04011974254 MINUTES OF THE REGULAR MEETING OF THE BOARD OF. COMMISSIONERS FOR APRIL 1, 1974. CALL TO ORDER Chairman Brock called the meeting to order at 9:30 a.m. in the Comm. issioners Room, Courthouse, Lillington, with the following members present: Chairman M. H. Brock, Gilbert Brown, C. E. McLamb, W. J. Cotton, Jr. and Bobby R. Etheridge. Also, Edward McCormick, County Attorney and H. D. Carson, Jr., Clerk to the Board. PRAYER Thomas Allen, Tax Supervisor, offered the morning prayer. READING OF MINUTES The minutes of the last meeting of March 18, 1974, were read for the action of the Board. The following correction to the minutes as it related to Professional Services Policy was made as follows: Commissioner Etheridge stated his opinion as to the establishment of a policy on the use of professional services by the county, its agents and employees. TAX SUPERVISOR'S REPORT Thomas Allen, Tax Supervisor gave the report of his department. He indicated the progress that is being made in completing some of the Townships for the picking up on new construction. REFUNDS: Mr. Allen requested the following refunds to taxes: Anderson Creek Township, Horace E. Moffit, Amount of refund for the past two years error in listing taxes, $94.92. Black River Township - Daywood E. Langdon, double listed property, $16.89. Commissioner Cotton moved that upon the recommendation of the Tax Supervisor, the refunds be granted. Commissioner McLamb seconded the motion and it carried. dates for Board of E & R. The dates for the meetings of the Board of Equalization & Review were set by the Commissioners: April 29, 1974 - 10:00 a.m. Commissioners Room, Courthouse. May 13, 1974 10:00 a.m. It " May 16, 1974 10:00 a.m. It II (final date) KENNETH AUTRY TAX COLLECTOR'S REPORT Mr. Kenneth Autry from local office of Department of Trans- portation was present for the meeting. A general discussion was held by the Commissioners and Mr. Autry. W. Earl Jones, Tax Collector, presented the report for his depart- ment, stating his progress for the months past from the beginning of this fiscal year in collections and his plans for April. FEE $ 20.00 20.00 $ 40.00 PHN PROGRAM 1 :RE: ARMORY SITE #3- Averasboro Regarding Armory, Site #3, located on the Susan Tart Road, Aver - asboro Township, Dunn, N. C., Commissioner Cotton made a motion to approve $12,500. from the General Revenue Sharing Trust Fund for the purchase of Industrial Site #3, located on the Susan Tart Road. The motion was made after the County Attorney had had opportunity to view the prepared deed, and had indicated that it was the usual legal method employed in the preparation of such instruments. Commissioner McLamb seconded the motion and it passed. Regarding the Public Health Nurse Program for our county in the Tuberculosis area, the county voted to share in the salary of the Public Health Nurse in the amount of 50% of the total amount, and indicated the intent to incorporate this amount in the 1974- 75 budget proposal. Commissioner McLamb moved that the county take this action, Commissioner Etheridge seconded the motion and the issue passed. DEED FOR SITE #3 Commissioner McLamb moved that the Chairman, M. H. Brock, and the Clerk to the Board, H. D. Carson, Jr., be given authority to execute the deed from the County of Harnett, along with the City of Dunn, to the State of North Carolina, for an Armory Site #3, known as Industrial Site #3, located on the Susan Tart Road, on the condition that the State of North Carolina builds an Armory as set forth in the deed. Commissioner Brown seconded the motion and the issue passed. Policy on COUNTY ATTORNEY SERVICES The following policy on the committee appointed issionerkfi'Commissioner and placed into effect, and the issue passed: County Attorney services was offered by to prepare same, Chairman Brock and Comm - Cotton moved that the policy be adopted Commissioner Etheridge seconded the motion POLICY ON COUNTY ATTORNEY SERVICES 1. Purpose: It is the purpose of this policy to provide adequate legal services to the Board of Commissioners and all other , officials acting for and on behalf of the County and to provide adequate compensation to the County Attorney rendering such service. 2. County Attorney Appointment: State law provides that a County Attorney shall be appointed by the Board of County Commissioners to serve at its pleasure and to be its legal advisor. G.S. 153A -114. 