09171990 562 HARNETT COUNTY BOARD OF COMMISSIONERS' REGULAR SESSION, SEPTEMBER 17, 1990 The Harnett County Board of Commissioners met in regular session on Monday, September 17, 1990, in the County Office Building, LillingtoD, North Carolina, with the following members present: Rudy Collins, Mayo Smith, Mack Reid Hudson, Bill Shaw, and Chairman Lloyd G. Stewart presiding. Others present were: Dallas H. Pope, County Manager; Glenn Johnson, County Attorney; Vanessa Young, Clerk to the Board; and Shirley Wicker, Recording Secretary. I Chairman Stewart called the meeting to order at 7 p.m. Commissioner Smith offered the invocation. MINUTES APPROVED Commissioner Collins moved for the approval of the minutes of the regular meeting, September 4, 1990. Commissioner Shaw seconded the motion and it passed with a unanimous vote. ~1ENDMENT TO PERSONNEL Dallas H. Pope, County Manager, presented an Ordinance Amending an Ordinance ORDINANCE RE: TRAVEL Entitled Personnel Ordinance for Harnett County, North Carolina, Adopted July 18, ALLOWANCE 1988. This amendment to the Personnel Ordinance involves travel allowance. Commissioner Smith moved for the adoption of the Ordinance Amendment. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The Ordinance Amendment is copied in full at the end of these minutes dated September 17, 1990, as Document No.1. PETITION FOR WATERLINE Gordon Patterson, representing a group of citizens from the Harmony Baptist Church EXTENSION FOR HARMONY area, presented a petition requesting water line extension to a two-mile area on BAPTIST CHURCH AREA N. C. 210 South of Lillington, North Carolina. Stephen Burrow, Pastor of Harmony Baptist Church, and Louis Thomas, also spoke in favor of request for water line extension. John Phelps, Public Utilities Attorney, and Rodney Tart, Public Utilities Director, are to prepare a report concerning requested water line extension for presentation to the Board as soon as possible. Carla Stephens, Planning Director, presented the application for Woodrow Neal, S.R. 1460, to the Board. Chairman Stewart opened the hearing for public comments. CONSIDERATION OF The Board considered the following applications for road name changes: I REQUESTED ROAD NAME CHANGES 1. Woodrow Neal, S.R. 1460, Hector's Creek Township, from Lafayette Road to HHH Road. Commissioner Collins made a motion to change the name of S.R. 1460 to HHH Road. Commissioner Shaw seconded the motion and it passed with a unanimous vote. 2. Woodrow Neal, S.R. 1443, Hector's Creek Township, from Smith Road to Lafayette Road. Commissioner Collins made a motion to change the name of S.R. 1443 to Lafayette Road. Commissioner Hudson seconded the motion and it passed with a unanimous vote. PUBLIC HEARINGS RE: Carla Stephens, Planning Director, briefed the Board that there would be three ZONING DISTRICT CHANGE public hearings concerning applications for proposed zoning district changes and APPLICATIONS explained the purpose of the public hearings was to obtain public comments concerning the proposed zoning district changes. Carla Stephens, Planning Director, presented the application to the Board. Chairman Stewart opened the hearing for public comments. The following citizens provided comments: 1. I CYNTHIA JETER HOWARD Chairman Stewart called to order a public hearing concerning application for Cynthia Jeter Howard, and others - from RA-20R Zoning District to RA-20M Zoning District, Johnsonville Township, Hwy. 27, approximately 10 acres. Carla Stephens, Planning Director, presented the application to the Board. Chairman Stewart opened the hearing for public comments. No comments were offered and Chairman Stewart closed the public hearing. LINDA LEE STEVENS Chairman Stewart called to order a public hearing concerning application for Linda Lee Stevens - from Industrial Zoning District to RA-30 Zoning District. Averasboro Township, Hwy. 301, approximately 1.6 acres. Carla Stephens, Planning Director, presented the application to the Board. Chairman Stewart opened the hearing for public comments. No comments were offered and Chairman Stewart closed the public hearing. CONSIDERATION OF The Board considered the following applications for zoning district change: APPLICATIONS 1. Cathy Gardner - from RA-20M Zoning District to RA-30 Zoning District. The Planning Board recommended approval of the application. Commissioner Collins moved for the approval of the zoning district change application request. Commissioner Shaw seconded the motion and it passed with a unanimous vote. 2. Cynthia Jeter Howard, and others" - from RA-20R Zoning District to RA-20M Zoning District. The Planning Board recommended approval of the application. Commissioner Shaw made a motion that this request be tabled until Carla Stephens, Planning Director, corresponds with Ms. Howard to inform her of problems she may incur with proposed zoning change. Commissioner Hudson seconded the motion and it passed with a unanimous vote. I 3. Linda Lee Stevens - from