07011974MINUTES OF THE MEETING OF JULY 1, 1974 a REGULAR SESSION The Harnett County Board of Commissioners met in regular session on Monday, July 1, 1974. The Chairman called the meeting to order at 10:00 a.m., with the following members present: Gilbert Brown, C. E. McLamb, W. J. Cotton, Jr. and Bobby R. Etheridge. Also present, H. D. Carson, Jr., Clerk to the Board and Edward H. McCormick, County Attorney. PRAYER W. Earl Jones led the prayer. MINUTES READ The minutes were read and approved. K. AUTRY FROM D 0 T SCHOOLS BOND ORDER Mr. Kenneth Autry from the Department of Transportation, was pre- sent at the meeting. Gus McNeill who lies on SR 1779 asked that some caution signs be placed on this road that would regulate the traffic by the Oak Grove Church. He said there were no existing signs to slow the cars by the church. He also reported the need of a close -by ditch in that water could not drain properly. Her- bert McNeill, coming with Gus, also requested that a ditch off the King Roberts road be cleaned to help drainage. Mr. Autry assured them he would investigate all the points indicated and fill the responsibility of his office to the requests. The Clerk presented a certified copy of a resolution which had been received from the Harnett County Board of Education, a copy follows on page 289a and 289b: Thereupon Commissioner Etheridge introduced the following order authorizing bonds which was read: WHEREAS, the Harnett County Board of Education has certified to the Board of Commissioners for the County of Harnett a resolution passed on June 13, 1974, showing that adequate school facilities are not now available in the County of Harnett to comply with the requirements of Section 2 of Article IX of the Constitution of North Carolina for the maintenance of schools nine months in every year, and that it is necessary, in order to maintain such nine months' school term as required by said Section 2 of Article IX of the Constitution, to erect additional school buildings and other school plant facilities, remodel, enlarge and reconstruct existing school buildings and other school plant facilities, and acquire necessary land and equipment therefor, in order to provide additional school facilities in said units, the estimated cost of which is $15,000,000, $11,250,000 of which must come from local sources; and WHEREAS, said resolution requests said Board of Commissioners to call a referendum in the County on the question of approving $11,250,000 bonds of the County in order that such additional facilities may be provided; and WHEREAS, said Board of Commissioners has carefully examined the facts and has determined and does hereby find as a fact that the statements made in said resolutions are true and that it has become the duty of said Board of Comm- issioners, acting as an administrative agent of the State in providing a State system of public schools, to order the issuance of bonds of the County of Har- nett so that the school facilities mentioned in said resolution and in para- graph 1 of this order may be provided in order to maintain the nine months' school term in the County of Harnett as required by Section 2 of Article IX of the Constitution; now, therefore, BE IT ORDERED by the Board of Commissioners for the County of Harnett: 1. That, pursuant to the Local Government Bond Act, as amended, and in order to maintain the nine months' school term in the County of Harnett as re- quired by Section 2 of Article IX of the Constitution, the County of Harnett, North Carolina, is hereby authorized to contract a debt, in addition to any and all other debt which said County may now or hereafter have power or authority to contract, and in evidence thereof to issue School Bonds in an aggregate principal amount not exceeding $11,250,000 for the purpose of providing funds, with any other available funds, for erecting additional school buildings and other school plant facilities, remodeling, enlarging and reconstructing exist- ing school buildings and other school plant facilities, and acquiring nec- essary land and equipment therefor, in order to provide additional school facilities in the County of Harnett. 2. That taxes shall be levied in an amount sufficient to pay the prin- cipal of and the interest on said bonds. 3. That a sworn statement of the debt of the County has been filed with the Clerk and is open to public inspection. 4. That this order shall take effect when approved by the voters of the County at a referendum as provided in said Act. That the area involving the filling of areas below the water table be filled with such demolition materials as brick, masonry, materials, wood, and such other like material acceptable to Solid Waste and Vector Control Branch as not being potentially con- taminating material. 3. That those areas which are an acceptable distance above exist- ing ground water be used for the proper disposal of other solid waste. 4. That Harnett County request a specific period of time within which to secure subh a plan. ACTION: Commissioner Brown moved to request a 2 year time ext- ension, within which to plan and to adopt the recommendations of Mr. Thompson, Director of the Health Department. Commissioner McLamb seconded the motion and it passed unanimously. 1974 -75 BUDGET PROPOSAL Commissioner Cotton moved that the 1974 -75 Budget Proposal be adopted, Commissioner McLamb seconded the motion. 