3. Retainer and Compensation: The amount of a retainer and the rate of compensation for services ahall be mutually agreed upon by written contract between the Board of Commissioners and the Attorney, a sample of which is attached to this policy as Exhibit A. 4. Services the Attorney may provide upon proper request: a. Duties prescribed by Statute. b. Legal advice to officials of the County. c. Legal services to or on behalf of the County. d. Prosecution and defense of law suits and court or administrative proceedings on behalf of the County. e. Routine services such as attendance at meetings and conferences requested by officials of the County, answering routine inquiries of a legal nature affecting the County, review of County documents such as minutes, deeds and insurance policies that have legal consequences. f. Other legal services requested by the Board of Commissioners or County Manager from time to time. 5. Request for Legal Services: a. By County Commissioners, other elected officials or the County Manager. Any member of the Board of Commissioners of Harnett County, the Sheriff, the Register of Deeds or the County Manager may request advice of or services from the County Attorney. b. By other officials. Officials of other County Boards, Comm- issions or department of the County may request the advice or services of the Attorney by applying to any member of the Board of Commissioners or the County Manager. Other such Boards, Commissions or Departments include the areas of Dev- opment, Extension, Finance, Health, Mental Health, Social Services, Tax and Veterans Service. 6. Monthly Statement: The Attorney shall prepare a statement on a monthly basis for his advice and services as soon after the end of th e month as practicable. The Statement shall show the date of the advice or service, the description of such advice or service, the time required for such advice or service and the charge for each such advice or service at the agreed upon rate, or a state- ment that payment for such advice or service is included in the retainer. The statement, either by the format or context, must indicate the Board, Department, Commission or office to which the advice or service relates. 7. Monthly Report:- The statement submitted to the County Manager for approval shall constitute the Attorney's Report to the Board of Commissioners and a copy of such statement shall be mailed to each member of the Board by the County Attorney. 8. Payment for Non - Retainer Services: Payment shall be made to the County Attorney upon approval of the attorney's statement by the County Manager. 9. Papent for Retainer Services: The County shall pay to the County Attorney the monthly retainer on or before the end of each month. 10. Retainer Services: A. Retainer Services by the County Shall include: 1. Attendance at the two regular monthly meetings of the Board (1st and 3rd Mondays). 2. Public Relations Services: provided to the County, by reason of contact made to the County Attorney's Office by members of the general public and Press about County business; the County recognizes that the County Attorney ........... .._ n �58 .designated as the official representative for matters concerning wastewater planning for the designated area of County of Harnett. 4. That Chairman of County Board of Commissioners, M. H. Brock be and he is hereby instructed to secure and prepare such documentation as may be necessary from the Town of Angier, Town of Coats, Town of Lillington and the Buies Creek Community as well as other data relative to Wastewater requirements for the designated area of Harnett County all for incorporation into the Wastewater Facilities Plan for the designated ?area." TELEPHONE INSTALLATION FOR 'iTHE NEW BUILDING Chairman Brock was authorized by the Board to negotiate the tele- phone installation for the new County Office Building. rsalary and travel policy Chairman Brock presented the Board with information from State Personnel, in which three salary plans were explained: Alternate (1) indicated 5% increase in salaries, Alternate (2) indicated 7.5 increase in salaries, Alternate (3) indicated 10% increase in salaries. As this matter and the matter of the rate of reimburse- ment for' travel is vital to the preparation of the budget for FY 1974 -75, the following action took place: Commissioner Etheridge moved that the County adopt Alternate (2), providing for 7.5% increase in salary in July, 1974, and travel to be in line with the State of North Carolina's policy, whatever it may be. Commissioner Cotton seconded the motion and it passed. GI SAMUEL L. HALL liELECTRICAL INSPECTOR Samuel L. Hall, replacement for L. Perry Cameron who resigned as an electrical inspector, came before the Board. He indicated he was complying with State regulations in securing his permit to inspect, that he would do a good job, appreciated the opportunity and was anxious to begin his duties. FURNISHINGS Bill Gwinn, Architect, for the New County Office Building, came to 9I the Board meeting with swatches, pictures and chairs relative to t furnishings for the new building. The bids for the furnishingawil be let this week and received and opened on May 10. 1974. ;LANDSCAPING is Clerk to the Commissioner Cotton moved that an amount up to $1,000. be set asid for landscaping the new County Office Building yard.
