The Harnett County Board of Commissioners met in regular session on Monday, April 16, 2012,
in the Commissioners Meeting Room, County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chaiinian McNeill called the meeting to order at 7:00 pm. Vice Chairman Hill led the pledge of
allegiance and invocation.
Chaillnian McNeill called for additions and deletions to the published agenda. Chairman
McNeill announced that the Zoning Change Request by Brian Allen Sherrer from RA -20M to
Commercial Zoning for 83 +1- acres on Hwy 210 South in the Anderson Creek Township had
been withdrawn so there would be no public hearing on the zoning change.
Chairman McNeill requested the additions, to the consent agenda, of three budget amendment:
1) Emergency Medical Services Depai [went in the amount of $245, 2) Library, Cultural &
Recreational Department in the amount of $24,050; and 3) Health Department — RSVP in the
amount of $6,220. Commissioner Andrews moved to approve the agenda as amended.
Commissioner House seconded the motion which passed unanimously.
Commissioner House moved to approve the items on the consent agenda. Vice Chairman Hill
seconded the motion and the Board unanimously approved the following items on the consent

3. Sheriff's Office requested approval to charge a fee of $5.00 per day on vehicles stored
under the new "Run and You're Done" Law NC G.S. 20- 141.5.
4. Library Director requested permission to donate withdrawn library materials to be sold at
the Friends of the Library book sale April 24 -26, 2012.
5. Emergency Services requested authorization to submit and receive funds for the
Inventory System project through the WakeMed Health and Hospitals CAPRAC (Capital
Area Regional Advisory Committee) in the amount of $3,495. The Inventory System
project is needed to complete this grant year. NC Office of Emergency Medical Services
is in the process of approving the system for the handheld scanner that is recommended
for this purchase. Each handheld scanner will cost approximately $3,495 — each county
is budgeted to purchase one handheld scanner for use with their mass casualty inventory.
This will be a reimbursable grant project with no county matching funds required.
6. Information Technologies and the Sheriff's Office requested approval of a Memorandum
of Understanding between Johnston County and Harnett County to establish a formal
arrangement whereby Johnston County makes available to Harnett County its Backup
911 Center for use by Harnett County during such times as Harnett County may
experience failure to its primary 911 emergency call and dispatch center.
7. Public Utilities requested approval of an increasing final adjusting change order in the
amount of $47,707.44 for the East Central Water Improvements Project. These changes
amount to 4.62% of the total contract amount and will be paid from the project
contingency.
Chairman McNeill opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
- Mr. Kasdy Dawoud withdrew his request for a zoning change from RA -20R to
Commercial Zoning for land he owns on Hwy 401S on McNeill Hobbs Road in Stewart's
Creek which had previously been tabled by the Board of Commissioners. Mr. Dawoud
thanked county staff and commissioners for their help during this process.
- Mrs. Hattie Davis, owner of Benny's Mobile Home Park in Fuquay - Varina, said there is
a county sewer line nine - tenths of a mile from her park and asked when she would be
able to hook on to the sewer line. Mrs. Davis said she has exhausted her financial
resources repairing her system and believes that the county should reimburse her
expenses; alleging her septic system should have never passed inspection when it was
installed over 20 years ago and she still hasn't been able to get access to the county sewer
line. There are currently 35 homes in Mrs. Davis' mobile home park. Commissioner
Andrews reminded Mrs. Davis he had offered to allow her to go down his property line to
reach the sewer. Mrs. Davis told Commissioner Andrews the mobile home park nearest
to him was leaking raw sewer on to his property. Chairman McNeill asked Mr. Sauer to
work with Environmental Health regarding these issues.
- Charlene Jones of Old Buies Creek Road in Angier told commissioners the new
insurance plan they adopted for their employees is really bad. She demanded to know

