HARNETT COUNTY BOARD OF COMMISSIONERS' REGULAR SESSION, SEPTEMBER 4, 1990,
The Harnett County Board of Commissioners met in regular session on Tuesday, September
4, 1990, in the County Office Building, Lillington, North Carolina, with the following
members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman
Lloyd G. Stewart presiding. Others present were Dallas H. Pope, County Manager;
I W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S.
Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 9 a.m.
Commissioner Collins offered the invocation.
Commissioner Smith moved for the approval of the minutes of the regular meeting,
August 20, 1990. Commissioner Collins seconded the motion and it passed with a
unanimous vote.
DOT Mr. Steve Dupree presented a request to the Board to upgrade the Department of
S.R. 1505 Transportation's priority for State Road 1505 in order that Harnett County's portion
of State Road 1505 could be paved at the same time Johnston County's portion was
being paved by the Department of Transportation within Johnston County. Mr. Dupree
was advised that the current priority for the Harnett County portion of State Road
1505 was 48; and to change this priority to a lower priority for paving purposes,
would cause roads that are currently scheduled for paving not to be paved, creating
a situation which would require other means than changing the existing priority of
State Road 1505. The Board instructed the County Manager to request from the
Department of Transportation alternatives which might be considered for paving
State Road 1505 at the earliest possible date.
BRIEFING ON DOT Mr. Ray Stone, Highway Maintenance Engineer, North Carolina Department of Transporta-
tion, briefed the Board on current DOT activites.
RESOLUTION RE: Commissioner Shaw moved that the resolution recognizing Virginia Simmons for her
VIRGINIA SIMMONS' county service be approved. Commissioner Smith seconded the motion and it passed
RETIREMENT with a unanimous vote. Chairman Stewart then presented the resolution and a plaque
to Ms. Simmons. The resolution is copied in full at the end of these minutes dated
September 4, 1990, as Document No. 1.
I RESOLUTION RE: Commissioner Smith moved that the resolution recognizing Avis Hall for her county
AVIS HALL'S service be approved. Commissioner Shaw seconded the motion and it passed with a
RETIREMENT unanimous vote. Chairman Stewart then presented the resolution and a plaque to
Ms. Hall. The resolution is copied in full at the end of these minutes dated
September 4, 1990, as Document No.2.
CERTIFICATE OF AWARD Chairman Stewart presented a Certificate of Award from the N. C. Department of Human
PRESENTED TO MARY Resources to Mary Avery and Bonnie Jo Temple for their units' outstanding record of
AVERY AND BONNIE JO service for the period of October 1989 through March 1990.

Ms. Melissa Thomas briefed the Board concerning economic development associated with
BRIEFING ON RETIRE- retirement community developments which might be considered for areas in Harnett

PROPOSED ANIMAL CON- Ms. Julie Boyles, representing the Harnett County Humane Society, presented a proposal
TROL FACILITY BY to the Board for operation of a proposed county animal control facility. She also
HUMANE SOCIETY presented with the proposal a request for county funds to be provided to the Humane
Society in the amount of $35,000 for building construction and $33,000 for operating
funds for the animal control facility. The Chairman recognized W. Glenn Johnson,
County Attorney, and requested information concerning the legal aspects associated
with proposal as presented. Mr. Johnson then recommended to the Board that a contract
not be entered into as presented due to legal commitments the county has related to
state regulatory requirements. Mr. Johnson further recommended to the Board that the
county pursue a more centrally located building site for the proposed animal control
facility as suggested by the Humane Society and that a working relationship be
established between the county and the Humane Society for considering other operating
areas. Mr. George Fitspatrick and Mr. Peter McQueen, members of the Humane Society,
provided comments in support of the proposal submitted.
Commissioner Hudson moved that the county attempt to procure a centrally located
I site for the permanent animal control facility which would be built by the county
and then, to work with the Humane Society on programs which it desired to sponsor.
Commissioner Shaw seconded the motion and it passed with a unanimous vote.
EVALUATION OF BIDS Mr. John Phelps, Public Utilities Attorney, introduced Mr. Ralph Troutman from
RE: CONSTRUCTION OF Black & Veatch, who in turn reported to the Board an evaluation of bids received for
SOUTHWEST WATER & construction of the Southwest Water and Sewer District project. Commissioner Shaw
SEWER DISTRICT PROJ. moved that negotiation efforts with the low bidder for electrical work be initiated
and results of negotiations be reported back to the Board. Commissioner Collins
seconded the motion and it passed with a unanimous vote.
RESOLUTION RE: Mr. John Phelps presented a resolution establishing rules and regulations for
RULES AND REGULATIONS operation of Southwest Water and Sewer District of Harnett County for consideration
FOR OPERATION OF by the Board. Commissioner Smith moved that the above referenced resolution be
SOUTHWEST W & S DIST. adopted. Commissioner Shaw seconded the motion and it passed with a unanimous vote.

