The Harnett County Board of Commissioners met in regular session on Monday,
October 2, 2000, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina.
Members present: Dan B. Andrews, Chairman
Joseph T. Bowden
Teddy J. Byrd
Walt Titchener
Beatrice Bailey Hill, Vice Chair, was absent due to illness.

Chairman Andrews called the meeting to order at 9 a.m. and Commissioner Bowden
led the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with additional
budget amendments. Commissioner Byrd seconded the motion and it passed
unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Byrd, the
Board unanimously approved the following items on the consent agenda:

Coop. Ext . 4. Authorization for Cooperative Extension to apply for the following grants:
Grant Appli. A. $21,000 from N.C. Council on Developmental Disabilities for the 4-H
After School Enrichment Program to provide experimental opportunities
for 25 special needs students. The program will be for one year from
October, 2000 to May, 2001.
B. $49,311 from The Barbara Bush Foundation for Family Literacy for the
parenting (TAP) and Nutrition (EFNEP) outreach programs to promote
the educational success of children (0 to 5 years) by encouraging verbal
interaction between parents and children. This program's funds is for one
year, from July 1, 2001 to June 30, 2002.
C. $2,500,000 from the Golden Leaf Foundation for the Harnett Agri -Service
Extension Education Project.

Lease Agree. for 5. Lease agreement with Odell F. Hardee and wife, Ruby Powell Hardee for
Buckhorn Mini -site Buckhorn mini -site for monitored container and recyclable collection facility.
The term of the lease is 2 years beginning October 7, 2000 and ending October 6,
2002. The amount is $2,800. for the 2-year lease.
Contract Change 6. Contract change orders for Public Utilities for Watson Electric and T.A. Loving.
Ord. Public Utilities (Attachment 2)
7. Write-off of Public Utilities delinquent accounts for the first quarter of FY 2000-
Public utilities 2001. The accounts have been in delinquent status for more than 3 years and total
Writeoffs $7,950.24. (Attachment 3)
Public Utilities 8. Public Utilities Professional Services Agreement with Marziano & Minier, P.A.
Professional Services to perform services associated with the 18 mgd water treatment plant upgrade
Agreement project. The engineer shall be paid for the professional services on an hourly rate
not to exceed a fee of $241,450.00 for the scope of this agreement.
Local water Supply 9• Resolution to approve a revised version of Local Water Supply Plan. This
Plan - Revision document is required by the North Carolina Department of Environment and
Version Natural Resources, Division of Water Resources and will satisfy requirements of
G.S. 143-355(1). (Attachment 4) 1
Commissioner Titchener moved for the appointments listed below. Commissioner
Appointments Bowden seconded the motion and it passed unanimously.

Jesse Wayne Parrish for a 3-year term to expire 9/30 /03
Harnett County Council for Women
Karen Clayton for a 3-year term to expire 9/30/03
In response to the recent announcement of the closing of Swift Textiles in Erwin, Neil
Emory, County Manager, presented a plan of action regarding economic development
Swift Textiles efforts in the County. (Attachment 5) Jerry Hartgrove, Economic Development
Closing Director, reviewed recent losses of industry in the County and stressed the urgency for
the County to take radical action at this time to attract new industry. Also providing
comments and pledging support regarding economic development in Harnett County
were Jay Tilley, North Carolina Department of Commerce, James Glover, Erwin
Mayor, State Senator Oscar Harris, and State Representative Don Davis.
Commissioner Byrd moved to adopt a Resolution Requesting Urgent Assistance from
Swift Denim Due to Plants Closing. Commissioner Bowden seconded the motion and
it passed unanimously. (Attachment 6)
Chairman Andrews called to order a public hearing on a proposed Ordinance
Proposed 90-day Establishing aNinety (90) Day Moratorium on the Processing or Issuance of Certain
Moratorium/Towers Land Use Permits for Communication Transmission Towers in Harnett County.
George Jackson, Planning Director, presented the proposed ordinance to the Board and
noted that there are currently 17 communication transmission towers in the County
and no outstanding applications at this time. Chairman Andrews opened the meeting
for comments from the public. No comments were offered and Chairman Andrews
closed the public hearing. Commissioner Bowden moved to adopt the ordinance as
presented. Commissioner Titchener seconded the motion and it passed unanimously.