Industrial Zoning District to RA-30. The Planning Board recommended approval of the application. Commissioner Smith made a motion for the approval of the zoning district change application request. Commissioner Collins seconded the motion and it passed with a unanimous vote. REQUEST FOR DISPOSAL Gayle Holder, Register of Deeds, presented a list of records to be destroyed in OF RECORDS IN REGISTER the office of the Harnett County Register of Deeds, as set out under G. S. 121-5(b). OF DEEDS OFFICE Commissioner Shaw moved for the approval of the request. Commissioner Smith seconded the motion and it passed with a unanimous vote. Pope, County Manager, presented to the Board a request by Martha Womble, APPOINTED TO AGING Long Term Care Coordinator with Mid-Carolina Area Agency on Aging, that an elected ADVISORY CO~~HITTEE official be appointed to the Aging Advisory Committee. Com.issioner Hudson made a motion that Commissioner Shaw be appointed to the Aging Advisory Committee. Commissioner Smith seconded the motion and it passed with a unanimous vote. PROCLAMATION RE: Tony Wilder, Special Project Coordinator, presented for consideration a Proclamation ~ruNTING & FISHING DAY from the North Carolina Wildlife Federation proclaiming Saturday, September 22, 1990. as National Hunting and Fishing Day in Harnett County. Commissioner Shaw made a motion that Saturday, September 22, 1990, be proclaimed as National Hunting and Fishing Day in Harnett County. Commissioner Collins seconded the motion and it passed with a unanimous vote. The Proclamation is copied in full at the end of these minutes dated September 17, 1990, as Document No.3. DORIS SMITH & CATHY Bobby L. Wicker, Tax Administrator, requested that Doris J. Smith and Cathy M. ~~RTIN APPOINTED Martin be appointed Deputy Tax Collectors for the County of Harnett. Commissioner DEPUTY TAX COLLECTORS Smith moved that Doris J. Smith and Cathy M. Martin be appointed as Deputy Tax I Collectors for the County of Harnett and that the oath of office be so administered. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Sudia, Harnett County Fire Marshal, provided the following comments: The passage of the extension of the insurance and tax districts for the fire departments in Harnett County is critical to the progress of the departments and their capability to meet the up-and-coming growth with the necessary resources. In addition for those people who have been receiving an insurance premium break while living outside the insurance district, this extension will make them responsible for footing an equal part of the cost for their premium reductions. For those people who have not received the insurance premium break due to living outside the department's insurance district, they now will benefit from reduced insurance premiums while helping to fund their department's achievements. Sherrill Goss, citizen from Rt. 6, Box 45B, Fuquay-Varina, N. C., addressed the Board with regard to his wanting his property located in the Fuquay-Varina Fire District rather than the Angier-Black River Fire District. Mr. Goss was informed that this was not the purpose of the public hearing. However, his comments were I received. Glenn Johnson, County Attorney, presented for consideration a Resolution Expanding RESOLUTION EXPANDING RATED INSURANCE DIST. Rated Insurance Districts. Commissioner Hudson moved for the adoption of the ADOPTED resolution as presented. Commissioner Shaw seconded the motion and it passed with a unanimous vote. RESOLUTION EXPANDING Glenn Johnson, County Attorney, presented for consideration a Resolution Expanding THE BOUNDARIES OF the Boundaries of Fire Districts. Commissioner Collins moved for the adoption of the FIRE DISTRICTS resolution as presented. Commissioner Smith seconded the motion and it passed with ADOPTED a unanimous vote. Young, Finance Officer, presented for consideration the Cape Fear FACILITIES PROJECT Wastewater Facilities Project Ordinance. AGREEMENT RE: OFFICE Glenn Johnson, County Attorney, presented for consideration an agreement between SPACE FOR SO. SERVo Economy Cleaners, Inc., and the County of Harnett for office space for the Depart- ment of Social Services. Commissioner Shaw moved to approve and authorize execution of the agreement, the same to be appropriately recorded after execution and attached to the minutes of this meeting of the Board. Pope, County Manager, presented to the Board for consideration eleven NEW POSITIONS IN new positions for the Sanitation Landfill operations for manning the mini-container LANDFILL DEPT. sites. Ten new mini-site monitor positions would be classified 51A, and the one mini-site supervisor would be classified 58A. I Commissioner Shaw made a motion that the Board delay taking any action on the eleven new positions for the Sanitation Landfill operations. Commissioner Hudson seconded the motion and it passed with the following vote: Ayes: Commissioners Shaw, Collins, Hudson, and Stewart Noes: Commissioner Smith Thereafter