OPTION TO BUY PROPERTY Commissioner Shaw moved that Mr. John Phelps, Public Utilities Attorney, be authorized
FOR TANK SITE FOR SOUTH- to obtain an option on property consisting of 0.8 acres located in the vicinity of
WEST WATER & SEWER State Road 1001 for the purpose of establishing tank site for the Southwest Water and
DIST. PROJ. Sewer District project. Commissioner Hudson seconded the motion and it passed with a
unanimous vote.
JOHN SHAW REAPPOINTED Commissioner Smith moved that Mr. John Shaw be reappointed to the Economic Development
TO ECONOMIC DEV. COM. Commission for a period of two years. Commissioner Hudson seconded the motion and it III
passed with a unanimous vote.
MARIE BURGESS APPOINTED Commissioner Smith moved that Ms. Marie Burgess be appointed to the Nursing Home
TO NURSING HOME COMM. Community Advisory,Committee to fill the unexpired term of Ms. Ann Reece, with term
ADVISORY COMMITTEE expiring December 1992. Commissioner Collins seconded the motion and it passed with
a unanimous vote.
SYBIL POPE APPOINTED Commissioner Hudson moved that Ms. Sybil Pope be appointed to the Domiciliary Home
TO DOMICILIARY HOME Community Advisory Committee for a three-year term. Commissioner Collins seconded
COMM. ADVISORY COMMITTEE the motion and it passed with a unanimous vote.
RATNAM PATEL APPOINTED Commissioner Smith moved that the resolution be adopted appointing Mr. Ratnam Patel
TO AVERASBORO TOWNSHIP to the Averasboro Township Tourism Development Authority. Commissioner Hudson seconded
TOURISM DEV. AUTHORITY the motion and it passed with a unanimous vote. The resolution is copied in full at
the end of these minutes dated September 4, 1990, as Document No.4.
RESOLUTION RE: Commissioner Shaw moved that the resolution involving surplus property annual sale for
SURPLUS PROPERTY SALE the county be approved. Commissioner Collins seconded the motion and it passed with a
unanimous vote. The resolution is copied in full at the end of these minutes dated
September 4, 1990, as Document No.5.
BUDGET AMENDMENTS Commissioner Collins moved that the following budget amendment for Housing and Urban
Development be approved:

Commissioner Smith seconded the motion and it passed with a unanimous vote.
REPORTS Dallas H. Pope, County Manager, presented departmental reports for the Tax Department
and Veterans Service Office for the Board to review.
TAX REFUND Bobby L. Wicker, Tax Administrator, requested approval of a tax refund for Marsha
MARSHA BAS S Bass, World Omni Leasing, Inc., in the amount of $74.21. Commissioner Collins moved
that the tax bill for Marsha Bass, World Omni Leasing, Inc., in the amount of $74.21
be refunded. Commissioner Smith seconded the motion and it passed with a unanimous
I vote.
EXECUTIVE SESSION Commissioner Shaw moved that the Board go into executive session. Commissioner
Collins seconded the motion and it passed with a unanimous vote.
Commissioner Hudson moved that the Board come out of executive session. Commissioner
Shaw seconded the motion and it passed with a unanimous vote.
CHARGE TO TAX Commissioner Smith moved that Vanessa Young, Clerk to the Board, read the charge to
COLLECTOR the Tax Collector of Harnett County and that the charge to the Tax Collector be
approved as read and become a permanent part of the minutes of the Board meeting.
Commissioner Shaw seconded the motion and it passed with a unanimous vote.

RENTAL AGREEMENT Commissioner Smith moved that Dallas H. Pope, County Manager, be authorized to

ESTABLISHMENT OF Commissioner Hudson moved that a position be established in the Tax Department with

Shaw seconded the motion and it passed with a unanimous vote.
BUDGET AMENDMENT Commissioner Smith moved that the Tax Department budget amendment be approved.

