A RESOLUTION AMENDING THE HARNETT COUNTY SUBDIVISION REGULATIONS
TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted the Harnett County
Subdivision Regulations on April 7, 1977 for the purpose of promoting the health, safety, and
general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -330; and
WHEREAS, the Subdivision Regulations contains provisions for amending said ordinance and
those provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article I
Sections 1.5 and 2.2 of the Subdivision Regulations and recommends the adoption of the
following amendment;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article I of the Harnett County
Subdivision Regulations shall be amended as follows;
Delete the following text from Section 1.5 "Gift Lots ":
When a member of a lineal family transfers property to other direct lineal descendants,
ascendants, brothers, sisters, nieces, and nephews, this action shall be exempt from the
Harnett County Subdivision Regulations. However, requirements of the Zoning District
and/or Watershed District in which the land being divided is located shall be met. No
non - conforming lot(s) or parcel(s) shall be created. (Per H.B. 685, effective June 30,
1997.)
Delete the following text from Section 2.2 "Definition of Subdivision (G.S) 153A- 335) ":
5. The division of land is by any method of transfer among members of a lineal family,
which shall include direct lineal descendants (children, grandchildren, and great -
grandchildren) and direct lineal ascendants (father, mother, grandfather and
grandmother), and brothers, sisters, nieces, and nephews (Per House Bill 685,
effective June 30, 1997).
Duly adopted this 19" day of February, Two - Thousand and Seven and effective upon adoption.