what other companies and plans were had looked as well as deciding factors. Mrs. Jones
said county employees do not make enough money to afford this insurance plan. She
suggested polling employees regarding potential plans. Mrs. Jones commented, where
the plan may save the county money, it shows no appreciation for employees while the
county had lost $2 Million in "spy games" this year. Commissioner Burgin insisted the
new plan is a much better and richer plan than the current plan along with a drug
schedule where a majority of the drugs will be free. Chaimian McNeill noted the plan is
initially more expensive for employees until you hit the deductible.
Mark Locklear, Planning Manager, petitioned the board for a public hearing regarding Proposed
UDO Text Amendments, Applicant: Harnett County Planning Services; Unified Development
Ordinance: Article VI; VII, Sections 10.0 & 2.0 (Streets)
Mr. Locklear reported the Planning Department received a request from a developer to allow
standard subdivisions to be allowed to have private streets and be a gated community. Mr.
Locklear noted currently only PUD's or multi- family projects are allowed to have a gated
entrance and private streets. The proposed amendments would allow developers in all
subdivisions to have gated communities and private streets as well as requirements pertaining to
placement and location of school bus stops in all new subdivisions. Mr. Locklear reported that
the proposed amendments were tabled at the March Planning Board meeting but a unanimous
vote was taken at the April, 2, 2012, Planning Board meeting to recommend all gated
communities and private streets be considered on a case by case basis by the Harnett County
Planning Board.
Planning staff also put forth proposed recommendations attempting to address "connectivity"
and "access to adjacent properties" in the UDO. Mr. Locklear outlined the similarities and
difference between the two proposed recommendations and noted staff had met with the Board
of Education and understands school bus stops in subdivisions are a big issue.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public.
Mr. Ron Huff; the developer who requested this change, said he believes there is a need
and demand for this type of community in Harnett County. Mr. Huff responded he could
work with either proposed option as time is of the essence but he prefers no connectivity
requirement.
Seeing no one else move, Chairman McNeill closed the public hearing. Chaiiuian McNeill
moved to adopt Option B - Planning Board recommendation. Seconded by Commissioner
Burgin, the motion passed unanimously. (Attachment 1)
Jennifer Slusser, Staff Attorney, petitioned the board for a public hearing regarding the proposed
consolidation of the Bunnlevel Fire Protection Service District and the Summerville Fire
Protection District. Mrs. Slusser also provided a proposed resolution consolidating the districts
as requested if the board approved the merger. Also provided was a March 30, 2012, Report

Regarding the Proposal to Consolidate the Bunnlevel Fire Protection Service District and the
Summerville Fire Protection Service District. Lastly, Mrs. Slusser provided an affidavit
regarding the mailing of the public notice as required by law. Mrs. Slusser acknowledged
present for the public hearing were Director of Emergency Services Gary Pope, Fire Marshal
Jimmy Riddle and Attorney Holt Felmet.
Chailinan McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public.
- Mr. Phillip Moses, 1141 Nutgrass Road, stated his opposition as he wanted his fire
department "to stay put ". Mrs. Slusser clarified that the two groups were merging and
pooling resources but would continue to maintain and operate both locations. Mr. Gary
Pope pointed out that this proposal would reduce the tax rate as well as reduces insurance
cost.
Mr. Frankie Lewis of Lillington spoke in support of this merger but said he believed that
Lillington and Flatwoods also needed to merge to form a Southeast Harnett District.
Chairman McNeill noted said those conversations took place but with strong opposition.
- Mr. Leo McDonald, Chaiiiiian of Summerville Fire and Rescue, reiterated personnel
would remain at both locations. He stated the belief that the consolidation would help
both units and allow them to provide better service and noted they were open to future
mergers.
- Mr. Holt Felmet spoke in favor of the merger; noting his role as attorney to assist in the
merging of the two corporations, and commented how rare it is to have an opportunity to
vote for lower taxes and a better insurance rating.
Seeing no one else move, Chairman McNeill closed the public hearing. Commissioner Andrews
moved to adopt the resolution approving the consolidation of the Bunnlevel Fire Protection
Service District and the Summerville Fire Protection District. Vice Chairman Hill seconded the
motion which passed unanimously. (Attachment 2)
Mr. Sauer presented the following report:
• Planning Services Report March 2012
• March Landfill Billing
• March Veterans Affairs Activities Report
Mr. Sauer distributed handouts of 1) the most recent sales tax distribution through January 2012
and 2) the legal expenditures for Harnett County for all funds, departments and projects as
requested by Commissioner Burgin.
It was the consensus of the board to hold an Airport Summit on Tuesday, May 1, 2012, at 7:00
pm. Mr. Sauer noted staff is continuing to the review the proposed hanger lease for the airport.
Commissioner Burgin shared Mr. Jerry Milton's frustrations regarding the pending lease. Mrs.
Slusser responded Mr. Milton's attorney had failed to satisfactorily respond to requests and they
are currently waiting for insurance information. Commissioner Burgin questioned if it would be
appropriate for the Board to vote on the lease pending legal resolution but Mr. Snow reminded
the group the issue was not listed on the published nor amended agenda.