5% cont. fund. action BUDGET ORDINANCE. Commissioner Etheridge moved that the budget proposal be amended to establish a 5% contingency appropriation, or $274,257.95, to be appropriated from unappropriated surplus in 1973 -74 General Fund. Commissioner Cotton seconded the motion and it carried unanimously. The vote on the motion to adopt the budget proposal as amended was unanimous. The following amounts are hereby appropriated in the General Fund for the operation of the county government and its activities for the fiscal year beginning July 1, 1974, and ending June 30, 1975, in accordance with the chart of accounts heretofore established for this county: Governing Body $ 20,500. The Appropriations to the Board of Education firstly shall be made from any funds which are dedicated to the use of the schools and secondly shall be made from general county revenues to the extent necessary. All projects using county money shall be approved by the Harnett County Board of Commissioners. Section 3. It is estimated that the following revenues will be available in the General Fund for the fiscal year beginning July 1, 1974 and ending June 30, 1975. Current Year's Property Tax $ 2,195,030. It is estimated that the following revenues will be available in the Revenue Sharing Fund for the fiscal year beginning July 1, 1974, and ending June 30, 1975: Federal Government Grants $ 505,000. Interest on Investments 15,000. Expense Refunds 3,000. Fund Balance Appropriated 477,000. $ 1,000,000. Section 10. There is hereby levied a tax at the rate of Seventy Seven Cents ($.77) per one hun- dred dollars ($100.) valuation of property listed for taxes as of January 1, 1974, for the purpose of raising the revenue listed as 'Current Years Property Taxes' in the General Fund in Section 3 of this ordinance. This rate of tax is based on an estimated total valuation of property for the purpose of taxation of $300,000,000. and an estimated collection rate of 95%. The estimated rate of collection is based on the-fiscal 1973 -74 collection rate of approximately 960. 'Section 11. The Budget Officer is hereby authorized to transfer appropriations within a fund as contained herein under the following conditions: a. He may transfer amounts up to $500.00 between objects of expenditures within a department with an official report on such transfer at the next regular meeting of the Board of Commissioners. b. He may not transfer between departments of the same fund. c. He may not transfer any amount between funds nor from any contingency appropriation within any fund. Section 12. There is hereby levied a tax at the rate of seven cents (70) per one hundred dollars ($100) valuation of property listed for taxes as of Januayr 1, 1974, located within the special Averasboro School District for the raising of revenue for said Special School District. This rate of tax is based on an estimated total valuation of property for the purposes of taxation of $92,000,000. and an estimated collection rate of approximately 95 %. There is appropriated to the special Averasboro School District the sum of $89,390. for use by the Special School District in such manner and for such expenditures as is permitted by law from the proceeds of this tax and any other revenues otherwise accruing to said Special School District. Section 13. There is hereby levied the following tax rates per hundred dollar ($100) valuation of property listed for taxes as of January 1, 1974, located within the Special Fire Districts, for the raising of revenues for said Special Fire Districts, as follows: Anderson Creek Fire District Fifteen Cents 150 Black River Fire District Ten Cents 100 Buies Creek Fire District Ten Cents 100 Erwin Fire District Eight Cents 80 Flat Branch Fire District Fifteen Cents 154 Flatwoods Fire District Twelve Cents 124 Grove Fire District Fifteen Cents 150 Spout Springs Fire District Fifteen Cents 150 Summerville Fire District Fifteen Cents 150 This rate of tax is based on an estimated total valuation of property for the purposes of taxation as follows: Anderson Creek $ 4,000.000. Black River 14,000,000. Buies Creek 11,000,000. Erwin 15,500,000. Flat Branch 5,700,000. Flatwoods 5,300,000. Grove 5,000,000. Spout Springs 4,900,000. Summerville 16,500,000. These rates are based on an estimated collection rate of 95 %. The estimated collection is based on the 1973 -74 collection rate of approximately 96 %. The above sums for use by the special fire districts in such manner and for such expenditures as is permitted by law from the proceeds of this tax and any other< revenues otherwise accruing to said Special Fire District. Section 14. Copies cf this budget Ordinance shall be furnished to the Budget Officer, the Fianance Officer and the Tax Supervisor for direction in the carrying out of their duties. AMENDED PERSONNEL PLAN Commissioner Etheridge moved that the Personnel Plan as adopted July 17, 1968, be amended, resolution #004 -69, Article VI, Section III, to allow merit mises in addition to the 50% rule as defined in Sec- tion III. Commissioner McLamb seconded the motion and it passed. LEGALITIES OF THE MID -MONTH MEETING Regarding the necessity to change the mid -month meeting date for July, 1974, the meeting date was changed from July 15, 1974 to July 22, 1974, to accomodate the attendance of the commissioners at the Nat- ional Convention in Florida. Appropriate notice was given to the news media and an announcement placed upon the bulletin board in the Courthouse. MICRO FILM BIDS The Chairman informed the members that bids for the micro filming purchase had been let and the date to open the bids scheduled for August 1, 1974, at 1:00 p.m. ADJOURN Commissioner Cotton made a motion to adjourn the meeting until July 12, 1974, 10:00 a.m. Meeting to be reconvened in the Courthouse, Lillington, North Carolina on that date and at that time.
