2009/04/20 RESOLUTION TO SELL & TRANSFER REAL PROPERTYNORTH CAROLINA RESOLUTION TO SELL AND TRANSFER REAL PROPERTY HARNETT COUNTY THAT WHEREAS, the County of Harnett (hereinafter "COUNTY ") has the authority under North Carolina General Statute § 160A -279 to convey by private sale real property which the County owns to a non -profit entity to which it is authorized to appropriate funds and which said entity carries out a public purpose; and WHEREAS, Harnett Forward Together Committee (hereinafter "HFTC ") is a North Carolina nonprofit 501(c)(3) corporation whose purpose is to encourage and facilitate economic growth in Harnett County; that since its creation in 1994, HFTC has worked as an independent partner with Harnett County's Economic Development Department in soliciting and encouraging the location and/or expansion of new and current industry/business in Harnett County; that HFTC has been and is currently being appropriated funds from Harnett County in carrying out this public purpose; and WHEREAS, Harnett County is the titled owner of an approximate 19.5 acre real property tract located at the western corner of U.S. Highway 401 and McKinney Parkway which has been initially designed and planned as the Brightwater Business Park; that it is the desire of the Harnett County Board of Commissioners that this real property tract be privately sold and conveyed to HFTC in lieu of the appropriation of funds for the purpose of planning, subdividing, marketing, promoting and selling tracts within said 19.5 acre business park for the location of commercial businesses that will stimulate and promote economic activity for Harnett County through the creation of jobs, revenues, and tax base; that the conveyance from Harnett County to HFTC shall include the following conditions: (a) That the 19.5 acre tract shall be developed as a commercial business park based upon that park design and those Development Standards and Design Guidelines prepared by Jerry Turner and Associates, Inc. and adopted by the Board of Commissioners on April 20, 2009; (b) That once the 19.5 acre tract is properly subdivided into various lots, that one lot not exceeding 3.0 acres be conveyed by HFTC to First Choice Community Health Centers (hereinafter "First Choice ") with necessary restrictions mandating the construction and operation of a medical health care facility that will include the provision of medical services to uninsured and/or underserved citizens of Harnett County; that said lot shall be conveyed for the net proceeds that First Choice receives from the sale of its real property in the Johnsonville area of Hamett County to the Solid Rock Food Bank; (c) That HFTC shall develop said business park pursuant to all local government planning requirements. NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners does hereby direct that the 19.5 acre tract previously described be transferred and conveyed to the Harnett Forward Together Committee in lieu of appropriation of funds, subject to those conditions previously set forth at such time as local planning department guidelines are met and the provisions of N.C. This version includes the correction of the business park name to "Brightwater Business Park." N.C. Gen. Stat. § 160A -267 requires that once the resolution has been adopted then a summary of the resolution contents shall be published one time in a local newspaper. Ten days after the publication date the transfer can be consummated. Since the Resolution is short, I would go ahead and have the whole document published.