Commissioner Andrews moved to cancel the special session of the Board scheduled for Tuesday,
April 24, 2012. Vice Chaiiman Hill seconded the motion which passed unanimously with the
understanding that Commissioners would discuss some issue prior to the Airport Summit on
May 1, 2012, if needed.
Mr. Sauer announced that the Tax Department had negotiated an agreement with the Town of
Lillington for the collection of their taxes.
Commissioner Burgin moved that the Board go in to closed session to discuss certain personnel
matters. This motion is made pursuant to N.C. General Statute Section 143- 318.11(a)(6).
Commissioner House seconded the motion which passed unanimously.
Vice Chairman Hill moved that the Board come out of close session. Commissioner Burgin
seconded the motion which passed unanimously.
Chairman McNeill called for any new business. Commissioner Burgin mentioned a recent
article in the Fayetteville Observer where Paul Romine visited Fort Bragg regarding the
possibility of opening charter schools on base. Commissioner Burgin requested the Harnett
County Board of Commissioners and Board of Education meet with Mr. Romine to talk about
charter schools in Harnett County.
Commissioner Burgin moved to give S.A.F.E. $15,000. Commissioner House seconded the
motion saying he views S.A.F.E. as an extension of the county's Department of Social Services.
The motion failed 3 to 2. Vice Chairman Hill requested that commissioners wait for upcoming
budget discussions to consider funding S.A.F.E. as well as other agencies requesting funds from
the county.
Commissioner Burgin questioned if staff had signed the PFI document from BC /BS yet. Mrs.
Slusser responded they had not due to technology requirements by BC /BS that the county did not
have.
Commissioner Burgin reminded the group of his requests to discuss the use of all county
vehicles and made motion, with the exception of the Sheriffs office, that all county vehicles be
parked unless in use by on -call staff. Chaiiman McNeill offered an amendment to the motion to
allow the county manager and department heads to develop an overall plan for energy
conservation prior to the upcoming budget adoption. Commissioner Andrews seconded the
amendment which passed unanimously. The amended motion also passed unanimously. Vice
Chairman Hill said she has heard of employees driving personal vehicles to work but then
driving county vehicle to and from lunch.
Commissioner Burgin asked staff to talk to Ms. Sheila Simmons and the contractor for the First
Choice Building as he understands they used very few local contractors for the project.
Commissioner Burgin commented given the County donated the property to them he thought at
the very least the contractor could us local people to do the work.

Commissioner Andrews raised concern regarding a proposed NC DOT realignment project in
Kipling. He reported NC DOT's plans to spend $800,000 to close one of the two railroad
crossing in Kipling. Chairman McNeill requested a meeting with NC DOT representatives to
discuss this issue along with Ernest Lane and other issues.
Commissioner Burgin moved to adjourn the meeting at 8:46 pm. Vice Chairman Hill seconded
the motion which passed unanimously.

A RESOLUTION AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE

WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17,
2011 for the purpose of promoting the health, safety, and general welfare of the county residents;
and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have
been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the
UDO as listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article VI "General Development Standards ",
Section 10.0 School Bus Stops within Residential Subdivisions, Article VII "Development Design
Guidelines" Section 2.8 Types of Streets Required, and Article XI "Administration & Boards"
Section 3.0 Planning Board, of the UDO shall be amended to read as indicated in "Attachment ".
"Attachment" is filed with the Unified Development Ordinance in the Clerk to the Board's Office.
Duly adopted this 16th day of April, 2011 and effective upon adoption.