Jerry Blanchard, General Services Director, requested an increase in per mile fee from
Transportation $1.00/mile to $1.10/mile for services provided b the Harnett Count Transportation

Driver Salaries Department (HARTS). Additional revenues are needed to move temporary driver
Increase salaries to a level more in line with other area public systems. Commissioner Bowden
moved to authorize a fee increase per mile as requested, and to authorize salaries of
part-time drivers increased from $5.51/hour to $7.00/hour. Both fee and salary
increases are effective November 1, 2000. Commissioner Byrd seconded the motion
and it passed unanimously.
Nancy Clifton, Volunteer Center Director, presented for the Board's consideration, a
Make A Dif f erence proclamation regarding Make A Difference Day, October 28, 2000. Commissioner
Day Byrd moved to adopt the proclamation. Commissioner Bowden seconded the motion
and it passed unanimously. (Attachment 8)

The Department of Social Services' monthly report was filed with the Board.
Neil Emory, County Manager, reported on the following items:

Economic Development
Plan of Action
• The overall economic well-being of any community in large part determines the quality
of life enjoyed by the citizens that reside there. This fact is reflected in a community when one
looks at measures such as per capita income and the County's overall property values, which, in
turn, determine the investment the community can make in vital areas such as education and
public safety. Today, in Harnett County, we have experienced a loss of jobs which threatens our
economic well-being as well as the future prosperity of our County and our Towns.
While we have long had an economic development program here, current conditions
suggest that we must do more to recruit new jobs to replace those lost in recent years. With this
in mind, I would submit the following recommendations for consideration by the Board:
The Board must take the leadership role in bringing together those officials who
could impact economic development efforts in the County. This would entail inviting
our elected and appointed representatives (Governor, Secretary of Commerce, US
Senators, Congressman, State Legislators, as well as our Town Boards) to meet with
the Board, the Economic Development Commission, and representatives of our
Committee of 100. The purpose of this meeting would be to make everyone aware of
the severity of the job loss sustained by the County and to discuss the role of each
entity involved in a joint effort to bring new jobs to our community. When we leave
the meeting, we would need to schedule a follow-up meeting with the appropriate
staff to ensure that efforts move forward.
2. The Board should appropriate one million dollars for the purpose of incentives and
infrastructure improvements related to economic development. This appropriation
should also be made available to the Committee of 100.
3. The Board should meet with the corporate leadership of Swift, the Department of
• Commerce, and the Governing Board of Erwin to ensure that the existing facilities are
marketed aggressively and in a unified manner. In addition, other steps which could
benefit economic development in the County should be explored with Swift. An
example might be an industrial park on land owned by the corporation.
4. The Board must take a leadership role in unifying our County on this issue. To many
times our communities lose sight of the fact that the economic well-being of one area
of the County impacts the entire County. We must approach this issue as a
countywide issue and develop strategies in that manner.
5. We must also work with the other governmental entities in our County to build
partnerships, which will strengthen our ability to recruit industry. This would include
such issues as utility extension policies as well as the incentive policies offered by our
towns. To accomplish this goal, I would suggest contacting each of our mayors to
request that their manager meet with County staff to develop recommendations on
these issues by December 1, 2000.
6. The Board must ask the Governor and our State Legislators to consider legislative
changes which would recognize the difficulties faced by our County under the
existing William C. Lee Act. At this time, our designation as a Tier 4 County places
us at a tremendous disadvantage as we attempt to recruit new jobs. Current
conditions would definitely suggest that the losses we have suffered are not
recognized by the current legislation.
7. The County should stress again its opposition to our designation as a non -attainment
county under EPA guidelines.
8. Discussions should be held with CCCC to ensure that bond proceeds, if approved, are
utilized to assist overall economic development efforts in the County.
• 9. The Board, or representatives of the Board, should meet on a regular basis with the
other entities noted. This would ensure follow-up on the part of all involved.
10. These efforts should be linked with the ongoing economic development study being
conducted by Leak -Goforth. As you know, this study will recommend overall
changes to our current development program and will suggest specific actions that
should be taken by the appropriate agencies. Therefore, representatives of the firm
should be included in any discussions held regarding our efforts. In addition, we
must be prepared to aggressively pursue recommendations of the study.
I believe the steps outlined here will allow the County to move forward more
aggressively in our attempt to attract more industry. Please let me know your thoughts.

WHEREAS, Swift Denim officials and its employees worked tirelessly and
heroically for years to once again make the Swift Denim manufacturing facilities of
Erwin a cost effective and profitable industrial enterprise; and
WHEREAS, despite the best efforts of Swift Denim, the planned closure of its
two Erwin manufacturing facilities was recently announced; and
WHEREAS, the closure of these two industrial plants will result in the loss of 740
jobs locally; and
WHEREAS, the local impact of these plant closures to the Erwin community has
the potential to be financially devastating, not only to the Town but to its many family
owned private businesses and a large number of its elderly residents, many of whom are
retired from the mill following years of dedicated service.
NOW, THEREFORE, BE IT RESOLVED, that the Harnett county Board of
Commissioners requests that careful consideration be given by Swift Denim concerning a
proposal by the Town of Erwin that would transfer ownership rights of its wastewater
treatment and its water treatment facilities to the Town of Erwin, thereby significantly
reduce the devastating community wide impact of the aforementioned plant closures.