SOFTWARE LICENSE Dallas H. Pope, County Manager presented Software License Agreement with a'PIN Systems,
AGREEMENT WITH O'PIN Inc., for consideration by the Board. Glenn Johnson, County Attorney, recommended
SYSTEMS deletion of Section 8.4 under the General Provisions of the presented Software License
Agreement. Commissioner Shaw moved that the Software License Agreement with O'PIN
Systems, Inc., be approved with the deletion of Section 8.4 from the General Provisions
of the agreement. Commissioner Smith seconded the motion and it passed with a unanimous
vote.
REQUEST FOR RECLASSI- Mr. Henry Thompson, Director of the Health Department, requested that the Physician
FICATION OF PHYSICIAN Extender I position currently authorized for the Health Department be reclassified
EXTENDER POSITION - to a classification of 74 based on current needs for child and adult health services.
HEALTH DEPARTMENT Commissioner Smith moved that the classification for the Health Department's
Physician Extender I position be reclassified to a classification of 74 and that
the State Personnel Office be advised. Commissioner Hudson seconded the motion and
it passed with a unanimous vote.
ANIMAL CONTROL Mr. Henry Thompson, Director of the Health Department, advised the Board that the
FUNCTION REMAIN county should maintain ownership of the animal control function. He stated this
UNDER COUNTY was primarily due to the fact that the county had regulatory responsibility involving
CONTROL disease control, which includes rabies and working programs involving unwanted and
dangerous animals.
ADJOURNMENT There being no further business, the Harnett County Board of Commissioners' regular

RESOLUTION
THAT, WHEREAS, Virginia L. Simmons began her service to Harnett County with
the Agricultural Extension Service more than twenty-seven years ago; and
WHEREAS, Virginia L. Simmons, a former resident of Pittsboro, North
Carolina, started to work for Harnett County Agricultural Extension Service on I
October 1, 1963; and
WHEREAS, Virginia L. Simmons' pleasant personality, her honesty and high
moral character and her willingness and concern to help others has helped
to insure the success of the Extension Home Economics program; and
WHEREAS, Virginia L. Simmons' dedication, devotion and her excellency in
the performance of her duties, and involvement in the Extension Homemaker
program have won admiration and respect for her assistance, encouragement and
advice; and
WHEREAS, on July 31, 1990, after twenty-seven years and ten months of loyal
service, Virginia L. Simmons has retired from the Agricultural Extension
Service.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that Virginia L. Simmons has retired from her loyal and dedicated
service to Harnett County with great honor and distinction. That Virginia L.
Simmons be and she is hereby commended on behalf of all the citizens of Harnett
County for her valuable and immeasurable service. That a copy of this
resolution shall be given to Virginia L. Simmons, a copy spread upon the minutes
of this Board, and a copy to the media.

RESOLUTION
THAT, WHEREAS, in 1974, Avis R. Hall accepted the position as Director of
the Harnett County Retired Senior Volunteer Program and thereafter faithfully
served in that capacity for sixteen years: undertaking and discharging her
responsibilities in both an exemplary and inspirational manner; and
WHEREAS, under Avis R. Hall's conscientious dedication, devotion, and
leadership the Harnett County Retired Senior Volunteer Program has become
recognized as outstanding among those in North Carolina; and
WHEREAS, under Avis R. Hall's leadership volunteers have rendered services
to citizens of Harnett COunty that in monetary terms represent hundreds of
thousands of dollars; and
WHEREAS, Avis R. Hall's influence and energies have been felt in the
Harnett County Extension Homemakers Program, in the area of Mental Health, in
the Harnett COunty Literacy Association, in the Alliance for Families of
Mentally Ill, her church and community, and many other areas of service
including her family and friends; and
WHEREAS, Avis R. Hall's high morals, kind spirit, and just manner will
continue to be remembered in the hearts of all who knew her; and
WHEREAS, Avis R. Hall left the service of the Retired Senior Volunteer
Program on June 30, 1990,
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners, that Avis R. Hall retired from her loyal and dedicated service to
Harnett County with great honor and distinction; that Avis R. Hall be, and she I
is hereby commended on behalf of all the citizens of Harnett COunty for her
invaluable and immeasurable service to them which contributed significantly to

WHEREAS, the Harnett County Board of commissioners, sitting
as the governing body of tha Southwest Water and Sewer District of
Harnett County, (hereinafter -Board-) recognizes the need for
I general rules and regulations to manage and operate the water
distribution system of the Southwest Water and Sewer District of
Harnett County (hereinafter -District-) during both its
construction period and thereafter; and
WHEREAS, Harnett County now is operating and managing the
systems of several water service districts within Harnett County
and utilizes with respect thereto the current Operational Rules and
Regulations of the Northeast Metropolitan Water District of Harnett
county; and
WHEREAS, it has been recommended to the Board by the Harnett
County Director of Public Utilities that the currently existing
Rules and Regulations for the Northeast Metropolitan Water District
of Harnett County, except as the same relate to water rates,
charges and fees, be used as the rules and regulations for the
District; and
WHlREAS , it is the desire of the Board to make provision in
said rules and regulations for the water rates, charges and fees
to be applicable to said District, and in conjunction therewith
desires to adopt as Section 28, and Section 29 of said rules and
I regulations the provision herein below set forth.