ATTACHMENT
ADD the following to Article VI "General Development Standards"
Section 10.0 School Bus Stops within Residential Subdivisions
All major subdivisions shall install school bus stop facilities and locations as approved by Harnett County Schools. The
developer shall provide appropriate safe and facilitative movement for the bus and pedestrians. This location shall
allow for adequate car parking and /or stacking so as not to block any existing ingress or egress, or to damage private
property. These requirements shall be implemented at the time of final plat approval for each phase of the subdivision.
ADD the following to Article VII "Development Design Guidelines"
2.8 Type of Streets Required
2.8.2 Private Streets
Private streets shall be specifically allowed within planned unit developments, condominium and
townhome developments. All other developments proposing to have private streets and /or
gated entrances shall require Planning Board approval and may be subject to further conditions
regarding safety and /or connectivity. Additionally, all projects are subject to reasonable and
appropriate safety measure deemed necessary by the DRB under the following conditions.
A. Where private streets are provided in developments with lots or units for sale, such streets shall
be designated as part of areas held in common and under ownership of a homeowners'
association with maintenance provisions.
B. All private streets shall be constructed or improved to North Carolina Department of
Transportation Standards and certification of construction must be submitted at the final plat
stage by a professional licensed engineer.
C. The recorded plat of any subdivision that includes a private road shall clearly state that such road
is a private road. Further, the initial purchaser of a newly created lot served by a private street
shall be furnished by the seller with a disclosure statement outlining the maintenance
responsibilities for the road.
D. All private streets shall be constructed within a public utility easement and shall be recorded as
such, for the purpose of service and maintenance of public utilities with those right(s) -of -way. In
any case in which a developer installs or causes the installation of water, sewer, electrical power,
telephone, or cable television facilities and intends that such facilities shall be owned, operated,
or maintained by a public utility or any entity the necessary ownership or easement rights to
enable the utility or entity to operate and maintain such facilities must also be provided.
E. Gated Private Streets
1. All gated private streets shall be approved by the Fire Code Official prior to
construction installation of any such gates and related equipment and systems.
2. Gates shall be constructed and installed in compliance with Harnett County
regulations.
3. Adequate distance between the driveway from the State road and the actual gated
entrance shall be allowed for stacking of vehicles.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
CONSOLIDATING THE BUNNLEVEL FIRE PROTECTION SERVICE DISTRICT
AND THE SUMMERVILLE FIRE PROTECTION DISTRICT
WHEREAS, upon request of the emergency services departments servicing the
Bunnlevel Fire Protection Service District and the Summerville Fire Protection District, the
Harnett County Board of Commissioners decided, by general consensus to proceed with a
proposal to consolidate the Bunnlevel Fire Protection Service District and the Summerville Fire
Protection Service District.
WHEREAS, the Harnett County Manager, Harnett County Emergency Services
Director, Harnett County Fire Marshal, Harnett County Senior Staff Attorney, and other
appropriate representatives and employees of the County of Harnett were authorized to take such
steps as might be required or necessary to pursue the statutory and administrative processes
relative to the proposal to consolidate the Bunnlevel Fire Protection Service District and the
Summerville Fire Protection Service District into one fire protection service district known as the
Summerville - Bunnlevel Fire Protection Service District.
WHEREAS, North Carolina General Statute § 153A- 304(b) provides the standards and
process to be utilized in consolidating fire protection service districts.
WHEREAS, pursuant to the direction of the Harnett County Board of Commissioners
and in accordance with the North Carolina General Statutes relating to consolidation of fire
protection service districts, a thorough inquiry was conducted in connection with the proposed
consolidation of the Bunnlevel Fire Protection Service District and the Summerville Fire
Protection Service District. Such inquiry included input from citizens in the areas which would
be included in the consolidated service districts, fire departments which would service such
districts, consultations with faculty at the UNC School of Government, and comments of citizens
received by the Board of Commissioners and county staff.
WHEREAS, the Harnett County Board of Commissioners caused to be prepared a report
containing a map of the districts to be consolidated, a statement showing the proposed
consolidation meets the standards as required by law, and plans for providing fire protection to
the proposed consolidated district.
WHEREAS, the Harnett County Board of Commissioners conducted a duly noticed
public hearing on April 16, 2012 providing an opportunity for citizens to appear and be heard
concerning the subject proposal.

WHEREAS, it has been represented to the Harnett County Board of Commissioners that
such proposal enjoys support within the respective communities involved, with the fire
departments currently providing services within the districts, and through community support
within the subject districts.
WHEREAS, the fire protection service districts proposed to be consolidated are as
follows:
a. Bunnlevel Fire Protection Service District; and
b. Summerville Fire Protection Service District.
The proposed consolidated Summerville - Bunnlevel Fire Protection Service District is attached
hereto as Exhibit Al, as if fully set forth herein.
WHEREAS, the Harnett County Board of Commissioners has carefully considered the
report dated March 30, 2012 containing maps of the current and proposed consolidated district,
statements showing the proposed district meets the standards as required by law, and plans for
providing fire protection services to the proposed district, along with the input and comments of
citizens and fire departments which would service such districts.
WHEREAS, the Harnett County Board of Commissioners finds as follows:
1. The Bunn level Fire Protection Service District and the Summerville Fire Protection
District are contiguous each to the other; and
2. The Bunnlevel Fire Protection Service District and the Summerville Fire Protection
Service District each provide substantially the same type of service. The Bunnlevel
Fire Protection Service District provides fire protection services. The Summerville
Fire Protection Service District provides fire protection and rescue services; and
3. The proposed consolidated district is able to sustain the additional tax which would
be imposed. It should be noted in that regard that the County is well under its $1.50
authorized maximum; and
4. There is a need to increase the services provided in the Bunnlevel Fire Protection
Service District to a higher level. By consolidation, the Bunnlevel area will be served
by some paid staff, will not be required to rely solely on volunteers, will have access
to better equipment and training, will have access to rescue services, and will be in a
position to reduce the tax rate to the citizens in the area, while affecting homeowners'
insurance rates in a favorable manner; and
5. The Summerville Fire Protection Service District is adjacent to the Town of
Lillington and faces the prospect of losing service area through annexation. Should
this occur, it could negatively affect the operating ability of the Summerville Fire
Department; and
6. County of Harnett currently contracts with Bunnlevel Fire Department and
Summerville Fire Department to provide fire protection services in the respective