Commissioner Shaw moved to withdraw his motion to delay taking any action on the eleven new positions for the Sanitation Landfill operations. Commissioner Hudson seconded the motion and it passed with a unanimous vote. Commissioner Shaw moved that eleven new positions be approved for the Sanitation Landfill operations for manning the mini-container sites. Ten new mini-site monitor positions would be classified 51A, and the one mini-site supervisor position would be classified 58A. I - 595 I I - I 596 DOCUMENT NO. 8 STATE OF NORTH CAROLINA COUNTY OF HARNETT RESOLUTION EXPANDING THE BOUNDARIES OF FIRE DISTRICTS I THAT ha~EAS, on the 16th day of April, 1990, the Harnett County Board of commissioners, sitting in regular session, adopted a resolution asking the legislative delegation which represents the County of Harnett in the North Carolina General Assembly to enact local legislation which would authorize the Harnett County Board of Commissioners to increase the size of fire protection districts within the County in which taxes are levied for the providing of fire protection services to include areas up to a maximum of five (5) road miles of the respective fire headquarters serving such districtsJ and WHEREAS, pursuant to such resolution and action taken by said legislative delegation the North Carolina General Assembly enacted a local act which authorizes the Harnett County Board of Commissioners to increase the area of fire protection districts within which taxes are levied for the providing of fire protection services in the County of Barnett by including within the boundaries of such districts any adjoining territory which is not within the corporate limits of an incorporated municipality, and which is within five (5) road miles of the fire headquartersJ and WHEREAS, such local legislation provides that the Harnett County Board of Commissioners shall cause to be prepared a report containing a map of each district and the adjacent territory proposed to be annexed, showing the present and proposed boundaries of the district, which report shall be available for public inspection in the office to the clerk to the board for at least two weeks before the date of the below referenced public hearing which is also required by said legiSlation, and such report was filed with the clerk to the board of commissioners on the 31st day of August, 1990, and has been available for public inspection as so provided for the required periodJ and WHEREAS, said local legislation requires that the Harnett I County Board of Commissioners conduct a public hearing before adopting any resolution extending the boundaries of a fire protection district, and that notice of such hearing state the date, hour and place of the hearing and its subject, which notice shall be published at least once not less than two weeks before the hearing, and such notice has been published as required and said hearing has been conducted, and WHEREAS, all requirements set forth in the subject legislation have been met and the Board of Commissioners of the County of Harnett may proceed with the expansion of such districts as by law allowed: NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett that the boundaries of those fire protection districts which were established pursuant to the provisions of Chapter 69 of the General Statutes of the State of North Carolina within Harnett County and within which a tax is levied for the purpose of providing fire protection services shall be expanded and the area within such districts increased so that said districts respectively shall hereafter be as shown on Exhibits A through L which are attached hereto and incorporated herein by reference. Young, C H.rnett County Bo.r 598 DOCUMENT NO. 10 STATE OF NORTH CAROLINA COUNTY OF HARNETT LEASE AGREEMENT THIS LEASE AGREEMENT, made and entered into as of the 17th day of September, 1990, by and between BCONOMY CLEANERS, INC., a corporation organized and existing under and pursuant to the laws of the State of North Carolina with a place of business in Harnett County, North Carolina, party of the first part, I hereinafter referred to as "Lessor", and the COUNTY OF HARNETT, a body politic and corporate existing under the laws of the State of North Carolina, hereinafter referred to as "Lessee", !!!!!