that John Lewis Brown and wife presently own said lot and that they purchased said lot unaware of the fact that a lien had been placed on the records in the Clerk's office and further that theywaid approximately Three hundred dollars ($300.00) for said property and further that said property does not front on a public road but lies behind certain other properties owned by said John Lewis Broom and wife on the south side of Spears Street in Shawtown, Harnett County, North Carolina; and WHEREAS, it has been made to appear to the respective boards that the afore- said lien filed against said real estate should be released from under the county's lien heretofore filed against said properties owned previously by Henry Minter upon the payment of the sum of One hundred dollars ($100.00); said tract of land being described as follows: BEGINNING at an :iron stake the northwest corner of John Minter lot and in line of the Thomson- Spears property, and runs thence with line of John Minter lot South 21 degrees West 34.9 feet to iron stake corner in line of W.