to the Northeast Metropolitan Water District of Harnett County
except as the same relate to water rates, charges and fees are
hereby established as the rules and regulations for the water
operations of the District.
2. Section 28 of said Rules and Regulations shall read and
be as follows:
Section 28. Classifications. Rates. Fees and Charaes.
(a) Classification of Service.
All services are classified under two categories to
include residential or multi-unit services.
A residential service is a service which provides water
to a single family residence and the buildings appurtenant thereto.
A multi-unit service is a service which provides water
to more than one single family residence or more than one user
unit.
(b) IAtllt Schedules
(1) Residential Services:
I Water Schedule Monthly Rate
First 2,000 gallons $12 . 00
(minimum)
All water used over $ 2.50 per 1,000
2,000 gallons gallons
(2) Multi-Unit Rervices:
The minimum amount of $12.00 per unit or the amount
equal to the cost of the number of gallons used
through the multi-unit service at the rate of $2.50
per 1,000 gallons, whichever amount 1s greater.

(c) Tap-On-Fees. (TO become effective after completion of
initial sign up period)
(1) Tap-On-FAAI
The following tap-on-fees shall apply to the meter
services described:
2 inch connection $1,400
1 1/2 inch connection 800
1 inch connection 675 I
3/4 inch connection 500
The multi-unit or master meter connection fee is
cost of materials, plus twenty (20) percent.
Larger connections shall be negotiated as may be
appropriate.
(d) Fire protection Charqes

Others Negotiated
(e) Rates for persons livinq outside the District.
Rates for persons living outside the Southwest Water and
Sewer District of Hernett County shall be equal to rates
for persons living inside the District so long as no tax
is levied within the District for support of the system;
if a tax is levied on users inside the water District for
the purpose of supporting the water system, then the
users outside the District shall pay an increased rate I
as established by the County from time to time. In
setting such increased rate, the County will take into
consideration the rate paid by persons inside the
District plus taxes levied on them for support of the
water system.
3. Section 29 is added to said Rules and Regulations and
reads as follows:
Section 29
In the event the District desires to connect its water
distribution system to previously existing systems, all
such systems must have the approval of Division of Health
Services, of the North Carolina Department of Human
Resources before such connection may take place and,
unless otherwise specifically approved by the District,
all previously existing sources of water must be
completely abandoned and rendered incapable of future
water production.
4. This Board retains the right to make such changes in said
Rules and Regulations as applied to the District as may be needed
from time to time.

NORTH CAROLINA
RESOLUTION NAMING MEMBER OF THE
AVERASBORO TOWNSHIP TOURISM DEVELOPMENT AUTHORITY
THAT, WHEREAS, the North Carolina General Assembly did, on the 5th day of
May, 1987, ratify legislation entitled "An Act to Authorize the Levy of a Room
Occupancy and Tourism Development Tax in Averasboro Township in Harnett County";
and
WHEREAS, the Harnett County Board of Commissioners, by resolution adopted
on July 6, 1987, did levy the tax therein authorized in Averasboro Township,
Harnett County, North Carolina, effective on the 1st day of September, 1987;
and
WHEREAS, in said resolution so adopted on July 6, 1987, the Harnett County
Board of Commissioners established the Averasboro Township Tourism Development
Authority as provided in the above referenced act of the North Carolina General
Assembly; and
WHEREAS, the Harnett County Board of Commissioner is charged with the
responsibility of appointing the members of such Tourism Development Authority
as prescribed in the above referenced act; and
I WHEREAS, the Dunn Area Chamber of Commerce has submitted the name of Mr.
Ratnam Patel, owner of Econo Lodge, to replace Mr. Lee Tolar, Manager of Ramada
Inn.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners
that Mr. Ratnam Patel, owner of Econo Lodge, shall be and is hereby appointed to
serve as a member of said Authority.
Duly adopted by the Harnett County Board of Commissioners this 4th day of
September, 1990.

I CHARGE TO THE TAX COLLECTOR OF HARNETT COUNTY
You are hereby authorized, empowered, and commanded to collect the taxes
set forth in the tax records filed in the Office of the Tax Assessor and in
the tax receipts herewith delivered to you, in the amounts and from the
taxpayers likewise therein set forth. Such taxes are hereby declared to be a
first lien upon all real property of the respective taxpayers in the County of
Harnett, and this order shall be a full and sufficient authority to direct,