~~!!!!: THAT WHEREAS, Lessor is the owner of a building located on West James street in the Town of Lillington, North Carolina, a portion of which was previously occupied by Holder's PharmacYJ and WHEREAS, Lessee is desirous of leasing for certain of its governmental purposes that portion of said building the address of which is 20 West James Street, Lillington, North Carolina, said portion being that previously occupied by Holder's Pharmacy: and WHEREAS, the portion of said building which Lessee desires to lease from Lessor contains approximately two thousand six hundred (2,600> square feet of office space, and WHEREAS, Lessor has contracted and agreed to lease such space to Lessee, and Lessee has contracted and agreed to receive and lease said space from Lessor, all pursuant to the terms and conditions contained in this instrument: NOW, THEREFORE, for and in consideration of the sum of Ten Dollars ($10.00> paid by each party hereto to the other, together with additional good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Lessor and Lessee contract and agree as follows: 1. Lessor hereby leases and lets unto Lessee, and Lessee hereby leases and accepts from Lessor, approximately two thousand six hundred (2,600> square feet of space which consists of all of the area in the above referenced building which was previously occupied by Holder's Pharmacy. Such space is located at 20 West James Street in the Town of Lillington, North Carolina. I 2. Rental for the demised premises shall be seven hundred dollars ($700.00> per month. Such rental shall be payable in advance on or before the first day of each month, with the first such rental payment being due October 1, 1990. 3. The term of this lease agreement shall be for three months, that is beginning as of October 1, 1990 and extending through and including December 31, 1990. Such notwithstanding, Lessee shall have the absolute right and option to extend this lease agreement and its occupancy of the demised premises on the same terms and conditions herein set forth for up to five (5) consecutive periods of one year each by giving to Lessor notice of its intention to extend such lease agreement at any time prior to the expiration of the then existing term. In all events, however, if the County of Harnett fails to appropriate funds for the rental payments which are provided for in this instrument at any time this agreement or any extension thereof might be in effect, then this lease shall terminate effective at the cessation of funding by the County of Harnett, and neither party shall have any further claims against the other as the result thereof. In such regard, Lessee covenants that it has appropriated funds for lease of the subject premises for a period of three (3) months from and after October 1, 1990, and that a termination of this lease for failure to provide such funding will not occur during said three month period. 4. As a part of this agreement, Lessor shall make available to Lessee upon the property of Lessor, on a shared basis, adequate parking for the motor vehicles of those working upon or utilizing the demised premises. 5. Lessor shall keep and maintain the demised premises in all respects. However, Lessee shall have the responsibility to provide routine janitorial services for such premises. 6. Lessee shall bear the cost of all utilities used by it as a part of its occupancy of the demised premises. I 7. Lessee shall do nothing to damage the demised premises, and subject to the obligation of Lessor to repair and maintain said premises shall surrender same to Lessor at the termination of Lessee's occupancy in as good condition as received, reasonable wear and tear excepted. Purther, Lessee is entitled to make reasonable alterations of the demised premises in order to allow said premises to meet the needs of Lessee, except that any such alterations shall first be approved by Lessor, which approval shall not be unreasonably withheld. 8. Lessor shall be solely responsible for providing fire and extended insurance coverage on the demised premises in an amount of at least the fair market value of said premises. Lessee shall be responsible for providing such insurance as it might deem appropriate on its property located upon said premises. In the event the demised premises shall be damaged by tTre- or o EHef"'" 'cast1il 1 ty, ands';ici premises are thereby rendered not reasonably usable by Lessee for its purposes, then Lessee 599 shall have the absolute right to terminate this lease agreement, and in such event Lessor shall have no further rights or claims against Lessee as the result thereof. 9. The terms, conditions and provisions contained in this lease agreement shall be binding on the parties hereto and their successors and assigns. WHEREAS, these goals will assure that the service is as timely and cost efficient as possible; and WHEREAS, the Tax goals will provide a more efficient means by which motor vehicles will be listed and assessed, thereby reducing unlisted vehicles; and WHEREAS, the goals of Social Services and Tax areas will enhance Harnett County, as well as other counties in the state; and WHEREAS, these goals should be presented for inclusion in the North Carolina Association of County Commissioners' goals package to be adopted and used for the 1991 legislative goals. NOW, THEREFORE, the Harnett County Board of Commissioners recommends legislative goals involving county functions of Social Services and Tax area hereby attached to this resolution to be forwarded to the North Carolina Association of County Commissioners for its consideration of adopting as legislative goals for the 1991 legislative session.