IN HARNETT COUNTY
WHEREAS, the Harnett County Planning Board (Planning Board) in conjunction with the Harnett
County Planning Department (Planning Department) in fulfilling its obligations of developing and
recommending responsible development planning policies and ordinances for the benefit of Harnett
County, has determined that certain regulations on the development of communication transmission
towers located in Harnett County, N. C. are necessary in order to promote the health, safety and
isgeneral welfare of Harnett County and its residents; and
WHEREAS, the Planning Board and Planning Department have researched the development of
communication transmission towers in Harnett County and the surrounding areas and have found
that with the rapid advances and growth in communications technology and the advent of greater
demand and competition in communication transmission services that the development of
communication transmission towers has accelerated and said development will only increase in the
future; and
WHEREAS, in order to insure that the development of communication transmission towers in
Harnett County is orderly, safe and conforms to the County Comprehensive Land Use Plan and good
land use planning principles, the Planning Board and Planning Department have conducted research
and the compilation of certain regulations which would control the development of communication
transmission towers in Harnett County; that due to the increased demand for land use permits in the
location and construction of communication transmission towers in Harnett County, the Planning
Board at its regular meeting on September 5, 2000 unanimously recommended that the Harnett
County Board of Commissioners consider, issue and decree a moratorium not to exceed ninety (90)
days on the processing and issuance of any land use or development permits for the location,
construction and installation of any new communication transmission towers in Harnett County or
the expansion or increase in size of any communication transmission towers currently located in
Harnett County; that the purpose of this moratorium is to give the Planning Board and the Planning
Department additional time to study the impacts that such towers have on land use compatibility,
visual appearance, environmental issues and the health, safety and welfare of the County citizens and
to finalize their efforts in compiling and drafting a proposed ordinance on the development of
communication transmission towers. Such a moratorium would also allow the opportunity for any
proposed ordinance to be reviewed and public comment received regarding its terns; and
WHEREAS, the Board of Commissioners desires through this Ordinance to implement said
• moratorium on the development of communication transmission towers pursuant to the Planning
Board's recommendation.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Board of Commissioners of the
County of Harnett, N. C. as follows:
Beginning on the adopted date of this Ordinance, namely October 2, 2000, a moratorium shall go
into effect with the following provisions:
All County departments, boards, agencies and employees in the area of planning,
utility and environmental health shall cease and desist from processing conditional
use applications or issuing any development or land use permits for the location,
construction or installation of any new communication transmission towers in
Harnett County or the expansion or increase in size of any communication
transmission tower currently located in Harnett County. This moratorium shall exist
for a period of ninety (90) days beginning on October 2, 2000 and ending on
December 31, 2000 unless an Ordinance regulating the development of
communication transmission towers is enacted by the Harnett County Board of
Commissioners and it becomes effective during the 90 day moratorium period at
which time the moratorium shall terminate.
For purposes of this moratorium, a "communications transmission tower" is defined as:
Any tower, pole, or similar structure fifty (50) feet or more in height, used to support
one or more antennas, including self-supporting lattice towers, guyed towers, or
monopole towers. The term includes radio and television transmission towers,
personal communications service towers (PCS), microwave towers, common carrier
towers, cellular telephone towers, and alternative structures.
• This ordinance shall be known and may be cited as the Harnett County Communication
Transmission Towers Development Moratorium Ordinance (October 2, 2000). It is adopted under
authority granted by the General Assembly of the State of North Carolina particularly N.C. Gen. Stat.
Chapter 153A, Article 18.

Defendants shall Pay Plaintiff the total BUZ of $1,400,000.00

ithin —from the date of this Agreement.
gremeent.Satal sum shal be paid as
follows: Gulf Insurance Company in the amount of $1,300.000.00
and Allstate insurance company in the amount of $100,000.00.
Plaintiff shall execute such release as required by Defendants, in
form acceptable to Defendants, and shall file a Voluntary
Dismissal with Prejudice upon receipt and disbursement of said
settlement proceeds. Furthermore, said settlement may be paid in
cash monies and future structured monies as the parties may
hereafter agree upon.
Each of the parties hereto shall bear his/ber/their/its own
attorney's fees, costs and other expenses incurred in this civil
action.
The parties and their respective attorneys agree and consent
to the Court entering and enforcing and Order based upon the terms
and conditions in this Agreement.