service areas. The two departments have proposed a merger in which they will
consolidate operations into a new fire and rescue department referred to as the
Summerville- Bunnlevel Fire and Rescue Department, Inc. The new fire department
desires to provide fire protection and rescue services to residents residing in the
Bunnlevel and Summerville Fire Protection Service Districts and has specifically
requested that County of Harnett consolidate the service districts in order to serve a
greater number of people at a higher level of service, protect the service areas in
which the proposed Summerville - Bunnlevel Fire Protection Service District would
serve, and allow for the cost burden to be carried equitably by all service district
property owners through the service district tax; and
7. There are numerous calls each month within the area encompassed by the proposed
consolidated district and the proposed district would provide fire protection in a quick
and efficient manner, while making sure that the fire protection organization
responding to the calls is paid for the services provided. The proposed district is an
effective solution to address both immediate and long term fire protection needs,
providing flexibility and funding to support population shifts and growth.
NOW, THEREFORE BE IT RESOLVED BY THE HARNETT COUNTY BOARD
OF COMMISSIONERS that the Bunnlevel Fire Protection Service District and the
Summerville Fire Protection Service District are hereby consolidated as shown on the
map attached hereto and incorporated herein as Exhibit Al effective July 1, 2012 at 12:00
a.m..

Hamett County's human resources director is stepping down after nearly a dozen years with the county, citing divided county
leadership and poor treatment of county employees in contributing to her decision. Trinity Faucett sent a letter to county depart-
ment heads April 18 announcing her decision to resign effective Friday.
"It is with mixed feelings that I am notifying you of my resignation as human resources and risk management director," she said
in the email.
She said the decision to resign was not easy and that she has enjoyed working for the employees and citizens of Harnett
County.
"I am proud to be a part of the accomplishments of the human resources department over the past decade but feel now I have
been continually placed in a position that prevents me from being the effective leader that I know I can be," she wrote.
Asked to clarify her statement, Mrs. Faucett gave several reasons for her decision to resign her post. "It has been very difficult to
continue to see county employees — most whom I know to be highlymotivated public servants — suffer," she said. "Employees
have been subject to drastic reductions in benefits, little recognition for increase in duties, and a work environment where
leadership is divided, while facing continued scrutiny which has been sometimes quite hostile."
She said the work environment in Harnett County has led to low morale among employees, talented and dedicated employees

She called county employees the county's "most valuable asset."
"They are the ones who touch and impact the citizens and unfortunately are often under appreciated," she said.
During the recent discussion over health insurance for county employees, Ms. Faucett appeared frustrated at times. She was a
proponent of the Cigna plan, however county commissioners opted to go with a plan from Blue Cross, something Mrs. Faucett
said many employees were against.
She said the health insurance discussion did play a role in her decision to leave.
"As the former county manager, (Neil Emory), used to say, 'Public service is a higher calling,'" she said. "However, at this time, I
have decided to go home to concentrate on my family. I honestly wish the county employees the best."
Mrs. Faucett came to Harnett County in 2000 as an administrative assistant making $24,000. Just months after she was hired,
she was promoted to personnel technician and in 2004 was made assistant human resources director. In 2008, she was named
director of human resources and risk management for the county. Her current salary is $67,751.
Over the years, Mrs. Faucett has received numerous pay increases and promotions. She has never received a demotion or
suspension and only took one decrease in pay last year when her department agreed to a reduction in hours to save money in
the current year's budget. One week after taking the $4,250 pay cut, her pay was increased by $4,001.
Harnett County Manager Scott Sauer said employees are traditionally given raises once they have been in a position three and
five years. July 7, 2011, was the three -year anniversary of Mrs. Faucett becoming human resources director. Mr. Sauer said
recruiting for a new director will begin immediately.
"She leaves a significant role and big shoes to fill for sure," he said of Mrs. Faucett.
Until a replacement can be found, he said Mrs. Faucett's responsibilities will be spread out among existing staff. Because there
are only two other employees in human resources, he said many of the duties of HR director will fall to him for the time being. "In
terms of the normal routine, those tasks will fall under my responsibility," he said.
